<section id="H0F652ECFF36741F1872A9374F83668F5" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Federal Register Modernization Act</short-title></quote>.</text> </section> 
<section id="H847C86D273AD4861806ACD75B862F1B0"><enum>2.</enum><header>Federal register modernization</header> 
<subsection id="HBB50DAC8E6FA47F5B7AC2A8A4759E018"><enum>(a)</enum><header>References to printing</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/15">Chapter 15</external-xref> of title 44, United States Code, is amended—</text> 
<paragraph id="HBA8B4ACC447E4B5FB8DFC5BD80878BD6"><enum>(1)</enum><text>in section 1502—</text> 
<subparagraph id="HD23178DA05B349658AC70D70613BEC57"><enum>(A)</enum><text>in the heading, by striking <quote><header-in-text level="section" style="USC">printing</header-in-text></quote> and inserting <quote><header-in-text level="section" style="USC">publishing</header-in-text></quote>; and</text> </subparagraph>

<subsection id="H25DFF7DF36E74F388DCC3229BC9D0B52"><enum>(b)</enum><header>Publish defined</header><text><external-xref legal-doc="usc" parsable-cite="usc/44/1501">Section 1501</external-xref> of title 44, United States Code, is amended—</text> 
<paragraph id="H5135CA743532409CB8F06DDFC27F8182"><enum>(1)</enum><text>by striking <quote>; and</quote> at the end of the definition for <quote>person</quote> and inserting a semicolon;</text> </paragraph> 
<paragraph id="HF19AC78FFAB545F7B777E4DAAA0717B5"><enum>(2)</enum><text>by inserting after the definition for <quote>person</quote> the following:</text>

<paragraph id="H0A576694CA20454AA9C9CFFC80C697A7"><enum></enum><text display-inline="yes-display-inline"><term>publish</term> means to circulate for sale or distribution to the public; and</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection> 
<subsection id="HE5A3708906D64648ADAE36D0C2AA429B"><enum>(c)</enum><header>Filing documents with Office amendment</header><text><external-xref legal-doc="usc" parsable-cite="usc/44/1503">Section 1503</external-xref> of title 44, United States Code, is amended to read as follows:</text> 
<quoted-block display-inline="no-display-inline" id="H219C11B263C64B7DBA4782AB3E182A35" style="USC"> 
<section id="HCE6FE5CB6F6C4727A6AF6FFBB6B3DA1D"><enum>1503.</enum><header>Filing documents with Office; notation of time; public inspection; transmission for publishing</header><text display-inline="no-display-inline">The original document required or authorized to be published by <external-xref legal-doc="usc" parsable-cite="usc/44/1505">section 1505</external-xref> of this title shall be filed with the Office of the Federal Register for publication at times established by the Administrative Committee of the Federal Register by regulation. The Archivist of the United States shall cause to be noted on the original of each document the day and hour of filing. Upon filing, the document shall be immediately available for public inspection in the Office. The original shall be retained by the National Archives and Records Administration and shall be available for inspection under regulations prescribed by the Archivist, unless such original is disposed of in accordance with disposal schedules submitted by the Administrative Committee and authorized by the Archivist pursuant to regulations issued under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/33">chapter 33</external-xref> of this title; however, originals of proclamations of the President and Executive orders shall be permanently retained by the Administration as part of the National Archives of the United States. The Office shall transmit to the Government Printing Office, as provided by this chapter, each document required or authorized to be published by <external-xref legal-doc="usc" parsable-cite="usc/44/1505">section 1505</external-xref> of this title. Every Federal agency shall cause to be transmitted for filing the original of all such documents issued, prescribed, or promulgated by the agency.</text></section><after-quoted-block>.</after-quoted-block></quoted-block> </subsection> 
<subsection id="H342F13C6C3EC499FB9576DA0FB9EC829"><enum>(d)</enum><header>Federal Register amendment</header><text><external-xref legal-doc="usc" parsable-cite="usc/44/1504">Section 1504</external-xref> of title 44, United States Code, is amended to read as follows:</text>

<section id="H788309876BFB48788213D06A686B7483"><enum>1504.</enum><header><term>Federal Register</term>; publishing; contents; distribution; price </header><text display-inline="no-display-inline">Documents required or authorized to be published by <external-xref legal-doc="usc" parsable-cite="usc/44/1505">section 1505</external-xref> of this title shall be published immediately by the Government Printing Office in a serial publication designated the <term>Federal Register</term>. The Public Printer shall make available the facilities of the Government Printing Office for the prompt publication of the Federal Register in the manner and at the times required by this chapter and the regulations prescribed under it. The contents of the daily issues shall constitute all documents, required or authorized to be published, filed with the Office of the Federal Register up to the time of the day immediately preceding the day of publication fixed by regulations under this chapter. There shall be published with each document a copy of the notation, required to be made by <external-xref legal-doc="usc" parsable-cite="usc/44/1503">section 1503</external-xref> of this title, of the day and hour when, upon filing with the Office, the document was made available for public inspection. Distribution shall be made at a time in the morning of the day of distribution fixed by regulations prescribed under this chapter. The prices to be charged for the Federal Register may be fixed by the Administrative Committee of the Federal Register established by <external-xref legal-doc="usc" parsable-cite="usc/44/1506">section 1506</external-xref> of this title without reference to the restrictions placed upon and fixed for the sale of Government publications by <external-xref legal-doc="usc" parsable-cite="usc/44/1705">sections 1705</external-xref> and <external-xref legal-doc="usc" parsable-cite="usc/44/1708">1708</external-xref> of this title.</text></section><after-quoted-block>.</after-quoted-block></quoted-block> </subsection> 
<subsection id="H29A6F7366F0E43D0A0993F81C17DF3D8"><enum>(e)</enum><header>Documents To be published in Federal Register</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/44/1505">Section 1505</external-xref> of title 44, United States Code, is amended—</text> 
<paragraph id="H48B5DEBB81784A52B5A3098A05840BE6"><enum>(1)</enum><text>in subsection (b)—</text> 
<subparagraph id="H785D473CD4C74A19A867A3FE9D754E40"><enum>(A)</enum><text>in the heading, by striking <quote><header-in-text level="subsection" style="USC">comments</header-in-text></quote> and inserting <quote><header-in-text level="subsection" style="USC">news commentary</header-in-text></quote>; and</text> </subparagraph> 
<subparagraph id="H37FD3F005E824A7CADCFA4F5A0051BA7"><enum>(B)</enum><text display-inline="yes-display-inline">by striking <quote>comments</quote> and inserting <quote>news commentary</quote>; and</text> </subparagraph></paragraph>

<subparagraph id="HBDBF396C70DB4A60A77448CF5100DC54"><enum>(A)</enum><text>by inserting <quote>telecommunications, the Internet,</quote> after <quote>the press, the radio,</quote>; and</text> </subparagraph> 
<subparagraph id="H625949D2C5E24E30A07E4057D5324ECF"><enum>(B)</enum><text>by striking <quote>and two duplicate originals or two certified copies</quote> and inserting <quote>document</quote>.</text> </subparagraph></paragraph></subsection> 
<subsection id="H055B60B876414A4BA6D3881602ADAA69"><enum>(f)</enum><header>Administrative Committee of the Federal Register amendment</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/44/1506">Section 1506</external-xref> of title 44, United States Code, is amended to read as follows:</text> 
<quoted-block display-inline="no-display-inline" id="HBE5CA1FA51D54AF58BBD1E3342693262" style="USC"> 
<section id="HDA8684D3B3B64B54B8FE2EA91178CE34"><enum>1506.</enum><header>Administrative Committee of the Federal Register; establishment and composition; powers and duties </header><text display-inline="no-display-inline">The Administrative Committee of the Federal Register shall consist of the Archivist of the United States or Acting Archivist, who shall chair the committee, an officer of the Department of Justice designated by the Attorney General, and the Public Printer or Acting Public Printer. The Director of the Federal Register shall act as secretary of the committee. The committee shall prescribe, with the approval of the President, regulations for carrying out this chapter. The regulations shall provide for, among other things—</text> 
<paragraph id="H44E20ACC8211414780542A828FBCE7AC"><enum>(1)</enum><text>the documents which shall be authorized under <external-xref legal-doc="usc" parsable-cite="usc/44/1505">section 1505(b)</external-xref> of this title to be published in the Federal Register;</text> </paragraph> 
<paragraph id="H727162E9048C46AAACBE0248450B7737"><enum>(2)</enum><text>the manner and form in which the Federal Register shall be published;</text> </paragraph> 
<paragraph id="H98DB23F0800C4F919537DAC7F5B834A8"><enum>(3)</enum><text>the manner of distribution to Members of Congress, officers and employees of the United States, or Federal agency, for official use, and the number which shall be available for distribution to the public;</text> </paragraph> 
<paragraph id="H006D61FC950044018E1A2A3DA8C3D69C"><enum>(4)</enum><text>the prices to be charged for individual copies of, and subscriptions to, the Federal Register and any reprints and bound volumes of it;</text> </paragraph> 
<paragraph id="H4D29ABF9F534410DB6E40D3940EB6D13"><enum>(5)</enum><text>the manner and form by which the Federal Register may receive information and comments from the public, if practicable and efficient; and</text> </paragraph> 
<paragraph id="H571D6C0142CD41CBA39AB1E0ABA4EF23"><enum>(6)</enum><text>special editions of the Federal Register.</text></paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block> </subsection> 
<subsection id="H8E547AD34F7841A9B66D8DB2B78583C8"><enum>(g)</enum><header>Code of Federal Regulations amendment</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/44/1510">Section 1510</external-xref> of title 44, United States Code, is amended to read as follows:</text>

<section id="H77E0FA6301C2438D9F33AAB561CF9C6E"><enum>1510.</enum><header>Code of Federal Regulations</header> 
<subsection id="H4A820722AE404AD6A3DB9D319CE2E1D3"><enum>(a)</enum><header>Special edition for codification of agency documents</header><text>The Administrative Committee of the Federal Register, with the approval of the President, may require, from time to time as it considers necessary, the preparation and publication in a special edition of the Federal Register a complete codification of the documents of each agency of the Government having general applicability and legal effect, issued or promulgated by the agency by publication in the Federal Register or by filing with the Administrative Committee, and which are relied upon by the agency as authority for, or are invoked or used by it in the discharge of, its activities or functions, and are in effect as to facts arising on or after dates specified by the Administrative Committee.</text> </subsection> 
<subsection id="HBBDDE4E10B104744B4DCC6DC3B3B6FD4"><enum>(b)</enum><header>Code of Federal Regulations</header><text>A codification prepared under subsection (a) of this section shall be published and shall be designated as the <quote>Code of Federal Regulations</quote>. The Administrative Committee shall regulate the manner and forms of publishing this codification.</text> </subsection> 
<subsection id="H5DAF2258E73A458B8C1F9F4309159AE5"><enum>(c)</enum><header>Supplementation, collation, and republication</header><text display-inline="yes-display-inline">The Administrative Committee shall regulate the supplementation and the collation and republication of the codification with a view to keeping the Code of Federal Regulations as current as practicable. Each unit of codification shall be supplemented and republished at least once each calendar year. The Office of the Federal Register may create updates of each unit of codification from time to time and make the same available electronically or may provide public access using an electronic edition that allows a user to select a specific date and retrieve the version of the codification in effect as of that date.</text> </subsection> 
<subsection id="H0FB8F7FA3232487CA00557AE2463F041"><enum>(d)</enum><header>Preparation and publication by the Federal Register</header><text>The Office of the Federal Register shall prepare and publish the codifications, supplements, collations, and user aids authorized by this section.</text> </subsection> 
<subsection id="HFC5C9CA72F234DBD9D9A5B0E27EABE2D"><enum>(e)</enum><header>Prima facie evidence</header><text>The codified documents of the several agencies published in the Code of Federal Regulations under this section, as amended by documents subsequently filed with the Office and published in the daily issues of the Federal Register, shall be prima facie evidence of the text of the documents and of the fact that they are in effect on and after the date of publication.</text> </subsection> 
<subsection id="HF60E343C588E41AF844593DB045C2EB1"><enum>(f)</enum><header>Regulations</header><text>The Administrative Committee, with approval of the President, shall issue regulations for carrying out this section.</text> </subsection> 
<subsection id="H68D1677093CC4781966B22C10158AA2E"><enum>(g)</enum><header>Exception</header><text>This section does not require codification of the text of Presidential documents published and periodically compiled in supplements to title 3 of the Code of Federal Regulations.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block> </subsection> 
<subsection id="H7503233DAC7E463DBAA7DFD21B5092C7"><enum>(h)</enum><header>Technical and conforming amendments</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/15">chapter 15</external-xref> of title 44, United States Code, is amended by striking the items related to sections 1502, 1503, and 1504 and inserting the following:</text>
