		<section id="HA6C81BB7799C4A289B9ED5EE5681F3E0" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Veterans Traumatic Brain Injury Care Improvement Act of 2014</short-title></quote>.</text>
		</section><section id="H7317628373FE4A5C929E34D26CC26AAF"><enum>2.</enum><header>Extension and modification of pilot program on assisted living services for veterans with traumatic
			 brain injury</header>
			<subsection id="HD80F2BECB5204B9EAEFF84B16683BD36"><enum>(a)</enum><header>Extension of program</header><text>Subsection (a) of section 1705 of the National Defense Authorization Act for Fiscal Year 2008
			 (<external-xref legal-doc="public-law" parsable-cite="pl/110/181">Public Law 110–181</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/38/1710C">38 U.S.C. 1710C</external-xref> note) is amended by striking <quote>a five-year</quote> and inserting <quote>an eight-year</quote>.</text>
			</subsection><subsection id="HFFCF2311116142FF97FDA5F2DE7D6314"><enum>(b)</enum><header>Modification of locations</header><text>Subsection (b) of such section is amended—</text>
				<paragraph id="H3A3C03D382EE401893BD49A218DE5BED"><enum>(1)</enum><text>by redesignating paragraph (2) as paragraph (3); and</text>
				</paragraph><paragraph id="HFB84D3322FED446E90C2F6B6B917C6C5"><enum>(2)</enum><text>by striking paragraph (1) and inserting the following new paragraphs:</text>
					<quoted-block id="H0E2DE10695DA4A08899E793047E1C911" style="OLC">
						<paragraph id="H21185C0129AF45A4949FEF49029F04E5"><enum>(1)</enum><header>In general</header><text>The pilot program shall be carried out at locations selected by the Secretary for purposes of the
			 pilot program.</text>
						</paragraph><paragraph id="HF2B3D6445F354D9AA403066E1B04CB60"><enum>(2)</enum><header>Located in same region as polytrauma centers</header><text>Of the locations selected under paragraph (1), at least one location shall be in each health care
			 region of the Veterans Health Administration of the Department of Veterans
			 Affairs that contains a polytrauma center of the Department of Veterans
			 Affairs.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HFD6C81BD2C5E41DBABDDEBDE33866551"><enum>(c)</enum><header>Modification of report requirements</header><text>Subsection (e) of such section is amended to read as follows:</text>

					<subsection id="H3C4799A2548C4D29BDF79456E1C1B9B7"><enum>(e)</enum><header>Reports</header>
						<paragraph id="HF108C01BB6174B8E8B3631C448A55CEA"><enum>(1)</enum><header>Quarterly reports</header>
							<subparagraph commented="no" id="H61D6394328214DD186807B22DA0032F4"><enum>(A)</enum><header>In general</header><text>During each 90-day period occurring during the period beginning January 1, 2016, and ending January
			 1, 2018, the Secretary shall submit to the Committees on Veterans’ Affairs
			 of the Senate and the House of Representatives a report on the pilot
			 program.</text>
							</subparagraph><subparagraph id="H97914BA3FCE143B0882DE4092AF30349"><enum>(B)</enum><header>Elements</header><text>Each report submitted under subparagraph (A) shall include the following:</text>
								<clause id="H37D33670B689404AAB53800B8DE2BA26"><enum>(i)</enum><text>The number of individuals that participated in the pilot program during the quarter preceding the
			 submission of the report.</text>
								</clause><clause id="H1DCFE381174749BBB36E669672B8959A"><enum>(ii)</enum><text display-inline="yes-display-inline">The number of individuals that successfully completed the pilot program during the quarter
			 preceding the submission of the report.</text>
								</clause><clause id="H122D1A810EBD48489166145D34E74F72"><enum>(iii)</enum><text>The degree to which pilot program participants and family members of pilot program participants
			 were satisfied with the pilot program.</text>
								</clause><clause id="HCB6F858060F6422E8FE4DCC89467CDC5"><enum>(iv)</enum><text>The interim findings and conclusions of the Secretary with respect to the success of the pilot
			 program and recommendations for improvement.</text>
								</clause></subparagraph></paragraph><paragraph id="HCD6E7C673FC048909584579A5B55CF0E"><enum>(2)</enum><header>Final report</header>
							<subparagraph id="H7F5C1207DE2D40A698275BB22E40877F"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 60 days after the completion of the pilot program, the Secretary shall submit to the
			 Committees on Veterans’ Affairs of the Senate and the House of
			 Representatives a final report on the pilot program.</text>
							</subparagraph><subparagraph id="H43CA0BF2382242EEB5739A402DC448EE"><enum>(B)</enum><header>Elements</header><text>The final report required by subparagraph (A) shall include the following:</text>
								<clause id="H672E0C0298F647759F604ADED54618ED"><enum>(i)</enum><text>A description of the pilot program.</text>
								</clause><clause id="HA0ACBF73B1A94628947F9B06000DA9B9"><enum>(ii)</enum><text>An assessment of the utility of the activities under the pilot program in enhancing the
			 rehabilitation, quality of life, and community reintegration of veterans
			 with traumatic brain injury, including complex mild traumatic brain
			 injury.</text>
								</clause><clause id="HB913825F360C44A1B865BC1A13B7E939"><enum>(iii)</enum><text>An evaluation of the pilot program in light of independent living programs carried out by the
			 Secretary under title 38, United States Code, including—</text>
									<subclause id="H894E3354C7A843E9933E9ECA1C708084"><enum>(I)</enum><text display-inline="yes-display-inline">whether the pilot program duplicates services provided under such independent living programs;</text>
									</subclause><subclause id="H0CB0EA36037B43948B8A6E2BEDDB0EFE"><enum>(II)</enum><text>the ways in which the pilot program provides different services;</text>
									</subclause><subclause id="H3E5633372335408E9244586D323827D2"><enum>(III)</enum><text>how the pilot program could be better defined or shaped; and</text>
									</subclause><subclause id="HC8E69104EE0446A188C1DDE6DFD1EEBF"><enum>(IV)</enum><text display-inline="yes-display-inline">whether the pilot program should be incorporated into such independent living programs.</text>
									</subclause></clause><clause id="H18D6D662BC3A4E3E9B4B4F60E1718543"><enum>(iv)</enum><text>Such recommendations as the Secretary considers appropriate regarding improving the pilot program.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H8AE62322A1904EC49B4ABF8920A99739"><enum>(d)</enum><header>Modification of definitions</header>
				<paragraph id="HC9E073D3735A4FFDB6201CAA240C2778"><enum>(1)</enum><header>Community-based brain injury residential rehabilitative care services</header><text>Such section is further amended—</text>
					<subparagraph id="H4A7FF080D787441AA1F244EA1BB8AE12"><enum>(A)</enum><text>in the section heading, by striking <quote><header-in-text level="section" style="OLC">assisted living</header-in-text></quote> and inserting <quote><header-in-text level="section" style="OLC">community-based brain injury residential rehabilitative care</header-in-text></quote>;</text>
					</subparagraph><subparagraph id="HBA88AA1E37C54ECBA4D1E18BB09EF398"><enum>(B)</enum><text>in subsection (c), in the subsection heading, by striking <quote><header-in-text level="subsection" style="OLC">Assisted Living</header-in-text></quote> and inserting <quote><header-in-text level="subsection" style="OLC">Community-Based Brain Injury Residential Rehabilitative Care</header-in-text></quote>;</text>
					</subparagraph><subparagraph id="H966568946D624106B5AE7D567CDD41D4"><enum>(C)</enum><text>by striking <quote>assisted living</quote> each place it appears, and inserting <quote>community-based brain injury rehabilitative care</quote>; and</text>
					</subparagraph><subparagraph id="H7D15E6EA8E2041B7A3093E00A109C259"><enum>(D)</enum><text>in subsection (f)(1), by striking <quote>and personal care</quote> and inserting <quote>rehabilitation, and personal care</quote>.</text>
					</subparagraph></paragraph><paragraph id="HC40D61160FBD4352842A6A92708B1A29"><enum>(2)</enum><header>Eligible veteran</header><text>Subsection (f)(3) of such section is amended—</text>
					<subparagraph id="HD421C7E0E065488FA3AB2187D5082752"><enum>(A)</enum><text>in subparagraph (C), by striking <quote>; and</quote> and inserting a semicolon;</text>
					</subparagraph><subparagraph id="H6D997C68B1084A749767F7E7003F7690"><enum>(B)</enum><text>in subparagraph (D), by striking the period at the end and inserting <quote>; and</quote>; and</text>
					</subparagraph><subparagraph id="H61F7A023BDBD44208ADBE14EEC348AA9"><enum>(C)</enum><text>by adding at the end the following new subparagraph:</text>
						<quoted-block id="HE8663C3DDFB740B4BA43AE26CA29071E" style="OLC">
							<subparagraph id="H603E0FD8FC2C49CDA50B70499FCB5E04"><enum>(E)</enum><text>has a traumatic brain injury that is classified as complex-mild to severe.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph></subsection><subsection id="HADA20C66A29B4F4B81114D0D32D8011F"><enum>(e)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated for the Department of Veterans Affairs for fiscal year 2015
			 $46,000,000 to carry out the pilot program under section 1705 of the
			 National Defense Authorization Act for Fiscal Year 2008 (Public Law
			 110–181; <external-xref legal-doc="usc" parsable-cite="usc/38/1710C">38 U.S.C. 1710C</external-xref> note), as amended by this section. The amount so
			 authorized to be appropriated shall be available for obligation for the
			 three-year period beginning on October 1, 2014.</text>
			</subsection><subsection id="H95763D94A0604C0489D33759325E4CEB"><enum>(f)</enum><header>Effective date</header><text>The amendments made by this section shall take effect on October 1, 2014.</text>
			</subsection></section><section id="H671B24442676421E81411FC2A945CF14"><enum>3.</enum><header>Improvements to recovery by United States of cost of certain care and services provided by
			 Department of Veterans Affairs</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/38/1729">Section 1729(h)</external-xref> of title 38, United States Code, is amended by adding at the end the following new
			 paragraph:</text>
			<quoted-block display-inline="no-display-inline" id="H0B1A34DF89364CE0B0BA08FF227C773F" style="USC">
				<paragraph id="H7441C16F3AAF4C22AFD8ADABE502BCD8" indent="up1"><enum>(4)</enum>
					<subparagraph commented="no" display-inline="yes-display-inline" id="H2289D29B0C4D4FCB998808A468537725"><enum>(A)</enum><text>Notwithstanding paragraph (3) or section 7332 of this title, the Secretary may make available to
			 third parties medical records of a veteran described in paragraph (2)
			 without the written consent of the veteran if—</text>
						<clause id="HBCDB19EEB256482DB3D926C7D0BE3348" indent="up1"><enum>(i)</enum><text>the care or services furnished to the veteran for which recovery or collection is sought under this
			 section relates to drug abuse, alcoholism or alcohol abuse, infection with
			 the human immunodeficiency virus, or sickle cell anemia; and</text>
						</clause><clause id="HC69BE791D05840E68C5509339CB78776" indent="up1"><enum>(ii)</enum><text>by not later than 30 days after receiving such care or services, the Secretary does not receive
			 from the veteran a notification described in subparagraph (B).</text>
						</clause></subparagraph><subparagraph id="H1772C4D4966D4F188CA2992F1AEDE324" indent="up1"><enum>(B)</enum><text>A notification described in this subparagraph is a notification by a veteran that the veteran does
			 not consent to a disclosure of medical records of the veteran under
			 subparagraph (A).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
