			 provide for resale royalties, and for other purposes.</official-title>

		<section id="H3AD7C3B82DB04565AA587300C6BC44CE" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>American Royalties Too Act of 2014</short-title></quote>.</text>
		</section><section id="H4977CB35324C45EB922D26522EABE02B"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/17/101">Section 101</external-xref> of title 17, United States Code, is amended—</text>
			<paragraph id="H1215BA8987734D38ABADE9EBF629C12B"><enum>(1)</enum><text>by inserting after the definition of <term>architectural work</term> the following:</text>
				<quoted-block display-inline="no-display-inline" id="HDCC486803C534085A92CB879ACEF1DDD" style="USC"><list level="paragraph"><list-item>An <term>auction</term> means a public sale at which a work of visual art is sold to the highest bidder and which is run
			 by an entity that sold not less than $1,000,000 of works of visual art
			 during the previous year.</list-item></list><after-quoted-block>;</after-quoted-block></quoted-block>
			</paragraph><paragraph id="H02CC3665848F4772A393D77EA47DCCA9"><enum>(2)</enum><text>by inserting after the definition of <term>Pictorial, graphic, and sculptural works</term> the following:</text>
				<quoted-block display-inline="no-display-inline" id="HA68B7B19E6DD40FFADC57969FDCD63F2" style="USC"><list level="paragraph"><list-item>For purposes of section 106(b), <term>price</term> means the aggregate of all installments paid in cash or in-kind by or on behalf of a purchaser for
			 a work of visual art as the result of the auction of that work.</list-item></list><after-quoted-block>;</after-quoted-block></quoted-block>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H673DFD3FCC1548C091216CFA12AB13DE"><enum>(3)</enum><text>by inserting after the definition of <term>registration</term> the following:</text>
				<quoted-block display-inline="no-display-inline" id="HC91D46A71D394E7099A9A6DDBC230B2A" style="USC"><list level="paragraph"><list-item>For purposes of sections 106(b) and 701(b)(5), <term>sale</term> means transfer of ownership or physical possession of a work of visual art as the result of the
			 auction of that work.</list-item></list><after-quoted-block>; and</after-quoted-block></quoted-block>
			</paragraph><paragraph id="H97F00F4EF37741FEBD32ADE99C727415"><enum>(4)</enum><text>in the definition of <term>work of visual art</term>, by striking <quote>A <quote>work of visual art</quote> is—</quote> and all that follows through <quote>by the author.</quote> and inserting the following: <quote>A <quote>work of visual art</quote> is a painting, drawing, print, sculpture, or photograph, existing either in the original
			 embodiment or in a limited edition of 200 copies or fewer that bear the
			 signature or other identifying mark of the author and are consecutively
			 numbered by the author, or, in the case of a sculpture, in multiple cast,
			 carved, or fabricated sculptures of 200 or fewer that are consecutively
			 numbered by the author and bear the signature or other identifying mark of
			 the author.</quote>.</text>
			</paragraph></section><section id="H958A578D9B784A94A40221F19D044A64"><enum>3.</enum><header>Exclusive rights</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/17/106">Section 106</external-xref> of title 17, United States Code, is amended—</text>
			<paragraph id="H242D4622685D4BEFB3529D134C201564"><enum>(1)</enum><text display-inline="yes-display-inline">by inserting <quote>(a) <header-in-text level="subsection" style="USC">In general.—</header-in-text></quote> before <quote>Subject to sections 107 through 122</quote>;</text>
			</paragraph><paragraph id="HF5545F5A3AC84195BCFE1C23E036095B"><enum>(2)</enum><text>in paragraph (5), by striking <quote>and</quote> at the end;</text>
			</paragraph><paragraph id="H8D5D93960F2B4BFEA6124001771436BF"><enum>(3)</enum><text>in paragraph (6), by striking the period at the end and inserting <quote>; and</quote>; and</text>
			</paragraph><paragraph id="HDA86EC8E3E864F6D97E2B1951521CC9C"><enum>(4)</enum><text>by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HB897D1D572D94577B298A944CA4CC231" style="USC">
					<paragraph commented="no" id="H63F0BA4813CC4075A40ACAABCFECF23A"><enum>(7)</enum><text display-inline="yes-display-inline">in the case of a work of visual art, to collect a royalty for the work if the work is sold by a
			 person other than the author of the work for a price of not less than
			 $5,000 as the result of an auction.</text>
					</paragraph><subsection id="H626BD77F366D4A938BB2E6CA10C86618"><enum>(b)</enum><header>Collection of royalty</header>
						<paragraph id="HD84D7C6F84BB411A985DF717542348DA"><enum>(1)</enum><header>In general</header><text>The collection of a royalty under subsection (a)(7) shall be conducted in accordance with this
			 subsection.</text>
						</paragraph><paragraph id="HA906A98734724DF89294B7EB664A24A9"><enum>(2)</enum><header>Calculation of royalty</header>
							<subparagraph id="H28256D6F8B494133BF75F45BED877A0E"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The royalty shall be an amount equal to the lesser of—</text>
								<clause id="HF001D5DBC381466094199EAAED8CF29A"><enum>(i)</enum><text>5 percent of the price paid for the work of visual art; or</text>
								</clause><clause id="H4F92DE64D5F14BFC8F1A827AB40FEA98"><enum>(ii)</enum><text>$35,000.</text>
								</clause></subparagraph><subparagraph id="H0604797D6BAB499DAD531CBD616F04DD"><enum>(B)</enum><header>Adjustment of amount</header><text display-inline="yes-display-inline">In 2015 and each year thereafter, the dollar amount described in subparagraph (A)(ii) shall be
			 increased by an amount equal to the product of—</text>
								<clause id="H6180229892964F06A34DED3DDE313780"><enum>(i)</enum><text display-inline="yes-display-inline">that dollar amount; and</text>
								</clause><clause id="HB69C6EF2446E482DAA3DB03B05161B1D"><enum>(ii)</enum><text display-inline="yes-display-inline">the cost-of-living adjustment determined under <external-xref legal-doc="usc" parsable-cite="usc/26/1">section 1(f)(3)</external-xref> of the Internal Revenue Code of 1986
			 for the year, determined by substituting <quote>calender year 2015</quote> for <quote>calendar year 1992</quote> in subparagraph (B) thereof.</text>
								</clause></subparagraph></paragraph><paragraph id="H3B1BFCA0761A4B378E710FA9A20C95F3"><enum>(3)</enum><header>Collection of royalty</header>
							<subparagraph id="H52AE7C109B634CB8AB20EE67E367A992"><enum>(A)</enum><header>Collection</header><text display-inline="yes-display-inline">Not later than 90 days after the date on which the auction occurs, the entity that conducts the
			 auction shall—</text>
								<clause id="H21C97CCDF99A4DCF846A7979619DF9A4"><enum>(i)</enum><text display-inline="yes-display-inline">collect the royalty; and</text>
								</clause><clause id="HB776C9F2DB244995B6A61965B917F8DE"><enum>(ii)</enum><text display-inline="yes-display-inline">pay the royalty to a visual artists’ copyright collecting society.</text>
								</clause></subparagraph><subparagraph id="H4D6B394D9FB14596A0644AC91E241324"><enum>(B)</enum><header>Distribution</header><text display-inline="yes-display-inline">Not fewer than 4 times each year, the visual artists’ copyright collecting society shall distribute
			 to the author or his or her successor as copyright owner an amount equal
			 to the difference between—</text>
								<clause id="H6C80CD2D624242D9A9035AFE83DA31F1"><enum>(i)</enum><text display-inline="yes-display-inline">the net royalty attributable to the sales of the author; and</text>
								</clause><clause id="H9CF77061902E44DEA8BE6FCEF5A1A6BA"><enum>(ii)</enum><text display-inline="yes-display-inline">the reasonable administrative expenses of the collecting society as determined by regulations
			 issued under section 701(b)(5).</text>
								</clause></subparagraph></paragraph><paragraph id="HF0607F9CCD3E4CD88130AC6CA788574B"><enum>(4)</enum><header>Failure to pay royalty</header><text display-inline="yes-display-inline">Failure to pay a royalty provided for under this subsection shall—</text>
							<subparagraph id="HD17D0C99902B4A2B96F2C04843EEECFF"><enum>(A)</enum><text display-inline="yes-display-inline">constitute an infringement of copyright; and</text>
							</subparagraph><subparagraph id="HA23F1399BFC14A7AB5687D0ADE6C5FFF"><enum>(B)</enum><text display-inline="yes-display-inline">be subject to—</text>
								<clause id="H2F00A8A127EF47E3B4676EADC9B3D2C4"><enum>(i)</enum><text>the payment of statutory damages under section 504(c); and</text>
								</clause><clause id="HB7220D40FBEA40F49B7FB1EC669F6748"><enum>(ii)</enum><text>liability for payment of the full royalty due.</text>
								</clause></subparagraph></paragraph><paragraph id="H7EE2681230E4484D9676D4B4412BA309"><enum>(5)</enum><header>Right to collect royalty</header><text display-inline="yes-display-inline">The right to collect a royalty under this subsection may not be sold, assigned, or waived except as
			 provided in section 201.</text>
						</paragraph><paragraph id="H738D835BB6F9414088AC154563138E61"><enum>(6)</enum><header>Eligibility to receive royalty payment</header><text display-inline="yes-display-inline">The royalty shall be paid to—</text>
							<subparagraph id="H6F100F6D60A94D6DBD7AE126F250A402"><enum>(A)</enum><text display-inline="yes-display-inline">any author of a work of visual art—</text>
								<clause id="H94774C1CA925406694DEBBD46EAC96A5"><enum>(i)</enum><text>who is a citizen of or domiciled in the United States;</text>
								</clause><clause id="H4DBAB25DCCD5448CB4463BC8E5E09F62"><enum>(ii)</enum><text>who is a citizen of or domiciled in a country that provides resale royalty rights; or</text>
								</clause><clause id="H6D3429730344440B92D4495C88D4F153"><enum>(iii)</enum><text>whose work of visual art is first created in the United States or in a country that provides resale
			 royalty rights; or</text>
								</clause></subparagraph><subparagraph id="H11710A6CA0A144A3B772410168C8BB4D"><enum>(B)</enum><text>the successor as copyright owner of an author described in subparagraph (A).</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="H81056648C0C44CAD8B41DBB39DEEB8B5"><enum>4.</enum><header>Notice of copyright</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/17/401">Section 401</external-xref> of title 17, United States Code, is amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="HE4B7633DB125412C8BEC6FC8A300F5C1" style="USC">
				<subsection id="HBB7522CD2B0B451A9BF170EBA429B8A9"><enum>(e)</enum><header>Non-Applicability to works of visual art</header><text display-inline="yes-display-inline">The provisions of this section shall not apply to a work of visual art.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H28D14306BABF4EF59E2A023CB00DE17B"><enum>5.</enum><header>Copyright office</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/17/701">Section 701(b)</external-xref> of title 17, United States Code, is amended by—</text>
			<paragraph id="HBDB09C38D4AF4BAC915435BCEBC6A189"><enum>(1)</enum><text display-inline="yes-display-inline">redesignating paragraph (5) as paragraph (6); and</text>
			</paragraph><paragraph id="HD2AD3E55226B487FA444D9DA19710465"><enum>(2)</enum><text display-inline="yes-display-inline">inserting after paragraph (4) the following:</text>
				<quoted-block display-inline="no-display-inline" id="H2D3F740FFA574F068F45D95B239C7305" style="USC">
					<paragraph id="HFD7E748836024E10826DAC77FDFEED61"><enum>(5)</enum><text>Issue regulations governing visual artists’ copyright collecting societies described in section
			 106, that—</text>
						<subparagraph id="H8B075E07E6F34122856A479AF2A7942F"><enum>(A)</enum><text>establish a process by which an entity is determined to be and designated as a visual artists’
			 copyright collecting society, that—</text>
							<clause id="H14E9396D8A194D68922962E5EC1F4414"><enum>(i)</enum><text display-inline="yes-display-inline">requires that a visual artists’ copyright collecting society authorized to administer royalty
			 collections and distributions under this title shall—</text>
								<subclause id="HD4C3554C9901416F89C67EC347D6A1E5"><enum>(I)</enum><text>have prior experience in licensing the copyrights of authors of works of visual art in the United
			 States; or</text>
								</subclause><subclause id="H0DC673AEFF9B4D69936AC8566EF71312"><enum>(II)</enum><text>have been authorized by not fewer than 10,000 authors of works of visual art, either directly or
			 through reciprocal agreements with foreign collecting societies, to
			 license the rights granted under section 106; and</text>
								</subclause></clause><clause id="HC4F0805375BB4DF2B2810A51A949661B"><enum>(ii)</enum><text display-inline="yes-display-inline">prohibits an entity from being designated as a visual artists’ copyright collecting society if,
			 during a period of not less than 5 years that begins after the date on
			 which the entity is designated as a visual artists’ copyright collecting
			 society, the entity does not distribute directly to each author, or to the
			 successor as copyright owner of each author, the amount of the royalties
			 required to be distributed under section 106(b)(3)(B);</text>
							</clause></subparagraph><subparagraph id="HE75339BE272D4C238DBE4A1AF72D7BF8"><enum>(B)</enum><text>determine a reasonable amount of administrative expenses that a visual artists’ copyright
			 collecting society may deduct from the royalties payable to an author of a
			 work of visual art under section 106(b)(3); and</text>
						</subparagraph><subparagraph id="HE15E42C890B34214A0CEA93602FD3F20"><enum>(C)</enum><text>establish a process by which—</text>
							<clause id="H385C26D5B9EE481F9F0D089F2576ED26"><enum>(i)</enum><text>not less frequently than annually, a visual artists’ copyright collecting society may request from
			 any entity that conducts auctions a list of each work of visual art sold
			 in those auctions that is by an author represented by the collecting
			 society; and</text>
							</clause><clause id="HD263404C36BA4816A246C65FF02E2875"><enum>(ii)</enum><text display-inline="yes-display-inline">an author of a work of visual art may obtain from a visual artists’ copyright collecting society
			 any information requested by the collecting society under clause (i) that
			 relates to a sale of a work of visual art by the author, including the
			 amount of any royalty paid to the collecting society on behalf of the
			 author.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section commented="no" id="H8B14B0C3DC2548099957A1EB233B8AFF"><enum>6.</enum><header>Study required</header><text display-inline="no-display-inline">Not later than 5 years after the date of enactment of this Act, the Register of Copyrights shall—</text>
			<paragraph id="H88F3963FBBB74F6FA6E150C310F910DD"><enum>(1)</enum><text>conduct a study on—</text>
				<subparagraph commented="no" id="H28061663747143448FA244DD4EB5B216"><enum>(A)</enum><text display-inline="yes-display-inline">the effects, if any, of the implementation of this Act, and the amendments made by this Act, on the
			 art market in the United States; and</text>
				</subparagraph><subparagraph commented="no" id="H3B9A6460071040F0AEA0FF16D145B043"><enum>(B)</enum><text display-inline="yes-display-inline">whether the provisions of this Act, and the amendments made by this Act, should be expanded to
			 cover dealers, galleries, or other professionals engaged in the sale of
			 works of visual art; and</text>
				</subparagraph></paragraph><paragraph id="HA272F2AAC6D440ACB3BDD337C4A6B426"><enum>(2)</enum><text display-inline="yes-display-inline">submit to the Committee on the Judiciary of the Senate and the Committee on the Judiciary of the
			 House of Representatives a report on the study described in paragraph (1),
			 including any recommendations for legislation.</text>
			</paragraph></section><section commented="no" display-inline="no-display-inline" id="H6D914EE3C4BE453CA406DD9F59973ED6" section-type="subsequent-section"><enum>7.</enum><header>Effective date</header><text display-inline="no-display-inline">This Act and the amendments made by this Act shall take effect on the date that is 1 year after the
			 date of enactment of this Act.</text>
