<official-title display="yes">To amend title 49, United States Code, to allow advertisements and solicitations for passenger air transportation to state the base airfare of the transportation, and for other purposes.<pagebreak/></official-title>

<section id="HE658962A484C41949C171D2EBBF2E752" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Transparent Airfares Act of 2014</short-title></quote>.</text> </section>
<section id="HAE078DB8B0454BBA8851BBCBDE67151D"><enum>2.</enum><header>Advertisements and solicitations for passenger air transportation</header> 
<subsection id="H1DE214BFA6B942EF9A6F95AFE7A6544D"><enum>(a)</enum><header>Full fare advertising</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/49/41712">Section 41712</external-xref> of title 49, United States Code, is amended by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="HF4C2E9EBE1944C44B6625E66F8C417A1" style="USC"> 
<subsection id="HB9EF34A122A4493EB610F37D92982B4F"><enum>(d)</enum><header>Full fare advertising</header> 
<paragraph id="HFC7F55E08A314E6884492E93DF0234B5"><enum>(1)</enum><header>In general</header><text>It shall not be an unfair or deceptive practice under subsection (a) for a covered entity to state in an advertisement or solicitation for passenger air transportation the base airfare for the air transportation if the covered entity clearly and separately discloses—</text> 
<subparagraph id="H5AC171752A1C457D92B2B40EE51224D0"><enum>(A)</enum><text>the government-imposed taxes and fees associated with the air transportation; and</text> </subparagraph>
<subparagraph id="H6FDFB939CF7E4C978EC842F1B06818DB"><enum>(B)</enum><text>the total cost of the air transportation.</text> </subparagraph></paragraph>
<paragraph id="H5C4184B4818E4845AAE4CF964F99DDBA"><enum>(2)</enum><header>Form of disclosure</header> 
<subparagraph id="H4A53C9DD760F44CAAC9C6C197DCCB125"><enum>(A)</enum><header>In general</header><text>For purposes of paragraph (1), the information described in paragraphs (1)(A) and (1)(B) shall be disclosed in the advertisement or solicitation in a manner that clearly presents the information to the consumer.</text> </subparagraph>
<subparagraph id="H3BC06ECE7AA249BA8081074553B7B3E7"><enum>(B)</enum><header>Internet advertisements and solicitations</header><text display-inline="yes-display-inline">For purposes of paragraph (1), with respect to an advertisement or solicitation for passenger air transportation that appears on an Internet Web site, the information described in paragraphs (1)(A) and (1)(B) may be disclosed through a link or pop-up, as such terms may be defined by the Secretary, that displays the information in a manner that is easily accessible and viewable by the consumer.</text> </subparagraph></paragraph>
<paragraph id="H0E9918C6C9AC4BEEB3FBD142A89674B2"><enum>(3)</enum><header>Definitions</header><text>In this subsection, the following definitions apply:</text> 
<subparagraph id="H97632501DC2C43E28EEF6A3DD403A7F3"><enum>(A)</enum><header>Base airfare</header><text>The term <quote>base airfare</quote> means the cost of passenger air transportation, excluding government-imposed taxes and fees.</text> </subparagraph>
<subparagraph id="H6D3CCAB3094641698C3E5C9E81A82343"><enum>(B)</enum><header>Covered entity</header><text display-inline="yes-display-inline">The term <quote>covered entity</quote> means an air carrier, including an indirect air carrier, foreign carrier, ticket agent, or other person offering to sell tickets for passenger air transportation or a tour or tour component that must be purchased with air transportation.</text> </subparagraph></paragraph></subsection><after-quoted-block>. </after-quoted-block></quoted-block> </subsection>
<subsection id="HF1E19BC9DE1B4916949FE7B78D7BDA15"><enum>(b)</enum><header>Limitation on statutory construction</header><text display-inline="yes-display-inline">Nothing in the amendment made by subsection (a) may be construed to affect any obligation of a person that sells air transportation to disclose the total cost of the air transportation, including government-imposed taxes and fees, prior to purchase of the air transportation.</text> </subsection>
<subsection id="HEAE7E228A87D428996ACB9C82500C11B"><enum>(c)</enum><header>Regulations</header><text>Not later than 120 days after the date of enactment of this Act, the Secretary shall issue final regulations to carry out the amendment made by subsection (a).</text> </subsection>
<subsection id="HCE20A4B6F4754F75B6185749B39131EE"><enum>(d)</enum><header>Effective date</header><text>This Act, and the amendments made by this Act, shall take effect on the earlier of—</text> 
<paragraph id="HD54F649F7691417BAF7FFC4E5103D3A1"><enum>(1)</enum><text>the effective date of regulations issued under subsection (c); and</text> </paragraph>
<paragraph id="HBDBB94E9E78341FEBA20D5D289473385"><enum>(2)</enum><text>the date that is 180 days after the date of enactment of this Act.</text> </paragraph></subsection></section>
