		<section id="H8B265EE25628463A817245BAEF4E6D13" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Military Sexual Trauma Claims Administration Reform and Eligibility Act</short-title></quote>.</text>
		</section><section id="H1B72E7A7CC954564834B20A6875BB3EE" section-type="subsequent-section"><enum>2.</enum><header>Presumption of service connection for mental health conditions related to military sexual trauma</header>
			<subsection id="HCD1781214D614F9F802E2E15E5C87DD9"><enum>(a)</enum><header>Presumption</header>
				<paragraph id="H416877E6AB354A61B2AC9D6B98D1906E"><enum>(1)</enum><header>In general</header><text>Subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/11">chapter 11</external-xref> of title 38, United States Code, is amended by adding at the end the
			 following new section:</text>

						<section id="H63C68F28D56D45198BF449E8B5C9DA7A"><enum>1119.</enum><header>Presumption of service connection for mental health conditions related to military sexual trauma</header>
							<subsection display-inline="no-display-inline" id="H8045587979AF4E84BD20DF59D04C40F0"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">For purposes of section 1110 of this title, and subject to section 1113 of this title, a mental
			 health condition of a veteran that a veteran certifies to the Secretary as
			 being incurred in or aggravated by military sexual trauma shall be
			 considered to have been incurred in or aggravated by the service of the
			 veteran, notwithstanding that there is no record of evidence of such
			 mental health condition or such military sexual trauma occurring during
			 such service.</text>
							</subsection><subsection commented="no" id="H90784647F2E446E0B964E1DB0266913E"><enum>(b)</enum><header>Military sexual trauma defined</header><text display-inline="yes-display-inline">In this section, the term <term>military sexual trauma</term> means, with respect to a veteran, psychological trauma, which in the judgment of a mental health
			 professional, resulted from a physical assault of a sexual nature, battery
			 of a sexual nature, or sexual harassment (as defined in section 1720D of
			 this title) which occurred during a period of serving in the Armed Forces
			 on active duty or active duty for training.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H61B3B4F16ED34A0EBE9231A0643AFCB0"><enum>(2)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of chapter 11 of such title is amended by inserting after
			 the item relating to section 1118 the following new item:</text>

			 trauma.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HF71917FFF2124F63A3A4FB71421B699B"><enum>(b)</enum><header>Presumption rebuttable</header><text><external-xref legal-doc="usc" parsable-cite="usc/38/1113">Section 1113</external-xref> of title 38, United States Code, is amended by striking <quote>or 1118</quote> each place it appears and inserting <quote>1118, or 1119</quote>.</text>
			</subsection><subsection id="HA113F0920CEE488DA8BD5B99E8175434"><enum>(c)</enum><header>Presumption during peacetime service</header><text><external-xref legal-doc="usc" parsable-cite="usc/38/1137">Section 1137</external-xref> of title 38, United States Code, is amended by striking <quote>and 1113</quote> and inserting <quote>1113, and 1119</quote>.</text>
