		<official-title>To amend the Juvenile Justice and Delinquency Prevention Act of 1974 to eliminate the use of valid
			 court orders to secure lockup of status offenders, and for other purposes.</official-title>

		<section id="H80428B916CFE4D499AB4B5D8FEB98495" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Prohibiting Detention of Youth Status Offenders Act of 2014</short-title></quote>.</text>
		</section><section id="H3F2FF62B610A42AF996C252DDE94E7FD"><enum>2.</enum><header>Deinstitutionalization of status offenders</header><text display-inline="no-display-inline">Section 223 of the Juvenile Justice and Delinquency Prevention Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/5633">42 U.S.C. 5633</external-xref>) is
			 amended—</text>
			<paragraph id="H8534DC205214472ABF42DB02DD9D5382"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)(11)—</text>
				<subparagraph id="H104FE95E73074C419B7E28D91C9F080E"><enum>(A)</enum><text>by striking <quote>shall</quote> the first place it appears;</text>
				</subparagraph><subparagraph id="H6584F5D68C7140F8AAC2D0F32126F1E6"><enum>(B)</enum><text>in subparagraph (A)—</text>
					<clause id="H0E25B9632E564802A6945D117AADA46E"><enum>(i)</enum><text>in clause (i), by inserting <quote>and</quote> at the end;</text>
					</clause><clause id="HB1E3CE35ACD044529BA80B74B72BF9EE"><enum>(ii)</enum><text>in clause (ii), by striking <quote>and</quote> at the end;</text>
					</clause><clause id="HCD999A6EC89C490A90746F51D3DBB1B4"><enum>(iii)</enum><text>by striking clause (iii); and</text>
					</clause><clause id="H494390A9BFB345298B4201DD56AC691D"><enum>(iv)</enum><text>in the matter following clause (iii) by striking <quote>and</quote> at the end;</text>
					</clause></subparagraph><subparagraph id="H35EF23799D0441A79DAADF669BB09B23"><enum>(C)</enum><text>in subparagraph (B), by striking <quote>and</quote> at the end; and</text>
				</subparagraph><subparagraph id="HA80CA17E3D7C43768391999BE0D5C442"><enum>(D)</enum><text>by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="HEB65B7A166C94065890A7EAA37641B0B" style="OLC">
						<subparagraph id="HD3BF3811C31D4AFB82EA89FD61BCEFF2"><enum>(C)</enum><text>if a court determines the juvenile should be placed in a secure detention facility or correctional
			 facility for violating an order described in subparagraph (A)(ii)—</text>
							<clause id="HFEA94083354A4E79B62C4351B9A1F281"><enum>(i)</enum><text display-inline="yes-display-inline">the court shall issue a written order that—</text>
								<subclause id="HAA19F078F84E40F08B60766293288675"><enum>(I)</enum><text display-inline="yes-display-inline">identifies the valid court order that has been violated;</text>
								</subclause><subclause id="H29BFE907938F4C7A90355F4306012480"><enum>(II)</enum><text display-inline="yes-display-inline">specifies the factual basis for determining that there is reasonable cause to believe that the
			 juvenile has violated such order;</text>
								</subclause><subclause id="H1D1C7A0D8CE54171A0EBA07EDA357409"><enum>(III)</enum><text display-inline="yes-display-inline">includes findings of fact to support a determination that there is no appropriate less restrictive
			 alternative available to placing the juvenile in such a facility, with due
			 consideration to the best interest of the juvenile;</text>
								</subclause><subclause id="HBCBD56A4B4754515A8C68641BE082F08"><enum>(IV)</enum><text display-inline="yes-display-inline">specifies the length of time, not to exceed 3 days, that the juvenile may remain in a secure
			 detention facility or correctional facility, and includes a plan for the
			 juvenile’s release from such facility; and</text>
								</subclause><subclause id="HD269FB9A8AEE41CDA744317A718B3E29"><enum>(V)</enum><text display-inline="yes-display-inline">may not be renewed or extended; and</text>
								</subclause></clause><clause id="H85642375263144C29649BA2FDA340C66"><enum>(ii)</enum><text display-inline="yes-display-inline">the court may not issue a second or subsequent order described in clause (i) relating to a
			 juvenile, unless the juvenile violates a valid court order after the date
			 on which the court issues an order described in clause (i);</text>
							</clause></subparagraph><subparagraph id="H54C11F5D28084CA7B5582A3EB65969CD"><enum>(D)</enum><text display-inline="yes-display-inline">there are procedures in place to ensure that any juvenile held in a secure detention facility or
			 correctional facility pursuant to a court order described in this
			 paragraph does not remain in custody longer than 3 days (with the
			 exception of weekends and holidays) or the length of time authorized by
			 the court, or authorized under applicable State law, whichever is
			 shorter;</text>
						</subparagraph><subparagraph id="H690C7F04F41346E2B749760FF207FB7E"><enum>(E)</enum><text display-inline="yes-display-inline">juvenile status offenders detained or confined in a secure detention facility or correctional
			 facility pursuant to a court order as described in this paragraph may only
			 be detained in secure custody one time in any six-month period, provided
			 that all conditions set forth in subsection (D) are satisfied; and</text>
						</subparagraph><subparagraph id="HD6C76E4447174D49A246A682D2D179E9"><enum>(F)</enum><text display-inline="yes-display-inline">not later than one year after the date of enactment of this subparagraph, with a single one-year
			 extension if the State can demonstrate hardship as determined by the
			 Administrator, the State will eliminate the use of valid court orders as
			 described in paragraph (A)(ii) to provide secure lockup of status
			 offenders;</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block>
				</subparagraph></paragraph><paragraph id="HF8FF5096F13F4676A070712D61C796D2"><enum>(2)</enum><text>by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H7717C51735F84C8B95F9709A62F818A9" style="OLC">
					<subsection id="HF723598F07F448DDB741BB4A21B8572A"><enum>(g)</enum><header>Applications for extension for compliance</header><text display-inline="yes-display-inline">States may apply for a single one-year extension to comply with subsection (a)(11). To apply, State
			 must submit an application to the Administrator describing—</text>
						<paragraph id="HDDD52DB800B64DA88C6E2B9A90CC9CD2"><enum>(1)</enum><text>the State’s measurable progress and good faith effort to reduce the number of status offenders who
			 are placed in a secure detention facility or correctional facility
			 pursuant to a court order as described in this paragraph; and</text>
						</paragraph><paragraph id="H5C0AB3FC880648F9893B4F4884167052"><enum>(2)</enum><text>the State’s plan to come into compliance not later than 1 year after the date of extension.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
