		<section id="H4FBFE379E91149888101840A779B0C4C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Dangerous Products Warning Act</short-title></quote>.</text>
		</section><section id="H81412430E2BE4F9FA2B96DEF7901341E"><enum>2.</enum><header>Dangerous products</header>
			<subsection id="HD7F79BE5D20349558B8C821437CEF96F"><enum>(a)</enum><header>In general</header><text>Part 1 of title 18, United States Code, is amended by inserting after chapter 27 the following:</text>

						<section id="H9416CF901CC64C66AA8431143F03A463"><enum>571.</enum><header>Violations</header>
							<subsection id="H501710085F7243128BF6E375AEC1B308"><enum>(a)</enum><header>Failure To inform and warn</header><text>Whoever—</text>
								<paragraph id="H487D9CE7AB1D4CCCBDCC57AE71951E08"><enum>(1)</enum><text>is a business entity or a product supervisor with respect to a product or business practice;</text>
								</paragraph><paragraph id="H5A41D46921514C8CB1B8B05F7E299423"><enum>(2)</enum><text>knows of a serious danger associated with such product (or a component of that product) or business
			 practice; and</text>
								</paragraph><paragraph id="H1AEA1F836A2545E29E3B102429BD065A"><enum>(3)</enum><text display-inline="yes-display-inline">knowingly fails within 15 days after such discovery is made (or if there is imminent risk of
			 serious bodily injury or death, immediately) to do any of the following:</text>
									<subparagraph id="HE5837E177848408E90D534DC9786AB33"><enum>(A)</enum><text>To inform an appropriate Federal agency in writing, unless such product supervisor has actual
			 knowledge that such an agency has been so informed.</text>
									</subparagraph><subparagraph id="H80714E9D77C94643BF72805D83A4A06C"><enum>(B)</enum><text>To warn affected employees in writing, unless such product supervisor has actual knowledge that
			 such employees have been so warned.</text>
									</subparagraph><subparagraph id="H3DADA6D9FA01433EA6CB70152B5A51B0"><enum>(C)</enum><text>To inform persons other than affected employees at risk if they can reasonably be identified.</text></subparagraph></paragraph><continuation-text continuation-text-level="subsection">shall be fined under this title or imprisoned not more than 5 years, or both.</continuation-text></subsection><subsection id="H3A9E063E455148A09480B5A11061F2AE"><enum>(b)</enum><header>Retaliation</header><text>Whoever knowingly discriminates against any person in the terms or conditions of employment or in
			 retention in employment or in hiring because of such person having
			 informed a Federal agency or warned employees of a serious danger
			 associated with a product or business practice shall be fined under this
			 title or imprisoned not more than one year, or both.</text>
							</subsection><subsection id="H1E17D6166ED6442E962FB06B0B811707"><enum>(c)</enum><header>Nonpayment by business entities</header><text>If a fine is imposed on an individual under this section, such fine shall not be paid, directly or
			 indirectly, out of the assets of any business entity on behalf of that
			 individual.</text>
							</subsection></section><section id="HC7A873F11B404D24B19E8E26389D8201"><enum>572.</enum><header>Relationship to existing law</header>
							<subsection id="H744446A436C44630BEA34C05447BA9CE"><enum>(a)</enum><header>Rights To intervene</header><text>Nothing in this chapter shall be construed to limit the right of any individual or group of
			 individuals to initiate, intervene in, or otherwise participate in any
			 proceeding before a regulatory agency or court, nor to relieve any
			 regulatory agency, court, or other public body of any obligation, or
			 affect its discretion to permit intervention or participation by an
			 individual or group or class of consumers, employees or citizens in any
			 proceeding or activity.</text>
							</subsection><subsection id="H5FA11D33C0AB43ED8BD97A5BA9D21352"><enum>(b)</enum><header>State law</header><text>Nothing in this chapter preempts any State law or otherwise affects any State authority to adopt or
			 enforce any State law.</text>
							</subsection></section><section id="H8636A7EBD7D04722A0F06A1663DC6CB1"><enum>573.</enum><header>Construction</header><text display-inline="no-display-inline">This chapter shall be construed in such a manner as best to represent and protect the interests of
			 the public.</text>
						</section><section id="H6FBB9FECEA7B4DD5BBABEC0EB701CBAE"><enum>574.</enum><header>Definitions for chapter</header><text display-inline="no-display-inline">In this chapter—</text>
							<paragraph id="H9041A3AA32034EFC948AE4A023E2ACCA"><enum>(1)</enum><text display-inline="yes-display-inline">the term <term>product supervisor</term>—</text>
								<subparagraph id="H122CBD1F8B374D338126E9EFDBA3DB61"><enum>(A)</enum><text>means—</text>
									<clause id="H7F726410AFAE4A55A74071A7054625A4"><enum>(i)</enum><text>an officer or director of a corporation or an association;</text>
									</clause><clause id="HA90176AE2C9D4612855990D77063B1CC"><enum>(ii)</enum><text>a partner of a partnership; or</text>
									</clause><clause id="H3EE8AF2360C642298E4AF6BBDD2FBB10"><enum>(iii)</enum><text>any employee or other agent of a corporation, association, or partnership having duties such that
			 the conduct of such employee or agent may fairly be assumed to represent
			 the policy of the corporation, association, or partnership; and</text>
									</clause></subparagraph><subparagraph id="H6E9651BC293649DFB7248C96243C5347"><enum>(B)</enum><text>includes persons having management responsibility for—</text>
									<clause id="H66ACFCD1A7944BF2AF799A899C824479"><enum>(i)</enum><text>submissions to a Federal agency regarding the development or approval of any product;</text>
									</clause><clause id="H6FFA3DBE0727477DB3B1F8EF2B5C62D1"><enum>(ii)</enum><text>production, quality assurance, or quality control of any product; or</text>
									</clause><clause id="H05FE7D4EA4FC429586C7727359BEAB44"><enum>(iii)</enum><text>research and development of any product;</text>
									</clause></subparagraph></paragraph><paragraph id="H792ED8B4A0FE49429F0BDC9422868855"><enum>(2)</enum><text>the term <term>product</term> means a product or service of a business entity that enters or will enter interstate commerce;</text>
							</paragraph><paragraph id="HC70E6C90296F43BD8BB9D8AD88051C26"><enum>(3)</enum><text>the term <term>business entity</term> means any corporation, company, association, firm, partnership, or other business entity or a sole
			 proprietor;</text>
							</paragraph><paragraph id="H15EE348B561A4954A1B329AFB5C1AD12"><enum>(4)</enum><text>the term <term>business practice</term> means a method or practice of manufacturing, assembling, designing, researching, importing or
			 distributing a product that enters or will enter interstate commerce,
			 conducting, providing or preparing to provide a service that enters or
			 will enter interstate commerce, or otherwise carrying out business
			 operations related to products or services that enter or will enter
			 interstate commerce;</text>
							</paragraph><paragraph id="H366D15B32DAB4D59A4812B1A03AFAB94"><enum>(5)</enum><text>the term <term>serious danger</term>, used with respect to a product or business practice, means a danger, not readily apparent to the
			 average person, that the normal or reasonably foreseeable use of, or the
			 exposure of a human being to, that product or business practice may cause
			 death or serious bodily injury to a human being;</text>
							</paragraph><paragraph id="H84D3111A9F6047A9A23E3D5A378D0488"><enum>(6)</enum><text display-inline="yes-display-inline">the term <term>serious bodily injury</term> means an impairment of physical condition, including as result of trauma, repetitive motion or
			 disease, that—</text>
								<subparagraph id="HF2DCA638617C4AFBA21E196AEE950286"><enum>(A)</enum><text>creates a substantial risk of death; or</text>
								</subparagraph><subparagraph id="H5F2F7131945D4DBC97EBA84087592EB8"><enum>(B)</enum><text display-inline="yes-display-inline">causes—</text>
									<clause id="H8FD9200C7C4048E0938B6A94A6B1DED1"><enum>(i)</enum><text>serious permanent disfigurement;</text>
									</clause><clause id="H59702A1EB3184C58B59161826FC658DB"><enum>(ii)</enum><text>unconsciousness;</text>
									</clause><clause id="HE5495743F6EB4B4B9C31911F69927BB9"><enum>(iii)</enum><text>extreme pain; or</text>
									</clause><clause id="H04B859A57BF84218B8958FEDCAB07069"><enum>(iv)</enum><text>permanent or protracted loss or impairment of the function of any bodily member, organ, bodily
			 system, or mental faculty;</text>
									</clause></subparagraph></paragraph><paragraph id="H6B84A37A6E894EA1BD2652501F9BEB99"><enum>(7)</enum><text>the term <term>appropriate Federal agency</term> means any agency with jurisdiction over the product or business practice; and</text>
							</paragraph><paragraph id="HFB2AADA95C794BA6A664D0D06F8439E5"><enum>(8)</enum><text display-inline="yes-display-inline">the term <term>warn affected employees</term>, used with respect to a serious danger, means take reasonable steps to give sufficient description
			 of the serious danger to all individuals working for or in the business
			 entity who are likely to be subject to the serious danger in the course of
			 that work to make those individuals aware of that danger.</text></paragraph></section></chapter><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H33F71C68D82B42ADA18060BE08A7A5B3"><enum>(b)</enum><header>Clerical amendment</header><text>The table of chapters for title 18, United States Code, is amended by inserting, after the item
			 relating to chapter 27, the following:</text>

			</subsection></section><section id="HE79F0430B04C4CDF9F16EEE79F4A0418"><enum>3.</enum><header>Effective date</header><text display-inline="no-display-inline">The amendments made by this Act take effect 180 days after the date of enactment of this Act.</text>
