<official-title>To provide for the establishment of a fund to provide for an expanded and sustained national investment in biomedical research.</official-title>

<section id="H873FB7B70CD34201A901344AF0CAD90D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>America Helping Encourage Advancements in Lifesaving Science </short-title></quote> or the <quote>America HEALS Act</quote>.</text></section> 
<section id="H245F5A9EBCB54EA79DB7ED40FD9DBCF2"><enum>2.</enum><header>Biomedical Research Fund</header> 
<subsection id="HA7F5B02035334F1B9D052C316E4ABED4"><enum>(a)</enum><header>Purpose</header><text>It is the purpose of this section to establish a Biomedical Research Fund (referred to in this section as the <quote>Fund</quote>), to be administered by the Secretary of the Treasury, to provide for an expanded and sustained national investment in biomedical research through the programs and agencies described in subsection (b)(2).</text></subsection> 
<subsection id="HA5AEF578293948239E1B996E60583C3B"><enum>(b)</enum><header>Use of fund</header> 
<paragraph id="HF188D5E1A6D54FCB99105E5FB455855F"><enum>(1)</enum><header>In general</header><text>For each fiscal year, amounts shall be transferred from the Fund to the accounts related to the programs and agencies described in paragraph (2) to ensure that funding for such programs and agencies for such fiscal year does not fall below 105 percent of the level of funding provided for the fiscal year immediately preceding the fiscal year for which the determination is being made and an additional amount to account for any increases in the Gross Domestic Product for the year involved.</text></paragraph> 
<paragraph id="HC6129F87AD124558B59E7AFE3277A7DC"><enum>(2)</enum><header>Agencies</header><text>The programs and agencies described in this paragraph are the following:</text> 
<subparagraph id="H49B9993314A24689AA3B6F8C0A49E4FA"><enum>(A)</enum><text>The National Institutes of Health.</text></subparagraph> 
<subparagraph id="HB8196F31280C4D3A9E3B38A3EDCDD130"><enum>(B)</enum><text>The Centers for Disease Control and Prevention.</text></subparagraph> 
<subparagraph id="H62A826F57B434B2DBC43E48B19361421"><enum>(C)</enum><text>The Department of Defense health program.</text></subparagraph> 
<subparagraph id="H6FA0CEEE64704F518EE9538ED93E5F5B"><enum>(D)</enum><text>The medical and prosthetics research program of the Department of Veterans Affairs.</text></subparagraph></paragraph></subsection> 
<subsection id="HF38B3D7A7F6B46BD97495D7960AECF03"><enum>(c)</enum><header>Minimum continued funding requirement</header><text>Amounts appropriated for each of the programs and agencies described in subsection (b)(2) for a fiscal year shall not be less than the amounts appropriated for such programs and agencies for fiscal year 2014.</text></subsection> 
<subsection id="H128C8CECDCD54023B54F89FBF2643C20"><enum>(d)</enum><header>Funding</header><text>There are hereby authorized to be appropriated, and appropriated, to the Fund, out of any monies in the Treasury not otherwise appropriated, such sums as may be necessary in each fiscal year to enable the transfers to be made in accordance with subsection (b)(1).</text></subsection> 
<subsection id="H0C3BBC7894B94D9FA449AB8ED111BC7E"><enum>(e)</enum><header>Transfer authority</header><text>The Committee on Appropriations of the Senate and the Committee on Appropriations of the House of Representatives may provide for the transfer of funds in the Fund to eligible programs and agencies under this section, subject to subsection (b).</text></subsection> 
<subsection id="HE38861482A604F3FBAD4E49668AB0808"><enum>(f)</enum><header>Exemption of certain payments from sequestration</header> 
<paragraph id="H6C66DF03F8CF4200A84E6AC4CABE6053"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Section 255(g)(1)(A) of the Balanced Budget and Emergency Deficit Control Act (<external-xref legal-doc="usc" parsable-cite="usc/2/905">2 U.S.C. 905(g)(1)(A)</external-xref>) is amended by inserting after <quote>Advances to the Unemployment Trust Fund and Other Funds (16–0327–0–1–600).</quote> the following:</text>

<clause id="H1757F133C1BE4B89AF8431EC54D83AA5"><enum></enum><text>Biomedical Research Fund.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HA5BA3690073440DA937A38F60BB9AEF5"><enum>(2)</enum><header>Applicability</header><text>The amendment made by this section shall apply to any sequestration order issued under the Balanced Budget and Emergency Deficit Control Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/2/900">2 U.S.C. 900 et seq.</external-xref>) on or after the date of enactment of this Act.</text></paragraph></subsection></section>
