		<section display-inline="no-display-inline" id="id5ECD8B5E94214AB991073A510E365C6A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Rebalance for an Effective Defense Uniform and Civilian Employees Act (REDUCE Act)</short-title></quote>.</text></section><section id="H168FF64F200F45E6BFB60AC1B4DF6210" section-type="subsequent-section"><enum>2.</enum><header>Limitation on number of employees in the Department of Defense</header>
			<subsection id="H22748E125BD444B784FF6C7BF827F919"><enum>(a)</enum><header>Limitation on FTEs</header>
				<paragraph id="H540FCE90AED4441B9654C57D08DE8E4E"><enum>(1)</enum><header>In general</header><text>Notwithstanding the requirements of <external-xref legal-doc="usc" parsable-cite="usc/10/129">section 129</external-xref> of title 10, United States Code, and consistent
			 with the requirements of subsection (d), in each of fiscal years 2021
			 through 2025, the number of full-time equivalent civilian positions in the
			 Department of Defense may not be greater than 85 percent of the number of
			 such positions at the Department as of September 30, 2015, as determined
			 by the Director of the Office of Personnel Management.</text>
				</paragraph><paragraph id="H360F40A03A1D4B75A2B5491A46A30F89"><enum>(2)</enum><header>SES</header><text>Of the positions permitted pursuant to paragraph (1) for fiscal years 2021 through 2025 at the
			 Department of Defense, not more than 1,000 may be career appointee (as
			 defined in <external-xref legal-doc="usc" parsable-cite="usc/5/3132">section 3132(a)(4)</external-xref> of title 5, United States Code) positions
			 within the Senior Executive Service.</text>
				</paragraph></subsection><subsection id="HF682060C546348248058071CA11D4495"><enum>(b)</enum><header>Voluntary reductions</header><text>To achieve the reductions in personnel required by subsection (a), the Secretary of Defense may
			 exercise the authority provided for—</text>
				<paragraph id="H98FC1900C0CC4849A2ED605BA52D55C7"><enum>(1)</enum><text display-inline="yes-display-inline">voluntary separation incentive payments (subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/35">chapter 35</external-xref> of title 5, United States
			 Code); and</text>
				</paragraph><paragraph id="H92219C36852D488BA608CD06F97B0F27"><enum>(2)</enum><text display-inline="yes-display-inline">voluntary early retirement payments (sections 8336(d)(2)(D) and 8414(b)(1)(B) of such title).</text>
				</paragraph></subsection><subsection id="H001263579BE24582A5D5995722270EF2"><enum>(c)</enum><header>Involuntary reductions</header>
				<paragraph id="H9CFAE9DA278E40A4B0057F222453BF5A"><enum>(1)</enum><header>In general</header><text>Beginning on October 1, 2015, if voluntary reductions are inadequate to achieve the limitations
			 provided in subsection (a), the Secretary of Defense shall separate
			 employees using involuntary measures, including reductions in force.</text>
				</paragraph><paragraph id="HBF51E257D9144506A4ACB42B093BA0AA"><enum>(2)</enum><header>RIF application</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, rule, or regulation, when applying retention factors
			 with respect to any employee during any reduction in force under paragraph
			 (1), the Secretary of Defense shall assign greater weight to the
			 performance factor over the other factors if such employee has a summary
			 rating level of <quote>fully successful</quote> or better.</text>
				</paragraph></subsection><subsection id="HBB97A6D488B142D8BE37848FEAC193CB"><enum>(d)</enum><header>Adjustment of limit</header>
				<paragraph id="H4D4C29F44DC84607AD55831162FD3C84"><enum>(1)</enum><header>Determination</header><text>As soon as practicable after the start of each of fiscal years 2021 through 2025, the Secretary of
			 Defense shall determine the difference (if any), expressed as a
			 percentage, between the permanent active duty end strength minimum levels
			 in effect under <external-xref legal-doc="usc" parsable-cite="usc/10/691">section 691(b)</external-xref> of title 10, United States Code, for the
			 current fiscal year and the preceding fiscal year.</text>
				</paragraph><paragraph id="H2239152108814B5798D4E87226A836EF"><enum>(2)</enum><header>Adjustment</header><text>On the date that the determination is made under paragraph (1), the Secretary shall adjust the
			 limitations provided under subsection (a) with respect to the number of
			 total full-time equivalent positions and Senior Executive Service
			 positions by a percentage equal to the percentage determined under
			 paragraph (1).</text>
				</paragraph><paragraph id="H9239586E24804ACCB49A3DC094B9389D"><enum>(3)</enum><header>Achievement of adjustment</header><text>After any adjustment under paragraph (2), in order to achieve the adjusted limitation for the
			 applicable fiscal year, the Secretary (as the case may be)—</text>
					<subparagraph id="H99616042B7FB49B18ED81BC964DE0A84"><enum>(A)</enum><text>may hire individuals to occupy full-time equivalent positions; or</text>
					</subparagraph><subparagraph id="HD45238B89AE545179DFE56871AFFA49A"><enum>(B)</enum><text>shall separate employees occupying such positions using the involuntary procedures provided under
			 subsection (c).</text>
					</subparagraph></paragraph><paragraph id="H9A16ECF5D70D47B7BB02E521E77C6E06"><enum>(4)</enum><header>Limitation on adjustment</header><text display-inline="yes-display-inline">No adjustment may be made under this subsection that would result in the number of full-time
			 equivalent positions and Senior Executive Service positions to be greater
			 than the limitations on the number of such positions provided under
			 subsection (a).</text>
				</paragraph></subsection><subsection id="H741E83F54FCA4600A05558F1AA10D9D6"><enum>(e)</enum><header>Reports</header>
				<paragraph id="H1B13F4D86E644DB49AD971AE5BF04C70"><enum>(1)</enum><header>Secretary of Defense</header><text display-inline="yes-display-inline">The Secretary of Defense—</text>
					<subparagraph id="HC6A322CFC6A3492898D9E50A89CCA253"><enum>(A)</enum><text>shall include a report in the Secretary’s annual budget request for each of fiscal years 2017
			 through 2025 on the progress and impact of the requirements of this Act;
			 and</text>
					</subparagraph><subparagraph id="H7B9E91FF392647C4A0DC2A6A97ED134F"><enum>(B)</enum><text>may, in addition to the report required under subparagraph (A), report to Congress on the impact of
			 such requirements at any time throughout any of such fiscal years.</text>
					</subparagraph></paragraph><paragraph id="HB4F917300EB046A69011E87C452F2664"><enum>(2)</enum><header>GAO</header><text>Not later than 3 years after the date of enactment of this Act, the Administrator of General
			 Services shall submit a report to Congress examining the progress and
			 impact of the requirements of this Act.</text>
				</paragraph></subsection></section></legis-body>
