			 reference shall be considered to be made to a section or other provision
			 of the Native American Housing Assistance and Self-Determination Act of
			 1996 (<external-xref legal-doc="usc" parsable-cite="usc/25/4101">25 U.S.C. 4101 et seq.</external-xref>).</text>
		</section><title id="H94D924E6C043470996A35B8ABE6D2AF7"><enum>I</enum><header>BLOCK GRANTS AND GRANT REQUIREMENTS</header>
			<section id="H4F49079335EC4CFC9F539B4971FF65FB"><enum>101.</enum><header>Block grants</header><text display-inline="no-display-inline">Section 101 (<external-xref legal-doc="usc" parsable-cite="usc/25/4111">25 U.S.C. 4111</external-xref>) is amended—</text>
				<paragraph id="H2D1ED1E306A24485A8F51FD8ECCCA30A"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (c), by adding after the period at the end the following: <quote>If the Secretary fails to act on a waiver request submitted under this subsection by a recipient
			 within 60 days after receipt of such request, the waiver request shall be
			 deemed approved.</quote>;</text>
				</paragraph><paragraph id="H68433C984CE7423FAA3FB31511C408EE"><enum>(2)</enum><text>in subsection (j), by striking <quote>section 501 of title 40,</quote> and inserting <quote>title 40 of the</quote>; and</text>
				</paragraph><paragraph id="HD1FC7342C4D546ADAA20E53F543DF9B7"><enum>(3)</enum><text>in subsection (k), by striking <quote>1</quote> and inserting <quote>an</quote>.</text>
				</paragraph></section><section id="HED5ECF9DF6074A45952B8D25E81B1457"><enum>102.</enum><header>Indian housing plans</header><text display-inline="no-display-inline">Section 102(a) (<external-xref legal-doc="usc" parsable-cite="usc/25/4112">25 U.S.C. 4112(a)</external-xref>) is amended by inserting after and below paragraph (2) the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="H1D7995D14D5F456E9E73B8F8264C71CC" style="OLC">
					<quoted-block-continuation-text quoted-block-continuation-text-level="subsection"><quote>The Secretary may grant a waiver of the submission requirements under paragraph (1) upon meeting
			 certain factors that shall be set out by regulation, and provided further
			 that a request for such waiver shall be deemed approved if the Secretary
			 does not act on such request within 60 days of receipt.</quote></quoted-block-continuation-text><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="H6140E0C13F1441D5A36089A3938F8963"><enum>103.</enum><header>Environmental review</header><text display-inline="no-display-inline">Section 105 (<external-xref legal-doc="usc" parsable-cite="usc/25/4115">25 U.S.C. 4115</external-xref>) is amended—</text>
				<paragraph id="H7847F6F3B2C14D7D8613B5E9851174AB"><enum>(1)</enum><text>in subsection (d)—</text>
					<subparagraph id="H2EC05C606D994666AD637DAF1B072D80"><enum>(A)</enum><text>in the matter preceding paragraph (1), by striking <quote>may</quote> and inserting <quote>shall</quote>; and</text>
					</subparagraph><subparagraph id="H173C2DB7A08C4D438784ED61164EEBDF"><enum>(B)</enum><text>by adding after and below paragraph (4) the following:</text>
						<quoted-block display-inline="no-display-inline" id="HD95B17A5A08D469493DD12F026ACF8ED" style="OLC">
							<quoted-block-continuation-text quoted-block-continuation-text-level="subsection">If the Secretary fails to act on a waiver request submitted under this subsection by a recipient
			 within 60 days after receipt of such request, the waiver shall be deemed
			 approved.</quoted-block-continuation-text><after-quoted-block>; and</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="H501CBCD13F61441B8DA3D54FEE44A42D"><enum>(2)</enum><text>by adding at the end the following new subsection:</text>

						<subsection id="HE9A8579B9ED64D5188BFACACAFE84F6D"><enum>(e)</enum><header>Consolidation of environmental review requirements</header><text>If a recipient is using one or more sources of Federal funds in addition to grant amounts under
			 this Act in carrying out a project that qualifies as an affordable housing
			 activity under section 202 and the recipient’s tribe has assumed all of
			 the responsibilities for environmental review, decisionmaking, and action
			 pursuant to this section, the recipient’s compliance with the National
			 Environmental Policy Act of 1969 review requirements under this section
			 with regard to such project shall be deemed to fully comply with and
			 discharge any applicable environmental review requirements that might
			 apply to the use of such additional Federal funding sources for that
			 project.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></section><section id="HD21602156A5B473EB58318414FA69A3A"><enum>104.</enum><header>Failure to act on request for approval regarding exceeding TDC maximum cost for project</header>
				<subsection id="H821028D05CA040839EDDC95C7748487F"><enum>(a)</enum><header>Approval</header><text display-inline="yes-display-inline">Section 103 (<external-xref legal-doc="usc" parsable-cite="usc/25/4113">25 U.S.C. 4113</external-xref>) is amended by adding at the end the following new subsection:</text>
					<quoted-block display-inline="no-display-inline" id="H603817EBF3CA431A9A890FA245342BD7" style="OLC">
						<subsection id="H84C74BEFACB9432CA3803D0D046F4ECB"><enum>(f)</enum><header>Approval of request To exceed TDC maximum</header><text display-inline="yes-display-inline">A request for approval by the Secretary of Housing and Urban Development to exceed by more than 10
			 percent the total development cost maximum cost for a project shall be
			 deemed to be approved if the Secretary fails to take action on the request
			 during the 60-day period that begins on the date that the Secretary
			 receives the request.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="HCA057BFE687A4FF1A03A44C54306115D"><enum>(b)</enum><header>Definition</header><text>Section 4 (<external-xref legal-doc="usc" parsable-cite="usc/25/4103">25 U.S.C. 4103</external-xref>) is amended—</text>
					<paragraph id="H8988490B333A42648141F98467082BA4"><enum>(1)</enum><text>by redesignating paragraph (22) as paragraph (23); and</text>
					</paragraph><paragraph id="H9B0D68FF36474DF8A3514200A2D3513D"><enum>(2)</enum><text>by inserting after paragraph (21) the following new paragraph:</text>
						<quoted-block display-inline="no-display-inline" id="H139743352D384704B5B3A03B677F9119" style="OLC">
							<paragraph id="H06540937057A42E18EC10C9903CAAF2D"><enum>(22)</enum><header>Total development cost</header><text display-inline="yes-display-inline">The term <quote>total development cost</quote> means, with respect to a housing project, the sum of all costs for the project, including all
			 undertakings necessary for administration, planning, site acquisition,
			 demolition, construction or equipment and financing (including payment of
			 carrying charges), and for otherwise carrying out the development of the
			 project, excluding off-site water and sewer. The total development cost
			 amounts shall be based on a moderately designed house and determined by
			 averaging the current construction costs as listed in not less than two
			 nationally recognized residential construction cost indices.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection></section></title><title id="H3A9E72645DB4426A985C878891D540EF"><enum>II</enum><header>AFFORDABLE HOUSING ACTIVITIES</header>
			<section id="H8C5F4291B33C4C06BD2020CF25465C60"><enum>201.</enum><header>National objectives and eligible families</header><text display-inline="no-display-inline">Paragraph (6) of section 201(b) (<external-xref legal-doc="usc" parsable-cite="usc/25/4131">25 U.S.C. 4131(b)(6)</external-xref>; relating to exemption) is amended—</text>
				<paragraph id="H4E0CEFA8F5A1486F8FD3852F82C4F859"><enum>(1)</enum><text>by striking <quote>1964 and</quote> and inserting <quote>1964,</quote>; and</text>
				</paragraph><paragraph id="HD5B39E8C23CD44639EE13807EDC79128"><enum>(2)</enum><text>by inserting after <quote>1968</quote> the following: <quote>, and section 3 of the Housing and Urban Development Act of 1968</quote>.</text>
				</paragraph></section><section id="H9A2AE806751240A7B7BA2C4701D2C04F"><enum>202.</enum><header>Eligible affordable housing activities</header><text display-inline="no-display-inline">Section 202(9)(A) (<external-xref legal-doc="usc" parsable-cite="usc/25/4132">25 U.S.C. 4132(9)(A)</external-xref>) is amended—</text>
				<paragraph id="HE6E370F8ACDF4D2887D75E071E3E4358"><enum>(1)</enum><text>by striking <quote>only</quote>;</text>
				</paragraph><paragraph id="HCFDC10A5D8D8497687516C17ED6D8470"><enum>(2)</enum><text>by striking <quote>administration and planning related to</quote>; and</text>
				</paragraph><paragraph id="H3A84F75E54A64E55A1937F459F0E9BCA"><enum>(3)</enum><text display-inline="yes-display-inline">by inserting <quote>including administration and planning,</quote> after <quote>section,</quote>.</text>
				</paragraph></section><section id="HC0877897AD3D41F0889DE4A6B8D35767"><enum>203.</enum><header>Program requirements</header><text display-inline="no-display-inline">Section 203 (<external-xref legal-doc="usc" parsable-cite="usc/25/4133">25 U.S.C. 4133</external-xref>) is amended—</text>
				<paragraph id="HC185B562D12247A291350893D6FD0692"><enum>(1)</enum><text>in subsection (a)—</text>
					<subparagraph id="H6355100A74084D1DAB7AD071DC0316DA"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (1), by striking <quote>paragraph (2)</quote> and inserting <quote>paragraphs (2) and (3)</quote>; and</text>
					</subparagraph><subparagraph id="H103B3004D6884B3B9CECBEEFED5FB9AF"><enum>(B)</enum><text>by adding at the end the following new paragraph:</text>
						<quoted-block display-inline="no-display-inline" id="HDAE7CEDE1FA9494397E49EA1204BA6D1" style="OLC">
							<paragraph commented="no" id="HD83C53519BAE467793076AA2C683A41F"><enum>(3)</enum><header>Application of tribal policies</header><text display-inline="yes-display-inline">Paragraph (2) shall not apply if the recipient has a written policy governing rents and homebuyer
			 payments charged for dwelling units and such policy includes a provision
			 governing maximum rents or homebuyer payments.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="H28BD6A096EC346649E271A67E4DABB58"><enum>(2)</enum><text>in subsection (c), by striking <quote>or assisted with</quote> and inserting <quote>by a recipient</quote>; and</text>
				</paragraph><paragraph id="HDFC83B483BB5465FB65FEB8B623150E8"><enum>(3)</enum><text>in subsection (e), by striking <quote>assisted with</quote> and inserting <quote>units that are owned or operated by a recipient using</quote>.</text>
				</paragraph></section><section id="H3991662697A4412CA14AF000E891692F"><enum>204.</enum><header>Low-income requirement and income targeting</header><text display-inline="no-display-inline">Section 205 (<external-xref legal-doc="usc" parsable-cite="usc/25/4135">25 U.S.C. 4135</external-xref>) is amended—</text>
				<paragraph id="H06C6F070518E408FA8EF56526873563D"><enum>(1)</enum><text>in subsection (a)—</text>
					<subparagraph id="HB013EBF0B672439282051756C1118849"><enum>(A)</enum><text>in paragraph (1)—</text>
						<clause id="HC4F2F89CFF554470B2E27AE9BDADBCDB"><enum>(i)</enum><text>in subparagraph (C), by striking <quote>and</quote> at the end;</text>
						</clause><clause id="HC8973661050C4361BE926B9C17D649C7"><enum>(ii)</enum><text>in subparagraph (D), by striking the period at the end and inserting <quote>; and </quote>; and</text>
						</clause><clause id="HA4339D438FB64C3893E6C4A9B38846B4"><enum>(iii)</enum><text>by adding at the end the following new subparagraph:</text>
							<quoted-block display-inline="no-display-inline" id="HBCE0C24F237546B798620EF5B0ECE738" style="OLC">
								<subparagraph id="H6C12BB4D7E8C4910858CA9DA7D672804"><enum>(E)</enum><text display-inline="yes-display-inline">notwithstanding any other provision of this paragraph, in the case of rental housing that is made
			 available to a current rental family for conversion to a homebuyer or a
			 lease-purchase unit, that the current rental family can purchase through a
			 contract of sale, lease-purchase agreement, or any other sales agreement,
			 is made available for purchase only by the current rental family, if the
			 rental family was a low-income family at the time of their initial
			 occupancy of such unit; and</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block>
						</clause></subparagraph><subparagraph id="H7EF73DAAB5204CDE8E575E3DA6EBE1CC"><enum>(B)</enum><text>in paragraph (2)—</text>
						<clause id="H991315B409DB4BDAA8CC34AF6F6A6FE1"><enum>(i)</enum><text>by striking <quote>satisfactory to the Secretary</quote> and inserting <quote>in such forms as the Secretary shall, by regulation, require</quote>; and</text>
						</clause><clause id="H20CAAE02F0A048EC810FACB0C90E3537"><enum>(ii)</enum><text>by striking <quote>Secretary)</quote> and inserting <quote>recipient)</quote>; and</text>
						</clause></subparagraph></paragraph><paragraph id="HF33B85D9492B416EA659F2F00EE3BA43"><enum>(2)</enum><text>in subsection (c), by adding after the period at the end the following: <quote>The provisions of such paragraph regarding binding commitments for the remaining useful life of the
			 property shall not apply to improvements of privately owned homes if the
			 cost of such improvements do not exceed 10 percent of the maximum total
			 development cost for such home.</quote>.</text>
				</paragraph></section><section id="H9EFAC4E1ABB24EB69C3FDF52DEE177FE"><enum>205.</enum><header>Lease requirements and tenant selection</header><text display-inline="no-display-inline">Section 207 (<external-xref legal-doc="usc" parsable-cite="usc/25/4137">25 U.S.C. 4137</external-xref>) is amended by adding at the end the following new subsection:</text>
				<quoted-block id="H626EA0D2B51F494FA4553632AC19E3DE" style="OLC">
					<subsection id="H0EE1A68D4DCF4CF48ED2F216AE0D58E1"><enum>(c)</enum><header>Notice of termination</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, the owner or manager of rental housing that is assisted
			 in part with amounts provided under this Act and in part with one or more
			 other sources of Federal funds shall only utilize leases that require a
			 notice period for the termination of the lease pursuant to subsection
			 (a)(3).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="HA3DB52122148402AA9CBCF6D71C36A50"><enum>206.</enum><header>Tribal coordination of agency funding</header><text display-inline="no-display-inline">Subtitle A of title II (<external-xref legal-doc="usc" parsable-cite="usc/25/4131">25 U.S.C. 4131 et seq.</external-xref>) is amended by adding at the end the following new
			 section:</text>
				<quoted-block display-inline="no-display-inline" id="H60DBBDEC0CA543549B06F0E22BE74EE5" style="OLC">
					<section id="HE1B51FC537B04B19AD2F9F1288E3A897"><enum>211.</enum><header>Tribal coordination of agency funding</header><text display-inline="no-display-inline">Notwithstanding any other provision of law, a recipient authorized to receive funding under this
			 Act may, in its discretion, use funding from the Indian Health Service of
			 the Department of Health and Human Services for construction of sanitation
			 facilities for housing construction and renovation projects that are
			 funded in part by funds provided under this Act.</text></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</section></title><title id="HCEDD236F057E4389B5B76CA91D25EB45"><enum>III</enum><header>ALLOCATION OF GRANT AMOUNTS</header>
			<section id="HC3746AB4DDC34EA196FB500E35CB94EF"><enum>301.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">The first sentence of section 108 (<external-xref legal-doc="usc" parsable-cite="usc/25/4117">25 U.S.C. 4117</external-xref>) is amended by striking <quote>such sums as may be necessary for each of fiscal years 2009 through 2013</quote> and inserting <quote>$650,000,000 for each of fiscal years 2014 through 2018</quote>.</text>
			</section></title><title id="H00A409B7C088408484C9524D593DC092"><enum>IV</enum><header>AUDITS AND REPORTS</header>
			<section id="H71C4C1DC9FB243D0AD1E7325D02BFB7C"><enum>401.</enum><header>Review and audit by Secretary</header><text display-inline="no-display-inline">Section 405(c) (<external-xref legal-doc="usc" parsable-cite="usc/25/4165">25 U.S.C. 4165(c)</external-xref>) is amended, by adding at the end the following new paragraph:</text>
				<quoted-block display-inline="no-display-inline" id="H136D465FD3C940F78F2C0BBC7667273B" style="OLC">
					<paragraph id="H2D904D8C8BD34BB091059735FE8B1EC7"><enum>(3)</enum><header>Failure to issue final report</header><text display-inline="yes-display-inline">The Secretary shall issue a final report within 60 days after receiving comments under paragraph
			 (1) from a recipient.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="HC847395C2BEA440BB516E0BFFDE0964B"><enum>402.</enum><header>Reports to Congress</header><text display-inline="no-display-inline">Section 407 (<external-xref legal-doc="usc" parsable-cite="usc/25/4167">25 U.S.C. 4167</external-xref>) is amended—</text>
				<paragraph id="HE66046304AA748719CD7F879B923E5BA"><enum>(1)</enum><text>in subsection (a), by striking <quote>Congress</quote> and inserting <quote>Committee on Financial Services and the Committee on Natural Resources of the House of
			 Representatives, to the Committee on Indian Affairs and the Committee on
			 Banking, Housing, and Urban Affairs of the Senate, and to any
			 subcommittees of such committees having jurisdiction with respect to
			 Native American and Alaska Native affairs,</quote>; and</text>
				</paragraph><paragraph id="H75E379193BF04D24B1C96AAFB364ABD1"><enum>(2)</enum><text>by adding at the end the following new subsection:</text>

				</paragraph></section></title><title id="H4CB468A00C354FA08A24B20E5C9DFC7D"><enum>V</enum><header>OTHER HOUSING ASSISTANCE FOR NATIVE AMERICANS</header>
			<section display-inline="no-display-inline" id="H32399EE8F1D24BC48BA25B45D93D1A49"><enum>501.</enum><header>HUD–Veterans Affairs supportive housing program for Native American veterans</header><text display-inline="no-display-inline">Paragraph (19) of section 8(o) of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f(o)(19)</external-xref>) is
			 amended by adding at the end the following new subparagraph:</text>
				<quoted-block display-inline="no-display-inline" id="HB49E18D0BA844E1986FA6C510A2658F7" style="OLC">
					<subparagraph id="H0F92F8D507624499893A724A022F4FFC"><enum>(D)</enum><header>Native American veterans</header>
						<clause id="H30330C5083E24FC990BACC2813710A21"><enum>(i)</enum><header>Authority</header><text display-inline="yes-display-inline">Of the funds made available for rental assistance under this subsection for fiscal year 2015 and
			 each fiscal year thereafter, the Secretary shall set aside 0.1 percent for
			 a supported housing and rental assistance program modeled on the
			 HUD–Veterans Affairs Supportive Housing (HUD–VASH) program, to be
			 administered in conjunction with the Department of Veterans Affairs, for
			 the benefit of homeless Native American veterans and veterans at risk of
			 homelessness.</text>
						</clause><clause id="H5F3A70889C11404989A31B66A51C5B68"><enum>(ii)</enum><header>Recipients</header><text>Such rental assistance shall be made available to recipients eligible to receive block grants under
			 the Native American Housing Assistance and Self-Determination Act of 1996
			 (<external-xref legal-doc="usc" parsable-cite="usc/25/4101">25 U.S.C. 4101 et seq.</external-xref>).</text>
						</clause><clause id="HEE03008B64BA4839BA911AA271D5E278"><enum>(iii)</enum><header>Funding criteria</header><text>Funds shall be awarded based on need, administrative capacity, and any other funding criteria
			 established by the Secretary in a notice published in the Federal
			 Register, after consultation with the Secretary of Veterans Affairs, by a
			 date sufficient to provide for implementation of the program under this
			 subparagraph in accordance with clause (i).</text>
						</clause><clause id="H21B1D34FD3AC470CBE97835F9BAF8101"><enum>(iv)</enum><header>Program requirements</header><text>Such funds shall be administered by block grant recipients in accordance with program requirements
			 under Native American Housing Assistance and Self-Determination Act of
			 1996 in lieu of program requirements under this Act.</text>
						</clause><clause id="HC2F9082F0A2C4FC4A42990BFE52D4751"><enum>(v)</enum><header>Waiver</header><text>The Secretary may waive, or specify alternative requirements for any provision of any statute or
			 regulation that the Secretary administers in connection with the use of
			 funds made available under this subparagraph, but only upon a finding by
			 the Secretary that such waiver or alternative requirement is necessary to
			 promote administrative efficiency, eliminate delay, consolidate or
			 eliminate duplicative or ineffective requirements or criteria, or
			 otherwise provide for the effective delivery and administration of such
			 supportive housing assistance to Native American veterans.</text>
						</clause><clause id="H27525B78DB914AE2B42754A4F90E222B"><enum>(vi)</enum><header>Consultation</header><text>The Secretary and the Secretary of Veterans Affairs shall jointly consult with block grant
			 recipients and any other appropriate tribal organizations to—</text>
							<subclause id="H8C49EBB6C4B041AA93BABCBA81FE6F05"><enum>(I)</enum><text>ensure that block grant recipients administering funds made available under the program under this
			 subparagraph are able to effectively coordinate with providers of
			 supportive services provided in connection with such program; and</text>
							</subclause><subclause id="H1A8E8F59C4E24108A1E807E9AF61AEF9"><enum>(II)</enum><text>ensure the effective delivery of supportive services to Native American veterans that are homeless
			 or at risk of homelessness eligible to receive assistance under this
			 subparagraph.</text></subclause><continuation-text continuation-text-level="clause">Consultation pursuant to this clause shall be completed by a date sufficient to provide for
			 implementation of the program under this subparagraph in accordance with
			 clause (i).</continuation-text></clause><clause id="H8457A5D7325D401FA0F76CCE4F044D3A"><enum>(vii)</enum><header>Rulemaking</header><text>The first negotiated rulemaking committee established pursuant to subchapter III of chapter 5 of
			 title 5, United States Code, for rulemaking relating to the Native
			 American Housing Assistance and Self-Determination Act of 1996, or any
			 amendments to such Act, but that is not established to consider matters
			 relating to the allocation formula under section 302 of such Act (25
			 U.S.C. 4152), shall review the requirements and criteria for the supported
			 housing and rental assistance program under this subparagraph and may
			 report to the Secretary a proposed rule revising such requirements and
			 criteria.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="H5989B181476647928707B1950B64D425"><enum>502.</enum><header>50-year leasehold interest in trust or restricted lands for housing purposes</header><text display-inline="no-display-inline">Section 702(c)(1) (<external-xref legal-doc="usc" parsable-cite="usc/25/4211">25 U.S.C. 4211(c)(1)</external-xref>) is amended by inserting <quote>, whether enacted before, on, or after the date of the enactment of this section</quote> after <quote>law,</quote>.</text>
			</section><section id="H615D6354F3304D8686DACD7276345741"><enum>503.</enum><header>Training and technical assistance</header><text display-inline="no-display-inline">Section 703 (<external-xref legal-doc="usc" parsable-cite="usc/25/4212">25 U.S.C. 4212</external-xref>) is amended—</text>
				<paragraph id="HB3EF0871208A4098A4803C3D67F0A787"><enum>(1)</enum><text>by striking <quote>There are authorized to be appropriated</quote> and inserting <quote>Of any amounts appropriated pursuant to section 108, the Secretary may use such sums as may be

				<paragraph id="HDD235F5BD59C40BCB82F32CC8ACBD969"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (B), by inserting after the period at the end of the first sentence the following: <quote>There are authorized to be appropriated for such costs $12,200,000 for each of fiscal years 2014
			 through 2018.</quote>; and</text>
				</paragraph><paragraph id="HD3F1AF82620C46798FC3D38F703E366B"><enum>(2)</enum><text display-inline="yes-display-inline">in subparagraph (5)—</text>

			 Cherokee Nation</quote> and inserting <quote>Order issued September 21, 2011, by the Federal District Court for the District of Columbia</quote>.</text>
			</section><section id="HDEDBEECC65BE49888D813F6543B22196"><enum>603.</enum><header>Leasehold interest in trust or restricted lands for housing purposes</header><text display-inline="no-display-inline">Section 702 (<external-xref legal-doc="usc" parsable-cite="usc/25/4211">25 U.S.C. 4211</external-xref>) is amended by striking <quote>50 years</quote> each place such term appears and inserting <quote>99 years</quote>.</text>

			</section></title><title id="H2329DE974AB745BF99B0601D9F4C2ED8"><enum>VII</enum><header>DEMONSTRATION PROGRAM FOR ALTERNATIVE PRIVATIZATION AUTHORITY FOR NATIVE AMERICAN HOUSING</header>
			<section id="H72BFDBC2921B4B9395A3F875B1F3C40B"><enum>701.</enum><header>Demonstration program</header><text display-inline="no-display-inline">The Native American Housing and Self-Determination Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/25/4101">25 U.S.C. 4101 et seq.</external-xref>) is amended
			 by adding at the end the following new title:</text>
				<quoted-block display-inline="no-display-inline" id="HA4F73D4FD62241D8A776505D2C07A809" style="OLC">
					<title id="H68B6B4CDFF6F4862A3B334CC09A6F23B"><enum>IX</enum><header>Demonstration program for alternative privatization authority for Native American housing</header>
						<section id="HB6F808A7449C4B209204AAEABCBC47DF"><enum>901.</enum><header>Authority</header>
							<subsection id="H46B8A934226D43CDBE9FFAB77AC2F4DC"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">In addition to any other authority provided in this Act for the construction, development,
			 maintenance, and operation of housing for Indian families, the Secretary
			 shall provide the participating tribes having final plans approved
			 pursuant to section 905 with the authority to exercise the activities
			 provided under this title and such plan for the acquisition and
			 development of housing to meet the needs of tribal members.</text>
							</subsection><subsection id="HEEED4494B9874254AEF31940510A2F4D"><enum>(b)</enum><header>Inapplicability of NAHASDA provisions</header><text>Except as specifically provided otherwise in this title, titles I through IV, VI, and VII shall not
			 apply to a participating tribe during any period that the tribe is
			 participating in the demonstration program under this title.</text>
							</subsection><subsection id="HB75BE2710910411CAB997E2234C07040"><enum>(c)</enum><header>Continued applicability of certain NAHASDA provisions</header><text display-inline="yes-display-inline">The following provisions of titles I through VIII shall apply to the demonstration program under
			 this title and amounts made available under the demonstration program
			 under this title:</text>
								<paragraph id="H8D17C6EB4C6E49EF9ED341D827224336"><enum>(1)</enum><text>Subsections (d) and (e) of section 101 (relating to tax exemption).</text>
								</paragraph><paragraph id="H3593A968048647E1BF56DEE620EE642C"><enum>(2)</enum><text>Section 101(j) (relating to Federal supply sources).</text>
								</paragraph><paragraph id="H7F26B71020C342C78AD09886E8EB5671"><enum>(3)</enum><text>Section 101(k) (relating to tribal preference in employment and contracting).</text>
								</paragraph><paragraph id="HE92AE69CF6E34AA5B140AAE6E75C7FE1"><enum>(4)</enum><text>Section 104 (relating to treatment of program income and labor standards).</text>
								</paragraph><paragraph id="HE30E794A5EB74154A39CA2B0AE567B3B"><enum>(5)</enum><text>Section 105 (relating to environmental review).</text>
								</paragraph><paragraph id="H51DC8FCC9D79402AA1529B65ABC32CD9"><enum>(6)</enum><text>Section 201(b) (relating to eligible families), except as otherwise provided in this title.</text>
								</paragraph><paragraph id="H1B4D2014CE86486C8E6C43EFC409CD45"><enum>(7)</enum><text>Section 203(g) (relating to a de minimis exemption for procurement of goods and services).</text>
								</paragraph><paragraph id="HF5AF7F67600B412C898276CF8DC0E4C8"><enum>(8)</enum><text>Section 702 (relating to 99-year leasehold interests in trust or restricted lands for housing
			 purposes).</text>
								</paragraph></subsection></section><section id="H7A0AEB625EF640D7B35AE9A8415167F0"><enum>902.</enum><header>Participating tribes</header>
							<subsection id="H80CC27EBDCF84159A1F77CFD16CD17C6"><enum>(a)</enum><header>Request To participate</header><text display-inline="yes-display-inline">To be eligible to participate in the demonstration program under this title, an Indian tribe shall
			 submit to the Secretary a notice of intention to participate during the
			 60-day period beginning on the date of the enactment of this title, in
			 such form and such manner as the Secretary shall provide.</text>
							</subsection><subsection id="H2CEE7BD8E04A449A9F5369F1BCCB4BA4"><enum>(b)</enum><header>Cooperative agreement</header><text>Upon approval under section 905 of the final plan of an Indian tribe for participation in the
			 demonstration program under this title, the Secretary shall enter into a
			 cooperative agreement with the participating tribe that provides such
			 tribe with the authority to carry out activities under the demonstration
			 program.</text>
							</subsection></section><section id="H01A04982185A49918E11290DCC78CC3B"><enum>903.</enum><header>Request for quotes and selection of investor partner</header>
							<subsection id="H5727D75E52564B3792EA7F31924ACAD6"><enum>(a)</enum><header>Request for quotes</header><text display-inline="yes-display-inline">Not later than the expiration of the 180-day period beginning upon notification to the Secretary by
			 an Indian tribe of intention to participate in the demonstration program
			 under this title, the Indian tribe shall—</text>
								<paragraph id="H18F023725E394E038F58A092119887D1"><enum>(1)</enum><text>obtain assistance from a qualified entity in assessing the housing needs, including the affordable
			 housing needs, of the tribe; and</text>
								</paragraph><paragraph id="H8AB704867D9C466BB89B2F13B70ADEE9"><enum>(2)</enum><text>release a request for quotations from entities interested in partnering with the tribe in designing
			 and carrying out housing activities sufficient to meet the tribe’s housing
			 needs as identified pursuant to paragraph (1).</text>
								</paragraph></subsection><subsection id="H76A3DC8C7036484E812E485639B9FEAD"><enum>(b)</enum><header>Selection of investor partner</header>
								<paragraph id="H8E0D534944DF44BFA51CE3FFDD0A1EAD"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in paragraph (2), not later than the expiration of the 18-month period beginning
			 on the date of the enactment of this title, an Indian tribe requesting to
			 participate in the demonstration program under this title shall—</text>
									<subparagraph id="HB516B6C8390E47B6A274CDDD6AE5FF24"><enum>(A)</enum><text>select an investor partner from among the entities that have responded to the tribe’s request for
			 quotations; and</text>
									</subparagraph><subparagraph id="HB3AC3358CFF24548A33EE9572EB0BC9E"><enum>(B)</enum><text>together with such investor partner, establish and submit to the Secretary a final plan that meets
			 the requirements under section 904.</text>
									</subparagraph></paragraph><paragraph id="H4FC5CC9458E3449CB672F628A352F39B"><enum>(2)</enum><header>Exceptions</header><text>The Secretary may extend the period under paragraph (1) for any tribe that—</text>
									<subparagraph id="HA009100468F1498E8A6622AF9EDCAEDC"><enum>(A)</enum><text>has not received any satisfactory quotation in response to its request released pursuant to
			 subsection (a)(2); or</text>
									</subparagraph><subparagraph id="H004DCF5A8D144772B6A643431E25BC11"><enum>(B)</enum><text>has any other satisfactory reason, as determined by the Secretary, for failure to select an
			 investor partner.</text>
									</subparagraph></paragraph></subsection></section><section id="HF3785FC3051C402CBEB49F029358E3AF"><enum>904.</enum><header>Final plan</header><text display-inline="no-display-inline">A final plan under this section shall—</text>
							<paragraph id="H787F6A2D983B468FAB901C9D04D75892"><enum>(1)</enum><text>be developed by the participating tribe and the investor partner for the tribe selected pursuant to
			 section 903(b)(1)(A);</text>
							</paragraph><paragraph id="HF4A71FC0AF9D4BEB9962C574FA3714AD"><enum>(2)</enum><text>identify the qualified entity that assisted the tribe in assessing the housing needs of the tribe;</text>
							</paragraph><paragraph id="H26749C89AC9E4762B2A277ADB9958A97"><enum>(3)</enum><text>set forth a detailed description of such projected housing needs, including affordable housing
			 needs, of the tribe, which shall include—</text>
								<subparagraph id="HD5FF583EA85C434AB4244CB092C4057F"><enum>(A)</enum><text>a description of such need over the ensuing 24 months and thereafter until the expiration of the
			 ensuing 5-year period or until the affordable housing need is met,
			 whichever occurs sooner; and</text>
								</subparagraph><subparagraph id="H4933047655014C32BC942383E07D4447"><enum>(B)</enum><text>the same information that would be required under section 102 to be included in an Indian housing
			 plan for the tribe, as such requirements may be modified by the Secretary
			 to take consideration of the requirements of the demonstration program
			 under this title;</text>
								</subparagraph></paragraph><paragraph id="H55DEDB47DA8045FB974AB123FDCC5E83"><enum>(4)</enum><text display-inline="yes-display-inline">provide for specific housing activities sufficient to meet the tribe’s housing needs, including
			 affordable housing needs, as identified pursuant to paragraph (3) within
			 the periods referred to such paragraph, which shall include—</text>
								<subparagraph id="H58FA0474BDC64DDEB99B27F217E6C813"><enum>(A)</enum><text display-inline="yes-display-inline">development of affordable housing (as such term is defined in section 4 of this Act (25 U.S.C.
			 4103));</text>
								</subparagraph><subparagraph id="H8B93D65D7A354945B4753729A8249DD2"><enum>(B)</enum><text>development of conventional homes for rental, lease-to-own, or sale, which may be combined with
			 affordable housing developed pursuant to subparagraph (A);</text>
								</subparagraph><subparagraph id="H0F5E2759358D453C8E93919A5ECA5105"><enum>(C)</enum><text>development of housing infrastructure, including housing infrastructure sufficient to serve
			 affordable housing developed under the plan; and</text>
								</subparagraph><subparagraph id="H38C3C3A9DBFC48BFAE916594A335DC2D"><enum>(D)</enum><text>investments by the investor partner for the tribe, the participating tribe, members of the
			 participating tribe, and financial institutions and other outside
			 investors necessary to provide financing for the development of housing
			 under the plan and for mortgages for tribal members purchasing such
			 housing;</text>
								</subparagraph></paragraph><paragraph id="HCA1AA533017348E989215C36CB9956A6"><enum>(5)</enum><text>provide that the participating tribe will agree to provide long-term leases to tribal members
			 sufficient for lease-to-own arrangements for, and sale of, the housing
			 developed pursuant to paragraph (4);</text>
							</paragraph><paragraph id="H7F0CCAA8C81F4E30A2F11CC25D1FA644"><enum>(6)</enum><text>provide that the participating tribe—</text>
								<subparagraph id="H9DF7170F55DA49729647FA24C80280D1"><enum>(A)</enum><text display-inline="yes-display-inline">will be liable for delinquencies under mortgage agreements for housing developed under the plan
			 that are financed under the plan and entered into by tribal members; and</text>
								</subparagraph><subparagraph id="H997E16449AD846A28011558089E42326"><enum>(B)</enum><text>shall, upon foreclosure under such mortgages, take possession of such housing and have the
			 responsibility for making such housing available to other tribal members;</text>
								</subparagraph></paragraph><paragraph id="H916127BBB9CF43FC94466DE7D6863159"><enum>(7)</enum><text>provide for sufficient protections, in the determination of the Secretary, to ensure that the tribe
			 and the Federal Government are not liable for the acts of the investor
			 partner or of any contractors;</text>
							</paragraph><paragraph id="HB6EF2E305AAF4751A3FDD96009A60890"><enum>(8)</enum><text>provide that the participating tribe shall have sole final approval of design and location of
			 housing developed under the plan;</text>
							</paragraph><paragraph id="H00BAE05F30434A8FA42D9218917E4BA6"><enum>(9)</enum><text>set forth specific deadlines and schedules for activities to be undertaken under the plan and set
			 forth the responsibilities of the participating tribe and the investor
			 partner;</text>
							</paragraph><paragraph id="HE3E3EA27E45A44A2AE3A54C2578D617A"><enum>(10)</enum><text>set forth specific terms and conditions of return on investment by the investor partner and other
			 investors under the plan, and provide that the participating tribe shall
			 pledge grant amounts allocated for the tribe pursuant to title III for
			 such return on investment;</text>
							</paragraph><paragraph id="H7FA84AF84CC74E13B78E3930F95757BC"><enum>(11)</enum><text display-inline="yes-display-inline">set forth the terms of a cooperative agreement on the operation and management of the current
			 assistance housing stock and current housing stock for the tribe assisted
			 under the preceding titles of this Act;</text>
							</paragraph><paragraph id="HF53F3D368AFA4DD3974F88E9DB751E2A"><enum>(12)</enum><text>set forth any plans for sale of affordable housing of the participating tribe under section 907
			 and, if included, plans sufficient to meet the requirements of section 907
			 regarding meeting future affordable housing needs of the tribe;</text>
							</paragraph><paragraph id="HBD521EFADE9A481587C564D55B09354D"><enum>(13)</enum><text>set forth terms for enforcement of the plan, including an agreement regarding jurisdiction of any
			 actions under or to enforce the plan, including a waiver of immunity; and</text>
							</paragraph><paragraph id="HC51D8416ABDF4DB985AD638EF90CC776"><enum>(14)</enum><text>include such other information as the participating tribe and investor partner consider
			 appropriate.</text>
							</paragraph></section><section id="H79445B68621E45F9BCF20C2BD8254C8D"><enum>905.</enum><header>HUD review and approval of plan</header>
							<subsection id="H235C9B953FFE4CCAA0CEC2BAB945C4C9"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than the expiration of the 90-day period beginning upon a submission by an Indian tribe
			 of a final plan under section 904 to the Secretary, the Secretary shall—</text>
								<paragraph id="H825E6DD27FB043A99F6A863BA0A53712"><enum>(1)</enum><text>review the plan and the process by which the tribe solicited requests for quotations from investors
			 and selected the investor partner; and</text>
								</paragraph><paragraph id="H5189E93F8C854BBE9D609E4169D33011"><enum>(2)</enum>
									<subparagraph commented="no" display-inline="yes-display-inline" id="H4A993532D7A6473FBC6CE50DA7ADB8FC"><enum>(A)</enum><text display-inline="yes-display-inline">approve the plan, unless the Secretary determines that—</text>
										<clause commented="no" id="HB1946CDD462E4621915A54761FCB39D7" indent="up1"><enum>(i)</enum><text>the assessment of the tribe’s housing needs by the qualified entity, or as set forth in the plan
			 pursuant to section 904(3), is inaccurate or insufficient;</text>
										</clause><clause id="H547566303F2040768AE9CE0E2077024E" indent="up1"><enum>(ii)</enum><text>the process established by the tribe to solicit requests for quotations and select an investor
			 partner was insufficient or negligent; or</text>
										</clause><clause id="HC0F27FA6DB0D4E3B8E5B3326ABF078EF" indent="up1"><enum>(iii)</enum><text>the plan is insufficient to meet the housing needs of the tribe, as identified in the plan pursuant
			 to section 904(3);</text>
										</clause></subparagraph><subparagraph id="HA0352893E3134FCD94411E1D52690E38" indent="up1"><enum>(B)</enum><text>approve the plan, on the condition that the participating tribe and the investor make such
			 revisions to the plan as the Secretary may specify as appropriate to meet
			 the needs of the tribe for affordable housing; or</text>
									</subparagraph><subparagraph commented="no" id="HF5B48883A43B4D3E8972FC78C8CEB832" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">disapprove the plan, only if the Secretary determines that the plan fails to meet the minimal
			 housing standards and requirements set forth in this Act and the Secretary
			 notifies the tribe of the elements requiring the disapproval.</text>
									</subparagraph></paragraph></subsection><subsection id="H2E1B3EE9DE3C4BD19801179D13C70CB8"><enum>(b)</enum><header>Action upon disapproval</header>
								<paragraph id="H235CCBA450C14A0EAB4F589600067890"><enum>(1)</enum><header>Re-submission of plan</header><text display-inline="yes-display-inline">Subject to paragraph (2), in the case of any disapproval of a final plan of an Indian tribe
			 pursuant to subsection (a)(3), the Secretary shall allow the tribe a
			 period of 180 days from notification to the tribe of such disapproval to
			 re-submit a revised plan for approval.</text>
								</paragraph><paragraph id="H3DB1C69E1C554A2A9F5AE5FF4A423DE4"><enum>(2)</enum><header>Limitation</header><text>If the final plan for an Indian tribe is disapproved twice and resubmitted twice pursuant to the
			 authority under paragraph (1) and, upon such second re-submission of the
			 plan the Secretary disapproves the plan, the tribe may not re-submit the
			 plan again and shall be ineligible to participate in the demonstration
			 program under this title.</text>
								</paragraph></subsection><subsection id="H447B3644A36E47B988638172D41FD4B9"><enum>(c)</enum><header>Tribe authority of housing design and location</header><text>The Secretary may not disapprove a final plan under section 904, or condition approval of such a
			 plan, based on the design or location of any housing to be developed or
			 assisted under the plan.</text>
							</subsection><subsection id="HA8ED8438201B4CB289C04FE17BB8D266"><enum>(d)</enum><header>Failure To notify</header><text>If the Secretary does not notify a participating tribe submitting a final plan of approval,
			 conditional approval, or disapproval of the plan before the expiration of
			 the period referred to in paragraph (1), the plan shall be considered as
			 approved for all purposes of this title.</text>
							</subsection></section><section id="HB0BD4C3B30F34F50A20627FCA6699A2A"><enum>906.</enum><header>Treatment of NAHASDA allocation</header>
							<text display-inline="no-display-inline">Amounts otherwise allocated for a participating tribe under title III of this Act (25 U.S.C. 4151
			 et seq.) shall not be made available to the tribe under titles I through
			 XIII, but shall only be available for the tribe, upon request by the tribe
			 and approval by the Secretary, for the following purposes:</text>
							<paragraph id="HF574FB84067147B8A9697D0A7CBABC51"><enum>(1)</enum><header>Return on investment</header><text>Such amounts as are pledged by a participating tribe pursuant to section 904(10) for return on the
			 investment made by the investor partner or other investors may be used by
			 the Secretary to ensure such full return on investment.</text>
							</paragraph><paragraph id="HDA81BFC0A1A74C98AB2C9E56BFD04DBB"><enum>(2)</enum><header>Administrative expenses</header><text>The Secretary may provide to a participating tribe, upon the request of a tribe, not more than 10
			 percent of any annual allocation made under title III for the tribe during
			 such period for administrative costs of the tribe in completing the
			 processes to carry out sections 903 and 904.</text>
							</paragraph><paragraph id="H289114625C154E5FBAC444DB5EF328B9"><enum>(3)</enum><header>Housing infrastructure costs</header><text>A participating tribe may use such amounts for housing infrastructure costs associated with
			 providing affordable housing for the tribe under the final plan.</text>
							</paragraph></section><section id="H51A6F7B7DB544C429C6342A1EC9CE6E7"><enum>907.</enum><header>Resale of affordable housing</header><text display-inline="no-display-inline">Notwithstanding any other provision of this Act, a participating tribe may, in accordance with the
			 provisions of the final plan of the tribe approved pursuant to section
			 905, resell any affordable housing developed with assistance made
			 available under this Act for use other than as affordable housing, but
			 only if the tribe provides such assurances as the Secretary determines are
			 appropriate to ensure that—</text>
							<paragraph id="H2E53029DFFFB41FF8B972ECD21D078B4"><enum>(1)</enum><text>the tribe is meeting its need for affordable housing; and</text>
							</paragraph><paragraph id="H1A88AA44001741CF8139F5D0089DB92D"><enum>(2)</enum><text>will provide affordable housing in the future sufficient to meet future affordable housing needs.</text>
							</paragraph></section><section id="H2BAFA99EA55E4A61BD0EC5B25BB41955"><enum>908.</enum><header>Reports, audits, and compliance</header>
							<subsection id="HBB57E9249C314854BE9C486A045FA48C"><enum>(a)</enum><header>Annual reports by tribe</header><text display-inline="yes-display-inline">Each participating tribe shall submit a report to the Secretary annually regarding the progress of
			 the tribe in complying with, and meeting the deadlines and schedules set
			 forth under the approved final plan for the tribe. Such reports shall
			 contain such information as the Secretary shall require.</text>
							</subsection><subsection id="H431C4D7C2AC641B5A8F2BF80904B400B"><enum>(b)</enum><header>Reports to Congress</header><text>The Secretary shall submit a report to the Congress annually describing the activities and progress
			 of the demonstration program under this title, which shall—</text>
								<paragraph id="H64891142A71F4CC2A62493C53386A561"><enum>(1)</enum><text>summarize the information in the reports submitted by participating tribes pursuant to subsection
			 (a);</text>
								</paragraph><paragraph id="H081D5E97F0EE42DE9C4D8EEA4B81D5B1"><enum>(2)</enum><text>identify the number of tribes that have selected an investor partner pursuant to a request for
			 quotations;</text>
								</paragraph><paragraph id="HA9E2BBDC523F4244889FBD05C6BF575B"><enum>(3)</enum><text display-inline="yes-display-inline">include, for each tribe applying for participating in the demonstration program whose final plan
			 was disapproved under section 905(a)(2)(C), a detailed description and
			 explanation of the reasons for disapproval and all actions taken by the
			 tribe to eliminate the reasons for disapproval, and identify whether the
			 tribe has re-submitted a final plan;</text>
								</paragraph><paragraph id="H2ED49F408ED94D0F9DAF9251803CC059"><enum>(4)</enum><text>identify, by participating tribe, any amounts requested and approved for use under section 906; and</text>
								</paragraph><paragraph id="HAA3369A5B0C04970AED9D89F0798DEFE"><enum>(5)</enum><text>identify any participating tribes that have terminated participation in the demonstration program
			 and the circumstances of such terminations.</text>
								</paragraph></subsection><subsection id="HEEF31E9C51D74C19B10C1C1E3DBFC272"><enum>(c)</enum><header>Audits</header><text>The Secretary shall provide for random audits among participating tribes to ensure that the final
			 plans for such tribes are being implemented and complied with. Such audits
			 shall include on-site visits with participating tribes and requests for
			 documentation appropriate to ensure such compliance.</text>
							</subsection></section><section id="HF80E274832894625A4D9F8E20F5C9EFB"><enum>909.</enum><header>Termination of tribal participation</header>
							<subsection id="H17E0D0D2EDD142EFA474900ACDD2D40B"><enum>(a)</enum><header>Termination of participation</header><text display-inline="yes-display-inline">A participating tribe may terminate participation in the demonstration program under this title at
			 any time, subject to this section.</text>
							</subsection><subsection id="H5322E817103349E091E1EBA386BAE278"><enum>(b)</enum><header>Effect on existing obligations</header>
								<paragraph id="H8505093A60AF4D57AC8893985BD0F1E4"><enum>(1)</enum><header>No automatic termination</header><text display-inline="yes-display-inline">Termination by a participating tribe in the demonstration program under this section shall not
			 terminate any obligations of the tribe under agreements entered into under
			 the demonstration program with the investor partner for the tribe or any
			 other investors or contractors.</text>
								</paragraph><paragraph id="H048626DEE3294AC78C6D89962F36C64A"><enum>(2)</enum><header>Authority to mutually terminate agreements</header><text>Nothing in this title may be construed to prevent a tribe that terminates participation in the
			 demonstration program under this section and any party with which the
			 tribe has entered into an agreement from mutually agreeing to terminate
			 such agreement.</text>
								</paragraph></subsection><subsection id="H3D95B7934EC545B0864A4D7475681BFF"><enum>(c)</enum><header>Receipt of remaining grant amounts</header><text>The Secretary shall provide for grants to be made in accordance with, and subject to the
			 requirements of, this Act for any amounts remaining after use pursuant to
			 section 906 from the allocation under title III for a participating tribe
			 that terminates participation in the demonstration program.</text>
							</subsection><subsection id="HDAA52945D2CE4511AD9CC32AB89DA909"><enum>(d)</enum><header>Costs and obligations</header><text>The Secretary shall not be liable for any obligations or costs incurred by an Indian tribe during
			 its participation in the demonstration program under this title.</text>
							</subsection></section><section id="HBA74E1C413E44FDAAC5F9A8FBDAF3BC3"><enum>910.</enum><header>Final report</header><text display-inline="no-display-inline">Not later than the expiration of the 5-year period beginning on the date of the enactment of this
			 title, the Secretary shall submit a final report to the Congress regarding
			 the effectiveness of the demonstration program, which shall include—</text>
							<paragraph id="H000DB091FBE2413E8317E895DDA9D3EC"><enum>(1)</enum><text>an assessment of the success, under the demonstration program, of participating tribes in meeting
			 their housing needs, including affordable housing needs, on tribal land;</text>
							</paragraph><paragraph id="H655DFB86669041C8B8B313356BD85039"><enum>(2)</enum><text>recommendations for any improvements in the demonstration program; and</text>
							</paragraph><paragraph id="HB999539C035F4481BB8B47BFE9A766DD"><enum>(3)</enum><text>a determination of whether the demonstration should be expanded into a permanent program available
			 for Indian tribes to opt into at any time and, if so, recommendations for
			 such expansion, including any legislative actions necessary to expand the
			 program.</text>
							</paragraph></section><section id="HFD36DFF4AE2D491FB0F604D5133176A5"><enum>911.</enum><header>Definitions</header><text display-inline="no-display-inline">For purposes of this title, the following definitions shall apply:</text>
							<paragraph id="HA14A19181CFA46FDA40B55A393B32F70"><enum>(1)</enum><header>Affordable housing</header><text>The term <quote>affordable housing</quote> has the meaning given such term in section 4 (<external-xref legal-doc="usc" parsable-cite="usc/25/4103">25 U.S.C. 4103</external-xref>).</text>
							</paragraph><paragraph id="H2FD7CC4CD22E431D8672FCFC16073DAC"><enum>(2)</enum><header>Housing infrastructure</header><text display-inline="yes-display-inline">The term <quote>housing infrastructure</quote> means basic facilities, services, systems, and installations necessary or appropriate for the
			 functioning of a housing community, including facilities, services,
			 systems, and installations for water, sewage, power, communications, and
			 transportation.</text>
							</paragraph><paragraph id="HD60131341F254F62B391498D0E883709"><enum>(3)</enum><header>Long-term lease</header><text>The term <quote>long-term lease</quote> means an agreement between a participating tribe and a tribal member that authorizes the tribal
			 member to occupy a specific plot of tribal lands for 50 or more years and
			 to request renewal of the agreement at least once.</text>
							</paragraph><paragraph id="H92CF978002A0414EBE211B4CD13EDEA4"><enum>(4)</enum><header>Participating tribes</header><text>The term <quote>participating tribe</quote> means an Indian tribe for which a final plan under section 904 for participation in the
			 demonstration program under this title has been approved by the Secretary
			 under section 905.</text>
							</paragraph></section><section id="H49431163B72A408DA8D89BB9755AA243"><enum>912.</enum><header>Regulations and guidelines</header><text display-inline="no-display-inline">The Secretary shall issue such regulations as may be necessary to carry out the demonstration
