			 public school districts, and States, and for other purposes.</official-title>

		<section commented="no" id="HA2974DA51DF5453AA96BDA39735381D3" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Johnson-O’Malley Supplemental Indian Education Program Modernization Act</short-title></quote>.</text>
		</section><section id="H1A88438D54D94419B269A7C022188623"><enum>2.</enum><header>Johnson-O’Malley Supplemental Indian Education Program Modernization Act</header><text display-inline="no-display-inline">The Act of April 16, 1934 (commonly known as the <quote>Johnson-O'Malley Act</quote>; <external-xref legal-doc="usc" parsable-cite="usc/25/452">25 U.S.C. 452 et seq.</external-xref>), is amended by adding at the end the following new section:</text>
			<quoted-block display-inline="no-display-inline" id="HC116DA98896441ED9F6360133F7675D1" style="OLC">
				<section id="HEC75E0FEBF25437B8028DC4D89B59BA6"><enum>7.</enum><header>Johnson-O’Malley Supplemental Indian Education Program Modernization Act</header>
					<subsection id="H9D56D3D7126C4A289F95268516729B68"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, the Secretary of the Interior, acting through the
			 Assistant
			 Secretary of Indian Affairs and in conjunction with the Director of the
			 Bureau of Indian Education, shall establish a program to enter into
			 contracts with eligible entities that have or serve Indian students to
			 provide educational benefits to such Indian students.</text>
					</subsection><subsection id="HD13FB897BC414183AE87A58D92FC60CE"><enum>(b)</enum><header>Uses of funds</header><text>An eligible entity that enters into a contract under subsection (a) shall use the funds available
			 under the contract to provide educational benefits to Indian students, by—</text>
						<paragraph id="HBB2002CB45D640119A829FE8046E2A62"><enum>(1)</enum><text>carrying out programs or expanding programs in existence before the contract period that provide—</text>
							<subparagraph id="HB2AF7B04518241AF84329C6649C8AD8F"><enum>(A)</enum><text>remedial instruction, counseling, and cultural programs;</text>
							</subparagraph><subparagraph id="HD753C0C2F1A6497F81DE6B864DDB8C9B"><enum>(B)</enum><text display-inline="yes-display-inline">selected courses related to the academic and professional disciplines of science, technology,
			 engineering, and mathematics;</text>
							</subparagraph><subparagraph id="H99A09194BA42478BA78A8881237E46DA"><enum>(C)</enum><text>important needs, such as school supplies and items that enable recipients to participate in
			 curricular and extra-curricular programs; and</text>
							</subparagraph><subparagraph id="H17C6E7EB523744978A2969B630D42FF6"><enum>(D)</enum><text>program activities that were available to Indian students under contracts entered into under this
			 Act before October 1, 2012;</text>
							</subparagraph></paragraph><paragraph id="HF3DF55922E2F4684BAD2C72BD35EBC53"><enum>(2)</enum><text>the establishment of targeted and culturally sensitive dropout prevention activities; and</text>
						</paragraph><paragraph id="HD9443966A9CC4D97BD91BC205669CADC"><enum>(3)</enum><text>the purchase of equipment to facilitate training for professional trade skills and intensified
			 college preparation programs.</text>
						</paragraph></subsection><subsection commented="no" id="HDCE6AF70E2DC49C0BD3815B5588423FA"><enum>(c)</enum><header>Funding</header><text>The Secretary shall transfer to the Bureau of Indian Education the funds necessary to carry out
			 this section.</text>
					</subsection><subsection id="H0119C02009F547F9BCE7CFC6AD1A1D17"><enum>(d)</enum><header>Computation of awards</header>
						<paragraph id="H8A2D7EBB5B8D47DA8F5878E980506621"><enum>(1)</enum><header>Determination of total students</header><text>Except as provided under paragraph (2), for the purpose of computing the amount that an eligible
			 entity may receive under a contract entered into under subsection (a) for
			 any fiscal year, the Secretary shall—</text>
							<subparagraph id="H0512F63FBD1B4AA59D77BB9898BBC02A"><enum>(A)</enum><text>determine the number of Indian students who were in average daily attendance in the schools of the
			 public school districts served by the eligible entity, and for whom such
			 school districts provided free public education during the preceding
			 school year; and</text>
							</subparagraph><subparagraph id="HE4FE6CF23DA14787AE8FA487C10B5889"><enum>(B)</enum><text>provide a minimum of $125 per Indian student described in subparagraph (A).</text>
							</subparagraph></paragraph><paragraph id="H3BFC4ADF61A744BAB7F6B8598FCB613D"><enum>(2)</enum><header>Hold harmless</header><text display-inline="yes-display-inline">In the case of an eligible entity that has or serves eligible Indian children attending a public
			 school that has been afforded supplemental services under a contract
			 entered into under this Act on or before October 1, 1995, such eligible
			 entity shall receive an amount under a contract entered into under
			 subsection (a) that is at least equal to the amount that such eligible
			 entity would have received under the contract entered into under this Act
			 on or before October 1, 1995.</text>
						</paragraph></subsection><subsection id="H21E23896ACE44A9BB847978901383BBE"><enum>(e)</enum><header>Data use</header>
						<paragraph id="HD2C8CE1F49324DC9BEAD171DD57CE962"><enum>(1)</enum><header>In general</header><text>For purposes of the calculation under subsection (d)(1), the Secretary shall use data for a public
			 school district from not later than the fiscal year preceding the fiscal
			 year for which the eligible entity involved is applying for a contract
			 under subsection (a).</text>
						</paragraph><paragraph id="H86B592DC05FF42F6BDB2732B7C7FC3D7"><enum>(2)</enum><header>Tribal Organization</header><text>In the case of a tribal organization that has been established by the Bureau of Indian Affairs on
			 or after October 1, 2012, such tribal organization, shall, for the first
			 year of operation of such organization, be based on data for the public
			 school districts served by the organization for the fiscal year for which
			 the organization is applying for a contract under subsection (a).</text>
						</paragraph></subsection><subsection id="H0E878E91016C4CB3A45946C46979FAB8"><enum>(f)</enum><header>Geographic coverage and enhanced participation</header><text>In entering into contracts under subsection (a), the Secretary shall, to the extent practicable,
			 ensure full geographic coverage and the full participation of all
			 federally recognized tribes and school districts that have not entered
			 into a contract under this Act before fiscal year 2015.</text>
					</subsection><subsection id="H35A3825D83F743BBB2FC0FD9448CA1EE"><enum>(g)</enum><header>Complementary program participants</header><text display-inline="yes-display-inline">In entering into contracts under subsection (a), the Secretary may give preference a consortium of
			 tribal organizations, to encourage as many students and professionals as
			 possible to benefit from the program established under this section,
			 including such a consortium that includes a Tribal college or university.</text>
					</subsection><subsection id="H2FB9C0F64CF24B52B12334B201EFE599"><enum>(h)</enum><header>Annual report</header><text>The Secretary shall include in the Department of the Interior fiscal year annual budget request to
			 Congress an annual assessment of the program established under this
			 section.</text>
					</subsection><subsection id="H06AC788F2F254AAE8092DB285C55CB5C"><enum>(i)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There are authorized to be appropriated to the Secretary for carrying out this section such
			 sums as may be necessary.</text>
					</subsection><subsection id="H362A87F0390F479FABCB0CD13A061F52"><enum>(j)</enum><header>Definitions</header>
						<paragraph id="H25ECDDE38F4D4D4CA2DEA3A1ED26E407"><enum>(1)</enum><header>Eligible entity</header><text display-inline="yes-display-inline">The term <quote>eligible entity</quote> means a—</text>
							<subparagraph id="H1DF8ED77659E4273B93E3771F1A7305E"><enum>(A)</enum><text>tribal organization;</text>
							</subparagraph><subparagraph id="HEE239D76203345F283E407F1E72CB749"><enum>(B)</enum><text>Indian Corporation;</text>
							</subparagraph><subparagraph id="HFD23FD25CBF748D199828BB57AB23761"><enum>(C)</enum><text>public school district;</text>
							</subparagraph><subparagraph id="H08D186FFC62B4F8191E627768A6F13E3"><enum>(D)</enum><text>State; or</text>
							</subparagraph><subparagraph id="H1582C4475C5C4EB2B10285B11F2246F3"><enum>(E)</enum><text>a consortium of tribal organizations.</text>
							</subparagraph></paragraph><paragraph id="HBF8B8004330C4EDDB401165346FBBB49"><enum>(2)</enum><header>ESEA terms</header><text>The terms <quote>elementary school</quote>, <quote>secondary school</quote>, and <quote>State</quote> have the meanings given such terms in section 9101 of the Elementary and Secondary Education Act
			 of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>).</text>
						</paragraph><paragraph id="H75A6A9A09AAB45CD89E40440A958637F"><enum>(3)</enum><header>Indian student</header><text display-inline="yes-display-inline">The term <quote>Indian student</quote> means a student who—</text>
							<subparagraph id="H50E3969FE9454BB6826A2E1F46DD2A22"><enum>(A)</enum><text>attends a public school district; and</text>
							</subparagraph><subparagraph display-inline="no-display-inline" id="H625A3814498C4053BADB1CA10A32369C"><enum>(B)</enum><text>is between age 3 and grade 12, and—</text>
								<clause id="H887D192E415D4591B43A264E292BE237"><enum>(i)</enum><text>resides on or near an Indian reservation;</text>
								</clause><clause id="H492F653DEACE46CDA5F4FFAAC5B9537D"><enum>(ii)</enum><text display-inline="yes-display-inline">is an enrolled member, or at least one-fourth or more degree of Indian blood descendant, of a
			 member of a federally recognized Indian tribal government eligible for
			 service by the Bureau of Indian Affairs; or</text>
								</clause><clause id="H8325FC5AF96A42F88FF595487773F0FB"><enum>(iii)</enum><text>is an Alaska Native.</text>
								</clause></subparagraph></paragraph><paragraph id="H22EBEBF0D9064EADB5BECAFF690153A3"><enum>(4)</enum><header>Public school district</header><text display-inline="yes-display-inline">The term <quote>public school district</quote> means a school district that—</text>
							<subparagraph id="H3B80094D42E34B0095141947C7270ACF"><enum>(A)</enum><text>serves public elementary schools or public secondary schools; and</text>
							</subparagraph><subparagraph id="HDEED88BF49C34A68BCCC2E5AA28AA359"><enum>(B)</enum><text>has established or will establish local committees under section 5 of this Act or is using a
			 committee or Indian advisory school board described in such section 5 to
			 approve supplementary or operational support programs beneficial to Indian
			 students, including the programs described in paragraphs (1) through (3)
			 of subsection (b).</text>
							</subparagraph></paragraph><paragraph id="H1B0AB4686588442FAFA997507735A0EC"><enum>(5)</enum><header>Secretary</header><text>The term <quote>Secretary</quote> means the Secretary of the Interior.</text>
						</paragraph><paragraph id="H91521E3F8C564557851221B9553E320C"><enum>(6)</enum><header>Tribal college or university</header><text>The term <quote>Tribal college or university</quote> has the meaning given the term in section 316(b)(3) of the Higher Education Act of 1965 (20 U.S.C.
			 1059c(b)(3)).</text>
						</paragraph><paragraph id="H940D88FA285C428BBE814E24F68E94BD"><enum>(7)</enum><header>Tribal organization</header><text display-inline="yes-display-inline">The term <quote>Tribal organization</quote> means any tribe, band, or community of Indians which is subject to the laws of the United States
			 relating to Indian affairs or any corporation, association, or group which
			 is organized under any of such laws including Indian Education Consortiums
			 and Tribal Colleges and Universities.</text>
						</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
