		<section id="H2C06428EFD6044448E569C4AF40354B5" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Preservation Enhancement and Savings Opportunity Act of 2014</short-title></quote>.</text>
		</section><section id="H86823AA9B11F4AD495ECA8A11997C333"><enum>2.</enum><header>Distributions and residual receipts</header><text display-inline="no-display-inline">Section 222 of the Low-Income Housing Preservation and Resident Homeownership Act of 1990 (12
			 U.S.C. 4112) is amended by adding at the end the following new subsection:</text>
			<quoted-block id="HC9F8A61177594636B4C72AD60502AC0B" style="OLC">
				<subsection id="HAE7DF9B9C16547B7A74474010EDBF63D"><enum>(e)</enum><header>Distribution and residual receipts</header>
					<paragraph id="H3135A3A20F124436B2AE77578FB11BD5"><enum>(1)</enum><header>Authority</header><text display-inline="yes-display-inline">After the date of the enactment of the <short-title>Preservation Enhancement and Savings Opportunity Act of 2014</short-title>, the owner of a property subject to a plan of action or use agreement pursuant to this section
			 shall be entitled to distribute—</text>
						<subparagraph id="HC79018826FE4462F9AC6BB869A8A26FD"><enum>(A)</enum><text>annually, all surplus cash generated by the property; and</text>
						</subparagraph><subparagraph id="HE939210B49474BE5AA657B09479BB436"><enum>(B)</enum><text display-inline="yes-display-inline">upon request made to the Secretary and notwithstanding any conflicting provision in such use
			 agreement; any funds accumulated in a residual receipts account, but only
			 if the owner is in material compliance with such use agreement.</text>
						</subparagraph></paragraph><paragraph id="HFCFBC4E1C8204328A2B9A16D931F6D2A"><enum>(2)</enum><header>Operation of property</header><text display-inline="yes-display-inline">An owner that distributes any amounts pursuant to paragraph (1) shall—</text>
						<subparagraph id="HCE730863E22744A7AB7F6F0EE43915F3"><enum>(A)</enum><text>continue to operate the property in accordance with the affordability provisions of the use
			 agreement for the property for the remaining useful life of the property;</text>
						</subparagraph><subparagraph id="H276261F5BAC44FD4965FF85571BC5828"><enum>(B)</enum><text>as required by the plan of action for the property, continue to renew or extend any project-based
			 rental assistance contract for a term of not less than 20 years; and</text>
						</subparagraph><subparagraph id="HCD5211E1140848939EA0112AEF47551D"><enum>(C)</enum><text>if the owner has an existing multi-year project-based rental assistance contract for less than 20
			 years, have the option to extend the contract to a 20-year term.</text>
						</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H629F6D340C3A4ADEBF0863B87042ADAD"><enum>3.</enum><header>Future refinancings</header><text display-inline="no-display-inline">Section 214 of the Low-Income Housing Preservation and Resident Homeownership Act of 1990 (12
			 U.S.C. 4104) is amended by adding at the end the following new subsection:</text>
			<quoted-block id="H740E70372FA5424E9A252E9013090C56" style="OLC">
				<subsection id="H6BC483F0032F459F922C40C1F1E211BD"><enum>(c)</enum><header>Future financing</header><text>Neither this section, nor any plan of action or use agreement implementing this section, shall
			 restrict an owner from obtaining a new loan or refinancing an existing
			 loan secured by the project, or from distributing the proceeds of such a
			 loan; except that, in conjunction with such refinancing—</text>
					<paragraph id="HAF81426D63E448EFA5D31A87B2706C11"><enum>(1)</enum><text>the owner shall provide for adequate rehabilitation pursuant to a capital needs assessment to
			 ensure long-term sustainability of the property satisfactory to the lender
			 or bond issuance agency;</text>
					</paragraph><paragraph id="H98EF34A15C7441649FFACF7BC56E2F07"><enum>(2)</enum><text>any resulting budget-based rent increase shall include debt service on the new financing,
			 commercially reasonable debt service coverage, and replacement reserves as
			 required by the lender; and</text>
					</paragraph><paragraph id="HEE76376317044153AAC0AFB9136AE6AC"><enum>(3)</enum><text>rent increases for units not covered by a project-based rental subsidy contract or tenant-based
			 rental subsidy shall be limited to 10 percent.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
