			<subsection id="H118555ED5B58476394BED3025A59E374"><enum>(a)</enum><header>Short title</header><text display-inline="yes-display-inline">This Act may be cited as the <quote><short-title>Forging Peace Through Strength in Ukraine and the Transatlantic Alliance Act</short-title></quote>.</text>

			</subsection><subsection display-inline="no-display-inline" id="HB10065B428D747BB9E65818AC48300F3"><enum>(c)</enum><header>Definitions</header><text>In this Act:</text>
				<paragraph commented="no" id="H552EA9CE4C3242F2B3EE36F9CC01B8B0"><enum>(1)</enum><header>Appropriate congressional committees</header><text>Except as otherwise provided, the term <term>appropriate congressional committees</term> means—</text>
					<subparagraph commented="no" id="H27D9914DB595449EBBA8370BAA64BCDC"><enum>(A)</enum><text>the Committee on Armed Services and the Committee on Foreign Relations of the Senate; and</text>
					</subparagraph><subparagraph commented="no" id="H59A5755C5AA142CBBE301DFA5469E106"><enum>(B)</enum><text>the Committee on Armed Services and the Committee on Foreign Affairs of the House of
			 Representatives.</text>
					</subparagraph></paragraph><paragraph commented="no" id="H791B099694AE4F5C9741F8F4A6CB36E6"><enum>(2)</enum><header>Congressional defense committees</header><text>The term <term>congressional defense committees</term> has the meaning given that term in <external-xref legal-doc="usc" parsable-cite="usc/10/101">section 101(a)(16)</external-xref> of title 10, United States Code.</text>
				</paragraph><paragraph id="H774C0B38EE0A4B99A7E32F1289E21B49"><enum>(3)</enum><header>NATO</header><text>The term <term>NATO</term> means the North Atlantic Treaty Organization.</text>
				</paragraph><paragraph id="HB425FF6E983F44F79165165A8D5F6246"><enum>(4)</enum><header>Treaties defined</header>
					<subparagraph id="H1AAF021F57684BF8901E3511C44DD946"><enum>(A)</enum><header>CFE Treaty</header><text display-inline="yes-display-inline">The term <term>CFE Treaty</term> means the Treaty on Conventional Armed Forces in Europe, signed at Paris November 19, 1990, and
			 entered into force July 17, 1992.</text>
					</subparagraph><subparagraph id="H5CC5DC0D4D514916A66A8F11615FBEC5"><enum>(B)</enum><header>INF Treaty</header><text display-inline="yes-display-inline">The term <term>INF Treaty</term> means the Treaty Between the United States of America and the Union of Soviet Socialist Republics
			 on the Elimination of Their Intermediate-Range and Shorter-Range Missiles,
			 commonly referred to as the Intermediate-Range Nuclear Forces (INF)
			 Treaty, signed at Washington December 8, 1987, and entered into force June
			 1, 1988.</text>
					</subparagraph><subparagraph id="H3129EB95CD1946B7AE4938D26982D2EF"><enum>(C)</enum><header>North Atlantic Treaty</header><text display-inline="yes-display-inline">The term <term>North Atlantic Treaty</term> means the North Atlantic Treaty signed at Washington, April 4, 1949, and entered into force August
			 24, 1949.</text>
					</subparagraph></paragraph></subsection></section><section id="HBD3CE01BAF5045F98576781F0BF6A388"><enum>2.</enum><header>Sense of Congress</header>
			<subsection id="H4176E14024FC4507ADFC3802E40F12F9"><enum>(a)</enum><header>Findings</header><text>Congress finds the following:</text>
				<paragraph id="H5AC0760017654500BB50E76CC1A566D6"><enum>(1)</enum><text>On March 1, 2014, Russian Federation President Vladimir Putin sought and received from the upper
			 house of the Russian parliament the standing authorization of the use of
			 military force to send Russian forces into Ukrainian territory.</text>
				</paragraph><paragraph id="HFFF203EF8060444E8E85CBB6E964C9F6"><enum>(2)</enum><text>On March 2, 2014, Russian troops invaded the Ukrainian territory of Crimea, seizing control of the
			 peninsula, border crossings, government and administrative buildings, key
			 infrastructure, and surrounding Ukrainian military bases.</text>
				</paragraph><paragraph id="H344DBDD81EE64920A1BC9B64368415B7"><enum>(3)</enum><text>From February 26 to March 3, 2014, President Putin directed exercises of 150,000 troops, including
			 air and naval forces, and live fire demonstrations in western Russia, near
			 the border with Ukraine.</text>
				</paragraph><paragraph id="HE2537BD453E6495699E455BE155CA42B"><enum>(4)</enum><text>On March 3, 2014, the Department of Defense announced it was suspending United States military
			 engagement with Russia.</text>
				</paragraph><paragraph id="HA3072F70D5FB46C9B749C154481209D6"><enum>(5)</enum><text>On March 12, 2014, in response to Russian aggression and provocations, the United States deployed
			 additional F–15 aircraft to NATO’s Baltic Air Policing Mission and F–16
			 aircraft to an aviation detachment in Poland.</text>
				</paragraph><paragraph id="H76F0A6F65285466BA3925F6F6076E441"><enum>(6)</enum><text display-inline="yes-display-inline">On March 16, 2014, Crimea held a referendum on seceding from Ukraine and accede to the Russian
			 Federation, which violated the Ukrainian constitution, occurred under
			 duress of Russian military intervention, and was not recognized by the
			 international community.</text>
				</paragraph><paragraph id="HA0E18E50C099447194143A21E07A9174"><enum>(7)</enum><text>On March 20, 2014, the Russian parliament voted to annex Crimea and Russian President Putin signed
			 the treaty of accession annexing Crimea to the Russian Federation.</text>
				</paragraph><paragraph id="H2E94E6BA2C90429194E2CC006D8BA2C1"><enum>(8)</enum><text>On March 23, 2014, NATO Supreme Allied Command and Commander of U.S. European Command, General
			 Philip Breedlove stated that the Russian <quote>force that is at the Ukrainian border now to the east is very, very sizeable and very, very ready</quote>.</text>
				</paragraph><paragraph id="HD6918E4CA8C049B0A9E63D07D39D07EE"><enum>(9)</enum><text display-inline="yes-display-inline">The Government of the Federation of Russian continues to provoke demonstrations and violence in
			 Ukraine in order to create a false narrative of separatism and illegal
			 justification for Russian intervention.</text>
				</paragraph><paragraph id="HD766E18BCECC43F786B32D3F56298C24"><enum>(10)</enum><text>On April 3, 2014, NATO Supreme Allied Commander and Commander of U.S. European Command, General
			 Philip Breedlove, stated that Russia has 40,000 troops capable of moving
			 within 12 hours with elements of a Combined Arms Army, supported by
			 fixed-wing aircraft, rotary aircraft, and the logistics required in order
			 to successfully make an incursion.</text>
				</paragraph></subsection><subsection id="H0B3CA668571D40CD91C2F1154ACDD0C2"><enum>(b)</enum><header>Sense of Congress</header><text>It is the sense of the Congress that—</text>
				<paragraph id="H5937583D2CBA4D389F5ABD25015DC6B6"><enum>(1)</enum><text>the continuing and long-standing pattern and practice by the Government of the Russian Federation
			 of physical, diplomatic, and economic aggression toward neighboring
			 countries is clearly intended to undermine regional security and
			 stability;</text>
				</paragraph><paragraph id="H78C1F2E1451B4049A720ED239074A7C9"><enum>(2)</enum><text>the Russian military build-up and aggressive posture on the eastern border of Ukraine represents a
			 deliberate intent to intimidate Ukraine and its citizens to submit to
			 Russian control;</text>
				</paragraph><paragraph id="H6AFBFF2CC0B8415EB3040285E75F6FF5"><enum>(3)</enum><text display-inline="yes-display-inline">the Russian Federation should immediately cease all improper and illegal activities in Ukraine,
			 including the seizures of airfields and other locations, and President
			 Putin should direct an immediate return of Russian forces to their
			 barracks;</text>
				</paragraph><paragraph id="H7F0B82C50D9445FB8E70F5D0FF442B32"><enum>(4)</enum><text>the United States reaffirms its strong commitment to the 1994 Budapest Memorandum on Security
			 Assurances which was executed jointly with the Russian Federation and the
			 United Kingdom to explicitly secure the independence, sovereignty, and
			 territorial integrity and borders of Ukraine;</text>
				</paragraph><paragraph id="HBB754144B56D42B99620C66A3992A856"><enum>(5)</enum><text>the United States supports the continued professionalization of the Ukrainian military and should
			 enhance United States direct security cooperation with the Ukrainian
			 military;</text>
				</paragraph><paragraph id="H87614867D95947ECB0529E8C004CA58B"><enum>(6)</enum><text>the United States reaffirms its defense commitments to its treaty allies under Article 5 of the
			 North Atlantic Treaty;</text>
				</paragraph><paragraph id="HA9DF65238BA44F7FABCA6867CB518FE2"><enum>(7)</enum><text>the United States supports the expansion of security cooperation with states in Central and Eastern
			 Europe, including NATO member states, NATO aspirants, and appropriate
			 Eastern Partnership countries;</text>
				</paragraph><paragraph id="H1E0B1545A7334B758B7A8B97B722C7A1"><enum>(8)</enum><text>the United States should seek immediate membership in NATO for Montenegro, a NATO Membership Action
			 Plan for Georgia, a diplomatic solution to disputes between Macedonia and
			 Greece, and seek resolution to the constitutional issues of Bosnia and
			 Herzegovina;</text>
				</paragraph><paragraph id="HA2F46AF6D5DF4FE3AF5A1ECB9F31F7A3"><enum>(9)</enum><text>the United States reaffirms its support for the Supreme Allied Commander of Supreme Headquarters,
			 Allied Powers Europe to support NATO efforts to resolve the conflict
			 peacefully and diplomatically;</text>
				</paragraph><paragraph id="H6C79E3497FA24456883E7E528F96A8BB"><enum>(10)</enum><text>the United States encourages the North Atlantic Council to act in a timely manner to direct the
			 Supreme Allied Commander of Supreme Headquarters, Allied Powers Europe to
			 begin the NATO Defense Planning Process to NATO contingency plans in
			 response to a Russian invasion of Ukraine, including in Crimea, and
			 establish political guidance and determine military capability
			 requirements to effectively posture NATO military forces; and</text>
				</paragraph><paragraph id="H6E8120D2A3564C9AA5FBAE7545E9FB6C"><enum>(11)</enum><text display-inline="yes-display-inline">the United States should take immediate steps to enhance its military presence and readiness
			 posture in Europe to deter aggression and assure allies and partners
			 through forward presence and engagement.</text>
				</paragraph></subsection></section><section id="H56C44E7EF6714B849638B1FA1A09828A"><enum>3.</enum><header>Strategic framework for United States security force assistance and cooperation in the European and
			 Eurasian regions</header>
			<subsection id="HBA4ECD817B58495FA3FEDCDF26AE2407"><enum>(a)</enum><header>Strategic framework</header>
				<paragraph id="HCD6DEB01D1D7452D8DADFC9F74B8DA34"><enum>(1)</enum><header>In general</header><text>The Secretary of Defense, in coordination with the Secretary of State, shall develop a strategic
			 framework for United States security force assistance and cooperation in
			 the European and Eurasian regions.</text>
				</paragraph><paragraph id="H82F2CBF0B09F43DAB2E8B23F301AF3ED"><enum>(2)</enum><header>Elements</header><text>The strategic framework required by paragraph (1) shall include the following:</text>
					<subparagraph id="H087E1048F20147EEA95E1AB20FC04980"><enum>(A)</enum><text display-inline="yes-display-inline">An evaluation of the extent to which the threat to security and stability in the European and
			 Eurasian regions is a threat to the national security of the United States
			 and the security interests of the NATO alliance.</text>
					</subparagraph><subparagraph id="HAC0B9FC3447E45AC8373AAEA153F5EBC"><enum>(B)</enum><text>An identification of the primary objectives, priorities, and desired end-states of United States
			 security force assistance and cooperation programs in such regions and of
			 the resources required to achieve such objectives, priorities, and end
			 states.</text>
					</subparagraph><subparagraph id="HEA3D6E7291564C92B0E5D2EDD455E854"><enum>(C)</enum><text>A methodology for assessing the effectiveness of United States security force assistance and
			 cooperation programs in such regions in making progress towards such
			 objectives, priorities, and end-states, including an identification of key
			 benchmarks for such progress.</text>
					</subparagraph><subparagraph id="H284ABF2331DC4E59909CE57492A18829"><enum>(D)</enum><text>Criteria for bilateral and multilateral partnerships in such regions.</text>
					</subparagraph></paragraph></subsection><subsection display-inline="no-display-inline" id="H1317A30F06F444FA8CE9A9D7BBF880C7"><enum>(b)</enum><header>Report</header>
				<paragraph id="HF841302C4DCB4EA6934821FC44E76769"><enum>(1)</enum><header>In general</header><text>Not later than 180 days after the date of the enactment of this Act, the Secretary of Defense, in
			 coordination with the Secretary of State, shall submit to the appropriate
			 congressional committees a report on the strategic framework required by
			 subsection (a).</text>
				</paragraph><paragraph id="HA3A9B49458424A56A617172DBBF028F2"><enum>(2)</enum><header>Form</header><text>The report required by paragraph (1) shall be submitted in an unclassified form, but may include a
			 classified annex.</text>
				</paragraph></subsection></section><section id="H4428B1B48C0E4C919317BA3C9C930CB6"><enum>4.</enum><header>Requirement for plan to increase intelligence and cyber cooperation with Ukraine</header>
			<subsection id="H1AB9573075584E03B297C945E9ED8B16"><enum>(a)</enum><header>Plan required</header><text>Not later than 90 days after the date of the enactment of this Act, the President shall submit to
			 the appropriate congressional committees a plan to—</text>
				<paragraph id="HB0D0BC90FE9E4B8D8B08FB6352DB8E20"><enum>(1)</enum><text>increase United States intelligence, surveillance, and reconnaissance capabilities devoted to
			 monitoring the situation in Ukraine;</text>
				</paragraph><paragraph id="H9C3F408912AC469AA63FBE54942F5143"><enum>(2)</enum><text>increase United States intelligence information sharing and situational awareness to the maximum
			 extent practicable with Ukraine utilizing appropriate bilateral channels
			 and the NATO–Ukraine Commission;</text>
				</paragraph><paragraph id="H363FCB1875D647148D5C00D740B89AA2"><enum>(3)</enum><text>provide military advice and technical assistance to the Ukrainian military to enhance their
			 defensive preparations and posture;</text>
				</paragraph><paragraph id="H620BA21D0B7A422D8D716CD000FAEB5D"><enum>(4)</enum><text>convene NATO member states and Ukraine to review options and implement prudent steps to increase
			 the defense of United States, NATO and Ukraine cyber networks;</text>
				</paragraph><paragraph id="HE8F9E51EF18341A3ACC3616B2BD928DB"><enum>(5)</enum><text>work with NATO member states and the Ukrainian military to counter Russian propaganda; and</text>
				</paragraph><paragraph id="H346A6357D7724A728FE05E8061639F70"><enum>(6)</enum><text display-inline="yes-display-inline">provide any other types of intelligence and cyber cooperation with Ukraine and NATO members that
			 the Secretary of Defense deems appropriate.</text>
				</paragraph></subsection><subsection id="H7484A84C37B940868ED49B4B556AAB9B"><enum>(b)</enum><header>Form</header><text>The plan required in subsection (a) shall be submitted in an unclassified form, but may include a
			 classified annex.</text>
			</subsection><subsection id="H5D4CC4A049C749B6A980224D2BE9DDE2"><enum>(c)</enum><header>Appropriate congressional committees</header><text>In this section, the term <term>appropriate congressional committees</term> means—</text>
				<paragraph id="HDF36CBB3381847D6A9F23EE55F239E48"><enum>(1)</enum><text>the Committee on Armed Services, the Committee on Foreign Affairs, and the Permanent Select
			 Committee on Intelligence of the House of Representatives; and</text>
				</paragraph><paragraph id="H0A559DD43A4B48C8B88D4AD9FD2D73F2"><enum>(2)</enum><text>the Committee on Armed Services, the Committee on Foreign Relations, and the Select Committee on
			 Intelligence of the Senate.</text>
				</paragraph></subsection></section><section commented="no" id="H601B4BADF0984B0BBC8568588DAE06A3"><enum>5.</enum><header>Enhancing presence and capabilities of United States military in Europe</header>
			<subsection commented="no" id="H92336BAEEF0247D6904B72730696EB88"><enum>(a)</enum><header>Sense of Congress</header><text>It is the sense of Congress that the President should immediately augment the Armed Forces of the
			 United States in the area of responsibility of the United States European
			 Command to ensure that the Commander of the United States European Command
			 has the capabilities and capacity needed to meet operational plan
			 requirements for response under Article 5 of the North Atlantic Treaty in
			 support of a NATO ally.</text>
			</subsection><subsection commented="no" id="H620DBF7BDF4447199485A71CEB0BA9FC"><enum>(b)</enum><header>Notification</header><text display-inline="yes-display-inline">Not later than 60 days after the date of the enactment of this Act, the Secretary of Defense shall
			 submit to the congressional defense committees—</text>
				<paragraph id="H44049CB44CD64944AABA5CBE661B3DCB"><enum>(1)</enum><text>notification that the Secretary has commenced the augmentation described in subsection (a),
			 including—</text>
					<subparagraph id="H47288061E4E3470586A523CF1117A50D"><enum>(A)</enum><text display-inline="yes-display-inline">the means through which the United States European Command has been provided the capabilities and
			 capacity described in such subsection, including with respect to cyber,
			 special operations, and intelligence capabilities to counter or mitigate
			 conventional, unconventional, and subversive activities of the Russian
			 Federation within the area of responsibility of such command; and</text>
					</subparagraph><subparagraph id="HAD3DB801479049698E386C4DF5BB880F"><enum>(B)</enum><text>how such capabilities and capacity meet operational plan requirements; or</text>
					</subparagraph></paragraph><paragraph id="HA92B01529A744A80AE4E1BEC87210E0D"><enum>(2)</enum><text>a detailed justification of the Secretary for failing to—</text>
					<subparagraph id="HBCFE1ABC261C4CA59DC6597D9E31FB22"><enum>(A)</enum><text>commence such augmentation; and</text>
					</subparagraph><subparagraph id="H2CF7D0D04BAB4ABFB5E80F166A8565EB"><enum>(B)</enum><text display-inline="yes-display-inline">ensure that the Commander of the United States European Command has such capabilities and capacity.</text>
					</subparagraph></paragraph></subsection></section><section commented="no" id="HF76F7B399E0744D8AABD97DE0B311D3D"><enum>6.</enum><header>Enhancing readiness posture of United States military in Europe</header>
			<subsection commented="no" id="H82F3602D82014F57A38C132A33ADFB4B"><enum>(a)</enum><header>Sense of Congress</header><text display-inline="yes-display-inline">It is the sense of Congress that the President should—</text>
				<paragraph commented="no" id="H8D67ACDEBDE44F70B3A0FFDE387B14DA"><enum>(1)</enum><text display-inline="yes-display-inline">immediately correct deficiencies in the readiness of the Armed Forces of the United States in the
			 area of responsibility of the United States European Command to meet the
			 operational plan requirements for a response under Article 5 of the North
			 Atlantic Treaty in support of a NATO ally; and</text>
				</paragraph><paragraph commented="no" id="H99051E23CB154135A2C3B76CD052578C"><enum>(2)</enum><text>provide appropriate additional resources to NATO as needed to enhance the readiness of the forces
			 of NATO member states if a response under Article 5 of the North Atlantic
			 Treaty is required.</text>
				</paragraph></subsection><subsection commented="no" id="HB33D1B98053548AFA5E297EFFF717853"><enum>(b)</enum><header>Notification</header><text display-inline="yes-display-inline">Not later than 60 days after the date of the enactment of this Act, the Secretary of Defense shall
			 submit to the congressional defense committees—</text>
				<paragraph id="HC6A68CE2A927431684D0BD9CB069A271"><enum>(1)</enum><text>notification that—</text>
					<subparagraph id="H91C08FB6D53C43F49F11858F0477C100"><enum>(A)</enum><text>the Secretary has commenced the actions described in paragraphs (1) and (2) of subsection (a); and</text>
					</subparagraph><subparagraph id="HD21E49CF026C474AB00048015F770B72"><enum>(B)</enum><text display-inline="yes-display-inline">the current, as of the date of the notification, and the six-month projected readiness of the Armed
			 Forces of the United States meet the augmentation described in section
			 (4)(a); or</text>
					</subparagraph></paragraph><paragraph id="HF6E58EA5DA0A4CDDADB589884DFF2A87"><enum>(2)</enum><text display-inline="yes-display-inline">a detailed justification of the Secretary for failing to commence the actions described in
			 paragraphs (1) and (2) of subsection (a).</text>
				</paragraph></subsection></section><section commented="no" id="HE6C99F61243B40E18CD7F62A372C021D"><enum>7.</enum><header>Posturing United States strategic capabilities</header>
			<subsection commented="no" id="H1895997B98CD49EB95D77E228B759AD4"><enum>(a)</enum><header>Aegis Ashore system</header>
				<paragraph commented="no" id="H8B3D76A55BD4460BB0B439A1CB42A4D9"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than December 31, 2016, and pursuant to an agreement between the United States and the
			 Government of Poland, the Secretary of Defense shall ensure the
			 operational availability of the Aegis Ashore system site in Poland.</text>
				</paragraph><paragraph commented="no" id="HA9F12FDC641E4F7D919EA3346C47BDF2"><enum>(2)</enum><header>Relocation of assets</header><text display-inline="yes-display-inline">The Secretary may relocate the necessary assets of the Aegis weapon system between and within the
			 DDG–51 Class Destroyer program and the Aegis Ashore program to meet
			 mission requirements.</text>
				</paragraph><paragraph commented="no" id="HC91790B2F5D148DE90066CDBAE55007B"><enum>(3)</enum><header>Briefings</header><text display-inline="yes-display-inline">The Secretary shall provide to the congressional defense committees quarterly briefings to update
			 the status of the progress in carrying out paragraph (1).</text>
				</paragraph></subsection><subsection commented="no" id="HF2F34ABEAADA4236A9845B74C86799D6"><enum>(b)</enum><header>Theater air and missile defense</header>
				<paragraph id="H6C878803A56C422382AED35D17F64B5C"><enum>(1)</enum><header>Findings</header><text display-inline="yes-display-inline">Congress finds the following:</text>
					<subparagraph id="HC489180FBF524795A86D9BD777A1692F"><enum>(A)</enum><text display-inline="yes-display-inline">A Patriot battery of the United States providing a short-range air and missile defense capability
			 has previously been rotationally deployed to Poland, pursuant to an
			 agreement between the United States and the Government of Poland, during a
			 period occurring between 2010 to 2012.</text>
					</subparagraph><subparagraph id="H36248D33C98144868CA9432ABA917D0C"><enum>(B)</enum><text>The deployment of the Patriot battery did not include operational missiles and was not replaced
			 with another short-range air and missile defense system upon completion of
			 the deployment rotation in 2012.</text>
					</subparagraph></paragraph><paragraph id="HDFD5FF1FB868436F821F2A818A6CD5CE"><enum>(2)</enum><header>Policy</header><text display-inline="yes-display-inline">It is the policy of the United States that available short-range air and missile defense systems
			 and terminal missile defense systems of the United States with operational
			 missiles be rotationally deployed to central and eastern European allies,
			 pursuant to agreements between the United States and such allies, to
			 strength the air and missile defense capabilities of such allies.</text>
				</paragraph><paragraph commented="no" id="H59D32824863842B0A7A920E37DE9F385"><enum>(3)</enum><header>Missile defense capability of Poland</header>
					<subparagraph commented="no" id="HB0D15A2811674F4A9FEA07B72C3F36B0"><enum>(A)</enum><text>Not later than December 31, 2014, and pursuant to an agreement between the United States and the
			 Government of Poland, the Secretary of Defense shall deploy to Poland a
			 system providing a short-range air and missile defense capability or
			 terminal missile defense capability, or both, and the personnel required
			 to operate and maintain such system.</text>
					</subparagraph><subparagraph commented="no" id="HFABF85433F65484D955C772A0E1DB4A4"><enum>(B)</enum><text>No action may be taken to effect or implement the removal of the system or the personnel described
			 in subparagraph (A) unless—</text>
						<clause commented="no" id="H7CF5180627F845F2AF5BE9E2E91AD775"><enum>(i)</enum><text>at least 30 days before the removal, the Secretary of Defense notifies the congressional defense
			 committees that such removal is temporary and in the national security
			 interests of the United States; or</text>
						</clause><clause commented="no" id="HCE738EF3950B40A8B169C421C26426E8"><enum>(ii)</enum><text>the removal is requested by the Government of Poland in the manner provided in the agreement
			 between the United States and the Government of Poland regarding the
			 system and personnel.</text>
						</clause></subparagraph></paragraph><paragraph id="H63CE86EFAA0849CAB91B761EE7EA3B76"><enum>(4)</enum><header>Notification</header><text display-inline="yes-display-inline">The Secretary of Defense shall notify the appropriate congressional committees by not later than 60
			 days after the date on which a NATO member state makes a request that
			 communicates to the Secretary the interest of the member state in hosting
			 missile defense capabilities described in paragraph (2) and the plan of
			 the Secretary for addressing such request.</text>
				</paragraph></subsection><subsection commented="no" id="HFB4382B6BDC840FE8363768AB9EF4FAA"><enum>(c)</enum><header>Forward Deployed Nuclear Weapons</header><text>The Secretary of Defense shall immediately—</text>
				<paragraph commented="no" id="HF213285C17FD4BEFBA5D650C73B89F5A"><enum>(1)</enum><text display-inline="yes-display-inline">stop plans for the relocation and consolidation of dual-capable aircraft (as defined in section
			 497a of title 10, United States Code) of the United States that are based
			 in Europe;</text>
				</paragraph><paragraph commented="no" id="H8D105F6F1CA443778074660D7952AB22"><enum>(2)</enum><text>develop plans to temporarily base dual-capable aircraft of the United States in NATO member states
			 that make requests to host such aircraft;</text>
				</paragraph><paragraph commented="no" id="HE35008DA32E2418CB3302CA06ED20791"><enum>(3)</enum><text>conduct siting studies for the construction of weapon storage and security systems and protective
			 aircraft shelters in NATO members states that notify the Secretary of an
			 interest in hosting such systems and shelters and to provide for
			 reasonable burden sharing of associated non-recurring and recurring costs;
			 and</text>
				</paragraph><paragraph commented="no" id="H39B91221D5134D75A2BF25FE688A1D2D"><enum>(4)</enum><text display-inline="yes-display-inline">coordinate with NATO member states on the policy considerations of a decision by the United States
			 and its allies to alter the posture of forward deployed nuclear weapons
			 and related capabilities of the United States.</text>
				</paragraph></subsection></section><section id="H411264D52616413D8E80006C16BD7E0E"><enum>8.</enum><header>Limitation on military contact and cooperation between the United States and the Russian Federation</header>
			<subsection id="H33C65C1D98EF40158EE29109BCE6C0C2"><enum>(a)</enum><header>Limitation</header><text>None of the funds authorized to be appropriated or otherwise made available for fiscal year 2015
			 for the Department of Defense may be used for any bilateral
			 military-to-military contact or cooperation between the Governments of the
			 United States and the Russian Federation until the Secretary of Defense,
			 in consultation with the Secretary of State, certifies to the appropriate
			 congressional committees that—</text>
				<paragraph id="HBF1395455B624B2BACA9C06AA0FA7E7C"><enum>(1)</enum><text>the armed forces of the Russian Federation are no longer illegally occupying Ukrainian territory;</text>
				</paragraph><paragraph id="HAA7598A29C4C4769B7D130477AB1D758"><enum>(2)</enum><text>the Russian Federation is respecting the sovereignty of all Ukrainian territory;</text>
				</paragraph><paragraph id="HF5BAB1582379447293B6B1919D74925A"><enum>(3)</enum><text display-inline="yes-display-inline">the Russian Federation is no longer violating the INF Treaty; and</text>
				</paragraph><paragraph id="H6C02AA8112464E639EA0141F9EC86D90"><enum>(4)</enum><text>the Russian Federation is in compliance with the CFE Treaty and has lifted its suspension of
			 Russian observance of its treaty obligations.</text>
				</paragraph></subsection><subsection id="HE88D6E66A2984A8CB6BFC7597D34D82B"><enum>(b)</enum><header>Waiver</header><text>The Secretary of Defense may waive the limitation in subsection (a) if—</text>
				<paragraph id="HAF7A58263FE44BEBA0FDD35719511F0F"><enum>(1)</enum><text>the Secretary of Defense, in coordination with the Secretary of State, submits to the appropriate
			 congressional committees—</text>
					<subparagraph id="H8EDFD5734A674BDFA5563F0BE951650F"><enum>(A)</enum><text>a notification that such a waiver is in the national security interest of the United States and a
			 description of the national security interest covered by the waiver; and</text>
					</subparagraph><subparagraph id="HB35CF95BFC35489DA342118F8B039B53"><enum>(B)</enum><text display-inline="yes-display-inline">a report, in unclassified form, explaining why the Secretary of Defense cannot make the
			 certification under subsection (a); and</text>
					</subparagraph></paragraph><paragraph id="H14706B8E2C8142679474C38EE5404853"><enum>(2)</enum><text>a period of 30 days has elapsed following the date on which the Secretary of Defense submits the
			 information in the report under subparagraph (B).</text>
				</paragraph></subsection><subsection id="HA58D2360463B4DC69831EB2A594F2DD2"><enum>(c)</enum><header>Exception for certain military bases</header><text>The certification requirement specified in paragraph (1) of subsection (a) shall not apply to
			 military bases of the Russian Federation in Ukraine’s Crimean peninsula
			 operating in accordance with its 1997 agreement on the Status and
			 Conditions of the Black Sea Fleet Stationing on the Territory of Ukraine.</text>
			</subsection><subsection commented="no" id="HC079425FB7BF4F718C37FDFA34B40B2D"><enum>(d)</enum><header>Definition</header><text>In this section, the term <term>bilateral military-to-military contact or cooperation</term>—</text>
				<paragraph id="H109FD45BE37E4BBE942A5CE1C8AC2A4A"><enum>(1)</enum><text>means—</text>
					<subparagraph id="HF4C4FB43848C48F7943718BB18CC6E2F"><enum>(A)</enum><text>reciprocal visits and meetings by high-ranking delegations;</text>
					</subparagraph><subparagraph id="HEFC8C0D6D4544AC0B250D900D1727F5D"><enum>(B)</enum><text>information sharing, policy consultations, security dialogues or other forms of consultative
			 discussions;</text>
					</subparagraph><subparagraph id="HAD147274F3B341259C2403C1907B5076"><enum>(C)</enum><text>exchanges of military instructors, training personnel, and students;</text>
					</subparagraph><subparagraph id="HE278FDBAE9DE4FEC9BCAFDFC460B6726"><enum>(D)</enum><text>exchanges of information;</text>
					</subparagraph><subparagraph id="H8BE0453284E248A3AB9939D2AFD61469"><enum>(E)</enum><text>defense planning; and</text>
					</subparagraph><subparagraph id="H2F5F03347E69406B806B0FF2CB25C9FA"><enum>(F)</enum><text>military training or exercises; but</text>
					</subparagraph></paragraph><paragraph commented="no" id="H09EB5BAE4D6E4C39807FF2ACDBB59BF1"><enum>(2)</enum><text>does not include any contact or cooperation that is in support of United States stability
			 operations.</text>
				</paragraph></subsection><subsection commented="no" id="HE7BD71F4E3D14420A31F9E0B62E1ABAD"><enum>(e)</enum><header>Effective date</header><text>This section takes effect on the date of the enactment of this Act and applies with respect to
			 funds described in subsection (a) that are unobligated as of such date of
			 enactment.</text>
			</subsection></section><section id="H644DA08B640244B89C18ED4C60D02862"><enum>9.</enum><header>Limitation on non-proliferation activities between the United States and the Russian Federation</header>
			<subsection id="HD101F9BB13A641FC92C682BA0963D596"><enum>(a)</enum><header>Limitation</header><text display-inline="yes-display-inline">None of the funds authorized to be appropriated or otherwise made available for fiscal year 2015
			 for the National Nuclear Security Administration of the Department of
			 Energy may be used for any contact, cooperation, or transfer of technology
			 between the United States and the Russian Federation until the Secretary
			 of Energy, in consultation with the Secretary of State and Secretary of
			 Defense, certifies to the appropriate congressional committees that—</text>
				<paragraph id="H96C67D4D27584B539163CDE6B1466651"><enum>(1)</enum><text>the armed forces of the Russian Federation are no longer illegally occupying Ukrainian territory;</text>
				</paragraph><paragraph id="H8CC33689AA6D4977A7C15CBA3E92AB8F"><enum>(2)</enum><text>the Russian Federation is respecting the sovereignty of all Ukrainian territory;</text>
				</paragraph><paragraph id="HCB787782AA9041048A12A89603A325D9"><enum>(3)</enum><text>the Russian Federation is no longer violating the INF Treaty; and</text>
				</paragraph><paragraph id="HB1C5102076834C2C86E24F35C2EF6259"><enum>(4)</enum><text>the Russian Federation is in compliance with the CFE Treaty and has lifted its suspension of
			 Russian observance of its treaty obligations.</text>
				</paragraph></subsection><subsection id="H07DD5EEEF57B44A58DBE1BD86C0869F6"><enum>(b)</enum><header>Waiver</header><text>The Secretary of Energy may waive the limitation in subsection (a) if—</text>
				<paragraph id="HB05DAB5E19F643C6A4D29C282A60872E"><enum>(1)</enum><text>the Secretary of Energy, in coordination with the Secretary of State and Secretary of Defense,
			 submits to the appropriate congressional committees—</text>
					<subparagraph id="HB8396020621C4B5987CC69C065A0543A"><enum>(A)</enum><text>a notification that such a waiver is in the national security interest of the United States and a
			 description of the national security interest covered by the waiver; and</text>
					</subparagraph><subparagraph id="HD295A9FD53224BDE9A7D3D7742B322F1"><enum>(B)</enum><text display-inline="yes-display-inline">a report, in an unclassified form, explaining why the Secretary of Energy cannot make a
			 certification for such under subsection (a); and</text>
					</subparagraph></paragraph><paragraph id="H24E0D2CE3DBA44A28A13456C4EC7A9C6"><enum>(2)</enum><text>a period of 30 days has elapsed following the date on which the Secretary of Energy submits the
			 information in the report under subparagraph (B).</text>
				</paragraph></subsection><subsection id="H562E0CFCA3604CAF97745661672C26D2"><enum>(c)</enum><header>Exception for certain military bases</header><text>The certification requirement specified in paragraph (1) of subsection (a) shall not apply to
			 military bases of the Russian Federation in Ukraine’s Crimean peninsula
			 operating in accordance with its 1997 agreement on the Status and
			 Conditions of the Black Sea Fleet Stationing on the Territory of Ukraine.</text>
			</subsection><subsection commented="no" id="H92F3D819E95D41408CC233F6DEB032FB"><enum>(d)</enum><header>Effective date</header><text>This section takes effect on the date of the enactment of this Act and applies with respect to
			 funds described in subsection (a) that are unobligated as of such date of
			 enactment.</text>
			</subsection></section><section id="HD6463E5551374BE7BD9A41DBA23EB968"><enum>10.</enum><header>Annual report on military and security developments involving the Russian Federation</header>
			<subsection id="H81C4E86D89394BE28D89D81667D67688"><enum>(a)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than June 1 of each year, the Secretary of Defense shall submit to the appropriate
			 congressional committees a report, in both classified and unclassified
			 form, on the current and future military power of the Russian Federation
			 (in this section referred to as <quote>Russia</quote>). The report shall address the current and probable future course of military-technological
			 development of the Russian military, the tenets and probable development
			 of Russian security strategy and military strategy, and military
			 organizations and operational concepts, for the 20-year period following
			 submission of such report.</text>
			</subsection><subsection commented="no" id="H279D2F98B43640818F4D186FD06C1D93"><enum>(b)</enum><header>Matters To be included</header><text>A report required under subsection (a) shall include the following:</text>
				<paragraph commented="no" id="HA8B5F07C59AF4AF5845F47010CFD90C6"><enum>(1)</enum><text>An assessment of the security situation in regions neighboring Russia.</text>
				</paragraph><paragraph commented="no" id="HD4B9F93BE81343DAAF70812458FFE8D4"><enum>(2)</enum><text>The goals and factors shaping Russian security strategy and military strategy.</text>
				</paragraph><paragraph commented="no" id="H678F4DFE4F2647BBB1A3AF0EDA330232"><enum>(3)</enum><text>Trends in Russian security and military behavior that would be designed to achieve, or that are
			 consistent with, the goals described in paragraph (2).</text>
				</paragraph><paragraph commented="no" id="H4A93C5C311D642A687002DB5DC9A2C80"><enum>(4)</enum><text>An assessment of Russia’s global and regional security objectives, including objectives that would
			 affect NATO, the Middle East, and the People’s Republic of China.</text>
				</paragraph><paragraph commented="no" id="H8D96BB85859D42DF94ED4441071860F4"><enum>(5)</enum><text>A detailed assessment of the sizes, locations, and capabilities of Russian nuclear, special
			 operations, land, sea, and air forces.</text>
				</paragraph><paragraph commented="no" id="H57442C90D6AE4DEC8E17FDADDA43507D"><enum>(6)</enum><text>Developments in Russian military doctrine and training.</text>
				</paragraph><paragraph commented="no" id="H38A6AD975BE94C0CAC76608DF5FE2F96"><enum>(7)</enum><text>An assessment of the proliferation activities of Russia and Russian entities, as a supplier of
			 materials, technologies, or expertise relating to nuclear weapons or other
			 weapons of mass destruction or missile systems.</text>
				</paragraph><paragraph commented="no" id="HBDB51C5368D043ECAC12E9A5A9B5B75A"><enum>(8)</enum><text>Developments in Russia’s asymmetric capabilities, including its strategy and efforts to develop and
			 deploy cyberwarfare and electronic warfare capabilities, details on the
			 number of malicious cyber incidents originating from Russia against
			 Department of Defense infrastructure, and associated activities
			 originating or suspected of originating from Russia.</text>
				</paragraph><paragraph commented="no" id="HDE83C1E4C9EB4150AEADBDDE0A0E86D0"><enum>(9)</enum><text>The strategy and capabilities of Russian space and counterspace programs, including trends, global
			 and regional activities, the involvement of military and civilian
			 organizations, including state-owned enterprises, academic institutions,
			 and commercial entities, and efforts to develop, acquire, or gain access
			 to advanced technologies that would enhance Russian military capabilities.</text>
				</paragraph><paragraph commented="no" id="HFA7D29261FDC4793B3B9D1393746CF4C"><enum>(10)</enum><text>Developments in Russia’s nuclear program, including the size and state of Russia’s stockpile, its
			 nuclear strategy and associated doctrines, its civil and military
			 production capacities, and projections of its future arsenals.</text>
				</paragraph><paragraph commented="no" id="HAEF96293D2364EBE8EEC8BBA7D4AFBE0"><enum>(11)</enum><text>A description of Russia’s anti-access and area denial capabilities.</text>
				</paragraph><paragraph commented="no" id="H20B372456AFA44EC9333959ED846C57D"><enum>(12)</enum><text>A description of Russia’s command, control, communications, computers, intelligence, surveillance,
			 and reconnaissance modernization program and its applications for Russia’s
			 precision guided weapons.</text>
				</paragraph><paragraph commented="no" id="H1689B32486574774A4FAFF79320F483A"><enum>(13)</enum><text>In consultation with the Secretary of Energy and the Secretary of State, developments regarding
			 United States-Russian engagement and cooperation on security matters.</text>
				</paragraph><paragraph commented="no" id="HDFA156C774884926982AA30EED5DD447"><enum>(14)</enum><text>The current state of United States military-to-military contacts with the Russian Federation Armed
			 Forces, which shall include the following:</text>
					<subparagraph commented="no" id="HD46134DE388F44C2954FEC066812FA82"><enum>(A)</enum><text>A comprehensive and coordinated strategy for such military-to-military contacts and updates to the
			 strategy.</text>
					</subparagraph><subparagraph commented="no" id="H69A9764FEC4347E08DBC4561EA867568"><enum>(B)</enum><text>A summary of all such military-to-military contacts during the one-year period preceding the
			 report, including a summary of topics discussed and questions asked by the
			 Russian participants in those contacts.</text>
					</subparagraph><subparagraph commented="no" id="H902503AC446F47E78EE4E23FED181712"><enum>(C)</enum><text>A description of such military-to-military contacts scheduled for the 12-month period following
			 such report and the plan for future contacts.</text>
					</subparagraph><subparagraph commented="no" id="HA2E79F1786FE40A285E1D73198225780"><enum>(D)</enum><text>The Secretary’s assessment of the benefits the Russians expect to gain from such
			 military-to-military contacts.</text>
					</subparagraph><subparagraph commented="no" id="HFB38B1C383E04A3082AD58FAB167AD30"><enum>(E)</enum><text>The Secretary’s assessment of the benefits the Department of Defense expects to gain from such
			 military-to-military contacts, and any concerns regarding such contacts.</text>
					</subparagraph><subparagraph commented="no" id="H4D7F54FFDCDF4243A4A23CD99C1A0224"><enum>(F)</enum><text>The Secretary’s assessment of how such military-to-military contacts fit into the larger security
			 relationship between the United States and the Russian Federation.</text>
					</subparagraph></paragraph><paragraph commented="no" id="H69B3E8399A714978B5EFF556B632E0AC"><enum>(15)</enum><text>A description of Russian military-to-military relationships with other countries, including the
			 size and activity of military attaché offices around the world and
			 military education programs conducted in Russia for other countries or in
			 other countries for the Russians.</text>
				</paragraph><paragraph commented="no" id="H4AA35001EE2042ECB73879E371B999BF"><enum>(16)</enum><text>Other military and security developments involving Russia that the Secretary of Defense considers
			 relevant to United States national security.</text>
				</paragraph></subsection></section></legis-body>
