		<section id="H14552703C78B45279E97346938A0F46F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Farmer Identity Protection Act</short-title></quote>.</text>
		</section><section id="HA5F2C87F97D2461DB389044DA9D2905E" section-type="subsequent-section"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text>
			<paragraph id="HC78D0709B17D40D88A41862DF47FE1C8"><enum>(1)</enum><text>United States livestock producers supply a vital link in the food supply of the United States,
			 which is listed as a critical infrastructure by the Secretary of Homeland
			 Security;</text>
			</paragraph><paragraph id="HE96EBE810D3942079F4B0B3A8DF98FF9"><enum>(2)</enum><text>domestic terrorist attacks have occurred at livestock operations across the United States,
			 endangering the lives and property of people of the United States;</text>
			</paragraph><paragraph id="HA8078A9011C0484FB6D426792BD256AC"><enum>(3)</enum><text>livestock operations in the United States are largely family owned and operated with most families
			 living at the same location as the livestock operation;</text>
			</paragraph><paragraph id="H2DE162CCC93A4B66AC811286077A9028"><enum>(4)</enum><text>State governments and agencies are the primary authority in almost all States for the protection of
			 water quality under the Federal Water Pollution Control Act (33 U.S.C.
			 1251 et seq.);</text>
			</paragraph><paragraph id="HB0321596E6ED44B5B1AB92F0375EA2C6"><enum>(5)</enum><text>State agencies maintain records on livestock operations and have the authority to address water
			 quality issues where needed; and</text>
			</paragraph><paragraph id="HABEE088D4BA548C5B522F0DA81733778"><enum>(6)</enum><text>there is no discernible environmental or scientifically research-related need to create a database
			 or other system of records of livestock operations in the United States by
			 the Administrator.</text>
			</paragraph></section><section id="HDF3BF2C543C04978B06697137EE664EB"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="H5E1FEC01E40A44E88BC8AF9D0E623A14"><enum>(1)</enum><header>Administrator</header><text>The term <term>Administrator</term> means the Administrator of the Environmental Protection Agency.</text>
			</paragraph><paragraph id="H9B9534C00C464011A0D82CAD321991B6"><enum>(2)</enum><header>Agency</header><text>The term <term>Agency</term> means the Environmental Protection Agency.</text>
			</paragraph><paragraph id="H4640BD0893784963A26997E4218AF522"><enum>(3)</enum><header>Livestock operation</header><text>The term <term>livestock operation</term> includes any operation involved in the raising or finishing of livestock and poultry.</text>
			</paragraph></section><section id="H041022E56C55407E91D496DFBA8D38FD"><enum>4.</enum><header>Procurement and disclosure of information</header>
			<subsection id="H3F3F55E8B6284E1FAFC668B08114E4AB"><enum>(a)</enum><header>Prohibition</header><text>Except as provided in subsection (b), the Administrator, any officer or employee of the Agency, or
			 any contractor or cooperator of the Agency, shall not disclose the
			 information of any owner, operator, or employee of a livestock operation
			 provided to the Agency by a livestock producer or a State agency in
			 accordance with the Federal Water Pollution Control Act (33 U.S.C. 1251 et
			 seq.) or any other law, including—</text>
				<paragraph id="HF3A794B9697248E4B4739C99C43AD720"><enum>(1)</enum><text>names;</text>
				</paragraph><paragraph id="HE19247ECFAB74F7CAD2B140F200A90AE"><enum>(2)</enum><text>telephone numbers;</text>
				</paragraph><paragraph id="HD24231A87C64454E97F721B18E78B6D1"><enum>(3)</enum><text>email addresses;</text>
				</paragraph><paragraph id="HF6E78103F5AF4A70A48FC3BA2AE68D39"><enum>(4)</enum><text>physical addresses;</text>
				</paragraph><paragraph id="HC3B8CE25231E4320A1782BFA8C77E3F6"><enum>(5)</enum><text>Global Positioning System coordinates; or</text>
				</paragraph><paragraph id="H63B8A463FB07461D88CF9036AC4ABE26"><enum>(6)</enum><text>other identifying information regarding the location of the owner, operator, livestock, or
			 employee.</text>
				</paragraph></subsection><subsection id="H240B942B65D54054A31E769B18AA20B1"><enum>(b)</enum><header>Effect</header><text>Nothing in this Act affects—</text>
				<paragraph id="HB891AAE28AA84BFF8D33543C1282054E"><enum>(1)</enum><text>the disclosure of information described in subsection (a) if—</text>
					<subparagraph id="HA23BB0CA07BE4E7FBD64BC698CBC73BE"><enum>(A)</enum><text>the information has been transformed into a statistical or aggregate form at the county level or
			 higher without any information that identifies the agricultural operation
			 or agricultural producer; or</text>
					</subparagraph><subparagraph id="HBE95A5EC462D47E29193740C7685B79B"><enum>(B)</enum><text>the livestock producer consents to the disclosure;</text>
					</subparagraph></paragraph><paragraph id="H25DC8CA54E3A481797A4E840F67F470C"><enum>(2)</enum><text>the authority of any State agency to collect information on livestock operations;</text>
				</paragraph><paragraph id="H9CB318C63CE6458F81C1FEA7441D6DF0"><enum>(3)</enum><text>the authority of the Agency to disclose the information on livestock operations to State or other
			 Federal governmental agencies; or</text>
				</paragraph><paragraph id="H376E3FB3DD304B7689252C725E966842"><enum>(4)</enum><text display-inline="yes-display-inline">the authority of the Agency to maintain the National Pollutant Discharge Elimination System permit
			 program’s public notice and comment process.</text>
				</paragraph></subsection><subsection id="HD9A93D6F5EFF40ED91CB83FEE8AB00C4"><enum>(c)</enum><header>Condition of permit or other programs</header><text>The approval of any permit, practice, or program administered by the Administrator shall not be
			 conditioned on the consent of the livestock producer under subsection
			 (b)(1)(B).</text>
