		<section id="H58FA74CDDEE4437985CFA15D02C803C4" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Alaska Bypass Modernization Act of 2014</short-title></quote>.</text>
		</section><section id="H1B7BF5F79FC8458FB15E61B85D31EE79"><enum>2.</enum><header>Alaska bypass mail transportation</header>
			<subsection id="H1A06BBBB453C4074BAA9CC53E7F4D64D"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc" parsable-cite="usc/39/5402">Section 5402</external-xref> of title 39, United States Code, is amended—</text>
				<paragraph id="H620662CF118949C8913CECFC1B2E85D6"><enum>(1)</enum><text>in the section heading by striking <quote><header-in-text level="section" style="USC">Contracts for transportation of mail by air</header-in-text></quote> and inserting <quote><header-in-text level="section" style="USC">Alaska bypass mail transportation</header-in-text></quote>;</text>
				</paragraph><paragraph id="H3E5B554424E84994808B9D71BD480B17"><enum>(2)</enum><text>in subsection (a)—</text>
					<subparagraph id="H0A6BBBD2F5E9439B86A14D689B7DCF28"><enum>(A)</enum><text>by striking paragraphs (2), (7), and (9); and</text>
					</subparagraph><subparagraph id="HF9B42F86E0C04430A814C64F6AAD83C9"><enum>(B)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (3), (4), (5), (6), (8), (10), (11), (12), (13), (14), (15), (16),
			 (17), (18), (19), (20), (21), (22), (23), (24), and (25) as paragraphs (2)
			 through (22), respectively;</text>
					</subparagraph></paragraph><paragraph id="HDDE2BEBDA9984B6592F0B5E844AAC665"><enum>(3)</enum><text>by striking subsections (b) through (f);</text>
				</paragraph><paragraph id="H5324DF077C5E4B038376119600622CE6"><enum>(4)</enum><text>by redesignating subsections (g) through (s) as subsections (c) through (o), respectively;</text>
				</paragraph><paragraph id="HE0FBB319FF4E48F3AF69D85AB0C16035"><enum>(5)</enum><text>by inserting after subsection (a) the following:</text>
					<quoted-block id="H29515B8AD6C14A9FB1CBA3AF6822E5B3" style="OLC">
						<subsection id="H381BF884660D413EA54A0E7F32275CF2"><enum>(b)</enum><header>Efficient transport of Alaska bypass mail</header><text>In selecting a carrier of nonpriority bypass mail to a point in the State of Alaska, the Postal
			 Service shall—</text>
							<paragraph id="H2BD66CCDE6E24660BFEF0B8B37156D34"><enum>(1)</enum><text>ensure a minimum of 1 scheduled flight per week to each nonpriority bypass mail destination with
			 guaranteed capacity for nonpriority bypass mail, subject to the condition
			 that weather conditions, lack of available service, or other extraordinary
			 circumstances do not interfere with the fulfillment of this minimum
			 requirement; and</text>
							</paragraph><paragraph id="HA0EF70BC491F4B299CA7A4686EB706A9"><enum>(2)</enum><text>ensure that any flight that transports nonpriority bypass mail to a nonpriority bypass mail
			 destination and is in addition to the minimum flights required under
			 paragraph (1)—</text>
								<subparagraph id="HFD7301BAD5234BB7A08DB3EAE8CA447B"><enum>(A)</enum><text>is necessary to the delivery of nonpriority bypass mail; and</text>
								</subparagraph><subparagraph id="H97B4125ACE3844CB85EF42F79A884C07"><enum>(B)</enum><text>maximizes the cost efficiency to the Postal Service.</text></subparagraph></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H09BDC3E9F2FA454699CF90EEB3C54254"><enum>(6)</enum><text>in subsection (c)(2) (as redesignated by paragraph (4) of this subsection)—</text>
					<subparagraph id="HB985F4CF247149759EF5B4C19E03E07F"><enum>(A)</enum><text>in subparagraph (E) by striking <quote>(E)(i)</quote> and all that follows through the end of clause (i) and inserting the following:</text>
						<quoted-block id="HA8CC98C0DB5E408F831D331C5210F9CE" style="OLC">
							<subparagraph id="HD70FF2EFF04542AE84DBA67BAC4B68F2" indent="up1"><enum>(E)</enum>
								<clause commented="no" display-inline="yes-display-inline" id="H3F63C21912DD47E58D8564ACD571C01F"><enum>(i)</enum><text>may offer tender of nonpriority mainline bypass mail at mainline rates to a bush carrier operating
			 from an acceptance point to a hub point in the State of Alaska, in
			 addition to the terms of subparagraph (C); and</text></clause></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="H3B3663DC85D04FF1AEDE36A22A483079"><enum>(B)</enum><text>by striking subparagraph (F) and inserting the following:</text>
						<quoted-block id="H3DF873F5A03B4BA99E1042ED5DE21592" style="OLC">
							<subparagraph id="H93DF7C2FB290481DB9D7EB129F29B441" indent="up1"><enum>(F)</enum><text>shall offer equitable tender of nonpriority bypass mail in proportion to passenger and nonmail
			 freight pools described in this section between qualified passenger and
			 nonmail freight carriers on a route from an acceptance point to a bush
			 destination in the State of Alaska at a composite rate if—</text>
								<clause id="HF9FE5ECCF9174084A3C2EB4335B28ED7"><enum>(i)</enum>
									<subclause commented="no" display-inline="yes-display-inline" id="H21D8E0E544C241E78E82C98DE73F161F"><enum>(I)</enum><text>for a passenger carrier, the carrier receiving the composite rate provided passenger service in
			 accordance with the requirements of subsection (d)(2); or</text>
									</subclause><subclause id="H7241BA4CBF3C455792F21505E7A157BA" indent="up1"><enum>(II)</enum><text>for a nonmail freight carrier, the carrier receiving the composite rate provided at least 25
			 percent of the nonmail freight service for the 12 months immediately
			 preceding the date on which the carrier seeks tender of such mail;</text>
									</subclause></clause><clause id="H61F6AB6BD79244EA96C0759C9D99E6A9"><enum>(ii)</enum><text>the carrier qualifies under subsection (d) to be tendered nonpriority bypass mail out of the hub
			 point being bypassed;</text>
								</clause><clause id="H66ECE6DA33954C32929705E4C43614DE"><enum>(iii)</enum><text>the tender of such mail will not decrease efficiency of delivery of nonpriority bypass mail service
			 into or out of the hub point being bypassed; and</text>
								</clause><clause id="H78ECD3B128954761901A16DB980954F5"><enum>(iv)</enum><text>such tender will result in reduced payments to the carrier by the Postal Service over flying the
			 entire route; and</text></clause></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="H8584A7BF8A4542FDA9502DC0D190780C"><enum>(C)</enum><text>in subparagraph (G) by striking <quote>notwithstanding subparagraph (F),</quote>; and</text>
					</subparagraph><subparagraph commented="no" id="H828914F4F9C3451384D92072BEB016C1"><enum>(D)</enum><text>in the matter following subparagraph (G) by striking <quote>subparagraph (G)</quote> and inserting <quote>subparagraphs (F) and (G)</quote>; and</text>
					</subparagraph></paragraph><paragraph id="H0AFC6D0AD131408CA7190EE72582F607"><enum>(7)</enum><text display-inline="yes-display-inline">in subparagraph (c)(4)(A) (as redesignated by paragraph (4) of this subsection) by striking <quote>subparagraph (B)</quote> and inserting <quote>subparagraph (B), paragraph (2)(E),</quote>.</text>
				</paragraph></subsection><subsection id="HA0960BE653A94093B4303306C9778699"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections for chapter 54 of such title is amended by striking the item relating to
			 section 5402 and inserting the following:</text>

			<subsection id="HCD488360E9F54666823BA6D9F9811D01"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">At the end of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/39/54">chapter 54</external-xref> of title 39, United States Code, add the following:</text>

					<section id="H57C1224868244F07926E3F150820ABF4"><enum>5404.</enum><header>Contracts for foreign and interstate air transportation</header>
						<subsection id="H5880477CCC784E39AD8D8E3B6B519EAD"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section—</text>
							<paragraph id="HAB7B04E2B27F47B3BD64E71FAC00EC23"><enum>(1)</enum><text display-inline="yes-display-inline">the terms <term>air carrier</term>, <term>foreign air carrier</term>, <term>foreign air transportation</term>, and <term>interstate air transportation</term> have the meanings given such terms in <external-xref legal-doc="usc" parsable-cite="usc/49/40102">section 40102(a)</external-xref> of title 49;</text>
							</paragraph><paragraph id="HA85B68C2792649AC8A5C77C3E1234735"><enum>(2)</enum><text>the term <term>certificated air carrier</term> means an air carrier that holds a certificate of public convenience and necessity issued under
			 <external-xref legal-doc="usc" parsable-cite="usc/49/41102">section 41102(a)</external-xref> of title 49;</text>
							</paragraph><paragraph id="HC9A916C069C24BEDA78113D8749DE18A"><enum>(3)</enum><text>the term <term>code-share relationship</term> means a relationship pursuant to which any certificated air carrier or foreign air carrier’s
			 designation code is used to identify a flight operated by another air
			 carrier or foreign air carrier; and</text>
							</paragraph><paragraph id="H4337C224ADF645B9A4868E6CA660CBC7"><enum>(4)</enum><text>the term <term>Secretary</term> means the Secretary of Transportation.</text>
							</paragraph></subsection><subsection id="HF4F573D12CEA44AF822ED1FA988E778A"><enum>(b)</enum><header>International mail</header>
							<paragraph id="H0D0B48BDCE474DE9A628B0E5994829FF"><enum>(1)</enum><header>In general</header>
								<subparagraph id="H88B9E2A960374167B6D0654B37A9B5F9"><enum>(A)</enum><header>Use of certificated air carriers; code-share relationships</header><text display-inline="yes-display-inline">Except as otherwise provided in this subsection, the Postal Service may contract for the
			 transportation of mail by aircraft between any of the points in foreign
			 air transportation only with certificated air carriers. A contract may be
			 awarded to a certificated air carrier to transport mail by air between any
			 of the points in foreign air transportation that the Secretary has
			 authorized the carrier to serve either directly or through a code-share
			 relationship with 1 or more foreign air carriers.</text>
								</subparagraph><subparagraph id="HD74FC736E9B14EC5A94D3A37A3012A9D"><enum>(B)</enum><header>Use of foreign air carriers</header><text display-inline="yes-display-inline">If the Postal Service has sought offers or proposals from certificated air carriers to transport
			 mail in foreign air transportation between points, or pairs of points
			 within a geographic region or regions, and has not received offers or
			 proposals that meet Postal Service requirements at a fair and reasonable
			 price from at least 2 such carriers, the Postal Service may seek offers or
			 proposals from foreign air carriers. Where service in foreign air
			 transportation meeting the Postal Service’s requirements is unavailable at
			 a fair and reasonable price from at least 2 certificated air carriers,
			 either directly or through a code-share relationship with 1 or more
			 foreign air carriers, the Postal Service may contract with foreign air
			 carriers to provide the service sought if, when the Postal Service seeks
			 offers or proposals from foreign air carriers, it also seeks an offer or
			 proposal to provide that service from any certificated air carrier
			 providing service between those points, or pairs of points within a
			 geographic region or regions, on the same terms and conditions that are
			 being sought from foreign air carriers.</text>
								</subparagraph><subparagraph id="H592CBB79959C4304B9E9B26A30E75785"><enum>(C)</enum><header>Methodology for determining fair and reasonable prices</header><text display-inline="yes-display-inline">For purposes of this subsection, the Postal Service shall use a methodology for determining fair
			 and reasonable prices for the Postal Service designated region or regions
			 developed in consultation with, and with the concurrence of, certificated
			 air carriers representing at least 51 percent of available ton miles in
			 the markets of interest.</text>
								</subparagraph><subparagraph id="H709FDD4D04A14EBE9EA0D629A9C1F0B8"><enum>(D)</enum><header>Ceiling prices</header><text display-inline="yes-display-inline">For purposes of this subsection, ceiling prices determined pursuant to the methodology used under
			 subparagraph (C) shall be presumed to be fair and reasonable if they do
			 not exceed the ceiling prices derived from—</text>
									<clause id="H72587C0EDB61421991EBA1ADF12F0150"><enum>(i)</enum><text>a weighted average based on market rate data furnished by the International Air Transport
			 Association or a subsidiary unit thereof; or</text>
									</clause><clause id="HF0115C99D8D040429B388D7781D7A90B"><enum>(ii)</enum><text>if such data are not available from those sources, such other neutral, regularly updated set of
			 weighted average market rates as the Postal Service, with the concurrence
			 of certificated air carriers representing at least 51 percent of available
			 ton miles in the markets of interest, may designate.</text>
									</clause></subparagraph><subparagraph id="H716C01DD5D794871A47B5DE05ADEDAB6"><enum>(E)</enum><header>Situations in which concurrence cannot be attained</header><text display-inline="yes-display-inline">If, for purposes of subparagraph (D)(ii), concurrence cannot be attained, the most recently
			 available market rate data described in this paragraph shall continue to
			 apply for the relevant market or markets.</text>
								</subparagraph></paragraph><paragraph id="H608F89EC0B3E452981D078270368F454"><enum>(2)</enum><header>Contract process</header><text display-inline="yes-display-inline">The Postal Service shall contract for foreign air transportation as set forth in paragraph (1)
			 through an open procurement process that will provide—</text>
								<subparagraph id="H5C487AF4F80E4CB489AE76FE76C579EC"><enum>(A)</enum><text display-inline="yes-display-inline">potential offerors with timely notice of business opportunities in sufficient detail to allow them
			 to make a proposal;</text>
								</subparagraph><subparagraph id="HBD4F33A78DDD45A98EE8633C6221240F"><enum>(B)</enum><text display-inline="yes-display-inline">requirements, proposed terms and conditions, and evaluation criteria to potential offerors; and</text>
								</subparagraph><subparagraph id="HE171EB1716AD44409B0E3A37645F715D"><enum>(C)</enum><text display-inline="yes-display-inline">an opportunity for unsuccessful offerors to receive prompt feedback upon request.</text>
								</subparagraph></paragraph><paragraph id="H686D4ADF65374A8293D9177F8D04DCDB"><enum>(3)</enum><header>Emergency or unanticipated conditions; inadequate lift space</header><text>The Postal Service may enter into contracts to transport mail by air in foreign air transportation
			 with a certificated air carrier or a foreign air carrier without complying
			 with the requirements of paragraph (1) or (2) if—</text>
								<subparagraph id="H13BDEBBFEE4A444F9B4BF7CAE86B28AF"><enum>(A)</enum><text display-inline="yes-display-inline">emergency or unanticipated conditions exist that make it impractical for the Postal Service to
			 comply with such requirements; or</text>
								</subparagraph><subparagraph id="H6886C5D48CA546C2A00E732C7FBCD159"><enum>(B)</enum><text display-inline="yes-display-inline">the Postal Service’s demand for lift exceeds the space available to the Postal Service under
			 existing contracts and—</text>
									<clause id="HA1B27DAFC11D459887D1D3484386AD17"><enum>(i)</enum><text>there is insufficient time available to seek additional lift using procedures that comply with
			 those requirements without compromising the Postal Service’s service
			 commitments to its own customers; and</text>
									</clause><clause id="H28029194BED943438E785F4A954C39F8"><enum>(ii)</enum><text>the Postal Service first offers any certificated air carrier holding a contract to carry mail
			 between the relevant points the opportunity to carry such excess volumes
			 under the terms of its existing contract.</text>
									</clause></subparagraph></paragraph></subsection><subsection id="H8EE6D3D4023B40B2B16C108DABCF4C69"><enum>(c)</enum><header>Good-Faith effort required</header><text display-inline="yes-display-inline">The Postal Service and potential offerors shall put a good-faith effort into resolving disputes
			 concerning the award of contracts made under subsection (b).</text>
						</subsection><subsection id="HB4CFEFF136A347D39298241EF97C20B1"><enum>(d)</enum><header>Special circumstances</header><text display-inline="yes-display-inline">If the Postal Service determines that service by certificated air carriers or combination of air
			 carriers between any pair or pairs of points in foreign air transportation
			 is not adequate for its purposes, the Postal Service may contract, without
			 advertising for bids, in such manner and under such terms and conditions
			 as the Postal Service may deem appropriate, with any air taxi operator or
			 combination thereof for such air transportation service. Contracts made
			 under this subsection may be renewed at the existing rate by mutual
			 agreement between the holder and the Postal Service. The Postal Service,
			 with the consent of the air taxi operator, may adjust the compensation
			 under such contracts for increased or decreased costs occasioned by
			 changed conditions occurring during the contract term. The Postal Service
			 shall cancel such a contract when the Secretary authorizes an additional
			 certificated carrier or carriers to provide service between any pair or
			 pairs of points covered by the contract, and such carrier or carriers
			 inaugurate schedules adequate for its purposes.</text>
						</subsection><subsection id="H176BEEFE580F4586AF9BBDAEF9EE840D"><enum>(e)</enum><header>Transportation of mail by aircraft in interstate air transportation</header>
							<paragraph id="H04330776D7324410B8C344039B92662C"><enum>(1)</enum><header>Determination of rates and contract terms</header><text display-inline="yes-display-inline">The Postal Service may determine rates and contract with any air carrier for the transportation of
			 mail by aircraft in interstate air transportation either through
			 negotiations or competitive bidding.</text>
							</paragraph><paragraph id="HD9ACF77D711D4BB18B32B49F5E32A352"><enum>(2)</enum><header>Mail shipments of live animals</header>
								<subparagraph id="H578D0C98021842E3AC322B3172956A11"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">In the exercise of its authority under paragraph (1), the Postal Service may require any air
			 carrier to accept mail shipments of day-old poultry, honeybees, and such
			 other live animals as postal regulations allow to be transmitted as mail
			 matter. The authority of the Postal Service under this subparagraph shall
			 not apply in the case of any air carrier who commonly and regularly
			 refuses to accept any live animals as cargo.</text>
								</subparagraph><subparagraph id="HD3955717DDC345659C6AB84C8D5ADB6C"><enum>(B)</enum><header>Surcharges</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, the Postal Service is authorized to assess, as postage
			 to be paid by the mailers of any shipments covered by subparagraph (A), a
			 reasonable surcharge that the Postal Service determines in its discretion
			 to be adequate to compensate air carriers for any necessary additional
			 expense incurred in handling such shipments.</text>
								</subparagraph></paragraph></subsection><subsection id="H889BB9F7B49343BD8DD9396B03FDABBF"><enum>(f)</enum><header>Applicability to points within Alaska</header><text display-inline="yes-display-inline">The authority of the Secretary and the Postal Service under subsections (b), (c), and (d), as in
			 effect on September 30, 2008, shall also apply, and the authority of the
			 Postal Service under subsection (e) shall not apply, to the transportation
			 of mail by aircraft between any 2 points both of which are within the
			 State of Alaska and between which the air carrier is authorized by the
			 Secretary to engage in the transportation of mail.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" id="HCB81007B709F42759F832D7C922DD7E9"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections for chapter 54 of such title is amended by adding at the end the following:</text>

			</subsection></section><section id="HFE4EB31522F349B7AE44015345742EF9"><enum>4.</enum><header>Reduction of Alaska bypass mail subsidy</header>
			<subsection id="HCAA4C0E743C64A288BA82830A0F89829"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/39/54">Chapter 54</external-xref> of title 39, United States Code (as amended by this Act), is further amended by adding
			 at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H8619DAD76143400D9437FB3F56702AD1" style="USC">
					<section id="H6F115769266E41D7A966A359F5E7BA89"><enum>5405.</enum><header>Reduction of Alaska bypass mail subsidy</header>
						<subsection id="H69267D9EA83B499FBBD288DA7690F187"><enum>(a)</enum><header>Competitive product classification</header>
							<paragraph id="HE3CD87037514443BB2E0964967B33BB9"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in this section, Alaska bypass mail service under section 5402 shall be treated
			 as a separate competitive product for all purposes.</text>
							</paragraph><paragraph id="HD60F2C0D154247E58BFEDDE92BC62D10"><enum>(2)</enum><header>Transfer prohibited</header><text>No part of Alaska bypass mail service may be transferred to the market-dominant category of mail
			 under section 3642.</text>
							</paragraph><paragraph id="H6CC773D67EBF409DBEEA02C1AC579E6A"><enum>(3)</enum><header>Limitations</header><text display-inline="yes-display-inline">Alaska bypass mail service shall not be treated as a competitive product for purposes of the
			 implementation of sections 3633(a) and 3634.</text>
							</paragraph></subsection><subsection id="HB7F17CF037114E26B4195E095C84AD5B"><enum>(b)</enum><header>Minimum cost coverage</header>
							<paragraph commented="no" id="HEDB022C0275242B08A0968F8FE291FCD"><enum>(1)</enum><header>In general</header><text>The Postal Service shall establish and maintain rates and fees for matter sent by Alaska bypass
			 mail service—</text>
								<subparagraph commented="no" id="HDFF65AD21C1741E49F502C8AC3539B83"><enum>(A)</enum><text>for fiscal year 2015, that cover at least 30 percent of the costs attributable to Alaska bypass
			 mail service in that fiscal year;</text>
								</subparagraph><subparagraph commented="no" id="H6610E6E0C0D04B52AEF2368BAA0B1575"><enum>(B)</enum><text>for fiscal year 2016, that cover at least 34 percent of the costs attributable to Alaska bypass
			 mail service in that fiscal year;</text>
								</subparagraph><subparagraph commented="no" id="HD73FA0EDBB6047DB995B13902EB8C50F"><enum>(C)</enum><text display-inline="yes-display-inline">for fiscal year 2017, that cover at least 38 percent of the costs attributable to Alaska bypass
			 mail service in that fiscal year;</text>
								</subparagraph><subparagraph id="HFB515D968D8A41888E0659D730C83490"><enum>(D)</enum><text display-inline="yes-display-inline">for fiscal year 2018, that cover at least 42 percent of the costs attributable to Alaska bypass
			 mail service in that fiscal year;</text>
								</subparagraph><subparagraph id="HB311999C4B2E49EB85C8647594BCBB29"><enum>(E)</enum><text>for fiscal year 2019, that cover at least 46 percent of the costs attributable to Alaska bypass
			 mail service in that fiscal year; and</text>
								</subparagraph><subparagraph id="H92D0238799D14379AA6A542509887C8F"><enum>(F)</enum><text display-inline="yes-display-inline">for fiscal year 2020, and for each fiscal year thereafter, that cover at least 50 percent of the
			 costs attributable to Alaska bypass mail service in that fiscal year.</text>
								</subparagraph></paragraph><paragraph id="H834BC7123BC04481A6E5D82797627C0E"><enum>(2)</enum><header>Costs attributable</header><text display-inline="yes-display-inline">The costs attributable to Alaska bypass mail service for a fiscal year shall include all the direct
			 and indirect costs of Alaska bypass mail service during that fiscal year
			 that are attributable to that service through reliably identified causal
			 relationships.</text>
							</paragraph><paragraph id="HF3E394E3F63B41E0A71AE80CAAF58B50"><enum>(3)</enum><header>Institutional costs</header><text display-inline="yes-display-inline">Costs that can be attributed to Alaska bypass mail service may not be classified as institutional
			 costs of the Postal Service.</text>
							</paragraph><paragraph id="H9C097BD6DB724866A4BF1F6C6E53483F"><enum>(4)</enum><header>Rate increase limitation</header><text display-inline="yes-display-inline">For fiscal years 2014 through 2020, no rate for any type of Alaska bypass mail service may be
			 increased in a fiscal year by more than the maximum permitted rate
			 increase for market dominant products plus an additional 1 percent.</text>
							</paragraph></subsection><subsection id="H71E2894AD84A43CD8A3095B014144155"><enum>(c)</enum><header>Compliance</header>
							<paragraph id="H7D8E2FCEA8534A8D8BA0EE9A1E43F9F2"><enum>(1)</enum><header>Annual review</header><text display-inline="yes-display-inline">At least once each fiscal year, the Postal Regulatory Commission shall determine whether the Postal
			 Service is in compliance with the requirements under subsection (b).</text>
							</paragraph><paragraph id="H568838BA915E4705BB535244D12F0CBC"><enum>(2)</enum><header>Remedial actions</header><text display-inline="yes-display-inline">If, under paragraph (1), the Postal Regulatory Commission determines that the Postal Service has
			 not complied with the requirements under subsection (b) with respect to a
			 fiscal year, the Commission shall prescribe, not later than 60 days after
			 making such determination, actions to ensure—</text>
								<subparagraph id="HB463C4F011AF48E4A7EB6E06FF008C81"><enum>(A)</enum><text display-inline="yes-display-inline">the establishment and maintenance of rates and fees for Alaska bypass mail service that recover any
			 costs required to have been covered for such fiscal year under subsection
			 (b), but that were not covered, by the date that is not later than the
			 last day of the fiscal year that follows such fiscal year; and</text>
								</subparagraph><subparagraph id="H76477DB412AE40B3850C76C382EDF7AB"><enum>(B)</enum><text>compliance with the requirements under subsection (b) in subsequent fiscal years.</text>
								</subparagraph></paragraph><paragraph id="H1AD31BA2839C4D87B2A63DDD9BA47DC3"><enum>(3)</enum><header>Limitation</header><text display-inline="yes-display-inline">The Postal Regulatory Commission may not order the Postal Service to discontinue Alaska bypass mail
			 service.</text>
							</paragraph><paragraph id="H07F437D20D1144CF8002FD6F24B344D5"><enum>(4)</enum><header>Regulations</header><text>Not later than 90 days after the date of enactment of this subsection, the Postal Regulatory
			 Commission shall issue regulations to implement this subsection.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HA9B80F5E502F4C7398A9D1E0682532E9"><enum>(b)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of sections for chapter 54 of such title (as amended by this Act) is further amended by
			 adding at the end the following:</text>
