		<official-title>To amend the Servicemembers Civil Relief Act to require the consent of parties to contracts for the
			 use of arbitration to resolve controversies arising under the contracts
			 and subject to provisions of such Act and to preserve the rights of
			 servicemembers to bring class actions under such Act, and for other
			 purposes.</official-title>

		<section id="H28987F6B608B45D5A3826144B77AA49C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>SCRA Rights Protection Act of 2014</short-title></quote>.</text>
		</section><section id="HDC37920557014829B8C96116875BDF68" section-type="subsequent-section"><enum>2.</enum><header>Election of arbitration to resolve controversies under Servicemembers Civil Relief Act</header>
			<subsection id="HEAC22437CCBC423B9D7899D9F7D446A1"><enum>(a)</enum><header>In general</header><text>Section 102 of the Servicemembers Civil Relief Act (<external-xref legal-doc="usc-appendix" parsable-cite="usc-appendix/50/512">50 U.S.C. App. 512</external-xref>) is amended by adding at the
			 end the following new subsection:</text>
				<quoted-block display-inline="no-display-inline" id="H6EE8B7C26A41457EB0BDFC62C34B3C1F" style="OLC">
					<subsection id="H2716665C561844058D8C175A78AEFC0C"><enum>(d)</enum><header>Written consent required for arbitration</header><text>Notwithstanding any other provision of law, whenever a contract with a servicemember, or a
			 servicemember and the servicemember’s spouse jointly, provides for the use
			 of arbitration to resolve a controversy subject to a provision of this Act
			 and arising out of or relating to such contract, arbitration may be used
			 to settle such controversy only if, after such controversy arises, all
			 parties to such controversy consent in writing to use arbitration to
			 settle such controversy.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H206064329BD64FDB9D5A1761B28415DF"><enum>(b)</enum><header>Applicability</header><text>Subsection (d) of such section, as added by subsection (a), shall apply with respect to contracts
			 entered into, amended, altered, modified, renewed, or extended after the
			 date of the enactment of this Act.</text>
			</subsection></section><section id="H028BD6888C474438B509BC4A9ED5E6C8"><enum>3.</enum><header>Limitation on waiver of rights and protections under Servicemembers Civil Relief Act</header>
			<subsection id="H8A87676B16484311B9682EE1D9C5DF45"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 107(a) of the Servicemembers Civil Relief Act (<external-xref legal-doc="usc-appendix" parsable-cite="usc-appendix/50/517">50 U.S.C. App. 517(a)</external-xref>) is amended—</text>
				<paragraph id="HD09614B948AE4DF4ADCBCA4786D53FA3"><enum>(1)</enum><text display-inline="yes-display-inline">in the second sentence, by inserting <quote>and if it is made after a specific dispute has arisen and the dispute is identified in the waiver</quote> after <quote>to which it applies</quote>; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H504C20CE025B46BAB3A11C9A543AAAAE"><enum>(2)</enum><text>in the third sentence, by inserting <quote>and if it is made after a specific dispute has arisen and the dispute is identified in the waiver</quote> after <quote>period of military service</quote>.</text>
				</paragraph></subsection><subsection id="HAB303C1EDAC24419BC17CD98EB647CD4"><enum>(b)</enum><header>Applicability</header><text>The amendment made by subsection (a) shall apply with respect to waivers made on or after the date
			 of the enactment of this Act.</text>
			</subsection></section><section id="H30CEDE4F95FA4E85B45C6C07564F3E6B"><enum>4.</enum><header>Preservation of right to bring class action under Servicemembers Civil Relief Act</header>
			<subsection id="H538EA2882CB542C68C24BD6C4FFE702E"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 802(a) of the Servicemembers Civil Relief Act (<external-xref legal-doc="usc-appendix" parsable-cite="usc-appendix/50/597a">50 U.S.C. App. 597a(a)</external-xref>) is amended—</text>
				<paragraph id="H7FF6B94C010C4A339B04FE1742ACC086"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1), by striking <quote>and</quote> at the end;</text>
				</paragraph><paragraph id="H0D65A711BCB24D5A968AD7DEBE6C2E56"><enum>(2)</enum><text>in paragraph (2), by striking the period at the end and inserting <quote>; and</quote>; and</text>
				</paragraph><paragraph id="HAD17428C57CE4F6898CC08A5F9FA333F"><enum>(3)</enum><text>by adding at the end the following new paragraph:</text>
					<quoted-block display-inline="no-display-inline" id="HE27101FFB2DE458E8F48AF2B3F0868B8" style="OLC">
						<paragraph id="H1AE80A0D629444CB815D52611BFD99B0"><enum>(3)</enum><text>be a representative party on behalf of members of a class or be a member of a class, in accordance
			 with the Federal Rules of Civil Procedure, notwithstanding any previous
			 agreement to the contrary.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H3EED91E465E64E69BC22391A60637A67"><enum>(b)</enum><header>Construction</header><text>The amendments made by subsection (a) shall not be construed to imply that a person aggrieved by a
			 violation of such Act did not have a right to bring a civil action as a
			 representative party on behalf of members of a class or be a member of a
			 class in a civil action before the date of the enactment of this Act.</text>
