			</subsection></section><section id="HC8F0E6DA818D4035A21AEF2AD1918180"><enum>2.</enum><header>United States policy</header><text display-inline="no-display-inline">It is the policy of the United States—</text>
			<paragraph id="HAAAACA6D4D9F4A8FBBED68D0CB3AA821"><enum>(1)</enum><text>to support the right of the people of Ukraine to freely determine their future, including their
			 country’s relationship with other nations and international organizations,
			 without interference, intimidation, or coercion by other countries;</text>
			</paragraph><paragraph id="H95C22984BA9C4DC9876484D92BAF6BC3"><enum>(2)</enum><text>to support the people of Ukraine in their desire to address endemic corruption, consolidate
			 democracy, and achieve sustained prosperity;</text>
			</paragraph><paragraph id="HC1D004019783480CB0171991B7EDFDD6"><enum>(3)</enum><text>to support the efforts of the Government of Ukraine to bring to justice those responsible for the
			 acts of violence against peaceful protestors and other unprovoked acts of
			 violence related to the anti-government protests that began on November
			 21, 2013;</text>
			</paragraph><paragraph id="H491BD73DC4B94BA18B6CFAE10C0407D0"><enum>(4)</enum><text>to support the efforts of the Government of Ukraine to recover and return to the Ukrainian state
			 funds stolen by former President Yanukovych, his family, and other current
			 and former members of the Ukrainian government, along with others
			 legitimately charged by government authorities with similar offenses;</text>
			</paragraph><paragraph id="HEDFCC0DCB07340ADB77D7EE5329B4549"><enum>(5)</enum><text>to assist the Government of Ukraine in preparations for the presidential election scheduled for May
			 25, 2014, and to participate in efforts to ensure that this election is
			 conducted in accordance with international standards;</text>
			</paragraph><paragraph id="HD9783035015949B9935F0A71E1CD3176"><enum>(6)</enum><text display-inline="yes-display-inline">to promote democratic values, transparent and accountable government institutions, and advance
			 United States national security interests through United States
			 international broadcasting, including the Voice of America and Radio Free
			 Europe/Radio Liberty (RFE/RL), Incorporated;</text>
			</paragraph><paragraph id="HA6DF4F7D1BED4DF4AA71A3AD10CBD30F"><enum>(7)</enum><text>to support needed economic structural reforms in Ukraine, including in the fiscal, energy, pension,
			 and banking sectors, among others;</text>
			</paragraph><paragraph id="HD23F8323F0EC48C1B08EBC8943813FF9"><enum>(8)</enum><text>to support energy diversification initiatives to reduce Russian control of energy supplies to
			 Ukraine and other European countries, including United States promotion of
			 increased natural gas exports and energy efficiency;</text>
			</paragraph><paragraph id="H991FD67B2E99460F805C620E949969DD"><enum>(9)</enum><text>to condemn the armed intervention of the Russian Federation in Ukraine, including its continuing
			 political, economic, and military aggression against that country;</text>
			</paragraph><paragraph id="HB07B82F1A5C54433A55FE7B501327151"><enum>(10)</enum><text>to work with United States allies and partners in Europe and around the world, including at the
			 United Nations, to ensure that all nations refuse to recognize the illegal
			 annexation of Crimea by the Russian Federation and reaffirm the
			 independence, sovereignty, and territorial integrity of Ukraine;</text>
			</paragraph><paragraph id="HA373E1936F144F9E8A71AF4F2831C9FE"><enum>(11)</enum><text>to refuse to recognize the legitimacy of the illegal referendum in Crimea on March 16, 2014, on the
			 status of that region of Ukraine, which was held under conditions of
			 occupation and coercion by Russian forces;</text>
			</paragraph><paragraph id="HDE8459CA5DD84A73BB83EF1204CF5DC2"><enum>(12)</enum><text>to support the deployment of international monitors to Ukraine to assess the current status of its
			 territorial integrity and the safety of all people in Ukraine;</text>
			</paragraph><paragraph id="H4276919A2B7544D6970A189828822EBA"><enum>(13)</enum><text>to encourage the Government of Ukraine to continue to respect and protect the rights of all ethnic,
			 religious, and linguistic minorities;</text>
			</paragraph><paragraph id="HEAA911390AC748EE93863C5CC44BD8E7"><enum>(14)</enum><text>to call on all Ukrainians to respect the legitimate government authorities, as well as all
			 Ukrainian laws and the Constitution of Ukraine in all regions of Ukraine,
			 including Crimea; and</text>
			</paragraph><paragraph id="H3EA52E3D49964BD9B8A91B4A1E635E02"><enum>(15)</enum><text>to honor and abide by its commitments undertaken pursuant to Article 5 of the North Atlantic
			 Treaty, signed at Washington, District of Columbia, on April 4, 1949, and
			 entered into force on August 24, 1949.</text>
			</paragraph></section><title id="HBD33487757454D49BE2480EC52903C62"><enum>I</enum><header>Assistance provisions</header>
			<section id="H4720BA8A65DE45838CCDE1809F083709"><enum>101.</enum><header>Support for democratic governance and civil society in Ukraine</header>
				<subsection id="H685ED599ADEB47FCA96423C6B4F8C88A"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The President is authorized and encouraged to provide assistance to support democracy and civil
			 society in Ukraine by undertaking the activities described in subsection
			 (b).</text>
				</subsection><subsection id="HC41B838197594178952095CC947EC228"><enum>(b)</enum><header>Activities described</header><text>The activities described in this subsection are—</text>
					<paragraph id="H1E5B0FAC56DD40CFB5ACE432B86F815B"><enum>(1)</enum><text>improving democratic governance, transparency, accountability, rule of law, and anti-corruption
			 efforts;</text>
					</paragraph><paragraph id="H1233F4E8CA0E4CFAB5BA890DA0D79AFA"><enum>(2)</enum><text display-inline="yes-display-inline">supporting Ukrainian efforts to foster greater unity among people and regions of the country,
			 combat anti-Semitism and promote respect for religious freedom;</text>
					</paragraph><paragraph id="H7F85EA78F44F4AC78A9AD15DF21EDAA3"><enum>(3)</enum><text>supporting the people and Government of Ukraine in preparing to conduct and participate in free and
			 fair elections, including through domestic and international election
			 monitoring;</text>
					</paragraph><paragraph id="H555584320D664EB68500809056344FAE"><enum>(4)</enum><text>assisting Ukraine in diversifying its economy, trade, and energy supplies, including at the
			 national, regional, and local levels;</text>
					</paragraph><paragraph id="H4A52E582A56844338EDE93A805C13693"><enum>(5)</enum><text>strengthening democratic institutions and political and civil society organizations; and</text>
					</paragraph><paragraph id="H42CFB7C5825F4407817BD9EDEF2DAF7C"><enum>(6)</enum><text>expanding free and unfettered access to independent media of all kinds in Ukraine and assisting
			 with the protection of journalists and civil society activists who have
			 been targeted for free speech activities.</text>
					</paragraph></subsection><subsection id="HF3B87F8135C14E16BE6B7524E0D61CE6"><enum>(c)</enum><header>Availability of funds</header><text>Of amounts made available to carry out the Foreign Assistance Act of 1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2151">22 U.S.C. 2151 et seq.</external-xref>)
			 for fiscal year 2014, $50,000,000 is authorized to be appropriated to
			 carry out this section.</text>
				</subsection></section><section id="HA80FDE3F123E4125B2B5ACA297BD6C03"><enum>102.</enum><header>Economic reform in Ukraine</header>
				<subsection id="HB58C5380020443DEB31484F047B46FC5"><enum>(a)</enum><header>Findings</header><text display-inline="yes-display-inline">Congress finds the following:</text>
					<paragraph id="H29FB6A606856484D923454183CA8B190"><enum>(1)</enum><text>The Ukrainian economy is weak and vulnerable, as evidenced by short-term debt interest rates as
			 high as 15 percent, a high proportion of foreign exchange-denominated
			 government debt that will mature in 2014 and 2015, a banking sector with
			 non-performing loans at the high level of 14 percent, a financing gap
			 which the Government of Ukraine has estimated will amount to $35 billion
			 over the next two years, and a large underground economy. This economic
			 condition undermines democratic prospects in Ukraine.</text>
					</paragraph><paragraph id="H6773F3ECEC61442A8D7344772D39599B"><enum>(2)</enum><text>Years of poor economic management and performance have undermined and may continue to undermine
			 political stability and unity within Ukraine.</text>
					</paragraph><paragraph id="H16BF0720324342568008DA10D15C14EA"><enum>(3)</enum><text>On March 6, 2014, the House of Representatives passed H.R. 4152, to redirect previously
			 appropriated funds to cover the cost of roughly $1 billion in loan
			 guarantees for Ukraine.</text>
					</paragraph></subsection><subsection id="H8728F7543CF14E008C6664A12C31B610"><enum>(b)</enum><header>Statement of policy</header><text display-inline="yes-display-inline">It shall be the policy of the United States to work with other countries and international
			 institutions to stabilize the Ukrainian economy, while promoting
			 critically needed structural economic reforms in Ukraine, including—</text>
					<paragraph id="HAF9581793EBB474490AAE2D527FEDD23"><enum>(1)</enum><text>cutting the massive natural gas subsidies that have led to market inefficiencies;</text>
					</paragraph><paragraph id="HFC192EA0972C47C399AABD442BCC250E"><enum>(2)</enum><text>reducing the bloated public sector;</text>
					</paragraph><paragraph id="HEE0C053CD0904007BD65CC49C8C46912"><enum>(3)</enum><text>maintaining a market-determined exchange rate;</text>
					</paragraph><paragraph id="H76F3DC768A9448F387377CB0E59D503B"><enum>(4)</enum><text>strengthening the vulnerable banking sector; and</text>
					</paragraph><paragraph id="HB96DF3BD331F47D9B79DA1656F8606EE"><enum>(5)</enum><text>reducing corruption.</text>
					</paragraph></subsection><subsection id="HF93C1649360747A392F17161A184A13D"><enum>(c)</enum><header>Sense of Congress</header><text>It is the sense of Congress that loan guarantees provided by the United States for Ukraine should
			 be used to promote government, banking and energy sector reform, and
			 anti-corruption efforts in Ukraine.</text>
				</subsection></section><section id="H931E362D8732448B8699FF5C2D498B5B"><enum>103.</enum><header>United States international programming to Ukraine and neighboring regions</header>
				<subsection id="HFBB01F1F40BB4702B5254679E4CFD67D"><enum>(a)</enum><header>Findings and declarations</header><text>Congress finds and declares the following:</text>
					<paragraph id="HB15E512E408549FEA65F3C75DB1ECA0E"><enum>(1)</enum><text>The Russian Government has deliberately blocked the Ukrainian people’s access to uncensored sources
			 of information and has provided alternative news and information that is
			 both inaccurate and inflammatory.</text>
					</paragraph><paragraph id="HFA5B517FCE6A46EEA453500D29C351AC"><enum>(2)</enum><text>United States international programming exists to advance the United States interests and values
			 by presenting accurate and comprehensive news and information, which is
			 the foundation for democratic governance.</text>
					</paragraph><paragraph id="HDDEFDD84BAA541FCA2F82E617CD0436E"><enum>(3)</enum><text>The opinions and views of the Ukrainian people, especially those people located in the eastern
			 regions and Crimea, are not being accurately represented in Russian
			 dominated mass media.</text>
					</paragraph><paragraph id="HAB184F27ED594EAAA28C24E872784E5C"><enum>(4)</enum><text>Russian forces have seized more than five television stations in Crimea and taken over
			 transmissions, switching to a 24/7 Russian propaganda format; this
			 increase in programming augments the already robust pro-Russian
			 programming to Ukraine.</text>
					</paragraph><paragraph id="H4C554BCF282A4CA8AB99B1C8E5731FCF"><enum>(5)</enum><text>United States international programming has the potential to combat this anti-democratic
			 propaganda.</text>
					</paragraph></subsection><subsection id="H5F7D3BB8BB8C435AA288C35EAC765880"><enum>(b)</enum><header>Programming</header><text>Radio Free Europe/Radio Liberty (RFE/RL), Incorporated, and the Voice of America service to Ukraine
			 and neighboring regions shall—</text>
					<paragraph id="H3B05CD12454E4CFD9CACF614549DC1F4"><enum>(1)</enum><text>provide news and information that is accessible, credible, and accurate;</text>
					</paragraph><paragraph id="HEF66F85B40B64519AA63362E95A3B96C"><enum>(2)</enum><text>emphasize investigative and analytical journalism to highlight inconsistencies and misinformation
			 provided by Russian or pro-Russian media outlets;</text>
					</paragraph><paragraph id="H40BA31A13A90422E80CCC7BD182B4D17"><enum>(3)</enum><text>prioritize programming to areas where access to uncensored sources of information is limited or
			 non-existent, especially populations serviced by Russian supported media
			 outlets;</text>
					</paragraph><paragraph id="H46EE83814349401EAA9B278F3A86DAD3"><enum>(4)</enum><text>increase the number of reporters and organizational presence in eastern Ukraine, especially in
			 Crimea;</text>
					</paragraph><paragraph id="H6C301D0884B7482299BC9FAFA47955C8"><enum>(5)</enum><text>promote democratic processes, respect for human rights, freedom of the press, and territorial
			 sovereignty; and</text>
					</paragraph><paragraph id="H899663453D844F83BC5514E3A12C1698"><enum>(6)</enum><text>take necessary preparatory steps to continue and increase programming and content services to
			 Russia.</text>
					</paragraph></subsection><subsection id="H5FE2F77178F54B47A37687BF1B189A51"><enum>(c)</enum><header>Programming surge</header><text>RFE/RL, Incorporated, and Voice of America programming to Ukraine and neighboring regions shall—</text>
					<paragraph id="H02BE549542154B2F8EFB523887F128E0"><enum>(1)</enum><text>prioritize programming to eastern Ukraine, including Crimea, and to ethnic and linguistic Russian
			 populations, as well as Tatar minorities;</text>
					</paragraph><paragraph id="H1F761952DC8F4D1599F22FBDA2526EE5"><enum>(2)</enum><text>prioritize news and information that directly contributes to the target audiences’ understanding of
			 political and economic developments in Ukraine, including countering
			 misinformation that may originate from other news outlets, especially
			 Russian supported news outlets;</text>
					</paragraph><paragraph id="H1E19427CE27441BFB375A0BB7FED7B48"><enum>(3)</enum><text display-inline="yes-display-inline">provide programming content 24 hours a day, seven days a week to target populations, using all
			 available and effective distribution outlets, including—</text>
						<subparagraph id="H8CB6747D715440518B040D90294BFC2C"><enum>(A)</enum><text>at least 8 weekly hours of total original television and video content in Ukrainian, Russian, and
			 Tatar languages, not inclusive of live video streaming coverage of
			 breaking news, to be distributed on satellite, digital, and through
			 regional television affiliates by the Voice of America; and</text>
						</subparagraph><subparagraph id="H7C00501F50D74A069CBF4E15D7D8A380"><enum>(B)</enum><text>at least 14 weekly hours the total audio content in Ukrainian, Russian, and Tatar languages to be
			 distributed on satellite, digital, and through regional radio affiliates
			 of RFE/RL, Incorporated;</text>
						</subparagraph></paragraph><paragraph id="H679A7C42B74246B19C377CEF527E58B5"><enum>(4)</enum><text>expand the use, audience, and audience engagement of mobile news and multimedia platforms by
			 RFE/RL, Incorporated, and the Voice of America, including through
			 Internet-based social networking platforms; and</text>
					</paragraph><paragraph id="HCD4B0C21EA6040349CCCA2399E193E69"><enum>(5)</enum><text>partner with private sector broadcasters and affiliates to seek and start co-production for new,
			 original content, when possible, to increase distribution.</text>
					</paragraph></subsection><subsection id="H91A45DCF10864E6F87E16CF9F5264EF3"><enum>(d)</enum><header>Authorization of appropriations</header>
					<paragraph id="HD4E2BD39159445368E358BFED0FB0345"><enum>(1)</enum><header>In general</header><text>There is authorized to be appropriated for fiscal year 2014, in addition to funds otherwise made
			 available for such purposes, up to $10,000,000 to carry out programming in
			 the Ukrainian, Balkan, Russian, and Tatar language services of RFE/RL,
			 Incorporated, and the Voice of America, for the purpose of bolstering
			 existing United States programming to the people of Ukraine and
			 neighboring regions, and increasing programming capacity and jamming
			 circumvention technology to overcome any disruptions to service.</text>
					</paragraph><paragraph commented="no" id="HA37F5F91F1724F77AD294EE3FF782A40"><enum>(2)</enum><header>Offset</header><text>Section 102(a) of the Enhanced Partnership with Pakistan Act of 2009 (<external-xref legal-doc="usc" parsable-cite="usc/22/8412">22 U.S.C. 8412(a)</external-xref>; Public Law
			 111–73; 123 Stat. 2068) is amended by striking <quote>$1,500,000,000</quote> and inserting <quote>$1,490,000,000</quote>.</text>
					</paragraph></subsection><subsection id="HD8099AA3E498404DB2227E228203B89D"><enum>(e)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 15 days after the date of the enactment of this Act, the Broadcasting Board of
			 Governors shall submit to the Committees on Foreign Affairs and
			 Appropriations of the House of Representatives and the Committees on
			 Foreign Relations and Appropriations of the Senate a detailed report on
			 plans to increase broadcasts pursuant to subsections (a) and (b).</text>
				</subsection></section><section id="H7C4218AF3C6C4B2EA103BFCC04C42BA5"><enum>104.</enum><header>Overseas Private Investment Corporation</header><text display-inline="no-display-inline">It is the sense of Congress that the Overseas Private Investment Corporation should prioritize
			 investments in Ukraine.</text>
			</section><section id="H7A670197030146078E3CBB6E87D9D3D5"><enum>105.</enum><header>Enhanced assistance for law enforcement in Ukraine</header>
				<subsection id="HF7061D31484F46DD9D3CBC7F63727ACF"><enum>(a)</enum><header>Statement of policy</header><text display-inline="yes-display-inline">It shall be the policy of the United States to assist Ukraine to eliminate the human rights abuses
			 associated with the Berkut forces in order to foster a
			 democratically reformed police force with strong public oversight, which
			 is critical to fostering political unity and stability throughout Ukraine.</text>
				</subsection><subsection commented="no" id="H29A12D7CF75343E8BBE848E88B08D733"><enum>(b)</enum><header>Availability of funds</header><text display-inline="yes-display-inline">Of amounts made available to carry out section 1207 of the National Defense Authorization Act for
			 Fiscal Year 2012 (<external-xref legal-doc="usc" parsable-cite="usc/22/2151">22 U.S.C. 2151</external-xref> note) for fiscal year 2014, $8,000,000 is
			 authorized to be appropriated to enhance United States efforts to assist
			 Ukraine to strengthen law enforcement capabilities and maintain the rule
			 of law.</text>
				</subsection><subsection id="H6A3A51AEF7F6494083698152A83F5A25"><enum>(c)</enum><header>Notification requirement</header><text>The congressional notification requirements contained in section 1207(l) of the National Defense
			 Authorization Act for Fiscal Year 2012 (<external-xref legal-doc="usc" parsable-cite="usc/22/2151">22 U.S.C. 2151</external-xref> note) shall apply
			 to the initiation of activities under a program of assistance under
			 subsection (b) to the same extent and in the same manner as such
			 congressional notification requirements apply to the initiation of
			 activities under a program of assistance section 1207(b) of such Act.</text>
				</subsection></section><section id="H40D31F57837D49D8B99ABC0B37499A1E"><enum>106.</enum><header>Enhanced security cooperation among Central and Eastern European NATO member states</header>
				<subsection id="H50369996BEA44DDB991D4991518CE449"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of State, in consultation with the heads of appropriate United States departments and
			 agencies, shall seek to provide enhanced security cooperation with Central
			 and Eastern European North Atlantic Treaty Organization (NATO) member
			 states by undertaking the activities described in subsection (b).</text>
				</subsection><subsection id="H5DEC2DB394CB4CAC9DB3F5B486037C35"><enum>(b)</enum><header>Activities described</header><text>The activities described in this subsection are—</text>
					<paragraph id="HA036DD6C4E2C437699C48A064C46DA82"><enum>(1)</enum><text>enhancing existing security cooperation, including defense and military-to-military cooperation,
			 among Central and Eastern European NATO member states;</text>
					</paragraph><paragraph id="HF1A0FE2B8E854FDDAE2B3927591C8665"><enum>(2)</enum><text>enhancing security relationships among the United States, the European Union, and Central and
			 Eastern European NATO member states;</text>
					</paragraph><paragraph id="H310DA36BB1D14882B344EB82AE080D6D"><enum>(3)</enum><text>providing defense articles, defense services, and military training to Central and Eastern European
			 NATO member states;</text>
					</paragraph><paragraph id="H965F2688C24C495AAD00A738A35A238D"><enum>(4)</enum><text display-inline="yes-display-inline">expanding the scope and frequency of military exercises among Central and Eastern European NATO
			 member states; and</text>
					</paragraph><paragraph id="H3E3683B902B04EA4B04A13BC24F0B72A"><enum>(5)</enum><text>supporting greater reform, professionalism, and capacity-building efforts within the military,
			 intelligence, and security services in Central and Eastern European NATO
			 member states.</text>
					</paragraph></subsection></section><section id="HC34D01DFCAD74030A76F2878123D172D"><enum>107.</enum><header>United States-Ukraine security assistance</header>
				<subsection id="HD7AE576262EA471FB52808CD96577C1C"><enum>(a)</enum><header>Findings</header><text display-inline="yes-display-inline">Congress finds that—</text>
					<paragraph id="H7FBFDCAAF4E747088161022336C56D44"><enum>(1)</enum><text>in fiscal year 2013 the United States provided Ukraine with nearly $2,000,000 in assistance under
			 chapter 5 of part II of the Foreign Assistance Act of 1961 (22 U.S.C. 2347
			 et seq.; relating to International Military Education Training) and nearly
			 $7,000,000 in assistance under section 23 of the Arms Export Control Act
			 (<external-xref legal-doc="usc" parsable-cite="usc/22/2763">22 U.S.C. 2763</external-xref>; relating to the Foreign Military Financing Program); and</text>
					</paragraph><paragraph id="HCCFC990ACC7E4E62B3B20210D875384F"><enum>(2)</enum><text display-inline="yes-display-inline">Ukraine has been a longstanding member of NATO’s Partnership for Peace.</text>
					</paragraph></subsection><subsection id="H000B95FA709F4103BB7BD8C8EC1DF1F4"><enum>(b)</enum><header>Sense of Congress</header><text display-inline="yes-display-inline">It is the sense of Congress that—</text>
					<paragraph id="H39A4949C7AB5482E8F4562D92D7F97DF"><enum>(1)</enum><text>United States assistance to Ukraine under chapter 5 of part II of the Foreign Assistance Act of
			 1961 and section 23 of the Arms Export Control Act should continue;</text>
					</paragraph><paragraph id="H3BE02596852047C2B15F5BDDF3EBFCD9"><enum>(2)</enum><text>consistent with section 506(a) of the Foreign Assistance Act of 1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2318">22 U.S.C. 2318(a)</external-xref>), the
			 President is encouraged to draw down defense articles from the stocks of
			 the Department of Defense, in order to provide non-lethal assistance,
			 which could include communication equipment, clothing, fuel and other
			 forms of appropriate assistance, to the Government of Ukraine; and</text>
					</paragraph><paragraph id="H66BA4B1205B644AA90DED1B2ACF13AB2"><enum>(3)</enum><text display-inline="yes-display-inline">the Administration should expeditiously conclude its current review of all security assistance to
			 the Government of Ukraine.</text>
					</paragraph></subsection></section><section id="HBD68288DF0C2441298ECBE85CCCE0681"><enum>108.</enum><header>Recovery of assets linked to corruption in Ukraine</header><text display-inline="no-display-inline">It is the sense of Congress that the Administration should provide expedited assistance to the
			 Government of Ukraine to identify, investigate, secure, and recover assets
			 stolen from the Government of Ukraine or linked to acts of corruption by
			 former President Viktor Yanukovych, members of his family, and other
			 former or current Ukrainian government officials, and their accomplices in
			 any jurisdiction through appropriate United States Government and
			 multilateral programs, including the Department of Justice’s Kleptocracy
			 Asset Recovery Initiative, the Egmont Group, the Stolen Asset Recovery
			 Initiative, the Camden Asset Recovery Inter-Agency Network, and the Asset
			 Recovery Focal Point Initiative.</text>
			</section><section id="H0EB1BDC66C914BF0B067F901297CC7FC"><enum>109.</enum><header>European Bank for Reconstruction and Development</header>
				<subsection id="HA0A8232635FD4DADB27BA0ED3598E083"><enum>(a)</enum><header>Findings</header><text display-inline="yes-display-inline">The Congress finds the following:</text>
					<paragraph id="HE7E2DC14E6A14E0CB4B46877D9E09EEC"><enum>(1)</enum><text>Article 1 of the Agreement Establishing the European Bank for Reconstruction and Development (EBRD)
			 states that the EBRD should support investments in countries that are
			 committed to and applying the principles of multiparty democracy,
			 pluralism, and market economics, and the EBRD has recognized that Russian <quote>progress in the application of these principles … has been uneven</quote>.</text>
					</paragraph><paragraph id="H05A4F96CF7194B3281A9C1B0B682DBDB"><enum>(2)</enum><text>Russia received 21 percent of the investments made by the EBRD in 2013, which is more than any
			 other country received from the EBRD in that year, and has received an
			 inordinate ratio of investment from the EBRD since the 2006 Capital
			 Resources Review.</text>
					</paragraph></subsection><subsection id="HE738C3E8F65F47EAB8AB34ECCF4169DE"><enum>(b)</enum><header>Sense of the Congress</header><text>It is the sense of the Congress that the European Bank for Reconstruction and Development (EBRD)
			 should increase investments in Ukraine and cease new investments in the
			 Russian Federation, and the United States Government should press the EBRD
			 to support new investment in Ukraine and halt consideration of new
			 investment in Russia.</text>
				</subsection></section></title><title id="H99D34C66D6E8406BBD4C6BA6A7FD0F17"><enum>II</enum><header>Sanctions provisions</header>
			<section id="H9DE237EDE73A426383BDCBC24D490237"><enum>201.</enum><header>Continuation in effect of sanctions with respect to the blocking of certain persons contributing to
			 the situation in Ukraine</header>
				<subsection id="H9F5CB1C1D62A42968023D6B70A920E48"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">United States sanctions described in subsection (b), as in effect on the day before the date of the
			 enactment of this Act, shall remain in effect until the earlier of—</text>
					<paragraph id="HC2E17AB1442644C4B6C5E79322070184"><enum>(1)</enum><text>the date that is 90 days after the date on which the President submits to the appropriate
			 congressional committees the certification described in subsection (a) of
			 section 206 in accordance with subsection (b) of such section; or</text>
					</paragraph><paragraph id="H4ADF0701913E42FCB8F4D3C6BA0E0668"><enum>(2)</enum><text display-inline="yes-display-inline">the date that is 30 days after any date subsequent to January 1, 2020, on which the President
			 submits to the appropriate congressional committees in writing a
			 determination that the termination of such sanctions imposed is in the
			 vital national security interests of the United States.</text>
					</paragraph></subsection><subsection id="HFE187EE874B543959025D87738D6E028"><enum>(b)</enum><header>Sanctions described</header><text display-inline="yes-display-inline">United States sanctions described in this subsection are sanctions imposed under the following
			 executive orders:</text>
					<paragraph id="HDBAF18B41A7D4A9D95936A6C9E091E47"><enum>(1)</enum><text>Executive Order 13660 (March 6, 2014; relating to blocking property of certain persons contributing
			 to the situation in Ukraine).</text>
					</paragraph><paragraph id="H7E8100D0DBD54912A3C9D88C87977481"><enum>(2)</enum><text>Executive Order 13661 (March 16, 2014; relating to blocking property of additional persons
			 contributing to the situation in Ukraine).</text>
					</paragraph><paragraph id="HA05DEA6EB1D6469CB14592A61ED2E966"><enum>(3)</enum><text>Executive Order 13662 (March 20, 2014; relating to blocking property of additional persons
			 contributing to the situation in Ukraine).</text>
					</paragraph></subsection></section><section id="H60E42EAB1EC34DD49F8903ECA1E93B90"><enum>202.</enum><header>Imposition of additional sanctions on persons responsible for violence or who undermine the
			 independence, sovereignty, or territorial or economic integrity of Ukraine</header>
				<subsection id="H1E2FC867253D41639C4532869D4DA3E6"><enum>(a)</enum><header>Statement of policy</header><text display-inline="yes-display-inline">It shall be the policy of the United States to impose sanctions with respect to those individuals
			 within and outside of the Government of the Russian Federation whom the
			 President determines wields significant influence over the formation and
			 implementation of Russian foreign policy, in particular with respect to
			 the violation of Ukraine’s sovereignty, democracy, and territorial
			 integrity.</text>
				</subsection><subsection id="H5BFB9CF9D5604CA0995F24A954371BD0"><enum>(b)</enum><header>Criteria for imposition of sanctions</header><text>A foreign person or an alien is subject to sanctions under subsection (c) in accordance with the
			 provisions of such subsection if the foreign person or alien, on or after
			 November 21, 2013—</text>
					<paragraph id="H3B93F4BAF4F84D54AC886055EA75842E"><enum>(1)</enum><text>is knowingly responsible for or complicit in, or engaged in, directly or indirectly—</text>
						<subparagraph id="H3EE3427ED6874355BECE3304BE74225D"><enum>(A)</enum><text>actions that significantly undermine democratic processes or institutions in Ukraine;</text>
						</subparagraph><subparagraph id="H4F96FB6CF11F490CB07C96CD14EE823F"><enum>(B)</enum><text>actions that significantly threaten the peace, security, stability, sovereignty, or territorial
			 integrity of Ukraine;</text>
						</subparagraph><subparagraph id="H4EF5723D980846F68BCE3F7438707F9D"><enum>(C)</enum><text display-inline="yes-display-inline">acts of significant corruption in Ukraine, or the seizure or expropriation of significant economic
			 assets from Ukraine, including the expropriation of private or state
			 assets for personal gain, or the facilitation or transfer of the proceeds
			 of such expropriation to foreign jurisdictions; or</text>
						</subparagraph><subparagraph id="H0B121A7AE5204371BBCBDCCBD03632BC"><enum>(D)</enum><text>the commission of serious human rights abuses against citizens of Ukraine or citizens of the
			 Russian Federation;</text>
						</subparagraph></paragraph><paragraph id="H4592170423184940B1B24D0A0CC7BF88"><enum>(2)</enum><text display-inline="yes-display-inline">is a current or former senior official of the Government of the Russian Federation who has engaged
			 in any activity described in paragraph (1);</text>
					</paragraph><paragraph id="HA400286C55FA4079A66DE25373E0C506"><enum>(3)</enum><text>operates in the arms or related materiel sector in the Russian Federation that has engaged in any
			 activity described in paragraph (1);</text>
					</paragraph><paragraph id="H83125240BD8B4B1E8015D29CB0BDA924"><enum>(4)</enum><text display-inline="yes-display-inline">is a current or former leader of an entity that has, or whose members have, knowingly engaged in
			 any activity described in paragraph (1), (2), or (3) or of an entity whose
			 property and interests in property are blocked pursuant to this section;</text>
					</paragraph><paragraph id="HABFCC9FB723C4391B916426E940441BD"><enum>(5)</enum><text display-inline="yes-display-inline">has knowingly materially assisted, sponsored, or provided financial, material, or technological
			 support for, or goods or services to or in support of, any activity
			 described in paragraph (1), (2), or (3) or of any person whose property
			 and interests in property are blocked pursuant to this section; or</text>
					</paragraph><paragraph id="H7122C93E5CCA4F20A78EC497A7152030"><enum>(6)</enum><text display-inline="yes-display-inline">is owned or controlled by, or has acted or purported to act for or on behalf of, directly or
			 indirectly, any person whose property and interests in property are
			 blocked pursuant to this section.</text>
					</paragraph></subsection><subsection id="HACD45B6FFEC84CB1BA04531B02A1AC6F"><enum>(c)</enum><header>Sanctions described</header>
					<paragraph id="H8638B58CEE314300A9EF044D0C95933F"><enum>(1)</enum><header>In general</header><text>The sanctions described in this subsection are the following:</text>
						<subparagraph id="H6D1931878F0F4C0B98BCD47029DCDFCF"><enum>(A)</enum><header>Asset blocking</header><text display-inline="yes-display-inline">With respect to a foreign person who the President, acting through the Secretary of the Treasury
			 and in consultation with the Secretary of State (or their designees),
			 determines meets the requirements described in subsection (b), the
			 President, acting through the Secretary of the Treasury and in
			 consultation with the Secretary of State (or their designees), shall to
			 the extent necessary investigate, block during the pendency of an
			 investigation, regulate, direct and compel, nullify, void, prevent or
			 prohibit, any acquisition, holding, withholding, use, transfer,
			 withdrawal, transportation, or exportation of, or dealing in, or
			 exercising any right, power, or privilege with respect to, or transactions
			 involving, any property in which any foreign country or a national thereof
			 has any interest by any person, or with respect to any property, subject
			 to the jurisdiction of the United States if such property and interests in
			 property are in the United States, come within the United States, or are
			 or come within the possession or control of a United States person.</text>
						</subparagraph><subparagraph id="HB94FD9C4A83B4A60B9FA1759254A60F3"><enum>(B)</enum><header>Aliens ineligible for visas, admission, or parole</header>
							<clause id="HD1F7AC8FC31C42F0B71E1D634F910B6D"><enum>(i)</enum><header>Visas, admission, or parole</header><text>An alien who the Secretary of State or the Secretary of Homeland Security (or a designee of one of
			 such Secretaries) knows, or has reason to believe, meets any of the
			 criteria described in subsection (b) is—</text>
								<subclause id="HB9428056DCB14C5B86785B18CBC418EF"><enum>(I)</enum><text>inadmissible to the United States;</text>
								</subclause><subclause id="HCB46D18EAF2B47E4BD4CD3752BC711E7"><enum>(II)</enum><text>ineligible to receive a visa or other documentation to enter the United States; and</text>
								</subclause><subclause id="H050E3DB8E3C34F07A47DE83659BF0A3E"><enum>(III)</enum><text>otherwise ineligible to be admitted or paroled into the United States or to receive any other
			 benefit under the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101 et seq.</external-xref>).</text>
								</subclause></clause><clause id="H8492054DFECE401E977D210D5F164DD7"><enum>(ii)</enum><header>Current visas revoked</header>
								<subclause id="H6767D90158674A0AA53BD849C3DBEEFD"><enum>(I)</enum><header>In general</header><text>The issuing consular officer, the Secretary of State, or the Secretary of Homeland Security (or a
			 designee of one of such Secretaries) shall revoke any visa or other entry
			 documentation issued to an alien who meets any of the criteria described
			 in subsection (b), regardless of when issued.</text>
								</subclause><subclause id="HA2C75831DA52469F89511D63AC3C2900"><enum>(II)</enum><header>Judicial review</header><text>Notwithstanding any other provision of law, including <external-xref legal-doc="usc" parsable-cite="usc/28/2241">section 2241</external-xref> of title 28, United States Code,
			 or any other habeas corpus provision, and sections 1361 and 1651 of such
			 title, no court shall have jurisdiction to review a revocation decision
			 under this clause, and no court shall have jurisdiction to hear any claim
			 arising from, or any challenge to, such a revocation.</text>
								</subclause><subclause id="H39229BFBF2DF4E5EBA8E38E38BF14D9B"><enum>(III)</enum><header>Effect of revocation</header><text>A revocation under subclause (I)—</text>
									<item id="H78FFDE061BC54416ABF681856834B215"><enum>(aa)</enum><text>shall take effect immediately; and</text>
									</item><item id="HCF81351EABB84C7FA156BD56293A6310"><enum>(bb)</enum><text>shall automatically cancel any other valid visa or entry documentation that is in the alien’s
			 possession.</text>
									</item></subclause></clause></subparagraph></paragraph><paragraph id="H9B75907593424B819B790F1AFF231C20"><enum>(2)</enum><header>Penalties</header><text>A foreign person that violates, attempts to violate, conspires to violate, or causes a violation of
			 paragraph (1)(A) or any regulation, license, or order issued to carry out
			 paragraph (1)(A) shall be subject to the penalties set forth in
			 subsections (b) and (c) of section 206 of the International Emergency
			 Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1705">50 U.S.C. 1705</external-xref>) to the same extent as a person that
			 commits an unlawful act described in subsection (a) of that section.</text>
					</paragraph><paragraph commented="no" id="HE7D49DD05B1749288C70BF40C0FBAB33"><enum>(3)</enum><header>Regulatory authority</header><text>The President shall, not later than 90 days after the date of the enactment of this Act, promulgate
			 regulations as necessary for the implementation of this section.</text>
					</paragraph><paragraph id="H79181E02AA6541E2929B39A2ED771688"><enum>(4)</enum><header>Exception to comply with united nations headquarters agreement</header><text>Sanctions under paragraph (1)(B) shall not apply to an alien if admitting the alien into the United
			 States is necessary to permit the United States to comply with the
			 Agreement regarding the Headquarters of the United Nations, signed at Lake
			 Success June 26, 1947, and entered into force November 21, 1947, between
			 the United Nations and the United States, or other applicable
			 international obligations.</text>
					</paragraph><paragraph commented="no" id="H71258644E3AF434086B14C6338D5FB02"><enum>(5)</enum><header>Rule of construction</header><text>Nothing in this section shall be construed to limit the authority of the President pursuant to the
			 International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701 et seq.</external-xref>).</text>
					</paragraph></subsection><subsection id="HAA90D3C339CC4BEE9B71F0CAB40E9431"><enum>(d)</enum><header>Waiver</header><text>The President may waive the application of sanctions under subsection (c) with respect to a foreign
			 person or alien if the President—</text>
					<paragraph id="HC0827581C9E2458A8EB4420E50154E3D"><enum>(1)</enum><text>determines that such a waiver is vital to the national interest of the United States; and</text>
					</paragraph><paragraph id="H8E0C6A0A4F3547458D157CA418A0E4C8"><enum>(2)</enum><text>not less than 15 days after the waiver takes effect, submits to the appropriate congressional
			 committees a notice of the waiver and a justification for such waiver.</text>
					</paragraph></subsection><subsection commented="no" id="HFEBC906B391F4267B62B4B6FB528E6B8"><enum>(e)</enum><header>Report</header>
					<paragraph commented="no" id="H068A18FB3FBD4B3280FB0DA008E84E06"><enum>(1)</enum><header>Report required</header>
						<subparagraph id="HA70C442F25544BC9A65D9C268D1F6660"><enum>(A)</enum><header>In general</header><text>Not later than 30 days after the date of the enactment of this Act, and every 180 days thereafter
			 for a period not to exceed 2 years, the Secretary of State, in
			 consultation with the Secretary of the Treasury, shall submit to the
			 appropriate congressional committees a detailed report with respect to
			 whether senior foreign political figures of the Russian Federation are
			 responsible for engaging in activities described in subsection (b).</text>
						</subparagraph><subparagraph commented="no" id="H9B1C43E232EE47688A062CF9990D86D1"><enum>(B)</enum><header>Form</header><text display-inline="yes-display-inline">The report required by subparagraph (A) shall be submitted in unclassified form but may contain a
			 classified annex.</text>
						</subparagraph></paragraph><paragraph commented="no" id="HD47F88E8612D4C038EEF4AD55761FB38"><enum>(2)</enum><header>Requests by chairperson and ranking member of appropriate congressional committees</header>
						<subparagraph commented="no" id="H6111F16C4C8A4724A1D53E4456CC4AB1"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 120 days after receiving a written request from the chairperson and ranking member
			 of one of the appropriate congressional committees with respect to whether
			 a senior foreign political figure of the Russian Federation is responsible
			 for engaging in activities described in subsection (b), the President
			 shall submit a response to the chairperson and ranking member of the
			 committee which made the request with respect to the status of the person.</text>
						</subparagraph><subparagraph commented="no" id="H2831ED9600C84CA891D248EADB5B6C56"><enum>(B)</enum><header>Form</header><text display-inline="yes-display-inline">The President may submit a response required by subparagraph (A) in classified form if the
			 President determines that it is necessary for the national security
			 interests of the United States to do so.</text>
						</subparagraph></paragraph><paragraph commented="no" id="HFF00D6696B0946BB87078A185E968848"><enum>(3)</enum><header>Definition</header><text>In this subsection, the term <term>appropriate congressional committees</term> means—</text>
						<subparagraph commented="no" id="H656EE137337947298C97AEB101799891"><enum>(A)</enum><text>the Committee on Foreign Affairs and the Committee on Financial Services of the House of
			 Representatives; and</text>
						</subparagraph><subparagraph commented="no" id="H7CC7F9BE18224E9AB878610D18F4D2D0"><enum>(B)</enum><text>the Committee on Foreign Relations and the Committee on Banking, Housing, and Urban Affairs of the
			 Senate.</text>
						</subparagraph></paragraph></subsection><subsection id="HE4CB29CF4CE34DB3BE891663DE6C666D"><enum>(f)</enum><header>Definitions</header><text>In this section:</text>
					<paragraph id="H763C8E2D1C5548AEAA8B6CCB20C8F481"><enum>(1)</enum><header>Admitted</header><text display-inline="yes-display-inline">The term <term>admitted</term> has the meaning given such term in section 101(a)(13)(A) of the Immigration and Nationality Act (8
			 U.S.C. 1101(a)(13)(A)).</text>
					</paragraph><paragraph id="H5EF3F65E0882482A83421BA003566D01"><enum>(2)</enum><header>Alien</header><text>The term <term>alien</term> has the meaning given such term in section 101(a)(3) of the Immigration and Nationality Act (8
			 U.S.C. 1101(a)(3)).</text>
					</paragraph><paragraph id="H98B584AD4AE44A7BAB61544A04F98FA7"><enum>(3)</enum><header>Financial institution</header><text>The term <term>financial institution</term> has the meaning given that term in <external-xref legal-doc="usc" parsable-cite="usc/31/5312">section 5312</external-xref> of title 31, United States Code.</text>
					</paragraph><paragraph id="HE69C138332FD49E0A17E71166AFBE03A"><enum>(4)</enum><header>Foreign person</header><text>The term <term>foreign person</term> means—</text>
						<subparagraph id="HED52B89673394BD19F26433D80289DBC"><enum>(A)</enum><text>an individual who is not a United States person or an alien lawfully admitted for permanent
			 residence into the United States;</text>
						</subparagraph><subparagraph id="HBE2876A6CBCB40A19B6E7F5ED08ECDF0"><enum>(B)</enum><text>a corporation, partnership, or other nongovernmental entity which is not a United States person; or</text>
						</subparagraph><subparagraph id="HCB25BE576DCE4754ACAB420A5C1A28B0"><enum>(C)</enum><text>any representative, agent or instrumentality of, or an individual working on behalf of a foreign
			 government.</text>
						</subparagraph></paragraph><paragraph id="HBB06CC56A34C434180487BB8E5DA1B46"><enum>(5)</enum><header>Paroled</header><text>The term <term>paroled</term> means paroled into the United States under section 212(d)(5) of the Immigration and Nationality
			 Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(d)(5)</external-xref>).</text>
					</paragraph><paragraph id="H3781B78597F247D78EE8A8F6CF066A85"><enum>(6)</enum><header>Senior foreign political figure</header><text>The term <term>senior foreign political figure</term> means—</text>
						<subparagraph id="H5BDA7D3E0FAD4386AF96B60710456EB3"><enum>(A)</enum><text display-inline="yes-display-inline">a current or former—</text>
							<clause id="H6CD89146E3494DE18BA2C59911F1DB61"><enum>(i)</enum><text>senior official in the executive, legislative, administrative, military, or judicial branches of a
			 foreign government (whether elected or not);</text>
							</clause><clause id="HC67C527312F343549BAE8DB5AE4E9611"><enum>(ii)</enum><text>senior official of a major foreign political party; or</text>
							</clause><clause id="H02E6C663BAAC47A88D0752DF4626575B"><enum>(iii)</enum><text>senior executive of a foreign-government-owned commercial enterprise;</text>
							</clause></subparagraph><subparagraph id="H7C16D78D5419487D8A236318C0471E4B"><enum>(B)</enum><text>a corporation, business, or other entity that has been formed by, or for the benefit of, any such
			 individual;</text>
						</subparagraph><subparagraph id="H8A03DB8B42DA4B7B90B66721EECE25A2"><enum>(C)</enum><text>an immediate family member (including spouses, parents, siblings, children, and a spouse’s parents
			 and siblings) of any such individual; or</text>
						</subparagraph><subparagraph id="H6686953130F645568179486400E6B21E"><enum>(D)</enum><text>a person who is widely and publicly known to be a close associate of such individual.</text>
						</subparagraph></paragraph><paragraph id="H11D4CB9B305242ECB08AEC08A0330BBE"><enum>(7)</enum><header>United states person</header><text>The term <term>United States person</term> means—</text>
						<subparagraph id="H9F635B6715B341B892E99246D76D1392"><enum>(A)</enum><text>a United States citizen or an alien lawfully admitted for permanent residence to the United States;
			 or</text>
						</subparagraph><subparagraph id="HB114E00E31284CFF99726762846C79FE"><enum>(B)</enum><text>an entity organized under the laws of the United States or of any jurisdiction within the United
			 States, including a foreign branch of such an entity.</text>
						</subparagraph></paragraph></subsection><subsection commented="no" id="HF29102E138944811AEA51907DDE73A61"><enum>(g)</enum><header>Termination</header><text display-inline="yes-display-inline">This section and any sanction imposed by this section shall remain in effect until the earlier of—</text>
					<paragraph id="H64E544E1C379434CA0DE979A7D68AD38"><enum>(1)</enum><text>the date that is 90 days after the date on which the President submits to the appropriate
			 congressional committees the certification described in subsection (a) of
			 section 206 in accordance with subsection (b) of such section; or</text>
					</paragraph><paragraph id="H39FF0CB0B0FE476786F4D2018EB8B30D"><enum>(2)</enum><text display-inline="yes-display-inline">the date that is 30 days after any date subsequent to January 1, 2020, on which the President
			 submits to the appropriate congressional committees in writing a
			 determination that the termination of this section and the sanctions
			 imposed by this section is in the vital national security interests of the
			 United States.</text>
					</paragraph></subsection></section><section id="H61258AEDACFF4B6481A2FF859C2C481A"><enum>203.</enum><header>Report on certain foreign financial institutions</header>
				<subsection id="HBF8844EE55A648A093DADCC4C870AAB9"><enum>(a)</enum><header>Findings</header><text display-inline="yes-display-inline">Congress finds the following:</text>
					<paragraph id="H46BBB0E0BE334FC7BE17986F3EBD0362"><enum>(1)</enum><text>On February 26, 2014, the Department of the Treasury’s Financial Crimes Enforcement Network advised
			 United States financial institutions of their responsibility to take
			 reasonable, risk-based steps regarding the potential suspicious movement
			 of assets related to Viktor Yanukovych departing Kyiv and abdicating his
			 responsibilities and other senior officials resigning from their positions
			 or departing Kyiv.</text>
					</paragraph><paragraph id="HDF7D7EA83F5A469F82D32325D51F9422"><enum>(2)</enum><text>United States financial institutions are required to apply enhanced scrutiny to private banking
			 accounts held by or on behalf of senior foreign political figures and to
			 monitor transactions that could potentially represent misappropriated or
			 diverted state assets, the proceeds of bribery or other illegal payments,
			 or other public corruption proceeds.</text>
					</paragraph><paragraph id="H189ACB45E829478BA5C6E31A160D014C"><enum>(3)</enum><text>On March 3, 2014, the Government of Ukraine announced that it had initiated criminal proceedings
			 against a number of former Ukrainian officials or close associates of
			 former Ukrainian officials.</text>
					</paragraph><paragraph id="H956C717698C1464F9BD4B45BA3FFA2F0"><enum>(4)</enum><text>On March 5, 2014, the European Union, based on information from Ukraine’s Prosecutor General,
			 issued a Council Regulation requiring the European Union to freeze the
			 funds and economic resources of various former Ukrainian officials and
			 their close associates.</text>
					</paragraph><paragraph id="H1EF3F241031B4147948940B49B064669"><enum>(5)</enum><text>The Government of Canada has taken similar action against the same individuals.</text>
					</paragraph><paragraph id="H5C04CCC0BCBF47EFBE825F64F1C048B2"><enum>(6)</enum><text>The measures being taken against these former Ukrainian officials and their close associates
			 increase the risk that they will seek to move their assets in a deceptive
			 fashion.</text>
					</paragraph><paragraph id="HA8F168E46EF644D8AECA495C187D42F2"><enum>(7)</enum><text>Foreign financial institutions should apply similar, enhanced due-diligence and reporting
			 requirements.</text>
					</paragraph><paragraph id="H2DDFA138639B4D8799AFDF30F3986798"><enum>(8)</enum><text>The United States has a strong interest in seeing the international financial system protected from
			 illicit financial activity, including money laundering, terrorism and
			 proliferation financing, transnational organized crime, and the
			 misappropriation of state assets, and international sanctions evasion,
			 among others.</text>
					</paragraph><paragraph id="H94E125B846C248F787E8D40CC8DCF839"><enum>(9)</enum><text>The Department of the Treasury possesses a range of authorities to insulate the United States
			 financial system from entities or jurisdictions that pose an illicit
			 financing risk.</text>
					</paragraph></subsection><subsection id="H3F356A3C72594754BE8B080165C69D12"><enum>(b)</enum><header>Statement of policy</header><text>It shall be the policy of the United States to use all of its regulatory and statutory authorities
			 to closely scrutinize all foreign financial institutions, including those
			 in the Russian Federation, that may be complicit in enabling foreign
			 persons and transnational criminal enterprises to evade or otherwise
			 circumvent United States and international sanctions, launder the proceeds
			 of criminal activity, finance acts of terrorism and the proliferation of
			 weapons of mass destruction, or any other illicit activity that presents
			 risks and vulnerabilities to the United States financial system.</text>
				</subsection><subsection id="H4EB74F8942EA454AAD7B511DEBBB3B03"><enum>(c)</enum><header>Report</header>
					<paragraph id="H3399E38C5FE74785AFF3085680B98D6E"><enum>(1)</enum><header>In general</header><text>Not later than 30 days after the date of the enactment of this Act, and every 180 days thereafter
			 for a period not to exceed 2 years, the Secretary of State and the
			 Secretary of the Treasury shall jointly submit to the appropriate
			 congressional committees a report on—</text>
						<subparagraph id="HFF094D306BE7435CAFC6A524D908D76A"><enum>(A)</enum><text display-inline="yes-display-inline">foreign financial institutions that are in direct or indirect control of Government of Ukraine
			 state-owned or controlled assets without the knowledge or approval of the
			 Government of Ukraine;</text>
						</subparagraph><subparagraph id="HD32608E27C0D42E39EB1C1D0984563E1"><enum>(B)</enum><text display-inline="yes-display-inline">foreign financial institutions that may be complicit in illicit financial activity, including money
			 laundering, terrorism and proliferation financing, transnational organized
			 crime, misappropriation of state assets, or otherwise engaged in any
			 activity prohibited under United States law that are—</text>
							<clause id="H4AA8BF7F7C8F4FEA8A120ECA7013FE61"><enum>(i)</enum><text>organized under the laws of the Russian Federation; or</text>
							</clause><clause id="HBE2D7F91AA284684A4B5FD8D7C19314B"><enum>(ii)</enum><text>owned or controlled by a foreign person described in section 202(b); and</text>
							</clause></subparagraph><subparagraph id="HDC3D1381ADB54DF88DAF36474111D7B8"><enum>(C)</enum><text>foreign financial institutions that are directly or indirectly assisting or otherwise aiding the
			 violation of Ukrainian sovereignty, independence, and territorial
			 integrity, including, the Crimea.</text>
						</subparagraph></paragraph><paragraph id="H786A75BA65AA4C64ACC7E6DB4E38C53E"><enum>(2)</enum><header>Form</header><text>The report required to be submitted under this subsection shall be submitted in an unclassified
			 form, to the extent appropriate, but may include a classified annex.</text>
					</paragraph></subsection></section><section id="HA7537C79A42949FDA87C46E725CDE826"><enum>204.</enum><header>Amendment to the Iran, North Korea, and Syria Nonproliferation Act</header>
				<subsection id="HB1707680821943C89D63190D399EDA86"><enum>(a)</enum><header>Findings</header><text display-inline="yes-display-inline">Congress finds the following:</text>
					<paragraph id="HFFC6C2792B0D41C6ACFE346F968E88F3"><enum>(1)</enum><text display-inline="yes-display-inline">Iran continues its longstanding effort to obtain banned components for its nuclear and missile
			 programs in violation of its obligations under successive United Nations
			 Security Council Resolutions.</text>
					</paragraph><paragraph id="H067701823AFC43E78CA96D6CC0401F52"><enum>(2)</enum><text display-inline="yes-display-inline">Russian entities, including Rosoboronexport, have been sanctioned with respect to proliferation
			 activities, particularly sanctions under the Iran, North Korea, and Syria
			 Nonproliferation Act (<external-xref legal-doc="public-law" parsable-cite="pl/106/178">Public Law 106–178</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> note).</text>
					</paragraph><paragraph id="H796A0B22325A458ABA268F51D98C6949"><enum>(3)</enum><text>The Department of State must expeditiously restore the deterrent effect of the Iran, North Korea,
			 and Syria Nonproliferation Act by fully applying and enforcing such Act.</text>
					</paragraph></subsection><subsection id="H6B41026CA1264B6489EDD10F7D1701BB"><enum>(b)</enum><header>Amendment</header><text display-inline="yes-display-inline">Section 2 of the Iran, North Korea, and Syria Nonproliferation Act (<external-xref legal-doc="public-law" parsable-cite="pl/106/178">Public Law 106–178</external-xref>; 50 U.S.C.
			 1701 note) is amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H049D63DAC4FA420BA548605D7FA42115" style="OLC">
						<subsection id="H73EC2262D0454956AC53848243C183F7"><enum>(f)</enum><header>Plan To expedite reports and sanctions under this Act</header><text display-inline="yes-display-inline">Not later than 30 days after the date of the enactment of the Ukraine Support Act, the President
			 shall submit to the Committee on Foreign Affairs of the House of
			 Representatives and the Committee on Foreign Relations in the Senate, a
			 plan, to include specific timetables, to expedite the implementation of
			 this Act with respect to submission of reports required under subsection
			 (a) and the application of measures to certain foreign persons under
			 section 3.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection></section><section id="HE048DD0D20434DC6A0EB5E4974C34DFF"><enum>205.</enum><header>Sense of Congress on human rights in the Russian Federation</header><text display-inline="no-display-inline">It is the sense of Congress that the President should greatly expand the list of 18 Russian
			 officials and others published on April 12, 2013, who were engaged in
			 actions described in section 404 of the Sergei Magnitsky Rule of Law
			 Accountability Act of 2012 (title IV of <external-xref legal-doc="public-law" parsable-cite="pl/112/208">Public Law 112–208</external-xref>; 22 U.S.C.
			 5811) regarding the death of Sergei Magnitsky, illegal activity by
			 officials of the Government of the Russian Federation, or violations of
			 human rights and other offenses in Russia.</text>
			</section><section id="H033FF6BC4785452B857CDC64B7B55A4E"><enum>206.</enum><header>Certification described and submission to Congress</header>
				<subsection id="H058C35E77EA14CE1A40C1B68A3FA2861"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">A certification described in this section is a certification of the President to Congress that
			 Ukrainian sovereignty, independence, and territorial integrity is not
			 being violated by the Russian Federation or any other state actor.</text>
				</subsection><subsection id="HF300AD799D954834A8FDF60903912802"><enum>(b)</enum><header>Submission to congress</header>
					<paragraph id="H39689DF68807406EAF4DCC3C15A93CCA"><enum>(1)</enum><header>In general</header><text>The President shall submit the certification described in subsection (a) to the appropriate
			 congressional committees in writing and shall include a justification for
			 the certification.</text>
					</paragraph><paragraph id="H9385B3513F1E4F959B493E946AD6E290"><enum>(2)</enum><header>Form of certification</header><text>The certification described in subsection (a) shall be submitted in unclassified form but may
			 contain a classified annex.</text>
					</paragraph></subsection></section><section id="HBFCA35628EC34BADB0454CED5F6EF22D"><enum>207.</enum><header>Appropriate congressional committees defined</header><text display-inline="no-display-inline">Except as otherwise provided, in this title the term <term>appropriate congressional committees</term> means—</text>
				<paragraph id="HDAA9503D1975451BB833B5A4BCC8D99A"><enum>(1)</enum><text>the Committee on Foreign Affairs, the Committee on Financial Services, the Committee on Ways and
			 Means, and the Committee on the Judiciary of the House of Representatives;
			 and</text>
				</paragraph><paragraph id="HA827A4D84BD24C49BE4525769180B75B"><enum>(2)</enum><text>Committee on Foreign Relations, the Committee on Banking, Housing, and Urban Affairs, and the
			 Committee on the Judiciary of the Senate.</text>
