		<official-title>To amend title 17, United States Code, to ensure fairness in the establishment of certain rates and
			 fees under sections 114 and 115 of such title, and for other purposes.</official-title>

		<section id="HDBD7992C51E04BFA93C4D71046295C6E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Songwriter Equity Act of 2014</short-title></quote>.</text>
		</section><section id="H47A811B861AE4B4AA7A4F8A4E60D7733"><enum>2.</enum><header>Effect on royalties for underlying works</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/17/114">Section 114(i)</external-xref> of title 17, United States Code, is amended to read as follows:</text>
			<quoted-block display-inline="no-display-inline" id="H2CDC6C4F3A3445EAB3EDA36BB57834A7" style="OLC">
				<subsection id="H0C00DDDF0F6A406F9E7640ADF28A130A"><enum>(i) </enum><header>Effect on royalties for underlying works</header><text display-inline="yes-display-inline">It is the intent of Congress that royalties payable to copyright owners of musical works for the
			 public performance of their works shall not be diminished in any respect
			 as a result of the rights granted in section 106(6).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H4720FAB50CAB473BB1516401C945C30D"><enum>3.</enum><header>Application to sections <enum-in-header>112(e)</enum-in-header> and <enum-in-header>114(f)</enum-in-header> sound recording proceedings</header>
			<subsection id="HF5478C334DF2436F872D46736F511885"><enum>(a)</enum><header>Proceedings not affected</header><text display-inline="yes-display-inline">Neither section 2 of this Act nor the amendment made to <external-xref legal-doc="usc" parsable-cite="usc/17/114">section 114(i)</external-xref> of title 17, United States
			 Code, by such section 2 shall be taken into account in any proceeding to
			 set or adjust the rates and fees payable for the use of sound recordings
			 under section 112(e) or section 114(f) of such title that is pending on,
			 or commenced on or after, the date of the enactment of this Act.</text>
			</subsection><subsection id="HE39554998B354DFCA0CF88D09E85F67B"><enum>(b)</enum><header>Decisions and precedents not affected</header><text display-inline="yes-display-inline">Neither section 2 of this Act nor the amendment made to <external-xref legal-doc="usc" parsable-cite="usc/17/114">section 114(i)</external-xref> of title 17, United States
			 Code, by such section 2 shall have any effect upon the decisions, or the
			 precedents established or relied upon, in any proceeding to set or adjust
			 the rates and fees payable for the use of sound recordings under section
			 112(e) or section 114(f) of such title before the date of the enactment of
			 this Act.</text>
			</subsection></section><section id="H1E25F70730FE4C12BF384474C82BE2E5"><enum>4.</enum><header>Functions of copyright royalty judges</header>
			<subsection id="HDF9BC42F75AF4A0CBEC338E06F7B0575"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/17/801">Section 801(b)(1)</external-xref> of title 17, United States Code, is amended by striking <quote>The rates applicable under sections 114(f)(1)(B), 115, and 116 shall be calculated to achieve the
			 following objectives</quote> and inserting <quote>The rates applicable under sections 114(f)(1)(B) and 116 shall be calculated to achieve the
			 following objectives</quote>.</text>
			</subsection><subsection id="HDC85AD1DA5D54449870C02D73D059A66"><enum>(b)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendment made by subsection (a) shall apply to any proceeding that is pending on, or commenced
			 on or after, the date of the enactment of this Act.</text>
			</subsection></section><section id="H529C938946C14EBFAB1B1D29B5E8215B"><enum>5.</enum><header>Royalty payable under compulsory license</header>
			<subsection id="HB8E1CC5BCAE049DE8F5070F2E9994F33"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/17/115">Section 115(c)(3)(D)</external-xref> of title 17, United States Code, is amended by striking <quote>In addition to the objectives set forth in section 801(b)(1), in establishing such rates and terms,
			 the Copyright Royalty Judges may consider rates and terms under voluntary
			 license agreements described in subparagraphs (B) and (C).</quote> and inserting the following: <quote>The Copyright Royalty Judges shall establish rates and terms that most clearly represent the rates
			 and terms that would have been negotiated in the marketplace between a
			 willing buyer and a willing seller. In establishing such rates and terms,
			 the Copyright Royalty Judges shall base their decision on marketplace,
			 economic, and use information presented by the participants. In
			 establishing such rates and terms, the Copyright Royalty Judges may
			 consider the rates and terms for comparable uses and comparable
			 circumstances under voluntary license agreements.</quote>.</text>
			</subsection><subsection display-inline="no-display-inline" id="H78CD01C5282746C393204CE4D817C18C"><enum>(b)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendment made by subsection (a) shall apply to any proceeding that is pending on, or commenced
			 on or after, the date of the enactment of this Act.</text>
