		<official-title>To amend title XVIII of the Social Security Act to adjust the Medicare hospital readmission
			 reduction program to respond to patient disparities, and for other
			 purposes.</official-title>

		<section id="H2017570C253744808989FF759B6B0526" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Establishing Beneficiary Equity in the Hospital Readmission Program Act</short-title></quote>.</text>
		</section><section id="H8D618869F0314F86895A8EF823AC609A"><enum>2.</enum><header>Adjusting the Medicare hospital readmission reduction program to respond to patient disparities</header>
			<subsection id="H2772CAA6AE684443A889EFB5D65F30FF"><enum>(a)</enum><header>Removal of certain readmissions</header><text display-inline="yes-display-inline">Section 1886(q)(5)(E) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395ww">42 U.S.C. 1395ww(q)(5)(E)</external-xref>) is amended by adding
			 at the end the following: <quote>Such term does not include an admission that is classified within one or more of the following:
			 transplants, end-stage renal disease, burns, trauma, psychosis, or
			 substance abuse.</quote> .</text>
			</subsection><subsection id="HE097127F349240668747BF60521D541A"><enum>(b)</enum><header>Adjustment for dual eligible population</header><text>Section 1886(q)(4)(C) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395ww">42 U.S.C. 1395ww(q)(4)(C)</external-xref>) is amended by adding
			 at the end the following new clause:</text>
				<quoted-block display-inline="no-display-inline" id="H15490F3DDA754EDA8476E1203E2D37A2" style="OLC">
					<clause id="H404F77F0C3164E79854D7CA00580EC46"><enum>(iii)</enum><header>Adjustment for dual eligibles</header><text display-inline="yes-display-inline">In applying clause (i), the Secretary shall provide for such risk adjustment as will take into
			 account a hospital’s proportion of inpatients who are full-benefit dual
			 eligible individuals (as defined in section 1935(c)(6)) in order to ensure
			 that hospitals that treat the most vulnerable populations are not unfairly
			 penalized by the program under this subsection.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H07ACA89AA79D4314878FC18B0818E143"><enum>(c)</enum><header>MedPAC study on 30-Day readmission threshold</header><text display-inline="yes-display-inline">The Medicare Payment Advisory Commission shall conduct a study on the appropriateness of using a
			 threshold of 30 days for readmissions under section 1886(q)(5)(E) of the
			 Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395ww">42 U.S.C. 1395ww(q)(5)(E)</external-xref>). The Commission shall
			 submit to Congress a report on such study in its report to Congress in
			 June 2014.</text>
			</subsection><subsection id="H97F7AF137BE34575807AE25DC4A4C475"><enum>(d)</enum><header>Addressing issue of noncompliant patients</header><text display-inline="yes-display-inline">Section 1886(q)(4)(C) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395ww">42 U.S.C. 1395ww(q)(4)(C)</external-xref>), as amended by
			 subsection (b), is further amended by adding at the end the following new
			 clause:</text>
				<quoted-block display-inline="no-display-inline" id="H225A09C4BDD54AB4B637BE8394B5E985" style="OLC">
					<clause id="H8536CBA9F18A48AAADDAA92F809B4B71"><enum>(iv)</enum><header>Consideration of exclusion of noncompliant patient cases based on V codes</header><text display-inline="yes-display-inline">In promulgating regulations to carry out this subsection for the applicable period with respect to
			 fiscal year 2015, the Secretary shall consider the use of V codes for
			 potential exclusions of cases in order to address the issue of
			 noncompliant patients.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HF714D81B6CCE4193834AD67BD71E6E18"><enum>(e)</enum><header>Effective date; budget neutral implementation</header>
				<paragraph id="H200FAF188D444AEFA24D015F6CABA67C"><enum>(1)</enum><text>The amendments made by this section shall be effective for applicable periods with respect to
			 fiscal year 2015 and each succeeding fiscal year.</text>
				</paragraph><paragraph id="H79679EC537B840879D993EF1BA2F1514"><enum>(2)</enum><text>The Secretary of Health and Human Services shall make such payment adjustment to subsection (d)
			 hospitals under the inpatient prospective payment system under section
			 1886 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395ww">42 U.S.C. 1395ww</external-xref>) as may be necessary to
			 ensure that the implementation of the amendments made by this section do
			 not result in an increase in aggregate expenditures under such section.</text>
				</paragraph></subsection></section></legis-body>
