		<legis-type>A BILL</legis-type>
		<official-title>To amend the Endangered Species Act of 1973 to require disclosure to States of the basis of
			 determinations under such Act, to ensure use of information provided by
			 State, tribal, and county governments in decisionmaking under such Act,
			 and for other purposes.</official-title>

		<section id="H45A3E490088F42DC86B9E937FA6388F5" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>State, Tribal, and Local Species Transparency and Recovery Act</short-title></quote>.</text>
		</section><section id="H1BCA6C3388E24F06A0F8802C5129BDEB"><enum>2.</enum><header>Requiring decisional transparency with affected States</header><text display-inline="no-display-inline">Section 6(a) of the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1535">16 U.S.C. 1535(a)</external-xref>) is amended—</text>
			<paragraph id="H98C67AB3DD454C1CAFFC31E12281A125"><enum>(1)</enum><text>by inserting <quote>(1)</quote> before the first sentence; and</text>
			</paragraph><paragraph id="H445145D7AC4A4AD8938EAA102BAFCAE4"><enum>(2)</enum><text>by striking <quote>Such cooperation shall include</quote> and inserting the following:</text>
				<quoted-block id="H1BB55CF3E85342E587D374C27E5CE785" style="OLC">
					<paragraph id="H4AC3359D1A404A8AB74CAC9E12AE04A6" indent="up1"><enum>(2)</enum><text>Such cooperation shall include—</text>
						<subparagraph id="H74868FB606B24001A565DC3C5754D130"><enum>(A)</enum><text>before making a determination under section 4(a), providing to States affected by such
			 determination all data that is the basis of the determination; and</text>
						</subparagraph><subparagraph id="HA3F62FB84A53494D9A27F17125B7D02A"><enum>(B)</enum></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="HE6445C7232E64F62978920E179A0E193"><enum>3.</enum><header>Ensuring use of State, tribal, and local information</header>
			<subsection id="HAD3D855592FD4C169748CEAA7A35B5D1"><enum>(a)</enum><header>In general</header><text>Section 3 of the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1532">16 U.S.C. 1532</external-xref>) is amended—</text>
				<paragraph id="HAF139EDC29134BE0BBD0F1EC66835217"><enum>(1)</enum><text>by redesignating paragraphs (2) through (21) as paragraphs (3) through (22), respectively; and</text>
				</paragraph><paragraph id="HBBD5595B3E7E4965969C39DB4B931A96"><enum>(2)</enum><text>by inserting after paragraph (1) the following:</text>
					<quoted-block id="HC734AC7DF76540FFADE0DBCB8C07564A" style="OLC">
						<paragraph id="H8E5B66D09D414E28B88343F429FD763B" indent="up1"><enum>(2)</enum><text>The term <quote>best scientific and commercial data available</quote> includes all such data submitted by a State, tribal, or county government.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HBA2919262C3446189E69CB65CDA0D36B"><enum>(b)</enum><header>Conforming amendment</header><text>Section 7(n) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1536">16 U.S.C. 1536(n)</external-xref>) is amended by striking <quote>section 3(13)</quote> and inserting <quote>section 3(14)</quote>.</text>
