			 States.</official-title>

		<section id="H2ADFF2BA516F42F6A31461337F804128" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Legitimate Use of Medicinal Marijuana Act</short-title></quote> or the <quote><short-title>LUMMA</short-title></quote>.</text>
		</section><section id="H995759221A234BADB0EFE11F3593F1CF"><enum>2.</enum><header>Scheduling of marijuana; prescriptions</header>
			<subsection id="H209BF487F62B4777AEF9C57BC96360A5"><enum>(a)</enum><header>Schedule</header><text display-inline="yes-display-inline">Marijuana is moved from schedule I of the Controlled Substances Act to schedule II of such Act.</text>
			</subsection><subsection id="H3A3A9491C24743AF82B17264CBEBCFE5"><enum>(b)</enum><header>Prescription</header>
				<paragraph id="H90C164D95CDC4EE7AF62FBEA030A0BB3"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">In a State in which marijuana may be prescribed by a physician for medical use under applicable
			 State law, no provision of the Controlled Substances Act (21 U.S.C. 801 et
			 seq.) or of the Federal Food, Drug, and Cosmetic Act (21 U.S.C. 301 et
			 seq.) shall prohibit or otherwise restrict—</text>
					<subparagraph id="HA4FFA34205024932B35743C48D4C31C6"><enum>(A)</enum><text>the prescription of marijuana by a physician for medical use;</text>
					</subparagraph><subparagraph id="H0A0C1ADC76AD42DB9FC5D819EBA550AB"><enum>(B)</enum><text display-inline="yes-display-inline">an individual who is an authorized patient from obtaining, possessing, transporting within the
			 individual’s State, or using marijuana for that individual’s medical use;</text>
					</subparagraph><subparagraph id="H297A562294584B299476F59628A5142A"><enum>(C)</enum><text display-inline="yes-display-inline">an individual authorized under State law to obtain, possess, transport within their State, or
			 manufacture marijuana, from obtaining, possessing, transporting within
			 that State, or manufacturing marijuana pursuant to that authorization; or</text>
					</subparagraph><subparagraph id="H768011422B8D4C34AC4F2D726946DDC2"><enum>(D)</enum><text display-inline="yes-display-inline">a pharmacy or other entity authorized under State law to distribute medical marijuana to an
			 authorized patient, from obtaining or possessing marijuana for that
			 purpose, or from distributing marijuana to an authorized patient for
			 medical use.</text>
					</subparagraph></paragraph><paragraph id="H5CAC4F03C6F74B98BC84FDFA2502AE56"><enum>(2)</enum><header>Production</header><text display-inline="yes-display-inline">No provision of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/801">21 U.S.C. 801 et seq.</external-xref>) or of the Federal Food,
			 Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/301">21 U.S.C. 301 et seq.</external-xref>) shall prohibit or otherwise
			 restrict an entity authorized by a State, in which marijuana may be
			 prescribed by a physician for medical use, for the purpose of producing
			 marijuana for prescription by a physician for medical use, from producing,
			 processing, or distributing marijuana for such purpose.</text>
				</paragraph></subsection></section><section id="H58C309686BB34B5A9C423971558FEC82"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act—</text>
			<paragraph id="H7AB1B98DDB4046B6AB0E1209D5800317"><enum>(1)</enum><text>the term <quote>authorized patient</quote> means an individual using marijuana in accordance with a prescription of marijuana by a physician
			 for medical use;</text>
			</paragraph><paragraph id="H699F40ECA7F0478DB3B47DFE66EEA792"><enum>(2)</enum><text display-inline="yes-display-inline">the term <quote>physician</quote> means a practitioner of medicine, who—</text>
				<subparagraph id="H3FB967F13B374452A700E1E6B241BC58"><enum>(A)</enum><text>graduated from a college of medicine or osteopathy; and</text>
				</subparagraph><subparagraph id="H38874A248E6A4E08AF134E791BCD44C6"><enum>(B)</enum><text>is licensed by the appropriate State board;</text>
				</subparagraph></paragraph><paragraph id="H05769E338EFA4BAB86814CC8211D873E"><enum>(3)</enum><text display-inline="yes-display-inline">the term <quote>prescription</quote> means an instruction written by a medical physician in accordance with applicable State law that
			 authorizes a patient to be issued with a medicine or treatment; and</text>
			</paragraph><paragraph id="H4AF02566BCBF4A8587EB34CE0DF62713"><enum>(4)</enum><text>the term <quote>State</quote> includes the District of Columbia, Puerto Rico, and any other territory or possession of the
			 United States.</text>
			</paragraph></section><section id="HA7EA3FC6A011420291C30314EE40E180"><enum>4.</enum><header>Relation of Act to certain prohibitions relating to smoking</header><text display-inline="no-display-inline">This Act does not affect any Federal, State, or local law regulating or prohibiting smoking in
			 public.</text>
