		<section id="HA9E51FEC3C894D3F925F6A03B3AEB01A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Ensuring Patient Access and Effective Drug Enforcement Act of 2013</short-title></quote>.</text>
		</section><section id="H33E2EC8878C24BCCA891ADEF97893D64"><enum>2.</enum><header>Registration process under Controlled Substances Act</header>
			<subsection id="H91BA2ECC8582417B9880E845AB56A99D"><enum>(a)</enum><header>Definitions</header>
				<paragraph id="HE66167E3A57C45A6B770BC1C301ABBCA"><enum>(1)</enum><header>Consistent with the public health and safety</header><text>Section 303 of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/823">21 U.S.C. 823</external-xref>) is amended by adding at the end the
			 following:</text>
					<quoted-block display-inline="no-display-inline" id="H19D2F9DDD34344739CAF572A15699DC3" style="OLC">
						<subsection id="HEB2E82BBA43245EA987874195798D564"><enum>(j)</enum><text display-inline="yes-display-inline">In this section, the phrase <quote>consistent with the public health and safety</quote> means having a substantial relationship to this Act’s purpose of preventing diversion and abuse of
			 controlled substances.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H8A91251B948A455DB3B04D403BD0D572"><enum>(2)</enum><header>Imminent danger</header><text>Section 304(d) of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/824">21 U.S.C. 824(d)</external-xref>) is amended—</text>
					<subparagraph id="HDE022EB0D0DC46DB860CACBA729D2159"><enum>(A)</enum><text>by striking <quote>(d) The Attorney General</quote> and inserting <quote>(d)(1) The Attorney General</quote>; and</text>
					</subparagraph><subparagraph id="H37975DE457284496846318BE3478E746"><enum>(B)</enum><text>by adding at the end the following:</text>
						<quoted-block display-inline="no-display-inline" id="HF7AB5E690F79405AABFF9104D40D59D6" style="OLC">
							<paragraph id="HF208FE0F955A4D078378A647415EBDB5" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">In this subsection, the term <term>imminent danger</term> means a significant and present risk of death or serious bodily harm that is more likely than not
			 to occur in the absence of an immediate suspension order.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph></subsection><subsection id="H592DF4C2D9534E04AEBEC5F032FF6F8E"><enum>(b)</enum><header>Criminal background checks and drug testing for employees with access to controlled substances</header>
				<paragraph id="H078E9B3AD6614CD087B1ADB88B965142"><enum>(1)</enum><header>Requirements</header><text>Section 303 of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/823">21 U.S.C. 823</external-xref>) is amended by inserting before
			 subsection (j) (as added by subsection (a)(1)) the following:</text>
					<quoted-block display-inline="no-display-inline" id="H305C285C0AC14C1B83334903F998018F" style="OLC">
						<subsection id="HA9ECDA3C268249479B5961937627F805"><enum>(i)</enum>
							<paragraph commented="no" display-inline="yes-display-inline" id="H34CDCC171E7D4F789CA4AB8CA359B170"><enum>(1)</enum><text>The Attorney General shall require all registrants under subsections (a), (b), (d), or (e), as a
			 condition of such registration—</text>
								<subparagraph id="HA8C907C7AA8D490CBD911BCF1A010188" indent="up1"><enum>(A)</enum><text display-inline="yes-display-inline">to obtain a criminal background check on each of the registrant’s employees who has or will have
			 access to facility areas where controlled substances under the
			 registrant’s possession or control are stored, such as a cage, vault, or
			 safe; and</text>
								</subparagraph><subparagraph id="HC52243997B4A4C43BD9A4438D7D038B7" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">to perform drug testing on each such employee in accordance with Federal and State law.</text>
								</subparagraph></paragraph><paragraph id="H45115C612BCB465F8BE7E59938393F56" indent="up1"><enum>(2)</enum><text>The criminal background checks required by paragraph (1) shall be obtained—</text>
								<subparagraph id="HD8B682F9762F4758B2702A54FDF8F339"><enum>(A)</enum><text display-inline="yes-display-inline">periodically, but not more frequently than every 2 years, for all employees of the registrant who
			 are described in paragraph (1)(A); and</text>
								</subparagraph><subparagraph id="H1F40F4AB03FE499DBC87CEB038DB8927"><enum>(B)</enum><text>at the time of hire, for such employees who are hired after the date of enactment of the <short-title>Ensuring Patient Access and Effective Drug Enforcement Act of 2013</short-title>.</text>
								</subparagraph></paragraph><paragraph id="H206D57C4BEFF43F8B61F1B0A63226534" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">The term <term>drug testing</term> means testing designed to detect the illegal use of a controlled substance.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="HD0324B20F72545EDA812CBE1EFBBF6E6"><enum>(2)</enum><header>Conforming change</header><text>Section 304(a) of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/823">21 U.S.C. 823(a)</external-xref>) is amended—</text>
					<subparagraph id="H06121AD6B7EF4D3A85DC7F25D834D78B"><enum>(A)</enum><text>in paragraph (4), by striking <quote>or</quote> at the end;</text>
					</subparagraph><subparagraph id="H2C824B7CD2A44E1C82637EABEF9E1DF5"><enum>(B)</enum><text>in paragraph (5), by striking the period at the end and inserting <quote>; or</quote>; and</text>
					</subparagraph><subparagraph id="H08160EC15DC144D98857F3073258E147"><enum>(C)</enum><text>by adding at the end the following:</text>
						<quoted-block display-inline="no-display-inline" id="HC8B861B0D9064258BB33B9E75BA5D2C4" style="OLC">
							<paragraph id="HF9C41D6534CD4BBE9FE2E3AFC3B22A6D"><enum>(6)</enum><text display-inline="yes-display-inline">has failed to comply with the requirements under section 303(i) (relating to criminal background
			 checks and drug testing).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="H6C1B84D5C24E4DC8BDE7EF3E753E0061"><enum>(3)</enum><header>Alternative civil penalty for failure To comply with criminal background check and drug testing
			 requirements</header>
					<subparagraph id="HD4EA20F2F0C24867BF657066E4398C4B"><enum>(A)</enum><header>Prohibited act</header><text>Section 402(a) of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/842">21 U.S.C. 842(a)</external-xref>) is amended—</text>
						<clause id="HF91C828BFF1D4683A69CB9900C715196"><enum>(i)</enum><text>in paragraph (14), by striking <quote>or</quote> at the end;</text>
						</clause><clause id="HD0EB7EC205304311A6C55C4C494474A9"><enum>(ii)</enum><text>in paragraph (15), by striking the period at the end and inserting <quote>; or</quote>; and</text>
						</clause><clause id="H50E6D1346E5C47379EBBE3F12588A730"><enum>(iii)</enum><text>by inserting after paragraph (15) the following:</text>
							<quoted-block display-inline="no-display-inline" id="H25EFED54F00E4E12981E740BF90CC5B8" style="OLC">
								<paragraph id="H877B369462C94A45AD12E35ED8261764"><enum>(16)</enum><text display-inline="yes-display-inline">who is a registrant to fail to comply with the requirements under section 303(i) (relating to
			 criminal background checks and drug testing);</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</clause></subparagraph><subparagraph id="H9D5EA3C681D7423A902DECF1F70500CA"><enum>(B)</enum><header>Maximum civil penalty of $10,000</header><text display-inline="yes-display-inline">Subsection (c)(1)(B) of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/842">21 U.S.C. 842(c)(1)(B)</external-xref>) is amended by
			 striking <quote>paragraph (5) or (10)</quote> and inserting <quote>paragraph (5), (10), or (16)</quote>.</text>
					</subparagraph></paragraph><paragraph id="H08608286A3744C7392D2C484DD8FD783"><enum>(4)</enum><header>Regulations, guidance</header><text>The Attorney General of the United States shall finalize such regulations and guidance as the
			 Attorney General deems necessary to carry out the amendments made by this
			 subsection.</text>
				</paragraph><paragraph id="H1D2DE76F6FEF4B279BE66430FCD72483"><enum>(5)</enum><header>Applicability</header><text>The amendments made by this subsection shall apply beginning on the date that is 2 years after the
			 date of enactment of this Act.</text>
				</paragraph></subsection><subsection id="HF732DB8F0C9F4ACE90943AB43ABE74A9"><enum>(c)</enum><header>Opportunity To submit corrective action plan prior to revocation or suspension</header><text display-inline="yes-display-inline">Section 304(c) of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/824">21 U.S.C. 824(c)</external-xref>) is amended—</text>
				<paragraph id="H05D88B6EA15B4757BC422059CB070981"><enum>(1)</enum><text>by striking <quote>(c) Before</quote> and inserting <quote>(c)(1) Before</quote>; and</text>
				</paragraph><paragraph id="HD15370C040CE46C180276E0125E7B9DF"><enum>(2)</enum><text>by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H38FA68A5935F45ABA17C252773A843C8" style="OLC">
						<paragraph id="H6DFCC00934A74A528CDF52621C2EA9BB" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">Before revoking or suspending a registration pursuant to section 303, the Attorney General shall—</text>
							<subparagraph id="HFB3A5233B88144EA97F8949DDAE37487"><enum>(A)</enum><text display-inline="yes-display-inline">provide—</text>
								<clause id="H67CFA29D732B4CAABFCF929EEC4C7A55"><enum>(i)</enum><text>notice to the registrant of the grounds for revocation or suspension; and</text>
								</clause><clause id="HA420E0BDADA843B5B14C3622076C2E3A"><enum>(ii)</enum><text>in the case of any such grounds consisting of a violation of law, a specific citation to such law;</text>
								</clause></subparagraph><subparagraph id="HD3C48F76F81F4FB382B747D769D2F112"><enum>(B)</enum><text>give the registrant an opportunity to submit a corrective action plan within a reasonable period of
			 time to demonstrate how the registrant plans to correct the grounds for
			 revocation or suspension; and</text>
							</subparagraph><subparagraph id="HA9CEB95DA48F410EB851B5E92C2993FD"><enum>(C)</enum><text>determine whether—</text>
								<clause id="H876A31931F2249CE84DDC306DDD4740E"><enum>(i)</enum><text>in light of the plan, revocation or suspension proceedings should be discontinued or deferred; or</text>
								</clause><clause id="H04FA26F9F7964B6DA085FEF2C2326B66"><enum>(ii)</enum><text>additional changes need to be made in the corrective action plan.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection></section><section id="H0E8B4F61EF83486491380004A4E7C0ED"><enum>3.</enum><header>Combating Prescription Drug Abuse Working Group</header>
			<subsection id="H0427408361C74919AF2BE16CF6FDED0A"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">There is established the Combating Prescription Drug Abuse Working Group (referred to in this
			 section as the <quote>Working Group</quote>).</text>
			</subsection><subsection id="H624701A4EF70405EA673F5899C54A3C1"><enum>(b)</enum><header>Membership</header>
				<paragraph id="H1517A06750BD47759519D3458B95BC9C"><enum>(1)</enum><header>Appointment</header>
					<subparagraph id="HDD6FFA010E244B6AA47B573D95809346"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the President shall appoint
			 each member of the Working Group.</text>
					</subparagraph><subparagraph id="H4DAFEBBBB4864DB091C7861B7BBBA8B4"><enum>(B)</enum><header>Composition</header><text>The Working Group shall be composed of not more than 20 members and shall include at least 1 and
			 not more than 3 of each of the following:</text>
						<clause id="HE1B517BCBB44436CB6879F5B3EF077A3"><enum>(i)</enum><text display-inline="yes-display-inline">Public policy experts.</text>
						</clause><clause id="HD80F4D82C2C840359CF4C88F1BBEB3E8"><enum>(ii)</enum><text>Representatives of the Drug Enforcement Administration.</text>
						</clause><clause id="HEF333CD9C4EB44B49873B1FA3D8C9A2A"><enum>(iii)</enum><text display-inline="yes-display-inline">Representatives of the Food and Drug Administration.</text>
						</clause><clause id="H2D3C7DA0D6C84BA8A2ED1A69E9612D1B"><enum>(iv)</enum><text display-inline="yes-display-inline">Representatives of the Office of National Drug Control Policy.</text>
						</clause><clause id="HE61EF98AB90F48BE9747CFF0259E5987"><enum>(v)</enum><text display-inline="yes-display-inline">Representatives of patient groups.</text>
						</clause><clause id="HF36E82D9DABE49469168F766D525D07B"><enum>(vi)</enum><text display-inline="yes-display-inline">Representatives of pharmacies.</text>
						</clause><clause id="H570DFDF2831B4D119AE7AD177BC8DB78"><enum>(vii)</enum><text>Representatives of manufacturers of drugs.</text>
						</clause><clause id="HE445087361B541D8BDB89457F5855033"><enum>(viii)</enum><text>Representatives of wholesale distributors of drugs.</text>
						</clause><clause id="H48267B0E68D343659FE2685FFAA8F1B5"><enum>(ix)</enum><text>Representatives of hospitals, physicians, and other health care providers.</text>
						</clause><clause id="H870F3503D3D34650A5A513B77C5077DF"><enum>(x)</enum><text display-inline="yes-display-inline">Representatives of State attorneys general.</text>
						</clause><clause id="HFDEF39F4C8824DB983246411B7E27280"><enum>(xi)</enum><text display-inline="yes-display-inline">Representatives of law enforcement officials, including local law enforcement officials.</text>
						</clause><clause id="HA206F1F44F134711A2EEBCA9A425D27E"><enum>(xii)</enum><text display-inline="yes-display-inline">Representatives of health benefits plans and entities that provide pharmacy benefits management
			 services on behalf of a health benefits plans.</text>
						</clause></subparagraph></paragraph><paragraph id="H4D0397123D0C4F4A85DCAF7647B5C16A"><enum>(2)</enum><header>Co-chairs</header><text display-inline="yes-display-inline">The co-chairs shall be elected by the members of the Working Group. The Working Group shall select
			 for election from the members of the Group two individuals, of whom—</text>
					<subparagraph id="H77E926CF19D24620A0ACA7FE968CCF20"><enum>(A)</enum><text>one shall be a representative of the Federal Government or a State government; and</text>
					</subparagraph><subparagraph id="H7A6C32EC882E4AECB2A61ACD6E6A7491"><enum>(B)</enum><text>one shall be a representative of a non-governmental entity.</text>
					</subparagraph></paragraph><paragraph id="HC0092BAE35E345F389C630FC66842582"><enum>(3)</enum><header>Term; vacancies</header><text>Each member shall be appointed for the life of the Working Group. Any vacancy in the Working Group
			 shall not affect the powers of the Working Group and shall be filled in
			 the same manner in which the original appointment was made.</text>
				</paragraph><paragraph id="HA9399C3DF0134CF3B24F1407C9A27544"><enum>(4)</enum><header>Pay prohibited</header><text display-inline="yes-display-inline">Members of the Working Group shall serve without pay.</text>
				</paragraph></subsection><subsection id="H9EBCDEA7F55046ACA882D4F9A3B358F0"><enum>(c)</enum><header>Meetings</header><text>The Working Group shall meet at the call of the co-chairs. The Working Group shall conduct at least
			 two public meetings, at which the Working Group shall provide opportunity
			 for public comment.</text>
			</subsection><subsection id="HDBE979CF79754AD09B9ADA446AF4718C"><enum>(d)</enum><header>Duties of the Working Group</header>
				<paragraph id="H3DE843E494F04EFD94362DA24D3D1F44"><enum>(1)</enum><header>In general</header><text>The Working Group shall—</text>
					<subparagraph id="H42173077C4364977A80F55D7CAEC70AB"><enum>(A)</enum><text>review and report to Congress on Federal initiatives with respect to efforts to reduce prescription
			 drug diversion and abuse;</text>
					</subparagraph><subparagraph id="H0669898CDDCE4FB6909D2FFD802DC033"><enum>(B)</enum><text>identify gaps and opportunities with respect to ensuring the safe use of prescription drugs with
			 the potential for diversion and abuse;</text>
					</subparagraph><subparagraph id="HF2CFA43BC6484406B83BF66200C38722"><enum>(C)</enum><text display-inline="yes-display-inline">examine recommendations to transfer one or more controlled substances from schedule III to schedule
			 II under the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/801">21 U.S.C. 801 et seq.</external-xref>) to
			 evaluate—</text>
						<clause id="H90007DCA17E948629C2BA77B538E16C6"><enum>(i)</enum><text>the effectiveness of such a transfer in reducing diversion and abuse; and</text>
						</clause><clause id="H7B4E80E67B6040AC883E99762270FCE1"><enum>(ii)</enum><text>any effect of such a transfer on access to prescription drugs for legitimate medical purposes; and</text>
						</clause></subparagraph><subparagraph id="H8B7A14687BE945669B1281BB5C7124E2"><enum>(D)</enum><text>make recommendations on specific ways to reduce the diversion and abuse of prescription drugs.</text>
					</subparagraph></paragraph><paragraph id="H46AF2F2EB99E4B99849B42B9A9ECF6B7"><enum>(2)</enum><header>Report</header>
					<subparagraph id="H9CDD58051C794FC4B946800736D9AB87"><enum>(A)</enum><header>In general</header><text>Not later than one year after the date of the enactment of this Act, the Working Group shall issue
			 a report to Congress that describes the efforts of the Working Group to
			 prevent or reduce prescription drug diversion and abuse to ensure that
			 patients continue to have access to medications.</text>
					</subparagraph><subparagraph id="H94EC3C8E34F54112A29F329DF85AEC0E"><enum>(B)</enum><header>Recommendations</header><text>The report described in subparagraph (A) shall include specific recommendations for the Drug
			 Enforcement Administration, the Food and Drug Administration, and other
			 Federal and State agencies, as appropriate, and shall address the
			 following topics:</text>
						<clause id="H8C5174E5D72145939380F656E9529852"><enum>(i)</enum><text>Systems for prescription drug monitoring.</text>
						</clause><clause id="H446FC28D1BD245A5B49E6A4E7B17E5DE"><enum>(ii)</enum><text display-inline="yes-display-inline">Illegal prescription drug Internet sites and facilities that distribute and fill prescriptions
			 indiscriminately.</text>
						</clause><clause id="HB08A0C8535B242D59699D71C42B090BC"><enum>(iii)</enum><text>Facilitating proper disposal of prescription drugs.</text>
						</clause><clause id="HC9AD27E5C2454B2F8F4F38601EA040B2"><enum>(iv)</enum><text>Identifying active geographic areas in which prescription drug abuse is prevalent.</text>
						</clause><clause id="HF3F39556595848B5A41B04FC667DA0CF"><enum>(v)</enum><text display-inline="yes-display-inline">Ensuring access to prescription drugs for legitimate medical purposes.</text>
						</clause><clause id="H9573C87EB2134ABCAB91E0EA3C509039"><enum>(vi)</enum><text display-inline="yes-display-inline">Improving collaboration among Federal agencies, especially the Drug Enforcement Administration and
			 the Food and Drug Administration, for purposes of coordinating prevention
			 and enforcement efforts to reduce prescription drug diversion and abuse.</text>
						</clause><clause id="HF887B7B36F0348ECB072F6A8EAF66349"><enum>(vii)</enum><text>Improving collaboration among Federal agencies and State agencies for purposes of coordinating
			 prevention and enforcement efforts to reduce prescription drug diversion
			 and abuse.</text>
						</clause><clause id="H4F3EA94D102940EA8E7FF96C7E7EBD31"><enum>(viii)</enum><text>The resource needs for law enforcement with respect to prescription drug abuse.</text>
						</clause><clause id="H1992E11484254CA39C120543D2E3E50D"><enum>(ix)</enum><text>The need for education of providers, patients, parents, and youth on prescription drug abuse.</text>
						</clause><clause id="HA23943D6C5184CD3AB6C62308BBA69F3"><enum>(x)</enum><text>Development of abuse-resistant prescription drug products.</text>
						</clause><clause id="HD9AFD518483A42A296A58779A180AB17"><enum>(xi)</enum><text>Recommendations for reducing robberies, burglaries, and cargo theft of prescription drugs.</text>
						</clause></subparagraph></paragraph></subsection><subsection id="H53F7FFE9C0A24B87953396C3465143BC"><enum>(e)</enum><header>Powers of the Working Group</header>
				<paragraph id="HD1408E1E819F4619B2FB5B18613FC3FE"><enum>(1)</enum><header>Hearings</header><text display-inline="yes-display-inline">The Working Group may, for the purpose of carrying out this section, hold hearings, sit and act at
			 times and places, take testimony, and receive evidence as the Working
			 Group considers necessary.</text>
				</paragraph><paragraph id="HE33280DB1B6E420BB271176C419FFF92"><enum>(2)</enum><header>Information from Federal agencies</header><text display-inline="yes-display-inline">The Working Group may secure directly from any Federal department or agency such information as the
			 Working Group considers necessary to carry out this section. Upon the
			 request of the co-chairs of the Working Group, the head of such department
			 or agency shall furnish such information to the Working Group in a timely
