		<section id="H052997F26BE54278B3B104CA0DABD1C8" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Voluntary Certification Program Act of 2014</short-title></quote>.</text>
		</section><section id="H7A50B8C34DF84584801536EACEF9B673"><enum>2.</enum><header>Voluntary certification programs for air conditioning, furnace, boiler, heat pump, and water heater
			 products</header><text display-inline="no-display-inline">Section 326(b) of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6296">42 U.S.C. 6296(b)</external-xref>) is amended by adding
			 at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="H34E519B8D6194C7FB4F3B635980F6C99" style="OLC">
				<paragraph id="H1A27958AAD1A49DAB76DA0A9D66B1730"><enum>(6)</enum><header>Voluntary certification programs for air conditioning, furnace, boiler, heat pump, and water heater
			 products</header>
					<subparagraph id="H4DD35D3832F44F8FBBD81AC6180460FF"><enum>(A)</enum><header>Definition of basic model group</header><text>In this paragraph, the term <term>basic model group</term> means a set of models—</text>
						<clause id="HD54404EFBDCA43378522EFDC48AFFA09"><enum>(i)</enum><text>that share characteristics that allow the performance of 1 model to be generally representative of
			 the performance of other models within the group; and</text>
						</clause><clause id="H50258A3209FB48D8A5D3ED1823C39992"><enum>(ii)</enum><text>in which the group of products does not necessarily have to share discrete performance.</text>
						</clause></subparagraph><subparagraph id="HC4D51432143847028813D15CF6079536"><enum>(B)</enum><header>Reliance on voluntary certification programs</header><text>For the purpose of testing to verify the performance rating of, or receiving test reports from
			 manufacturers certifying compliance with energy conservation standards and
			 Energy Star specifications established under sections 324A, 325, and 342,
			 the covered products described in paragraphs (3), (4), (5), (9), and (11)
			 of section 322(a) and covered equipment described in subparagraphs (B),
			 (C), (D), (F), (I), (J), and (K) of section 340(1), the Secretary and
			 Administrator shall rely on voluntary certification programs that—</text>
						<clause id="H507F08042DFF42BFA0F7E59C9E776340"><enum>(i)</enum><text>are nationally recognized;</text>
						</clause><clause id="HD07DEB2F2D504779920CD6B5434895F4"><enum>(ii)</enum><text>maintain a publicly available list of all certified products and equipment;</text>
						</clause><clause id="HE4AF9E7227EC42ADB0EA345F323E6B53"><enum>(iii)</enum><text>as determined by the Secretary, annually test not less than 10 percent and not more than 30 percent
			 of the basic model group of a program participant;</text>
						</clause><clause id="H2DF0E484F91C4CDAB68AD63DAE098B24"><enum>(iv)</enum><text>require the changing of the performance rating or removal of the product or equipment from the
			 program, if verification testing determines that the performance rating
			 does not meet the levels the manufacturer has certified to the Secretary;</text>
						</clause><clause id="H14DA1C1FBEF6415D803EB608A2D89C12"><enum>(v)</enum><text>require the qualification of new participants in the program through testing and production of test
			 reports;</text>
						</clause><clause id="H5669F88AF792494EAC0A44E1D29D33EA"><enum>(vi)</enum><text>allow for challenge testing of products and equipment within the scope of the program;</text>
						</clause><clause id="HB8A2C29BFB8F491CBA27F8FB849C24EC"><enum>(vii)</enum><text>require program participants to certify the performance rating of all covered products and
			 equipment within the scope of the program;</text>
						</clause><clause id="H890E5A51AF6E46858A0323CED6DDD3A3"><enum>(viii)</enum><text>are conducted by a certification body that is accredited under International Organization for
			 Standardization/International Electrotechnical Commission (ISO/IEC)
			 Standard 17065;</text>
						</clause><clause id="HA50ED72EC7F646A0B1AC1630F4D3547F"><enum>(ix)</enum><text>provide to the Secretary—</text>
							<subclause id="H957209A1972F43AC94078F17071C0C8F"><enum>(I)</enum><text>an annual report of all test results;</text>
							</subclause><subclause id="HFC86137C226A449A80F6A8EB51C0D4E6"><enum>(II)</enum><text>prompt notification when program testing results in—</text>
								<item id="H5B51A7965EB6400C892FDEF812BF1806"><enum>(aa)</enum><text>the rerating of the performance rating of a product or equipment; or</text>
								</item><item id="HD6110BEDC61E41D09731EC792D4B0243"><enum>(bb)</enum><text>the delisting of a product or equipment; and</text>
								</item></subclause><subclause id="HCDC3FED8F577425E8F1CB05D9A0B88CF"><enum>(III)</enum><text>test reports, on the request of the Secretary or the Administrator, for Energy Star compliant
			 products, which shall be treated as confidential business information as
			 provided for under <external-xref legal-doc="usc" parsable-cite="usc/5/552">section 552(b)(4)</external-xref> of title 5, United States Code
			 (commonly known as the <quote>Freedom of Information Act</quote>);</text>
							</subclause></clause><clause id="HEA668CD51BC6412895F9807F93B6D7C5"><enum>(x)</enum><text>use verification testing that—</text>
							<subclause id="HE4795431D7C544E9B3B197AAC5AD2196"><enum>(I)</enum><text>is conducted by an independent test laboratory that is accredited under International Organization
			 for Standardization/International Electrotechnical Commission
			 (ISO/IEC)
			 Standard 17025 with a scope covering the tested products or equipment;</text>
							</subclause><subclause id="H9140453723C34584929D2DA7B0E6E10B"><enum>(II)</enum><text>follows the test procedures established under this title; and</text>
							</subclause><subclause id="H5166F80F44804BFEA1334172C2D170F5"><enum>(III)</enum><text>notes in each test report any instructions specified by the manufacturer or the representative of
			 the manufacturer for the purpose of conducting the verification testing;
			 and</text>
							</subclause></clause><clause id="H865E075D4CF846BE87E637116DCBDEE7"><enum>(xi)</enum><text>satisfy such other requirements as the Secretary has determined—</text>
							<subclause id="H99758F2BA23140A49EE696B6A9FD0715"><enum>(I)</enum><text>are essential to ensure standards compliance; or</text>
							</subclause><subclause id="H4642B7DDF4EF4620B07BE5A446436077"><enum>(II)</enum><text>have consensus support achieved through a negotiated rulemaking process.</text>
							</subclause></clause></subparagraph><subparagraph id="H2D548FAD3B624AE593AEF17228E83DB6"><enum>(C)</enum><header>Administration</header>
						<clause id="HEEF5763C16414E2F96B9BA2DAEC0E81A"><enum>(i)</enum><header>In general</header><text>The Secretary shall not require—</text>
							<subclause id="H8D3D84D752A0469CB8BAE1CC6F82902E"><enum>(I)</enum><text>manufacturers to participate in a voluntary certification program described in subparagraph (B); or</text>
							</subclause><subclause id="H3F8C018F3E06407EB9B52B562E112E19"><enum>(II)</enum><text>participating manufacturers to provide information that can be obtained through a voluntary
			 certification program described in subparagraph (B).</text>
							</subclause></clause><clause id="H61AA48C75DB44D69B99C0B368ADD0F6A"><enum>(ii)</enum><header>List of covered products</header><text>The Secretary or the Administrator may maintain a publicly available list of covered products and
			 equipment certified under a program described in subparagraph (B) that
			 distinguishes between—</text>
							<subclause id="H10415BFD8A3E4028A88EE55DD3D725FC"><enum>(I)</enum><text>covered products and equipment verified by the program; and</text>
							</subclause><subclause id="H4D36DEA74AFC45A4B26C65E6624CD99E"><enum>(II)</enum><text>products not verified by the program.</text>
							</subclause></clause><clause id="H37A9AEC2B43244CAA4AA0EE7D2EE9A25"><enum>(iii)</enum><header>Reduction of requirements</header><text>Any rules promulgated by the Secretary that require testing of products or equipment for
			 certification of performance ratings shall on average reduce requirements
			 and burdens for manufacturers participating in a voluntary certification
			 program described in subparagraph (B) for the products or equipment
			 relative to other manufacturers.</text>
						</clause><clause id="H3D30904FBA20440D94E01706E1D2EE9F"><enum>(iv)</enum><header>Periodic testing by program nonparticipants</header><text>In addition to certification requirements, the Secretary shall require a manufacturer that does not
			 participate in a voluntary certification program described in subparagraph
			 (B)—</text>
							<subclause id="HC3875FC4CB214B3D8752493F3CB22E0F"><enum>(I)</enum><text>to verify the accuracy of the performance rating of the product or equipment through periodic
			 testing using the testing methods described in clause (iii) or (x) of
			 subparagraph (B); and</text>
							</subclause><subclause id="H38F6D9FC456E44AD962E3458C264A58E"><enum>(II)</enum><text>to provide to the Secretary test results and, on request, test reports verifying the certified
			 performance for each basic model group of the manufacturer.</text>
							</subclause></clause><clause id="H4267129AAFF749209261B590B12391DF"><enum>(v)</enum><header>Restrictions on test laboratories</header>
							<subclause id="H0142A697C9364D99B9B411EB52443F69"><enum>(I)</enum><header>In general</header><text>Subject to subclause (II), with respect to covered products and equipment, a voluntary
			 certification program described in subparagraph (B) shall not be a test
			 laboratory that conducts the testing on products or equipment within the
			 scope of the program.</text>
							</subclause><subclause id="H960577D443414E2EBBDE8F1E9DAC9469"><enum>(II)</enum><header>Limitation</header><text>Subclause (I) shall not apply to Energy Star specifications established under section 324A.</text>
							</subclause></clause><clause id="HCC6B985FF2CD4E3CAB89381A81A89C91"><enum>(vi)</enum><header>Effect on other authority</header><text>Nothing in this paragraph limits the authority of the Secretary or the Administrator to test
			 products or equipment or to enforce compliance with any law (including
			 regulations).</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
