<section id="H924531DED7424B5D9AFEAE8F683A09A1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Foreign Cultural Exchange Jurisdictional Immunity Clarification Act</short-title></quote>.</text> </section>
<section id="HCDFF52524EA54F879B750274694376DA"><enum>2.</enum><header>Clarification of jurisdictional immunity of foreign states</header> 
<subsection id="H2478F78F8F764A02B75B9C1E722556EB"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/28/1605">Section 1605</external-xref> of title 28, United States Code, is amended by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="H3880BB1DECA74D898FCD3022BB6FEED9" style="OLC"> 
<subsection id="H8653BF9482D34E5B849C6F6D19861E74"><enum>(h)</enum><header>Jurisdictional immunity for certain art exhibition activities</header> 
<paragraph id="H2A7630F6E459456B97F722EADAFB4A24"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">If—</text> 
<subparagraph id="H5B37F22A9463458F9AEC97408829ADE3"><enum>(A)</enum><text display-inline="yes-display-inline">a work is imported into the United States from any foreign country pursuant to an agreement that provides for the temporary exhibition or display of such work entered into between a foreign state that is the owner or custodian of such work and the United States or one or more cultural or educational institutions within the United States,</text> </subparagraph>
<subparagraph id="HC614750A371C4AAE8129B4926D092F85"><enum>(B)</enum><text display-inline="yes-display-inline">the President, or the President’s designee, has determined, in accordance with subsection (a) of <external-xref legal-doc="public-law" parsable-cite="pl/89/259">Public Law 89–259</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/22/2459">22 U.S.C. 2459(a)</external-xref>), that such work is of cultural significance and the temporary exhibition or display of such work is in the national interest, and</text> </subparagraph>
<subparagraph id="HB6CA9A47A294495CA9473B916036F508"><enum>(C)</enum><text>the notice thereof has been published in accordance with subsection (a) of <external-xref legal-doc="public-law" parsable-cite="pl/89/259">Public Law 89–259</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/22/2459">22 U.S.C. 2459(a)</external-xref>),</text></subparagraph><continuation-text continuation-text-level="paragraph">any activity in the United States of such foreign state, or of any carrier, that is associated with the temporary exhibition or display of such work shall not be considered to be commercial activity by such foreign state for purposes of subsection (a)(3).</continuation-text></paragraph>
<paragraph id="H99296C7CF62940B9BF58AA2D42A15022"><enum>(2)</enum><header>Nazi-era claims</header><text>Paragraph (1) shall not apply in any case asserting jurisdiction under subsection (a)(3) in which rights in property taken in violation of international law are in issue within the meaning of that subsection and—</text> 
<subparagraph id="H6C80BC3FAB8F47D586C83D006A04E62F"><enum>(A)</enum><text>the property at issue is the work described in paragraph (1);</text> </subparagraph>
<subparagraph id="H72A18FE3A511446C89E901D4F10246B3"><enum>(B)</enum><text>the action is based upon a claim that such work was taken in connection with the acts of a covered government during the covered period;</text> </subparagraph>
<subparagraph id="H40E85FD6901A4D33AC6CFAEBB069D5B3"><enum>(C)</enum><text>the court determines that the activity associated with the exhibition or display is commercial activity, as that term is defined in section 1603(d); and</text> </subparagraph>
<subparagraph id="HA0870068E9B949CF8EC769F9389A3FFD"><enum>(D)</enum><text>a determination under subparagraph (C) is necessary for the court to exercise jurisdiction over the foreign state under subsection (a)(3).</text> </subparagraph></paragraph>
<paragraph id="H0235BCF5B5F540D28BA1F7F694E8C231"><enum>(3)</enum><header>Definitions</header><text>For purposes of this subsection—</text> 
<subparagraph id="H48E3EEF58B534313B11D063567777E1D"><enum>(A)</enum><text>the term <term>work</term> means a work of art or other object of cultural significance;</text> </subparagraph>
<subparagraph id="H18CF658332984B55AE7037D0C191BFF2"><enum>(B)</enum><text>the term <term>covered government</term> means—</text> 
<clause id="H2A72CA0572A54E9B907C343531AFADBF"><enum>(i)</enum><text>the Government of Germany during the covered period;</text> </clause>
<clause id="HE19E062624034C048B12DDFDC2E1D3D8"><enum>(ii)</enum><text display-inline="yes-display-inline">any government in any area in Europe that was occupied by the military forces of the Government of Germany during the covered period;</text> </clause>
<clause id="H54209AA793C14A06B30C7DC575ECCE8D"><enum>(iii)</enum><text display-inline="yes-display-inline">any government in Europe that was established with the assistance or cooperation of the Government of Germany during the covered period; and</text> </clause>
<clause id="H4BD803AA4C6146708D92A0BAC8B22EBB"><enum>(iv)</enum><text>any government in Europe that was an ally of the Government of Germany during the covered period; and</text> </clause></subparagraph>
<subparagraph id="H56B6A7C7D29B4322B9B70428E717FCAB"><enum>(C)</enum><text>the term <term>covered period</term> means the period beginning on January 30, 1933, and ending on May 8, 1945.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </subsection>
<subsection id="HC777CF8F1B6F41F5B48492AFEE55D873"><enum>(b)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendment made by this section shall apply to any civil action commenced on or after the date of the enactment of this Act.</text> </subsection></section>
