		<section id="H35E1618102944DB08AFBEB519E0C0B82" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Chemical Facility Anti-Terrorism Standards Program Authorization and Accountability Act of 2014</short-title></quote>.</text>
		</section><section id="H24207C3DAB5F457F9A2094193A2FB29C"><enum>2.</enum><header>Chemical Facility Anti-Terrorism Standards Program</header>
			<subsection id="H3BDFBD991D934DFCB726F27785470719"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/101">6 U.S.C. 101 et seq.</external-xref>) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HCE179E6C5D734E25861E910E2611E733" style="OLC">
					<title id="HE866DB88C3FB45E588F61614D076E735"><enum>XXI</enum><header>CHEMICAL FACILITY ANTI–TERRORISM STANDARDS</header>
						<section id="HF4AB768C2CE54DA39D9A683B24E1996F"><enum>2101.</enum><header>Chemical Facility Anti-Terrorism Standards Program</header>
							<subsection id="H60724736360D4B629AD86C7E9003EB66"><enum>(a)</enum><header>Program established</header><text display-inline="yes-display-inline">There is in the Department a Chemical Facility Anti-Terrorism Standards Program. Under such
			 Program, the Secretary shall establish risk-based performance standards
			 designed to protect covered chemical facilities and chemical facilities of
			 interest from acts of terrorism and other security risks and require such
			 facilities to submit security vulnerability assessments and to develop and
			 implement site security plans.</text>
							</subsection><subsection id="HDD3FDCD60AAA41E6BFC9782CBF67692C"><enum>(b)</enum><header>Security measures</header><text>Site security plans required under subsection (a) may include layered security measures that, in
			 combination, appropriately address the security vulnerability assessment
			 and the risk-based performance standards for security for the facility.</text>
							</subsection><subsection id="HDDF8D7C4872B446CA02E0CFA50E1F883"><enum>(c)</enum><header>Approval or disapproval of site security plans</header>
								<paragraph id="H2C5ABFDB885E417DA4A07572A5233CED"><enum>(1)</enum><header>In general</header><text>The Secretary shall review and approve or disapprove each security vulnerability assessment and
			 site security plan under subsection (a). The Secretary may not disapprove
			 a site security plan based on the presence or absence of a particular
			 security measure, but the Secretary shall disapprove a site security plan
			 if the plan fails to satisfy the risk-based performance standards
			 established under subsection (a).</text>
								</paragraph><paragraph id="H977C41D1C89A4418AE4535FC9A90B0E8"><enum>(2)</enum><header>Alternative security programs</header><text display-inline="yes-display-inline">The Secretary may approve an alternative security program established by a private sector entity or
			 a Federal, State, or local authority or pursuant to other applicable laws,
			 if the Secretary determines that the requirements of such program meet the
			 requirements of this section. A covered chemical facility may meet the
			 site security plan requirement under subsection (a) by adopting an
			 alternative security program that has been reviewed and approved by the
			 Secretary under this paragraph.</text>
								</paragraph><paragraph id="H992B5638CF5446BE85AB40F3346379B9"><enum>(3)</enum><header>Site security plan assessments</header><text display-inline="yes-display-inline">In approving or disapproving a site security plan under this subsection, the Secretary shall employ
			 the risk assessment policies and procedures developed under this title. In
			 the case of a covered chemical facility for which a site security plan has
			 been approved by the Secretary before the date of the enactment of this
			 title, the Secretary may not require the resubmission of the site security
			 information solely by reason of the enactment of this title.</text>
								</paragraph><paragraph display-inline="no-display-inline" id="H6929B43DD029421396DD7CE4767C744E"><enum>(4)</enum><header>Consultation</header><text display-inline="yes-display-inline">The Secretary may consult with the Government Accountability Office to investigate the feasibility
			 and applicability a third party accreditation program that would work with
			 industry stakeholders to develop site security plans that may be
			 applicable to all similarly situated facilities. The program would include
			 the development of Program-Specific Handbooks for facilities to reference
			 on site.</text>
								</paragraph></subsection><subsection id="HB1DCE4D466A64026BEDB06C388E51670"><enum>(d)</enum><header>Compliance</header>
								<paragraph display-inline="no-display-inline" id="H637AB34AA43848FE9191CE0A849D8EA5"><enum>(1)</enum><header>Audits and inspections</header>
									<subparagraph id="H840A3A09BD95446D8D1E9888EF99F678"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall conduct the audit and inspection of covered chemical facilities for the purpose
			 of determining compliance with this Act. The audit and inspection may be
			 carried out by a non-Department or nongovernment entity, as approved by
			 the Secretary.</text>
									</subparagraph><subparagraph display-inline="no-display-inline" id="H30E77349DE8646A6B75C9C373240CF00"><enum>(B)</enum><header>Reporting structure</header><text display-inline="yes-display-inline">Any audit or inspection conducted by an individual employed by a nongovernment entity shall be
			 assigned in coordination with the head of audits and inspections for the
			 region in which the audit or inspection is to be conducted. When in the
			 field, any individual employed by a nongovernment entity shall report to
			 the respective head of audits and inspections for the region in which the
			 individual is operating.</text>
									</subparagraph><subparagraph id="H76F5418A91C6496081FCF4DAC0737A56"><enum>(C)</enum><header>Requirements for nongovernment personnel</header><text>If the Secretary arranges for an audit or inspection under subparagraph (A) to be carried out by a
			 nongovernment entity, the Secretary shall require, as a condition of such
			 arrangement, that any individual who conducts the audit or inspection be a
			 citizen of the United States and shall prescribe standards for the
			 qualification of the individuals who carry out such audits and inspections
			 that are commensurate with the standards for a Government auditor or
			 inspector. Such standards shall include—</text>
										<clause id="H0B9839868AF845DEB996ACDCCFB86973"><enum>(i)</enum><text display-inline="yes-display-inline">minimum training requirements for new auditors or inspectors;</text>
										</clause><clause id="H9867C674D6FE46F4897F26C80B032F85"><enum>(ii)</enum><text>retraining requirements;</text>
										</clause><clause id="H21AE206FA2BE4B7190DE82C04BCA1018"><enum>(iii)</enum><text>minimum education and experience levels;</text>
										</clause><clause id="HEFBD5884967E477F8C89C3ED60AB093A"><enum>(iv)</enum><text>the submission of information as required by the Secretary to enable determination of whether the
			 auditor or inspector has a conflict of interest;</text>
										</clause><clause id="H28559B76E8B948F3A6422D5579A68EAD"><enum>(v)</enum><text>the maintenance of a secret security clearance;</text>
										</clause><clause id="HDC5AB5B74798497DA62E151C5B652520"><enum>(vi)</enum><text>reporting any issue of non-compliance with this section to the Secretary within 24 hours; and</text>
										</clause><clause id="H9E67E133D3834FD59CBD6197192719F6"><enum>(vii)</enum><text>any additional qualifications for fitness of duty as the Secretary may establish.</text>
										</clause></subparagraph><subparagraph display-inline="no-display-inline" id="HC0D5831BF20E4790A908B8F4811AB4F8"><enum>(D)</enum><header>Training of Department auditors and inspectors</header><text display-inline="yes-display-inline">The Secretary shall prescribe standards for the training and retraining of individuals employed by
			 the Department as auditors and inspectors. Such standards shall include—</text>
										<clause id="H6279E579154E4658B2DE4B54B6B93D1F"><enum>(i)</enum><text>minimum training requirements for new auditors and inspectors;</text>
										</clause><clause id="HA8B6327BEEEF485B8766CEC57EC35CCD"><enum>(ii)</enum><text>retraining requirements; and</text>
										</clause><clause id="HD1E9DC911269492AAA8667DFEEAE3ED1"><enum>(iii)</enum><text>any additional requirements the Secretary may establish.</text>
										</clause></subparagraph></paragraph><paragraph id="H507A700D3D374F1C871A9B7CE4B10FCB"><enum>(2)</enum><header>Notice of noncompliance</header>
									<subparagraph id="H0AAD699ED6CC4E7284E140C9E00EF443"><enum>(A)</enum><header>Notice</header><text>If the Secretary determines that a covered chemical facility or a chemical facility of interest is
			 not in compliance with this section, the Secretary shall—</text>
										<clause id="HDA9347442B644B99A18BA898E67DE734"><enum>(i)</enum><text>provide the owner or operator of the facility with—</text>
											<subclause id="HCA819B97D6D74CD3988B0EDF67894841"><enum>(I)</enum><text>written notification (including a clear explanation of any deficiency in the security vulnerability
			 assessment or site security plan) by not later than 14 days after the
			 determination is made; and</text>
											</subclause><subclause id="H9DD96872DD744278B48F0B1B90C29F54"><enum>(II)</enum><text>an opportunity for consultation with the Secretary or the Secretary’s designee; and</text>
											</subclause></clause><clause id="H2A44904B7E9D4D1AAA82C9E8D3C9967E"><enum>(ii)</enum><text>issue an order to comply by such date as the Secretary determines to be appropriate under the
			 circumstances.</text>
										</clause></subparagraph><subparagraph id="HAEE0EBC5D90943EFB3B701DC902359F9"><enum>(B)</enum><header>Continued noncompliance</header><text>If the owner or operator continues to be in noncompliance after the date specified in such order,
			 the Secretary may enter an order assessing a civil penalty, an order to
			 cease operations, or both.</text>
									</subparagraph></paragraph><paragraph commented="no" id="H37BFC1C12E6049D19AC382809E231611"><enum>(3)</enum><header>Personnel surety</header>
									<subparagraph id="HF81AA050F9754B30AD5BB5A29191406E"><enum>(A)</enum><header>Personnel surety program</header><text display-inline="yes-display-inline">For purposes of this title, the Secretary shall carry out a Personnel Surety Program that—</text>
										<clause id="HE687426D22914A81BFB0212AB9970F5D"><enum>(i)</enum><text display-inline="yes-display-inline">does not require an owner or operator of a covered chemical facility that voluntarily participates
			 to submit information about an individual more than one time;</text>
										</clause><clause id="H08CF198C0073435FB5A9FF435BA62349"><enum>(ii)</enum><text>provides a participating owner or operator of a covered chemical facility with feedback about an
			 individual based on vetting the individual against the terrorist screening
			 database, to the extent that such feedback is necessary for the facility’s
			 compliance with regulations promulgated under this title; and</text>
										</clause><clause id="HA83BBF886D114BCF8EFC3DCCAD7F17AB"><enum>(iii)</enum><text>provides redress to an individual whose information was vetted against the terrorist screening
			 database under the program and who believes that the personally
			 identifiable information submitted to the Department for such vetting by a
			 covered chemical facility, or its designated representative, was
			 inaccurate.</text>
										</clause></subparagraph><subparagraph id="H99228CC518934949BB1953614EBBB5D2"><enum>(B)</enum><header>Personnel surety implementation</header><text>To the extent that a risk-based performance standard under subsection (a) is directed toward
			 identifying individuals with terrorist ties—</text>
										<clause commented="no" id="HB65E7DB4D6DD422E9294E1B2A72E4A44"><enum>(i)</enum><text>a covered chemical facility may satisfy its obligation under such standard with respect to an
			 individual by utilizing any Federal screening program that periodically
			 vets individuals against the terrorist screening database, or any
			 successor, including the Personnel Surety Program under subparagraph (A);
			 and</text>
										</clause><clause commented="no" id="H5994E441543345C0A596C11633B1F920"><enum>(ii)</enum><text>the Secretary may not require a covered chemical facility to submit any information about such
			 individual unless the individual—</text>
											<subclause commented="no" id="HAC32D58296724380BE6C8BC38B002F68"><enum>(I)</enum><text>is vetted under the Personnel Surety Program; or</text>
											</subclause><subclause commented="no" id="H9AFBE674C81A4200BD1EEB311E09E55E"><enum>(II)</enum><text>has been identified as presenting a terrorism security risk.</text>
											</subclause></clause></subparagraph><subparagraph id="HCF40A0BC604045578D85E50995CC49EB"><enum>(C)</enum><header>Responsibilities of Security Screening Coordination Office</header>
										<clause id="HD5B9905B98A649CEAC62182C47263720"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall direct the Security Screening Coordination Office of the Department to
			 coordinate with the National Protection and Programs Directorate to
			 expedite the development of a common credential that screens against the
			 terrorist screening database on a recurrent basis and meets all other
			 screening requirements of this title.</text>
										</clause><clause id="H69D546B02EED42B1BE23F1442A2DAA31"><enum>(ii)</enum><header>Report</header><text>Not later than March 1, 2015, and annually thereafter, the Secretary shall submit to Congress a
			 report on the progress of the Secretary in meeting the requirements of
			 clause (i).</text>
										</clause></subparagraph></paragraph><paragraph id="HE7B3BD87412B45458408DC9C8E2F27B8"><enum>(4)</enum><header>Facility access</header><text>For purposes of the compliance of a covered chemical facility with a risk-based performance
			 standard established under subsection (a), the Secretary may not require
			 the facility to submit any information about an individual who has been
			 granted access to the facility unless the individual—</text>
									<subparagraph id="H2A8152D319EF4C77A940C6F969A314C5"><enum>(A)</enum><text>was vetted under the Personnel Surety Program; or</text>
									</subparagraph><subparagraph id="HE21640BBBA044F21A85265F0B6E1A979"><enum>(B)</enum><text>has been identified as presenting a terrorism security risk.</text>
									</subparagraph></paragraph><paragraph id="H60830BE8279545C08D1B2E1D443745FD"><enum>(5)</enum><header>Availability of information</header><text>The Secretary shall share with the owner or operator of a covered chemical facility such
			 information as the owner or operator needs to comply with this section.</text>
								</paragraph></subsection><subsection id="HBF5C43F784CC459A84A0EC17F08F7061"><enum>(e)</enum><header>Responsibilities of the Secretary</header>
								<paragraph id="H52F312B949BA4ECFBE55A6017971CE09"><enum>(1)</enum><header>Identification of facilities of interest</header><text>In carrying out this title, the Secretary shall consult with the heads of other Federal agencies,
			 States and political subdivisions thereof, and relevant business
			 associations to identify all chemical facilities of interest.</text>
								</paragraph><paragraph id="HCCB739F96AFD46DF9961714FBD18F41A"><enum>(2)</enum><header>Risk assessment</header>
									<subparagraph id="H639FF80B72CA4FDFA561AC0C9E7BFEF4"><enum>(A)</enum><header>In general</header><text>For purposes of this title, the Secretary shall develop a risk assessment approach and
			 corresponding tiering methodology that incorporates all relevant elements
			 of risk, including threat, vulnerability, and consequence.</text>
									</subparagraph><subparagraph id="H373F3B9B21514F5BADE5E0EA4F493107"><enum>(B)</enum><header>Criteria for determining security risk</header><text>The criteria for determining the security risk of terrorism associated with a facility shall
			 include—</text>
										<clause id="HA3CC1A808B5049B88CB322A66AE38E8B"><enum>(i)</enum><text display-inline="yes-display-inline">the relevant threat information;</text>
										</clause><clause id="HD8F2BDE747F9476CA8E861A11EBC4FEC"><enum>(ii)</enum><text>the potential economic consequences and the potential loss of human life in the event of the
			 facility being subject to a terrorist attack, compromise, infiltration, or
			 exploitation; and</text>
										</clause><clause id="HB455A54EFC394DE7BA8D3292427BACE0"><enum>(iii)</enum><text>the vulnerability of the facility to a terrorist attack, compromise, infiltration, or exploitation.</text>
										</clause></subparagraph></paragraph><paragraph display-inline="no-display-inline" id="HE742A5DEE7B044F69AB98C0D28AC347E"><enum>(3)</enum><header>Changes in tiering</header><text display-inline="yes-display-inline">Any time that tiering for a covered chemical facility is changed and the facility is determined to
			 no longer be subject to the requirements of this title, the Secretary
			 shall maintain records to reflect the basis for this determination. The
			 records shall include information on whether and how the information that
			 was the basis for the determination was confirmed by the Secretary.</text>
								</paragraph></subsection><subsection id="H3B6351F973194C3F9FB32F90A5E189BE"><enum>(f)</enum><header>Definitions</header><text>In this title:</text>
								<paragraph id="HDDB84991F79345A9891CA9C905B405B8"><enum>(1)</enum><text display-inline="yes-display-inline">The term <term>covered chemical facility</term> means a facility that the Secretary identifies as a chemical facility of interest and, based upon
			 review of a Top-Screen, as such term is defined in <external-xref legal-doc="usc" parsable-cite="usc/6/27">section 27.105</external-xref> of title 6 of Code of Federal Regulations, determines meets the risk criteria developed pursuant
			 subsection (e)(2)(B). Such term does not include any of the following:</text>
									<subparagraph display-inline="no-display-inline" id="H4229A071F0B34B28B5DFC8A8921DCF3B"><enum>(A)</enum><text>A facility regulated pursuant to the Maritime Transportation Security Act of 2002 (<external-xref legal-doc="public-law" parsable-cite="pl/107/295">Public Law 107–295</external-xref>).</text>
									</subparagraph><subparagraph id="HFE4B102D0BBF417AAD7CF85D885562B4"><enum>(B)</enum><text>A Public Water System, as such term is defined by section 1401 of the Safe Drinking Water Act (<external-xref legal-doc="public-law" parsable-cite="pl/93/523">Public Law 93–523</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/42/300f">42 U.S.C. 300f</external-xref>).</text>
									</subparagraph><subparagraph id="H4262A059FD174998A3EFDCCA0B7A861C"><enum>(C)</enum><text>A Treatment Works, as such term is defined in section 212 of the Federal Water Pollution Control
			 Act (<external-xref legal-doc="public-law" parsable-cite="pl/92/500">Public Law 92–500</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/33/12920">33 U.S.C. 12920</external-xref>).</text>
									</subparagraph><subparagraph id="H7C7125B73F014498B24837DD3750BD20"><enum>(D)</enum><text>Any facility owned or operated by the Department of Defense or the Department of Energy.</text>
									</subparagraph><subparagraph id="H5F7E1D95C18D43AB9AF5130B49D9B70D"><enum>(E)</enum><text>Any facility subject to regulation by the Nuclear Regulatory Commission.</text>
									</subparagraph></paragraph><paragraph id="HC26C26E886FC4C2DBB53BB23245A7CA2"><enum>(2)</enum><text display-inline="yes-display-inline">The term <term>chemical facility of interest</term> means a facility that holds, or that the Secretary has a reasonable basis to believe holds, a
			 Chemical of Interest, as designated under in Appendix A of title 6 of the
			 Code of Federal Regulations, at a threshold quantity that meets relevant
			 risk-related criteria developed pursuant to subsection (e)(2)(B).</text>
								</paragraph></subsection></section><section id="H2073F2C62B8741D1A64C7034E022EA90"><enum>2102.</enum><header>Protection and sharing of information</header>
							<subsection id="HD9050A5C0AB64A66BCA8FD0FF408DCE8"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, information developed pursuant to this title, including
			 vulnerability assessments, site security plans, and other security related
			 information, records, and documents shall be given protections from public
			 disclosure consistent with similar information developed by chemical
			 facilities subject to regulation under <external-xref legal-doc="usc" parsable-cite="usc/46/70103">section 70103</external-xref> of title 46, United States Code.</text>
							</subsection><subsection id="HCD57C157907A44A19B429A4026ED9A3F"><enum>(b)</enum><header>Sharing of information with States and local governments</header><text>This section does not prohibit the sharing of information developed pursuant to this title, as the
			 Secretary deems appropriate, with State and local government officials
			 possessing the necessary security clearances, including law enforcement
			 officials and first responders, for the purpose of carrying out this
			 title, if such information may not be disclosed pursuant to any State or
			 local law.</text>
							</subsection><subsection id="HBCCBC401C0684915B89E9F29ED0F563D"><enum>(c)</enum><header>Sharing of information with first responders</header><text display-inline="yes-display-inline">The Secretary shall provide to State, local, and regional fusion centers (as such term is defined
			 in section 210A(j)(1) of this Act) and State and local government
			 officials, as determined appropriate by the Secretary, such information as
			 is necessary to help ensure that first responders are properly prepared
			 and provided with the situational awareness needed to respond to incidents
			 at covered chemical facilities. Such information shall be disseminated
			 through the Homeland Security Information Network or the Homeland Secure
			 Data Network, as appropriate.</text>
							</subsection><subsection id="H8652E3F239344E12A555853EA36B5C10"><enum>(d)</enum><header>Enforcement proceedings</header><text>In any proceeding to enforce this section, vulnerability assessments, site security plans, and
			 other information submitted to or obtained by the Secretary under this
			 section, and related vulnerability or security information, shall be
			 treated as if the information were classified material.</text>
							</subsection></section><section id="H1A0D7AFF48CA4D2D92A519A06114F40E"><enum>2103.</enum><header>Civil penalties</header>
							<subsection id="HA7C9109A59FA454CBB2A7F552C2FE583"><enum>(a)</enum><header>Violations</header><text display-inline="yes-display-inline">Any person who violates an order issued under this title shall be liable for a civil penalty under <external-xref legal-doc="usc" parsable-cite="usc/46/70119">section 70119(a)</external-xref> of title 46, United States Code.</text>
							</subsection><subsection id="H3DA71A9D90074E84A17676AC6A8D97BF"><enum>(b)</enum><header>Right of action</header><text display-inline="yes-display-inline">Nothing in this title confers upon any person except the Secretary a right of action against an
			 owner or operator of a covered chemical facility to enforce any provision
			 of this title.</text>
							</subsection></section><section id="H53CAB3817F2642AD97FD4039323620A2"><enum>2104.</enum><header>Whistleblower protections</header><text display-inline="no-display-inline">The Secretary shall publish on the Internet website of the Department and in other materials made
			 available to the public the whistleblower protections that an individual
			 providing such information would have.</text>
						</section><section id="H9882967523F64FA0958515F0F4056BD4"><enum>2105.</enum><header>Relationship to other laws</header>
							<subsection id="H073DC4E54D66466B8FC4A497F44E892C"><enum>(a)</enum><header>Other Federal laws</header><text display-inline="yes-display-inline">Nothing in this title shall be construed to supersede, amend, alter, or affect any Federal law that
			 regulates the manufacture, distribution in commerce, use, sale, other
			 treatment, or disposal of chemical substances or mixtures.</text>
							</subsection><subsection id="H3E9583AC99F448C5820CF094C5ED6F65"><enum>(b)</enum><header>States and political subdivisions</header><text>This title shall not preclude or deny any right of any State or political subdivision thereof to
			 adopt or enforce any regulation, requirement, or standard of performance
			 with respect to chemical facility security that is more stringent than a
			 regulation, requirement, or standard of performance issued under this
			 section, or otherwise impair any right or jurisdiction of any State with
			 respect to chemical facilities within that State, unless there is an
			 actual conflict between this section and the law of that State.</text>
							</subsection><subsection id="HD160699A0AE143A3A76D154B485C92CB"><enum>(c)</enum><header>Rail transit</header>
								<paragraph id="HEB854247D18142E18451DBB77BE1CA57"><enum>(1)</enum><header>Duplicative regulations</header><text>The Secretary shall coordinate with the Assistant Secretary of Homeland Security (Transportation
			 Security Administration) to eliminate any provision of this title
			 applicable to rail security that would duplicate any security measure
			 under the Rail Transportation Security Rule under <external-xref legal-doc="usc" parsable-cite="usc/49/1580">section 1580</external-xref> of title 49 of the Code of Federal Regulations, as in effect as of the date of the enactment of
			 this title. To the extent that there is a conflict between this title and
			 any regulation under the jurisdiction of the Transportation Security
			 Administration, the regulation under the jurisdiction of the
			 Transportation Security Administration shall prevail.</text>
								</paragraph><paragraph id="H9986EA23956F49EDB4B52269614055BF"><enum>(2)</enum><header>Exemption from Top-Screen</header><text>A rail transit facility or a rail facility, as such terms are defined in <external-xref legal-doc="usc" parsable-cite="usc/49/1580">section 1580.3</external-xref> of title 49 of the Code of Federal Regulations, to which subpart 3 of such title applies pursuant
			 to section 1580.100 of such title shall not be required to complete a
			 Top-Screen as such term is defined in <external-xref legal-doc="usc" parsable-cite="usc/6/27">section 27.105</external-xref> of title 6 of the Code of Federal Regulations.</text>
								</paragraph></subsection></section><section id="H92BC57C23B0A4F1BB37336CEBD0101CC"><enum>2106.</enum><header>Reports</header>
							<subsection id="H17546880575D4C5EB2032DE002D9946A"><enum>(a)</enum><header>Report to Congress</header><text display-inline="yes-display-inline">Not later than 18 months after the date of the enactment of this title, the Secretary shall submit
			 to Congress a report on the Chemical Facilities Anti-Terrorism Standards
			 Program. Such report shall include each of the following:</text>
								<paragraph commented="no" id="HABF9FB4412124930A201490F04EA8AC8"><enum>(1)</enum><text display-inline="yes-display-inline">Certification by the Secretary that the Secretary has made significant progress in the
			 identification of all chemical facilities of interest pursuant to section
			 2101(e)(1), including a description of the steps taken to achieve such
			 progress and the metrics used to measure it, information on whether
			 facilities that submitted Top-Screens as a result of such efforts were
			 tiered and in what tiers they were placed, and an action plan to better
			 identify chemical facilities of interest and bring those facilities into
			 compliance.</text>
								</paragraph><paragraph id="HD84C7B29673943ADAD8A96EB2F0E0200"><enum>(2)</enum><text>Certification by the Secretary that the Secretary has developed a risk assessment approach and
			 corresponding tiering methodology pursuant to section 2101(e)(2).</text>
								</paragraph><paragraph id="HAD32CA08E5EC43D0990C10D6730AF261"><enum>(3)</enum><text display-inline="yes-display-inline">An assessment by the Secretary of the implementation by the Department of any recommendations made
			 by the Homeland Security Studies and Analysis Institute as outlined in the
			 Institute’s Tiering Methodology Peer Review (Publication Number:
			 RP12–22–02).</text>
								</paragraph></subsection><subsection id="H939AD98727B44A9EAAF3B3E5E0E78FA8"><enum>(b)</enum><header>Semiannual GAO report</header><text display-inline="yes-display-inline">During the 3-year period beginning on the date of the enactment of this title, the Comptroller
			 General of the United States shall submit a semiannual report to Congress
			 containing the assessment of the Comptroller General of the implementation
			 of this title. The Comptroller General shall submit the first such report
			 by not later than the date that is 180 days after the date of the
			 enactment of this title.</text>
							</subsection></section><section id="H64803411944048AC9BD75EC6158D43AC"><enum>2107.</enum><header>CFATS regulations</header>
							<subsection id="H14886781F1F04D30A8C97C9E9C16D353"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary is authorized, in accordance with <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/5">chapter 5</external-xref> of title 5, United States Code, to promulgate regulations implementing the provisions of this
			 title.</text>
							</subsection><subsection id="HF0818E802B364071BA14740E928F2323"><enum>(b)</enum><header>Existing CFATS regulations</header><text display-inline="yes-display-inline">In carrying out the requirements of this title, the Secretary shall use the CFATS regulations, as
			 in effect immediately before the date of the enactment of this title, that
			 the Secretary determines carry out such requirements, and may issue new
			 regulations or amend such regulations pursuant to the authority in
			 subsection (a).</text>
							</subsection><subsection id="H0683E37FB1224B7AA24E3E27DCD9B3F6"><enum>(c)</enum><header>Definition of CFATS regulations</header><text display-inline="yes-display-inline">In this section, the term <term>CFATS regulations</term> means the regulations prescribed pursuant to section 550 of the Department of Homeland Security
			 Appropriations Act, 2007 (<external-xref legal-doc="public-law" parsable-cite="pl/109/295">Public Law 109–295</external-xref>; 120 Stat. 1388; <external-xref legal-doc="usc" parsable-cite="usc/6/121">6 U.S.C. 121</external-xref> note), as well as all Federal Register notices and other published guidance concerning section 550
			 of the Department of Homeland Security Appropriations Act, 2007.</text>
							</subsection><subsection id="HBDC5DEDBC7C241BEA62790DD16DB3717"><enum>(d)</enum><header>Authority</header><text display-inline="yes-display-inline">The Secretary shall exclusively rely upon authority provided in this title for determining
			 compliance with this title in—</text>
								<paragraph id="HDACF9328855D4DED81524EF57E8E0174"><enum>(1)</enum><text>identifying chemicals of interest;</text>
								</paragraph><paragraph id="H6FEB534A817C40E38C183B335EA5C6FA"><enum>(2)</enum><text>designating chemicals of interest; and</text>
								</paragraph><paragraph id="H2C7B52B50A274DD7B718E211AB57CF3A"><enum>(3)</enum><text>determining security risk associated with a chemical facility.</text>
								</paragraph></subsection></section><section display-inline="no-display-inline" id="H7B806D3B5B7D4998962BD0177538075D" section-type="subsequent-section"><enum>2108.</enum><header>Small covered chemical facilities</header>
							<subsection id="H6C4C220BB82E4A4AB67F6F2071833C21"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary may provide guidance and, as appropriate, tools, methodologies, or computer software,
			 to assist small covered chemical facilities in developing their physical
			 security.</text>
							</subsection><subsection id="H906CF0D359C44ABFA549AFB42FF3A180"><enum>(b)</enum><header>Report</header><text>The Secretary shall submit to the Committee on Homeland Security of the House of Representatives
			 and the Committee on Homeland Security and Governmental Affairs of the
			 Senate a report on best practices that may assist small chemical
			 facilities, as defined by the Secretary, in development of physical
			 security best practices.</text>
							</subsection><subsection id="H8820D7AD84D54B4B974A95ABEFA56790"><enum>(c)</enum><header>Definition</header><text>For purposes of this section, the term <quote>small covered chemical facility</quote> means a covered chemical facility that has fewer than 350 employees employed at the covered
			 chemical facility, and is not a branch or subsidiary of another entity.</text>
							</subsection></section><section display-inline="no-display-inline" id="H89C296EDF3B243248D75DEAFC7A538DE" section-type="subsequent-section"><enum>2109.</enum><header>Outreach to chemical facilities of interest</header><text display-inline="no-display-inline">Not later than 90 days after the date of the enactment of this title, the Secretary shall establish
			 an outreach implementation plan, in coordination with the heads of other
			 appropriate Federal and State agencies and relevant business associations,
			 to identify chemical facilities of interest and make available compliance
			 assistance materials and information on education and training.</text>
						</section><section commented="no" id="HE5078A7DF48B47A489827CAADFCE03F3"><enum>2110.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There is authorized to be appropriated to carry out this title $81,000,000 for each of fiscal years
			 2015, 2016, and 2017.</text></section></title><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H1459251FB5CA4C208FBD48A5B4D065BB"><enum>(b)</enum><header>Clerical amendment</header><text>The table of contents in section 1(b) of such Act is amended by adding at the end the following:</text>

			 2002, as added by subsection (a), the Secretary of Homeland Security shall
			 commission a third-party study to assess vulnerabilities to acts of
			 terrorism associated with the Chemical Facility Anti-Terrorism Standards
			 program, as authorized pursuant to section 550 of the Department of
			 Homeland Security Appropriations Act, 2007 (<external-xref legal-doc="public-law" parsable-cite="pl/109/295">Public Law 109–295</external-xref>; 120 Stat. 1388; <external-xref legal-doc="usc" parsable-cite="usc/6/121">6 U.S.C. 121</external-xref> note).</text>
			</subsection><subsection id="H5FDA5886C7E14FED9450BFDA0A309170"><enum>(d)</enum><header>Metrics</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Secretary shall submit to
			 Congress a plan for the utilization of metrics to assess the effectiveness
			 of the Chemical Facility Anti-Terrorism Standards program to reduce the
			 risk of a terrorist attack or other security risk to those citizens and
			 communities surrounding covered chemical facilities. The plan shall
			 include benchmarks on when the program will begin utilizing the metrics
			 and how the Department of Homeland Security plans to use the information
			 to inform the program.</text>
			</subsection></section><section id="H119FA7EF6BE546F6B2C519A18DEFFAC0"><enum>3.</enum><header>Effective date</header><text display-inline="no-display-inline">This Act, and the amendments made by this Act, shall take effect on the date that is 30 days after
			 the date of the enactment of this Act.</text>
