		<section id="H444190B1877A4245A9719E6E410527BA" section-type="section-one"><enum>1.</enum><header>Short Title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Animal Emergency Planning Act of 2014</short-title></quote>.</text>
		</section><section id="HA4F2ACBE7586428DB6BEED4ECE958D3F"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress makes the following findings:</text>
			<paragraph id="H70118AB58D4B420383C99E924B7BA2AE"><enum>(1)</enum><text>Hurricanes Katrina and Sandy, as well as other recent natural and man-made disasters, have
			 highlighted the need for planning to minimize the impact of disasters.</text>
			</paragraph><paragraph id="H13BF513FC97B46219EE626D1BBD0FA5F"><enum>(2)</enum><text>Lack of preparedness in times of disaster can have especially devastating effects on animals and
			 the people who risk their lives to protect them.</text>
			</paragraph><paragraph id="HB4734CD696264356B9665F7938FCB4E6"><enum>(3)</enum><text>Local first-responders, non-governmental agencies, and private individuals most often shoulder the
			 cost and responsibility of animals affected by disasters.</text>
			</paragraph><paragraph id="HD3896F4961234077BABB786CE5F6761C"><enum>(4)</enum><text>It is reasonable to ask those who use animals commercially to demonstrate a level of readiness to
			 protect the animals under their care.</text>
			</paragraph></section><section id="HAB303F14514346BA83BBD3B5BC109DEF"><enum>3.</enum><header>Requirement that covered entities develop and implement emergency contingency plans</header>
			<subsection id="HEC5950B9C548440A95C7EE4164FEFE53"><enum>(a)</enum><header>In General</header><text display-inline="yes-display-inline">The Animal Welfare Act (<external-xref legal-doc="usc" parsable-cite="usc/7/2131">7 U.S.C. 2131 et seq.</external-xref>) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HE633E798A1654283BEB5C393C48CE858" style="OLC">
					<section id="H6A9F05022AFB431EBCAEE6A4545E5FB6"><enum>30.</enum><header>Animal Emergency Planning</header>
						<subsection id="H90AAD814C125403CB822ECC3370D6B3D"><enum>(a)</enum><header>Covered Person</header><text display-inline="yes-display-inline">For purposes of this section, the term <term>covered person</term> means a research facility, dealer, exhibitor, intermediate handler, carrier, or Federal research
			 facility.</text>
						</subsection><subsection id="HF5B772A68F1A42AD91AE06A0F6D8DF84"><enum>(b)</enum><header>Contingency Plan</header><text display-inline="yes-display-inline">Each covered person shall develop, document, and follow a contingency plan to provide for the
			 humane handling, treatment, transportation, housing, and care of its
			 animals in the event of an emergency or disaster. Such a contingency plan
			 shall—</text>
							<paragraph id="HDA79B7CD71644456BCF634D0A2D0F414"><enum>(1)</enum><text display-inline="yes-display-inline">identify situations that the covered person might experience, including natural disasters and
			 emergencies such as electrical outages, faulty HVAC systems, fires,
			 mechanical breakdowns, and animal escapes, that would trigger the need for
			 the measures identified in the contingency plan to be put into action;</text>
							</paragraph><paragraph id="HE02A49C0AD814F4BBEDBE5E9410AB7D5"><enum>(2)</enum><text>outline specific tasks to be carried out in response to the identified emergencies or disasters,
			 including detailed animal evacuation or shelter-in-place instructions and
			 provisions for providing backup sources of food and water as well as
			 sanitation, ventilation, bedding, and veterinary care;</text>
							</paragraph><paragraph id="HB6A73538A37E42F99184F436D93D910A"><enum>(3)</enum><text>establish a chain of command and identify the individuals responsible for fulfilling the tasks
			 described in paragraph (2); and</text>
							</paragraph><paragraph id="HFCB327D51736496B9586A4CB3AF83A03"><enum>(4)</enum><text>address how response and recovery will be handled in terms of materials, resources, and training
			 needed.</text>
							</paragraph></subsection><subsection id="H986F240043524B5883306A22F9578EB6"><enum>(c)</enum><header>Annual Review</header><text display-inline="yes-display-inline">Each covered person shall—</text>
							<paragraph id="H78AE04E7A5264F4D936D44985E09F425"><enum>(1)</enum><text>review its contingency plan on at least an annual basis to ensure that it adequately addresses the
			 criteria described in subsection (b); and</text>
							</paragraph><paragraph id="H176C19E3A4DB47EE8D990E0E097A691D"><enum>(2)</enum><text>maintain documentation of the annual reviews and any amendments or changes made to its contingency
			 plan since the previous year's review.</text>
							</paragraph></subsection><subsection id="H131DF0C1B0DB4F9ABD90F12C4D91AAE0"><enum>(d)</enum><header>Training</header><text display-inline="yes-display-inline">Each covered person shall—</text>
							<paragraph id="H8B7604C40E7D47A8A8D5A558ACEAD683"><enum>(1)</enum><text>train its personnel in their roles and responsibilities as outlined in the contingency plan;</text>
							</paragraph><paragraph id="HA8782967D19E4DD1B518802C79750EC1"><enum>(2)</enum><text>communicate any changes in the contingency plan to personnel through training within 30 days after
			 making the changes; and</text>
							</paragraph><paragraph id="HF587CE67B3744FA09DE09AED96BB0831"><enum>(3)</enum><text display-inline="yes-display-inline">maintain documentation of its personnel’s participation in and successful completion of the
			 training required by this subsection.</text>
							</paragraph></subsection><subsection id="HFFC4A61CA87F41A1ABC25FCC63CD2D8F"><enum>(e)</enum><header>Availability of Documentation</header>
							<paragraph id="H43069BC7716542FC9417D60789D31C2F"><enum>(1)</enum><header>In General</header><text display-inline="yes-display-inline">Each covered person shall submit its contingency plan, as well as any documentation described in
			 subsections (c)(2) and (d)(3), to the Secretary annually.</text>
							</paragraph><paragraph id="H6BF39496D3B549C998D136B46E61FD20"><enum>(2)</enum><header>While Traveling</header><text display-inline="yes-display-inline">A covered person engaged in travel must carry a copy of its contingency plan with it at all times
			 and make it available for inspection by the Secretary while in travel
			 status.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H58C0E2F100C142C3B0C0B16D5B7BA127"><enum>(b)</enum><header>Regulations</header>
				<paragraph id="H31A1B417B54F42CFA36D4A0CD8D83314"><enum>(1)</enum><text>Not later than 30 days after the date of enactment of this Act, the Secretary of Agriculture of the
			 United States shall promulgate such regulations as the Secretary
			 determines to be necessary to carry out section 30 of the Animal Welfare
			 Act, as added by subsection (a) of this Act.</text>
				</paragraph><paragraph id="H0318B063DDCF429FA35EC17CB0685C8B"><enum>(2)</enum><text display-inline="yes-display-inline">The regulations described in paragraph (1) shall be made without regard to the rulemaking
			 procedures under <external-xref legal-doc="usc" parsable-cite="usc/5/553">section 553</external-xref> of title 5, United States Code.</text>
				</paragraph></subsection><subsection id="H50FF845F784E4F679884B171C2F36557"><enum>(c)</enum><header>No Preemption</header><text>Nothing in this Act or the amendments made by this Act preempts any law (including a regulation) of
			 a State, or a political subdivision of a State, containing requirements
			 that provide equivalent or greater protection for animals than the
			 requirements of this Act or the amendments made by this Act.</text>
			</subsection><subsection id="H4E1B6ED2AC9A47E4A800A10913322705"><enum>(d)</enum><header>Effective Date</header><text display-inline="yes-display-inline">The amendments made by subsection (a) shall apply to covered persons (as defined in such
			 subsection) beginning on the date that is 30 days after the date of
			 enactment of this Act.</text>
