<paragraph id="H666D2E1C4EDC447BB83F6B39F569BCFB"><enum>(2)</enum><text display-inline="yes-display-inline">For the acquisition, construction, rebuilding, and improvement of aids to navigation, shore and offshore facilities, vessels, and aircraft, including equipment related thereto—</text>

<section id="HC973BD9A7DBF47EBBB74156A351C31C9"><enum>102.</enum><header>Authorized levels of military strength and training</header> 
<subsection id="HF14D6DF979E347ABB44E72F46B6A46BA"><enum>(a)</enum><header>Active duty strength</header><text display-inline="yes-display-inline">The Coast Guard is authorized an end-of-year strength for active duty personnel of 43,000 for each of fiscal years 2015 and 2016.</text></subsection> 
<subsection id="HE9484F4DE00F4ACF85BE40CF4B8DE3DB"><enum>(b)</enum><header>Military training student loads</header><text display-inline="yes-display-inline">The Coast Guard is authorized average military training student loads for each of fiscal years 2015 and 2016 as follows:</text> 
<paragraph id="HA3F873EC33EC403E9BB701319E7CB866"><enum>(1)</enum><text>For recruit and special training, 2,500 student years.</text></paragraph> 
<paragraph id="H670DCBE8EE6645629D1A449EFA1BEF0B"><enum>(2)</enum><text>For flight training, 165 student years.</text></paragraph> 
<paragraph id="HE04845360C85482EAB1682859900859A"><enum>(3)</enum><text>For professional training in military and civilian institutions, 350 student years.</text></paragraph> 
<paragraph id="H180D5EA158534F30B50435ADD1C9801E"><enum>(4)</enum><text>For officer acquisition, 1,200 student years.</text></paragraph></subsection></section></title>

<section id="HED7920FF38B441668802BA0CE4D27CE8" section-type="subsequent-section"><enum>201.</enum><header>Commissioned officers</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/14/42">Section 42(a)</external-xref> of title 14, United States Code, is amended by striking <quote>7,200</quote> and inserting <quote>6,700</quote>.</text></section> 
<section id="HB119F114B7AE4F41AC793FEEA27BEDB1"><enum>202.</enum><header>Prevention and response workforces</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/14/57">Section 57</external-xref> of title 14, United States Code, is amended—</text> 
<paragraph id="H16FF8FD178464DC19569BE47E2B314E4"><enum>(1)</enum><text>in subsection (b)—</text> 
<subparagraph id="H8035EBC686904E6B881B5EF833E74FDE"><enum>(A)</enum><text>in paragraph (2) by striking <quote>or</quote> at the end;</text></subparagraph> 
<subparagraph id="HFE27F459DE0B40FAB6FDDAA21DA125C7"><enum>(B)</enum><text>in paragraph (3) by striking the period at the end and inserting a semicolon; and</text></subparagraph>

<section id="HBE7DC25C81F94D43A4269599C8CDFD9A"><enum>204.</enum><header>Agreements</header> 
<subsection id="H8A0DBE9AA45A401A8AF8D7BCD6876605"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/14/93">Section 93(a)(4)</external-xref> of title 14, United States Code, is amended—</text> 
<paragraph id="H76CD2794B8F3415D843C8B2CD2D7A0F7"><enum>(1)</enum><text>by striking <quote>, investigate</quote> and inserting <quote>and investigate</quote>; and</text></paragraph> 
<paragraph id="H55137990E2A04543BE8EA754B4526651"><enum>(2)</enum><text>by striking <quote>, and cooperate and coordinate such activities with other Government agencies and with private agencies</quote>.</text></paragraph></subsection> 
<subsection id="H2BA1693743984C9F9DE0A3DF784A8DFB"><enum>(b)</enum><header>Authority</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/14/5">Chapter 5</external-xref> of title 14, United States Code, is amended by adding at the end the following:</text>

<section id="H25BD1C5775144BF990CBF312D8B01B68"><enum>102.</enum><header>Agreements</header> 
<subsection commented="no" id="H1D6B26E93FAD47978C8A5DEECC3412C5"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">In carrying out section 93(a)(4), the Commandant may—</text> 
<paragraph id="HD0A68396DF244777B3E1080206A0E228"><enum>(1)</enum><text>enter into cooperative agreements, contracts, and other agreements with Federal entities and other public or private entities, including academic entities; and</text></paragraph> 
<paragraph id="HF592DB7362ED4C80ACA68F467A125C48"><enum>(2)</enum><text>impose on and collect from an entity subject to an agreement or contract under paragraph (1) a fee to assist with expenses incurred in carrying out such section.</text></paragraph></subsection> 
<subsection commented="no" id="H9532F2894EB64DBD98A7E88962D80FC6"><enum>(b)</enum><header>Deposit and use of fees</header><text display-inline="yes-display-inline">Fees collected under this section shall be deposited in the general fund of the Treasury as offsetting receipts. The fees may be used, to the extent provided in advance in an appropriation law, only to carry out activities under section 93(a)(4).</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection>

<paragraph id="H048C1B9A862548FB8CC4A7C0BCF18DC3"><enum>(2)</enum><header>Additional visits</header><text>With the approval of the Secretary, the Board or individual members of the Board may make other visits to the Academy in connection with the duties of the Board or to consult with the Superintendent of the Academy.</text></paragraph></subsection> 
<subsection id="H225152978E1D40CEB8FEABC0D22E9031"><enum>(d)</enum><header>Scope of review</header><text display-inline="yes-display-inline">The Board shall review, with respect to the Academy—</text>

<subsection id="H6D972BAB110E4239A397830D160D6998"><enum>(e)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 60 days after the date of an annual visit of the Board under subsection (c)(1), the Board shall submit to the Secretary, the Committee on Commerce, Science, and Transportation of the Senate, and the Committee on Transportation and Infrastructure of the House of Representatives a report on the actions of the Board during such visit and the recommendations of the Board pertaining to the Academy.</text></subsection> 
<subsection id="HDE4CC66BDAB2429BA9FA470214EFA58C"><enum>(f)</enum><header>Advisors</header><text display-inline="yes-display-inline">If approved by the Secretary, the Board may consult with advisors in carrying out this section.</text></subsection> 
<subsection id="H4A88CEE7816249E796ACC719FFB56305"><enum>(g)</enum><header>Reimbursement</header><text display-inline="yes-display-inline">Each member of the Board and each adviser consulted by the Board under subsection (f) shall be reimbursed, to the extent permitted by law, by the Coast Guard for actual expenses incurred while engaged in duties as a member or adviser.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section>

<paragraph id="H629457DB35904F629314D22BE57E27B0"><enum>(1)</enum><header>Integrated major acquisition mission need statement</header><text display-inline="yes-display-inline">The term <term>integrated major acquisition mission need statement</term> means a document that—</text> 
<subparagraph id="H210641C5D12742FABBCF4F27F61FF5B4"><enum>(A)</enum><text>identifies current and projected gaps in Coast Guard mission capabilities using mission hour targets;</text></subparagraph> 
<subparagraph id="HFF020F985F5E48FC97FBD915767CE4C3"><enum>(B)</enum><text>explains how each major acquisition program addresses gaps identified under subparagraph (A) if funded at the levels provided for such program in the most recently submitted capital investment plan; and</text></subparagraph> 
<subparagraph id="H78E7BC5F0D4A45AFAFD228A6E0BA26C4"><enum>(C)</enum><text>describes the missions the Coast Guard will not be able to achieve, by fiscal year, for each gap identified under subparagraph (A).</text></subparagraph></paragraph>

<paragraph id="H4F2CB1FD0CC1448A834E7D61C05FDFE3"><enum>(2)</enum><text>recommends authorizations of appropriations for that fiscal year, including with respect to matters described in section 662; and</text></paragraph>

<paragraph id="H998ADE3E3C4E4581AD082BEEF421D382"><enum>(2)</enum><text display-inline="yes-display-inline">an assessment of the physical condition of each unit of such property, excluding lands;</text></paragraph> 
<paragraph id="HD2D314FE2F1C407D89F6A5DBBC6BE8A6"><enum>(3)</enum><text>an estimate of the fair market value of each unit of such property;</text></paragraph> 
<paragraph id="HBD682BFF22704F49AC85D004B06EF7A4"><enum>(4)</enum><text>a determination of whether each unit of such property should be—</text> 
<subparagraph id="H03D698B271A64DC58EBFB52AA97E519B"><enum>(A)</enum><text>retained to fulfill a current or projected Coast Guard mission requirement; or</text></subparagraph>

<subsection id="H2A878B3576944CCEABB3B5F1540EBFAF"><enum>(c)</enum><header>Recommendations to Congress</header><text>Not later than March 30, 2015, and every 5 years thereafter, the Commandant shall submit to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate a report that includes—</text> 
<paragraph id="HDD31AA1BD942476F8E34F56FD2AD374A"><enum>(1)</enum><text>a list of all real property under the control of the Coast Guard and the location of such property by property type;</text></paragraph> 
<paragraph id="H0661BDDE01784528BD6CFB92C1023545"><enum>(2)</enum><text>recommendations for divestiture with respect to any units of such property, including an estimate of—</text> 
<subparagraph id="H506FD3874F9B45CABCB0BE40239DDDF8"><enum>(A)</enum><text>the fair market value of any property recommended for divestiture; and</text></subparagraph> 
<subparagraph id="H138FB120CAD34280883D8F3E783AA7B1"><enum>(B)</enum><text>the costs or savings associated with divestiture; and</text></subparagraph></paragraph> 
<paragraph id="HC866A35DB34A44BC9540E2A3E439A35A"><enum>(3)</enum><text>recommendations for consolidating any units of such property, including—</text> 
<subparagraph id="HC76D8BC1689542FAB59BD02C1785AFDA"><enum>(A)</enum><text>an estimate of the costs or savings associated with each recommended consolidation; and</text></subparagraph>

<paragraph id="HB5E89916FEBF40CB918ED9D10EE259F2"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (d)(2)—</text>

<paragraph id="HC8983470D22640A18751E6DC8EF9B7E3"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date on which the analysis required under subsection (a) is submitted, the Commandant of the Coast Guard shall submit to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate—</text> 
<subparagraph id="HDB34D3737A7D4A9A9F78D66E0F9721EE"><enum>(A)</enum><text>a strategy to meet the Coast Guard’s Arctic ice operations needs through September 30, 2050; and</text></subparagraph> 
<subparagraph id="HAFDB6A4B01E14025B4A7255D64B3C2C2"><enum>(B)</enum><text display-inline="yes-display-inline">unless the Secretary makes a determination under this section that it is cost-effective to reactivate the Polar Sea, a bridging strategy for maintaining the Coast Guard’s polar icebreaking services until at least September 30, 2024.</text></subparagraph></paragraph> 
<paragraph id="H46B2DD96E28140C2AE9D27D4DED05F53"><enum>(2)</enum><header>Requirement</header><text display-inline="yes-display-inline">The strategies required under paragraph (1) shall include a business case analysis comparing the leasing and purchasing of icebreakers to maintain the needs and services described in that paragraph.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HA443640905CD4281AB4E84BDD93C14B8"><enum>(b)</enum><header>Limitation</header> 
<paragraph id="H79CC964FD5464D72993F2B9DE929E4E3"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of the department in which the Coast Guard is operating may not expend amounts appropriated for the Coast Guard for any of fiscal years 2015 through 2024, for—</text> 
<subparagraph id="HC48C532479964FA983C1C77FF095C584"><enum>(A)</enum><text display-inline="yes-display-inline">design activities related to a capability of a Polar-Class Icebreaker that is based on an operational requirement of another Federal department or agency, except for amounts appropriated for design activities for a fiscal year before fiscal year 2016; or</text></subparagraph> 
<subparagraph id="H664C6A0691EB4AF2B6896017E5207F0C"><enum>(B)</enum><text>long-lead-time materials, production, or post-delivery activities related to such a capability.</text></subparagraph></paragraph> 
<paragraph id="H102243A2159C4D75BAF34E1BF0ED2C7E"><enum>(2)</enum><header>Other amounts</header><text>Amounts made available to the Secretary under an agreement with another Federal department or agency and expended on a capability of a Polar-Class Icebreaker that is based on an operational requirement of that or another Federal department or agency shall not be treated as amounts expended by the Secretary for purposes of the limitation established under paragraph (1).</text></paragraph></subsection></section> 
<section id="H1A9A4EEA0A2647F5BB76369A9714EA9F"><enum>215.</enum><header>Multiyear procurement authority for Offshore Patrol Cutters</header><text display-inline="no-display-inline">In fiscal year 2015 and each fiscal year thereafter, the Secretary of the department in which the Coast Guard is operating may enter into, in accordance with <external-xref legal-doc="usc" parsable-cite="usc/10/2306b">section 2306b</external-xref> of title 10, United States Code, multiyear contracts for the procurement of Offshore Patrol Cutters and associated equipment.</text></section> 
<section id="HACFC14A3FB704C60AE7AE42A79475DAC" section-type="subsequent-section"><enum>216.</enum><header>Maintaining Medium Endurance Cutter mission capability</header><text display-inline="no-display-inline">Not later than 30 days after the date of enactment of this Act, the Secretary of the department in which the Coast Guard is operating shall submit to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate a report that includes—</text> 
<paragraph id="HE403578E7B324F43BB93972FF0427052"><enum>(1)</enum><text display-inline="yes-display-inline">a schedule and plan for decommissioning, not later than September 30, 2029, each of the 210-foot, Reliance-Class Cutters operated by the Coast Guard on the date of enactment of this Act;</text></paragraph> 
<paragraph id="HFBE3CE3B43864DC1846943E6AD16038F"><enum>(2)</enum><text display-inline="yes-display-inline">a schedule and plan for enhancing the maintenance or extending the service life of each of the 270-foot, Famous-Class Cutters operated by the Coast Guard on the date of enactment of this Act—</text> 
<subparagraph id="H684DC2E332774B4DB654C4517CA5D082"><enum>(A)</enum><text>to maintain the capability of the Coast Guard to carry out sea-going missions with respect to such Cutters at the level of capability existing on September 30, 2013; and</text></subparagraph> 
<subparagraph id="H7D77B69836B0438ABFDCEE62F0F4EF79"><enum>(B)</enum><text>for the period beginning on the date of enactment of this Act and ending on the date on which the final Offshore Patrol Cutter is scheduled and planned to be commissioned under paragraph (4);</text></subparagraph></paragraph> 
<paragraph id="H3C167DB310CA4FB286FCBAC0DA42E98B"><enum>(3)</enum><text display-inline="yes-display-inline">an identification of the number of Offshore Patrol Cutters capable of sea state 5 operations that, if 8 National Security Cutters are commissioned, are necessary to return the sea state 5 operating capability of the Coast Guard to the level of capability that existed prior to the decommissioning of the first High Endurance Cutter in fiscal year 2011;</text></paragraph> 
<paragraph id="H8537C21B936C40D397CC68C55C2CC50F"><enum>(4)</enum><text display-inline="yes-display-inline">a schedule and plan for commissioning the number of Offshore Patrol Cutters identified under paragraph (3); and</text></paragraph> 
<paragraph id="H7E5085D3083D43D4BB0AB2DE6D896B9F"><enum>(5)</enum><text display-inline="yes-display-inline">a schedule and plan for commissioning, not later than September 30, 2034, a number of Offshore Patrol Cutters not capable of sea state 5 operations that is equal to—</text> 
<subparagraph commented="no" id="H112F7AD7AF684F28947E13F2DE21F697"><enum>(A)</enum><text>25; less</text></subparagraph> 
<subparagraph id="HEDA6D7DF058D4E90A26C6F20652323E3"><enum>(B)</enum><text>the number of Offshore Patrol Cutters identified under paragraph (3).</text></subparagraph></paragraph></section>

<subsection id="HFFB71E689B34452CB46698702C66D477"><enum>(b)</enum><header>Contents</header><text>The report required under subsection (a) shall—</text> 
<paragraph id="HEC47686E8DC348D4B9D7F9BF7D732CA7"><enum>(1)</enum><text>describe what improvements are being made to the distress response system in the areas specified in subsection (a), including information on which areas will receive digital selective calling and direction finding capability;</text></paragraph> 
<paragraph id="HCF84E50914744864B4654C27AC27E574"><enum>(2)</enum><text>describe the impediments to installing digital selective calling and direction finding capability in areas where such technology will not be installed;</text></paragraph> 
<paragraph id="H1F335713CDE446DC94DDB07B9F89C8EA"><enum>(3)</enum><text>identify locations in the areas specified in subsection (a) where communication gaps will continue to present a risk to mariners after completion of the Rescue 21 project;</text></paragraph> 
<paragraph id="H64A1BFBB87024FB3862500DBC157EFBE"><enum>(4)</enum><text>include a list of all reported marine accidents, casualties, and fatalities occurring in the locations identified under paragraph (3) since 1990; and</text></paragraph> 
<paragraph id="HD905D2875E2A4F1FADD45A31D098F64F"><enum>(5)</enum><text>provide an estimate of the costs associated with installing the technology necessary to close communication gaps in the locations identified under paragraph (3).</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section>

<subsection id="HFE1A568B38F34C5C87B93D49BED7D8DB"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of the department in which the Coast Guard is operating may not carry out activities related to the dismantling or disposal of infrastructure that supported the former LORAN system until the later of—</text> 
<paragraph id="H41DCDF9C2E304A73A92EEB86E9B7F735"><enum>(1)</enum><text>the date that is 1 year after the date of enactment of this Act; or</text></paragraph> 
<paragraph id="H130A5A4F3A3F4404B5F352ED29D4466D"><enum>(2)</enum><text>the date on which the Secretary provides to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate notice of a determination by the Secretary that such infrastructure is not required to provide a positioning, navigation, and timing system to provide redundant capability in the event GPS signals are disrupted.</text></paragraph></subsection> 
<subsection commented="no" id="H40929AC78A6B49139CB5BAC5CDC90DFA"><enum>(b)</enum><header>Exception</header><text>Subsection (a) does not apply to activities necessary for the safety of human life.</text></subsection> 
<subsection id="HFFAB8DC9491043E4809CC74DF0887393"><enum>(c)</enum><header>Agreements</header><text>The Secretary may enter into cooperative agreements, contracts, and other agreements with Federal entities and other public or private entities, including academic entities, to develop a positioning, timing, and navigation system, including an enhanced LORAN system, to provide redundant capability in the event GPS signals are disrupted.</text></subsection></section></title>

<paragraph id="HDB5E76064F8A4F8DA6D10FBB0CAE21AB"><enum>(1)</enum><text>is governed solely by the State or Federal law under which it is issued; and</text></paragraph> 
<paragraph id="H0499CE254F94460F80A85BAE360D05ED"><enum>(2)</enum><text>shall not be treated as part of a vessel, or as an appurtenance or intangible of a vessel, for any purpose under Federal law.</text></paragraph></subsection> 
<subsection id="H2DFB9B4A282B4048AFD509C2C4E30E5E"><enum>(c)</enum><header>Authority of Secretary of Commerce not affected</header><text>Nothing in this section shall be construed as imposing any limitation upon the authority of the Secretary of Commerce—</text> 
<paragraph id="H890DDF0E9E3648DDA002604BBD554561"><enum>(1)</enum><text>to modify, suspend, revoke, or impose a sanction on any fishing permit issued by the Secretary of Commerce; or</text></paragraph> 
<paragraph id="HFD623EBD1F87433992580333DFCD98A7"><enum>(2)</enum><text>to bring a civil action to enforce such a modification, suspension, revocation, or sanction.</text></paragraph></subsection> 
<subsection id="HB8C990D71B22477281E4B05647B5D5FF"><enum>(d)</enum><header>Fishing permit defined</header><text>In this section the term <term>fishing permit</term> means any authorization of a person or vessel to engage in fishing that is issued under State or Federal law.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H402B2672F2FD4AD6A2DC2EBCDE440877"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of such chapter is amended by inserting after the item relating to section 31309 the following:</text>

<subparagraph id="H5C46886D94EF422A865041F56D1FB1A4"><enum>(A)</enum><text>the cost incurred by the Coast Guard in maintaining the services; minus</text></subparagraph> 
<subparagraph id="H7C705F369D074B4BB1D1AC6955F49EE9"><enum>(B)</enum><text>the amount of the proportionate share of the expense generated by vessels documented under the laws of the United States.</text></subparagraph></paragraph> 
<paragraph id="H2732EFADD92748E38A651C34564D189A"><enum>(2)</enum><header>Exception</header><text>Notwithstanding paragraph (1), Coast Guard aircraft may be used to carry out an agreement under subsection (a) if the President determines it necessary in the interest of national security.</text></paragraph> 
<paragraph id="H35223D59B6604F0CA8E2C414B10C53F2"><enum>(3)</enum><header>Notification</header><text>The President shall notify the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate of a determination made under paragraph (2) within 15 days after such determination.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection>

<subparagraph id="H8365B517AE834D61A071D25BDB912E19"><enum>(A)</enum><text>the Secretary determines that such property is not needed by the Maritime Administration; and</text></subparagraph> 
<subparagraph id="H801C21AAF66A45BDB43901617C328EEC"><enum>(B)</enum><text>the recipient—</text> 
<clause id="HC819830CEE574876A4043D0C424ED493"><enum>(i)</enum><text>is a nonprofit organization, a State, or a political subdivision of a State;</text></clause> 
<clause id="HA770BA96DBFC4E88AB938785D0C22FEC"><enum>(ii)</enum><text>agrees to hold the Government harmless for any claims arising from exposure to hazardous materials, including asbestos, polychlorinated biphenyls, or lead paint, after conveyance of the property;</text></clause> 
<clause id="H467597A661D746BE828D42E0B8E7063F"><enum>(iii)</enum><text>provides a description and explanation of the intended use of the property to the Secretary for approval;</text></clause> 
<clause id="HD8CAE1C108E246AB8D3BE199F0404885"><enum>(iv)</enum><text>has provided to the Secretary proof, as determined by the Secretary, of resources sufficient to accomplish the intended use provided under clause (iii) and to maintain the property;</text></clause> 
<clause id="H8744700568BB4D31A5089866B45C94BA"><enum>(v)</enum><text>agrees that when the recipient no longer requires the property, the recipient shall—</text> 
<subclause id="HB5373CBD25A54C77A13F4CBB164D1993"><enum>(I)</enum><text>return the property to the Secretary, at the recipient’s expense and in the same condition as received except for ordinary wear and tear; or</text></subclause> 
<subclause id="H2FD1D09BC62247AB8729366E0B1F49D1"><enum>(II)</enum><text>subject to the approval of the Secretary, retain, sell, or otherwise dispose of the property in a manner consistent with applicable law; and</text></subclause></clause> 
<clause id="H67CE1EBB55D34F9DA1E1D6E39D6650B2"><enum>(vi)</enum><text>agree to any additional terms the Secretary considers appropriate.</text></clause></subparagraph></paragraph> 
<paragraph id="H73C4ECEFF85A421AB9788E626D30E0FC"><enum>(2)</enum><header>Reversion</header><text>The Secretary shall include in any conveyance under this subsection terms under which all right, title, and interest conveyed by the Secretary shall revert to the Government if the Secretary determines the property has been used other than as approved by the Secretary under paragraph (1)(B)(iii).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H98B134877E104459A80E2523D503B427"><enum>305.</enum><header>Small shipyards</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/46/54101">Section 54101(i)</external-xref> of title 46, United States Code, is amended by striking <quote>2009 through 2013</quote> and inserting <quote>2015 and 2016</quote>.</text></section>

<paragraph commented="no" id="HC0BCA7BA9C90483280602CA588F83F91"><enum>(2)</enum><text>the injury, illness, or death arose outside the territorial waters of the United States; and</text></paragraph> 
<paragraph commented="no" id="H62D3C7FA51F54969903631D0E09354F6"><enum>(3)</enum><text>the seaman or the seaman’s personal representative has or had a right to seek compensation for the injury, illness, or death in, or under the laws of—</text> 
<subparagraph commented="no" id="HD01642B633BE4C8DA4462472508846CA"><enum>(A)</enum><text>the nation in which the vessel was registered at the time the claim arose; or</text></subparagraph> 
<subparagraph commented="no" id="HF80267CFB5C5453F9E3307D2DC1488C9"><enum>(B)</enum><text>the nation in which the seaman maintained citizenship or residency at the time the claim arose.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section>

<subsection id="H94F2F899946447CFA616847F539C1D5E"><enum>(a)</enum><header>Endorsements for veterans</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/46/7101">Section 7101</external-xref> of title 46, United States Code, is amended by adding at the end the following:</text>

<paragraph id="H399DBDF080224B57B1C2A98096958263"><enum>(2)</enum><text>satisfies all other requirements for such a license.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection>

<paragraph id="H3C933D4776F246A3907D53E93B777EB0"><enum>(1)</enum><header>In general</header><text>Title 14, United States Code, as amended by this Act, is further amended by inserting after section 427 the following:</text>

<subsection id="H46D34653439644228F19B9CB77B11010"><enum>(b)</enum><header>Deadline</header><text>Not later than 30 days after receiving a request for a sea service letter from a member or former member of the Coast Guard under subsection (a), the Secretary shall provide such letter to such member or former member if such member or former member satisfies the requirement under subsection (a)(1).</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HA551F1262F8E4E9BBD90AC5DD40626E7"><enum>(2)</enum><header>Clerical amendment</header><text>The analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/14/11">chapter 11</external-xref> of title 14, United States Code, as amended by this Act, is further amended by inserting after the item relating to section 427 the following:</text>

<paragraph id="HD059D70B4BB84D15A0155D243CE78E15"><enum>(2)</enum><header>Notification</header><text>Not later than 90 days after the date of enactment of this Act, the Secretary shall notify the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate on the steps taken to implement this subsection.</text></paragraph></subsection></section>

<clause commented="no" id="H3ADC7F2EE5214EB3B329D1A251E7909B"><enum>(ii)</enum><text>Amounts reimbursed or recovered under subsection (d).</text></clause></subparagraph> 
<subparagraph commented="no" id="HF36F8540EFFE494CA22DFE03DCA67DDB"><enum>(B)</enum><header>Limitation</header><text>Amounts may be credited to the Fund under subparagraph (A)(i) only if the unobligated balance of the Fund is less than $2,000,000.</text></subparagraph></paragraph> 
<paragraph commented="no" id="H321F198EBAB24D9A98B22C3B2EF64EFE"><enum>(3)</enum><header>Report required</header><text>On the date on which the President submits each budget for a fiscal year pursuant to <external-xref legal-doc="usc" parsable-cite="usc/31/1105">section 1105</external-xref> of title 31, United States Code, the Secretary shall submit to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate a report that describes—</text> 
<subparagraph commented="no" id="H4E9FE23B65594835B571FB2ED5A79C7C"><enum>(A)</enum><text>the amounts credited to the Fund under paragraph (2) for the preceding fiscal year; and</text></subparagraph> 
<subparagraph commented="no" id="H0E1DF17217FB4614B031147D5B833282"><enum>(B)</enum><text>amounts in the Fund that were expended for the preceding fiscal year.</text></subparagraph></paragraph></subsection> 
<subsection commented="no" id="HDB9663E47E5F43A9A59EE767F976E9F6"><enum>(b)</enum><header>Authorization of appropriations from fund</header><text display-inline="yes-display-inline">Amounts in the Fund may be appropriated to the Secretary for use to—</text> 
<paragraph commented="no" id="HE520A5F3AF214E50917DD5714F3476B9"><enum>(1)</enum><text>pay necessary support of—</text> 
<subparagraph commented="no" id="HE209DA7DAFB9490382189B87A03D3348"><enum>(A)</enum><text>a seafarer that—</text> 
<clause commented="no" id="HFA2CB5F6CD3B49F78915E89936297FE5"><enum>(i)</enum><text>enters, remains, or is paroled into the United States; and</text></clause> 
<clause commented="no" id="H1BA621D5FE7F4980A33BDE456A64D120"><enum>(ii)</enum><text>is involved in an investigation, reporting, documentation, or adjudication of any matter that is related to the administration or enforcement of this Act by the Coast Guard; and</text></clause></subparagraph> 
<subparagraph commented="no" id="H060DD5F3C2BF4E288974DBC0C298DDC9"><enum>(B)</enum><text display-inline="yes-display-inline">a seafarer that the Secretary determines was abandoned in the United States and has not applied for asylum under section 208 or 235 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1158">8 U.S.C. 1158</external-xref>, 1225); and</text></subparagraph></paragraph> 
<paragraph commented="no" id="H3B1040DEBCD84A0BB1A90B7D3335EE05"><enum>(2)</enum><text>reimburse a vessel owner or operator that has provided necessary support of a seafarer who has been paroled into the United States to facilitate an investigation, reporting, documentation, or adjudication of any matter that is related to the administration or enforcement of this Act by the Coast Guard, for the costs of such necessary support.</text></paragraph></subsection> 
<subsection commented="no" id="H8A4E74B3480E4F3FAB8E6E16D091D2CD"><enum>(c)</enum><header>Limitation</header><text>Nothing in this section shall be construed—</text> 
<paragraph commented="no" id="H0543A567E41C4CB794516557EEE60204"><enum>(1)</enum><text>to create a private right of action or any other right, benefit, or entitlement to necessary support for any person; or</text></paragraph> 
<paragraph commented="no" id="HC94CC125753F4E55B422EE5C6C09AE90"><enum>(2)</enum><text>to compel the Secretary to pay or reimburse the cost of necessary support.</text></paragraph></subsection> 
<subsection commented="no" id="H5C19D2C4453D40DDB9B1C892424F31D0"><enum>(d)</enum><header>Reimbursement; recovery</header> 
<paragraph commented="no" id="HB4BE61527F8E47F5A032FBCB8EBA8C73"><enum>(1)</enum><header>In general</header><text>A vessel owner or operator shall reimburse the Fund an amount equal to the total amount paid from the Fund for necessary support of a seafarer, if—</text> 
<subparagraph commented="no" id="H2632543A6A3B4D3A91FC14187922C7E8"><enum>(A)</enum><text>the vessel owner or operator—</text> 
<clause commented="no" id="H2C29DB96284B4C0BB93F5081B9248EBC"><enum>(i)</enum><text>during the course of an investigation, reporting, documentation, or adjudication of any matter under this Act that the Coast Guard referred to a United States attorney or the Attorney General, fails to provide necessary support of a seafarer who was paroled into the United States to facilitate the investigation, reporting, documentation, or adjudication; and</text></clause> 
<clause commented="no" id="H0CBB1CDA35AD467A8E05E985F7304CAB"><enum>(ii)</enum><text display-inline="yes-display-inline">subsequently is—</text> 
<subclause commented="no" id="H27EE781D770C4ABAB1D1B019B6195FB9"><enum>(I)</enum><text>convicted of a criminal offense related to such matter; or</text></subclause> 
<subclause commented="no" id="H95FE7F1412BC4D7EA1DEB64BC6879F2F"><enum>(II)</enum><text>required to reimburse the Fund pursuant to a court order or negotiated settlement related to such matter; or</text></subclause></clause></subparagraph> 
<subparagraph commented="no" id="HF020D51C60AC43CEA76349F8428DCB4C"><enum>(B)</enum><text>the vessel owner or operator abandons a seafarer in the United States, as determined by the Secretary based on substantial evidence.</text></subparagraph></paragraph> 
<paragraph commented="no" id="H65DEDE94F47840BDB455A790FD76B495"><enum>(2)</enum><header>Enforcement</header><text>If a vessel owner or operator fails to reimburse the Fund under paragraph (1), the Secretary may—</text> 
<subparagraph commented="no" id="HDB99A96FC9A046BEBD973082ED417783"><enum>(A)</enum><text>proceed in rem against the vessel on which the affected seafarer served in the Federal district court for the district in which the vessel is found; and</text></subparagraph> 
<subparagraph commented="no" id="H4621218AACF644A2ABEA85019EB950EB"><enum>(B)</enum><text>withhold or revoke the clearance required under <external-xref legal-doc="usc" parsable-cite="usc/46/60105">section 60105</external-xref> of title 46, United States Code, for the vessel.</text></subparagraph></paragraph> 
<paragraph commented="no" id="H600A31E57E5D4DB585109E7CB59876E0"><enum>(3)</enum><header>Remedy</header><text>A vessel may obtain clearance from the Secretary after it is withheld or revoked under paragraph (2)(B) if the vessel owner or operator—</text> 
<subparagraph commented="no" id="HD0F0D910EA334BF19ACCC160B6438DF8"><enum>(A)</enum><text>reimburses the Fund the amount required under paragraph (1); or</text></subparagraph> 
<subparagraph commented="no" id="H00AB81E618904E5DAD24ACF96420C664"><enum>(B)</enum><text>provides a bond, or other evidence of financial responsibility sufficient to meet the amount required to be reimbursed under paragraph (1).</text></subparagraph></paragraph></subsection> 
<subsection commented="no" id="HA550542325CF453E925E44E4C88E2A12"><enum>(e)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph commented="no" id="H2E546BA979C742238FD24F8A9D7961F6"><enum>(1)</enum><header>Abandons; abandoned</header><text>Each of the terms <term>abandons</term> and <term>abandoned</term> means—</text> 
<subparagraph commented="no" id="H00080503865A4314BFB596806B8C0541"><enum>(A)</enum><text>a vessel owner’s or operator’s unilateral severance of ties with a seafarer; and</text></subparagraph> 
<subparagraph commented="no" id="HA3B75FF3DB684C9AB0DBBAF7A2A7D58E"><enum>(B)</enum><text>a vessel owner’s or operator’s failure to provide necessary support of a seafarer.</text></subparagraph></paragraph> 
<paragraph commented="no" id="HE291512B9B5848359FACBD2E77B4ED7C"><enum>(2)</enum><header>Fund</header><text>The term <term>Fund</term> means the Abandoned Seafarers Fund established under this section.</text></paragraph> 
<paragraph commented="no" id="H7788D26CBE224FC0BBBF0370AA2D2B18"><enum>(3)</enum><header>Necessary support</header><text display-inline="yes-display-inline">The term <term>necessary support</term> means normal wages and expenses the Secretary considers reasonable for lodging, subsistence, clothing, medical care (including hospitalization), repatriation, and any other support the Secretary considers to be appropriate.</text></paragraph> 
<paragraph commented="no" id="H56B00457B33542ED8BE0E0A5BBBB1566"><enum>(4)</enum><header>Seafarer</header><text>The term <term>seafarer</term> means an alien crewman who is employed or engaged in any capacity on board a vessel subject to this Act.</text></paragraph></subsection></section><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph commented="no" id="H2265996A9A57481F955C52209683A1A1"><enum>(2)</enum><text>in section 9, by adding at the end the following:</text> 
<quoted-block id="HF15A9C685A764E72BFD5A25E76E3E4D8" style="OLC"> 
<subsection commented="no" id="H7B2F8919653A43D1A87C3AE3C6FFF3BC"><enum>(g)</enum><text>Any penalty collected under subsection (a) or (b) that is not paid under that subsection to the person giving information leading to the conviction or assessment of such penalties shall be deposited in the Abandoned Seafarers Fund established under section 18, subject to the limitation in subsection (a)(2)(B) of such section.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section> 
<section id="H318128A25F604217A2DA5A933D003CC3" section-type="subsequent-section"><enum>311.</enum><header>Clarification of high-risk waters</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/46/55305">Section 55305(e)</external-xref> of title 46, United States Code, is amended—</text> 
<paragraph id="H89499CC359B5462896F5DE83C6150A48"><enum>(1)</enum><text>in paragraph (1)—</text> 
<subparagraph id="H984F4DECADF64724BD50586841966B98"><enum>(A)</enum><text>by striking <quote>provide armed personnel aboard</quote> and inserting <quote>reimburse, subject to the availability of appropriations, the owners or operators of</quote>; and</text></subparagraph> 
<subparagraph id="HEA3406308AD348F2BC501095C0A7FE40"><enum>(B)</enum><text>by inserting <quote>for the cost of providing armed personnel aboard such vessels</quote> before <quote>if</quote>; and</text></subparagraph></paragraph> 
<paragraph id="H65A876657442440A89E8E5174327CC4B"><enum>(2)</enum><text>by striking paragraphs (2) and (3) and inserting the following:</text> 
<quoted-block display-inline="no-display-inline" id="HE851D56F018443258243D71723427DE5" style="USC"> 
<paragraph id="H71F2A879654A4048B70B43F4FB05BA1E"><enum>(2)</enum><text display-inline="yes-display-inline">In this subsection, the term <term>high-risk waters</term> means waters—</text> 
<subparagraph id="H2F467E3954764488BECEF2D9FABE1251"><enum>(A)</enum><text>so designated by the Commandant of the Coast Guard in the maritime security directive issued by the Commandant and in effect on the date on which an applicable voyage begins; and</text></subparagraph> 
<subparagraph id="H26BE4431CA964497BDB4E71B3C1C2B81"><enum>(B)</enum><text>in which the Secretary of Transportation determines an act of piracy is likely to occur based on documented acts of piracy that occurred in such waters during the 12-month period preceding the date on which an applicable voyage begins.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="HE34ED0D40D40447B98FDFCA7F9A38546"><enum>312.</enum><header>Uninspected passenger vessels in the Virgin Islands</header> 
<subsection id="H99450CF500B3453EB96DC355D628FA29"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/46/4105">Section 4105</external-xref> of title 46, United States Code, is amended—</text> 
<paragraph id="H5FB3D07CC9BD48779CC2FB8BAB72BFE3"><enum>(1)</enum><text>by redesignating subsection (b) as subsection (c); and</text></paragraph> 
<paragraph id="H60847D9A7B834C71A4800A996DDFBD82"><enum>(2)</enum><text>by inserting after subsection (a) the following:</text> 
<quoted-block display-inline="no-display-inline" id="HD5C1C9837CE14388A12D97DC03844450" style="USC"> 
<subsection id="HD2539B879F754FC49AA8D4D86B2AF4BE"><enum>(b)</enum><text display-inline="yes-display-inline">In applying this title with respect to an uninspected vessel of less than 24 meters overall in length that carries passengers to or from a port in the United States Virgin Islands, the Secretary shall substitute <quote>12 passengers</quote> for <quote>6 passengers</quote> each place it appears in section 2101(42) if the Secretary determines that the vessel complies with—</text> 
<paragraph id="HECA45A1B91094AA0BDBD50BAACB2D25E"><enum>(1)</enum><text>the Code of Practice for the Safety of Small Commercial Motor Vessels (commonly referred to as the <quote>Yellow Code</quote>), as published by the U.K. Maritime and Coastguard Agency and in effect on January 1, 2014; or</text></paragraph> 
<paragraph id="H868879AE092C450E9F29CF75CD149F8F"><enum>(2)</enum><text>the Code of Practice for the Safety of Small Commercial Sailing Vessels (commonly referred to as the <quote>Blue Code</quote>), as published by such agency and in effect on such date.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection commented="no" id="HA4D6F7E828674EF595D055623957C343"><enum>(b)</enum><header>Technical correction</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/46/4105">Section 4105(c)</external-xref> of title 46, United States Code, as redesignated by subsection (a)(1) of this section, is amended by striking <quote>Within twenty-four months of the date of enactment of this subsection, the</quote> and inserting <quote>The</quote>.</text></subsection></section> 
<section id="H7389F51C5D1049C6A3A666EBE6066C87" section-type="subsequent-section"><enum>313.</enum><header>Offshore supply vessel third-party inspection</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/46/3316">Section 3316</external-xref> of title 46, United States Code, is amended by redesignating subsection (f) as subsection (g), and by inserting after subsection (e) the following:</text> 
<quoted-block display-inline="no-display-inline" id="HD22C2A79614E4EABA42168F6E1C12606" style="OLC"> 
<subsection id="HEB9D04EB1F9F4FC5AA10F0E09120A9EA"><enum>(f)</enum> 
<paragraph commented="no" display-inline="yes-display-inline" id="H2DD0201C13E343138ECFEF7A0DF92A56"><enum>(1)</enum><text display-inline="yes-display-inline">Upon request of an owner or operator of an offshore supply vessel, the Secretary shall delegate the authorities set forth in paragraph (1) of subsection (b) with respect to such vessel to a classification society to which a delegation is authorized under that paragraph. A delegation by the Secretary under this subsection shall be used for any vessel inspection and examination function carried out by the Secretary, including the issuance of certificates of inspection and all other related documents.</text></paragraph> 
<paragraph id="H079FC6C507A14287BC74687CBEA8293F" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">If the Secretary determines that a certificate of inspection or related document issued under authority delegated under paragraph (1) of this subsection with respect to a vessel has reduced the operational safety of that vessel, the Secretary may terminate the certificate or document, respectively.</text></paragraph> 
<paragraph id="H79999C0DA74C451393376D8AAA6AAD64" indent="up1"><enum>(3)</enum><text>Not later than 2 years after the date of the enactment of the <short-title>Coast Guard and Maritime Transportation Act of 2014</short-title>, and for each year of the subsequent 2-year period, the Secretary shall provide to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate a report describing—</text> 
<subparagraph id="HD6ADBD26845D460995907FDDD97D66C4"><enum>(A)</enum><text>the number of vessels for which a delegation was made under paragraph (1);</text></subparagraph> 
<subparagraph id="H23A4FBB53FD241D38895C58C7E2D4085"><enum>(B)</enum><text>any savings in personnel and operational costs incurred by the Coast Guard that resulted from the delegations; and</text></subparagraph> 
<subparagraph id="H14A492B56A7C463F9AD6D00914264823"><enum>(C)</enum><text>based on measurable marine casualty and other data, any impacts of the delegations on the operational safety of vessels for which the delegations were made, and on the crew on those vessels.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="HEFE124CE2F2C46FEABDFFC6E644F3C44"><enum>314.</enum><header>Survival craft</header> 
<subsection id="HAF96B2A22924457CB8C471944CB17702"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc" parsable-cite="usc/46/3104">Section 3104</external-xref> of title 46, United States Code, is amended to read as follows:</text> 
<quoted-block id="H3E0B5A29A4E8438EA449701132EAC0BA" style="USC"> 
<section id="HBAA33952724C4A39901B46306F63F70A"><enum>3104.</enum><header>Survival craft</header> 
<subsection id="HB5FCE7344F3F4716933E391EB9BE7BFA"><enum>(a)</enum><header>Requirement to Equip</header><text>The Secretary shall require that a passenger vessel be equipped with survival craft that ensures that no part of an individual is immersed in water, if—</text> 
<paragraph id="H2ABDB45FE8404D56BD16931125F3289D"><enum>(1)</enum><text>such vessel is built or undergoes a major conversion after January 1, 2016; and</text></paragraph> 
<paragraph id="HC36D03F8365041749D08A38754141BFD"><enum>(2)</enum><text>operates in cold waters as determined by the Secretary.</text></paragraph></subsection> 
<subsection id="H235EB61B101F4F10A7813789FDAD0195"><enum>(b)</enum><header>Higher Standard of Safety</header><text>The Secretary may revise part 117 or part 180 of title 46, Code of Federal Regulations, as in effect before January 1, 2016, if such revision provides a higher standard of safety than is provided by the regulations in effect on or before the date of enactment of the <short-title>Coast Guard and Maritime Transportation Act of 2014</short-title>.</text></subsection> 
<subsection id="HE975C50DD73C43D781C4E3934B75B6FB"><enum>(c)</enum><header>Innovative and Novel Designs</header><text>The Secretary may, in lieu of the requirements set out in part 117 or part 180 of title 46, Code of Federal Regulations, as in effect on the date of the enactment of the <short-title>Coast Guard and Maritime Transportation Act of 2014</short-title>, allow a passenger vessel to be equipped with a life saving appliance or arrangement of an innovative or novel design that—</text> 
<paragraph id="H9BFE85BB72864C728E4DAE138B15E567"><enum>(1)</enum><text>ensures no part of an individual is immersed in water; and</text></paragraph> 
<paragraph id="HAE1E6E7A007044FE9C04EDFD366B8029"><enum>(2)</enum><text>provides an equal or higher standard of safety than is provided by such requirements as in effect before such date of enactment.</text></paragraph></subsection> 
<subsection id="H91D383ADF7414AE3B83A694FE0D568B6"><enum>(d)</enum><header>Built Defined</header><text>In this section, the term <term>built</term> has the meaning that term has under section 4503(e).</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HAD3FBD3DDAA34F4A816E4B3D991EEB3A"><enum>(b)</enum><header>Review; revision of regulations</header> 
<paragraph id="H49D83F9D97AE46CC940BD7D16887C65E"><enum>(1)</enum><header>Review</header><text>Not later than December 31, 2015, the Secretary of the department in which the Coast Guard is operating shall submit to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate a review of—</text> 
<subparagraph id="H66F7621E6F4F4BA19F8D45530D1A6FB2"><enum>(A)</enum><text>the number of casualties for individuals with disabilities, children, and the elderly as a result of immersion in water, reported to the Coast Guard over the preceding 30-year period, by vessel type and area of operation;</text></subparagraph> 
<subparagraph id="H5282FB3085B14108AF6ED23E31BE7AF4"><enum>(B)</enum><text>the risks to individuals with disabilities, children, and the elderly as a result of immersion in water, by passenger vessel type and area of operation;</text></subparagraph> 
<subparagraph id="H1DB2BF621F85481AA3190EFECCB5975A"><enum>(C)</enum><text>the effect that carriage of survival craft that ensure that no part of an individual is immersed in water has on—</text> 
<clause id="H59CCA201B42A42CF8BB86556024234BE"><enum>(i)</enum><text>passenger vessel safety, including stability and safe navigation;</text></clause> 
<clause id="H2381F543DFF54E77978E09F701487E37"><enum>(ii)</enum><text>improving the survivability of individuals, including individuals with disabilities, children, and the elderly; and</text></clause> 
<clause id="H1A1A3E78E0DD4311AD15E47FB90334B6"><enum>(iii)</enum><text display-inline="yes-display-inline">the costs, the incremental cost difference to vessel operators, and the cost effectiveness of requiring the carriage of such survival craft to address the risks to individuals with disabilities, children, and the elderly;</text></clause></subparagraph> 
<subparagraph id="H0ACAD2B119C24218A2B167302E9DBEBC"><enum>(D)</enum><text display-inline="yes-display-inline">the efficacy of alternative safety systems, devices, or measures in improving survivability of individuals with disabilities, children, and the elderly; and</text></subparagraph> 
<subparagraph id="H627CCAC0E5B5406081C147260BFCD040"><enum>(E)</enum><text display-inline="yes-display-inline">the number of small businesses and nonprofit vessel operators that would be affected by requiring the carriage of such survival craft on passenger vessels to address the risks to individuals with disabilities, children, and the elderly.</text></subparagraph></paragraph> 
<paragraph id="H28119AB3C1434DB78901A3B729440476"><enum>(2)</enum><header>Revision</header><text>Based on the review conducted under paragraph (1), the Secretary may revise regulations concerning the carriage of survival craft pursuant to <external-xref legal-doc="usc" parsable-cite="usc/46/3104">section 3104(c)</external-xref> of title 46, United States Code.</text></paragraph></subsection></section> 
<section id="H64D584D7B07748AAB9B667497B8BB26B" section-type="subsequent-section"><enum>315.</enum><header>Technical correction to title 46</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/46/2116">Section 2116(b)(1)(D)</external-xref> of title 46, United States Code, is amended by striking <quote>section 93(c)</quote> and inserting <quote>section 93(c) of title 14</quote>.</text></section> 
<section id="H0DDA131D281D4E269C84209898FD35AB"><enum>316.</enum><header>Enforcement</header> 
<subsection id="HEADA9A8BF6E94C498189AD28876C2B07"><enum>(a)</enum><header>In general</header> 
<paragraph id="HACC3334717A74A978F558B6B56C5E77E"><enum>(1)</enum><header>Determination of covered programs</header><text><external-xref legal-doc="usc" parsable-cite="usc/46/55305">Section 55305(d)</external-xref> of title 46, United States Code, is amended—</text> 
<subparagraph id="HB105FA2253F243249213E50715275535"><enum>(A)</enum><text>by amending paragraph (1) to read as follows:</text>

<paragraph id="H2A0289AAB32B4A5A934FEA4FEDCE07AA"><enum>(1)</enum><text>The Secretary of Transportation shall annually review programs administered by other departments and agencies and determine whether each such program is subject to the requirements of this section.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph> 
<subparagraph id="HE2967D86A2B44E1BA58AEB00F8396CC2"><enum>(B)</enum><text>by redesignating paragraph (2) as paragraph (5), and by inserting after paragraph (1) the following:</text> 
<quoted-block id="HD70D6D2370C04603A7E3A65ED5D70880" style="OLC"> 
<paragraph id="HDCA69E068E3044CA9322540282065867"><enum>(2)</enum><text>The Secretary shall have the sole responsibility to make determinations described in paragraph (1).</text></paragraph> 
<paragraph id="H35CDF272D70B4886823EC243C071DFEB"><enum>(3)</enum><text>A determination made by the Secretary under paragraph (1) regarding a program shall remain in effect until the Secretary determines that such program is no longer subject to the requirements of this section.</text></paragraph> 
<paragraph id="HA9B41B72DDEA45C0848DE8A38C500CC4"><enum>(4)</enum><text>Each department or agency administering a program determined by the Secretary under paragraph (1) to be subject to the requirements of this section shall administer such program in accordance with this section and any rules or guidance issued by the Secretary. The issuance of such rules or guidance is not a prerequisite to the issuance of final determinations under paragraph (1).</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph> 
<subparagraph id="H7E6F48B376E84B71874B8515CDD07E12"><enum>(C)</enum><text>in paragraph (5)(A), as so redesignated, by striking <quote>section;</quote> and inserting <quote>section, to determine compliance with the requirements of this section;</quote>; and</text></subparagraph> 
<subparagraph id="H3819A9B2D38549B2BBD8B06020D7743E"><enum>(D)</enum><text>by adding at the end the following:</text>

<paragraph id="HAE8BBD0D4B5847419CD143AAC7EC85A8"><enum>(6)</enum><text>On the date on which the President submits to Congress a budget pursuant to <external-xref legal-doc="usc" parsable-cite="usc/31/1105">section 1105</external-xref> of title 31, the Secretary shall submit to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate a report that—</text> 
<subparagraph id="H031938EF3FFE4FA582FC9EFFA3102BDE"><enum>(A)</enum><text>lists the programs determined under paragraph (1) to be subject to the requirements of this section; and</text></subparagraph> 
<subparagraph id="HCD0B2F99342342488FBE5C9D01CCEC3F"><enum>(B)</enum><text>describes the results of the most recent annual review required by paragraph (5)(A), including identification of the departments and agencies that transported cargo in violation of this section and any action the Secretary took under paragraph (5) with respect to each violation.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="HCF9665DD9061467B9AF4E48BD5EEAEC1"><enum>(2)</enum><header>Deadline for first review</header><text>The Secretary of Transportation shall complete the first review and make the determinations required under the amendment made by paragraph (1)(A) by not later than December 31, 2015.</text></paragraph></subsection> 
<subsection id="H93E0F2097C4A49DFB66A4D56108D5DA9"><enum>(b)</enum><header>Rulemaking</header> 
<paragraph id="H15C81F554CCC4A7F9CF2A3ACEFAEC996"><enum>(1)</enum><header>Authority</header><text><external-xref legal-doc="usc" parsable-cite="usc/46/55305">Section 55305(d)</external-xref> of title 46, United States Code, is further amended by adding at the end the following:</text>

<section id="H839367C007F543278E990BFA1B7880DB"><enum>317.</enum><header>Severe marine debris events</header> 
<subsection id="HC932C64145A34960BD389324EB691487"><enum>(a)</enum><header>NOAA Marine Debris Program</header><text display-inline="yes-display-inline">Section 3 of the Marine Debris Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1952">33 U.S.C. 1952</external-xref>) is amended—</text> 
<paragraph id="H86E072022C674EE097D1CB5A0C327F20"><enum>(1)</enum><text>in subsection (c)—</text> 
<subparagraph id="H478105C4FD8244ED95CF5993D51CF972"><enum>(A)</enum><text>in the subsection heading by striking <quote><header-in-text level="subsection" style="OLC">and contracts</header-in-text></quote> and inserting <quote><header-in-text level="subsection" style="OLC">contracts, and other agreements</header-in-text></quote>;</text></subparagraph> 
<subparagraph id="H694399759CC14A1EA219A1D1847EF9D4"><enum>(B)</enum><text display-inline="yes-display-inline">by striking paragraph (1) and inserting the following:</text>

<subparagraph id="HB7B6B985CE9245E8B614CE20CEB06B5E"><enum>(B)</enum><text>make grants to—</text> 
<clause id="H85CE88564E064CB59F532257AAA9A01B"><enum>(i)</enum><text>State, local, and tribal governments; and</text></clause> 
<clause id="HBDCD853DC0724C82AC2586EE5F8A148A"><enum>(ii)</enum><text>institutions of higher education, nonprofit organizations, and commercial organizations with the expertise or responsibility to identify, determine sources of, assess, prevent, reduce, and remove marine debris.</text></clause></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph> 
<subparagraph id="H8D361F59CF5F443BB4E53372E6E8FC91"><enum>(C)</enum><text display-inline="yes-display-inline">by striking paragraphs (4), (5), and (6) and inserting the following:</text> 
<quoted-block display-inline="no-display-inline" id="H2505B5E8A35D46CD8AC75BD399BDCB81" style="OLC"> 
<paragraph id="HC5E667D94EE74D67AA588A253150EBD0"><enum>(4)</enum><header>Grants</header> 
<subparagraph id="HC1D49A0B45774A88B7CDB1DDC5F39CD1"><enum>(A)</enum><header>Eligibility</header><text display-inline="yes-display-inline">To be eligible for a grant under paragraph (1)(B), an entity specified in that paragraph shall submit to the Administrator a marine debris project proposal.</text></subparagraph> 
<subparagraph id="H70066A6E4E5B498A9C7DCB9515066D1D"><enum>(B)</enum><header>Review and approval</header><text display-inline="yes-display-inline">The Administrator shall—</text> 
<clause id="HA01FD5B59C6F43B2AC3CB955693A0343"><enum>(i)</enum><text>review each marine debris project proposal submitted under subparagraph (A) to determine if the proposal meets grant criteria established by the Administrator and supports the purposes set forth in section 2;</text></clause> 
<clause id="H9103697879ED455D917410BB4ACFF189"><enum>(ii)</enum><text>after considering any written comments and recommendations with respect to the review conducted under clause (i), approve or disapprove a grant for the proposal; and</text></clause> 
<clause id="H5EC528F6C880422FB977A2F17075C8E8"><enum>(iii)</enum><text>provide notification of that approval or disapproval to the entity that submitted the proposal.</text></clause></subparagraph> 
<subparagraph id="H0221906B91D345F592E605CB320A2AF8"><enum>(C)</enum><header>Reporting</header><text display-inline="yes-display-inline">Each entity receiving a grant under paragraph (1)(B) shall provide reports to the Administrator as required by the Administrator. Each report provided shall include all information determined necessary by the Administrator for evaluating the progress and success of the project for which the grant was provided and describe the impact of the grant on the identification, determination of sources, assessment, prevention, reduction, or removal of marine debris.</text></subparagraph> 
<subparagraph id="HA76128B86B9D4480BD23639CE35767D4"><enum>(D)</enum><header>Training</header><text>The Administrator may require a recipient of a grant under this subsection to provide training to persons engaged in marine debris response efforts funded by such grant with respect to the potential impacts of marine debris, including nonindigenous species related to the debris, on the economy of the United States, the marine environment, and navigation safety.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H5DD1D833A5404AEE90C681FFFC9FFC4E"><enum>(2)</enum><text>by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="H83FCB35A4FC645148FCBFD07955E8AE8" style="OLC"> 
<subsection id="H1C0DF01CA83147D79E887096C6516509"><enum>(d)</enum><header>Severe marine debris events</header> 
<paragraph id="H599B523A664E401BAF2DEABFB1E40F81"><enum>(1)</enum><header>Grant preference</header><text>In evaluating proposals for grants under subsection (c), the Administrator may give preference in approving grants to proposals that address a severe marine debris event.</text></paragraph> 
<paragraph id="H4FB4690E52264A7EB5AE97C6944800ED"><enum>(2)</enum><header>Request for a declaration</header> 
<subparagraph id="HAA6376E65FAE41FF905FD636B288C4DC"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">For purposes of paragraph (1), the Governor of a State may request that the Administrator declare a severe marine debris event in such State or a region that includes such State.</text></subparagraph> 
<subparagraph id="H2BB833C5A4504900811403E16900AC78"><enum>(B)</enum><header>Response to requests</header><text>Not later than 30 days after the Administrator receives a request under subparagraph (A), the Administrator shall either—</text> 
<clause id="HC70AF9FAA40445C493F3C07C32B65BF3"><enum>(i)</enum><text>declare a severe marine debris event with respect to the request; or</text></clause> 
<clause id="HF189C756B3194C4EB8FE6300F82371B2"><enum>(ii)</enum><text>submit a response to the Governor who submitted the request, explaining why the Administrator has not declared a severe marine debris event with respect to the request.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HE498BA13AE1247C391963BDBB4D164F7"><enum>(b)</enum><header>Definitions</header><text>Section 7 of the Marine Debris Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1956">33 U.S.C. 1956</external-xref>) is amended—</text> 
<paragraph id="H73A6DB8212DA4464B3B1987502976143"><enum>(1)</enum><text>by moving paragraph (5) to appear before paragraph (6);</text></paragraph> 
<paragraph id="H5EBDD2575193448FB2FC56644FD40FFB"><enum>(2)</enum><text>by redesignating paragraphs (5), (6), and (7) as paragraphs (6), (7), and (8), respectively; and</text></paragraph> 
<paragraph id="H32DCB0B514ED4D8FA7590AA1020D6797"><enum>(3)</enum><text>by inserting after paragraph (4) the following:</text>

<subsection id="H94DBC4CB248B4F548814D1BE1322C330"><enum>(c)</enum><header>Severe marine debris event determination</header> 
<paragraph id="HF1A2AF2B03E44700841C0207BC72CBA7"><enum>(1)</enum><header>Authority to provide funds</header> 
<subparagraph id="HB49ACE40A28C4F38800C51DBF3D28430"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Administrator of the National Oceanic and Atmospheric Administration may provide funds to an eligible entity impacted by the covered severe marine debris event to assist such entity with the costs of any activity carried out to address the effects of such event.</text></subparagraph> 
<subparagraph id="HA5F36A69F7254B249122A082E5D4CB88"><enum>(B)</enum><header>Funding</header><text>The Administrator may provide funds under subparagraph (A) using any funds provided by the Government of Japan for activities to address the effects of the covered severe marine debris event.</text></subparagraph> 
<subparagraph id="HC860DCB313CC41C5B712B3C141033E6A"><enum>(C)</enum><header>Definitions</header><text>In this subsection, the following definitions apply:</text> 
<clause id="H70A9547B1777482EAFBE34807EC217AB"><enum>(i)</enum><header>Covered severe marine debris event</header><text>The term <quote>covered severe marine debris event</quote> means the events, including marine debris, resulting from the March 2011 Tohoku earthquake and subsequent tsunami.</text></clause> 
<clause id="H50B2B33906B84A8BB3F8EB37CA302B21"><enum>(ii)</enum><header>Eligible entity</header><text>The term <quote>eligible entity</quote> means any State (as defined in section 7 of the Marine Debris Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1956">33 U.S.C. 1956</external-xref>)), local, or tribal government.</text></clause></subparagraph></paragraph> 
<paragraph id="HE3B108E9FB3C49B19AEB5F7F2BB0B517"><enum>(2)</enum><header>Repeal</header><text>The Coast Guard and Maritime Transportation Act of 2012 (<external-xref legal-doc="public-law" parsable-cite="pl/112/213">Public Law 112–213</external-xref>) is amended—</text> 
<subparagraph id="HA40B1BE794B444EE9FC0F9472FD5C4CC"><enum>(A)</enum><text>in the table of contents in section 1(b) by striking the item relating to section 609; and</text></subparagraph>

<subsection id="HEA84332E78294DB2BB1B03FBED772E6D"><enum>(a)</enum><header>Establishment of advisory committee</header> 
<paragraph id="H26148F05F77A4BEAABD4816E433424E7"><enum>(1)</enum><header>Establishment</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/46/81">Chapter 81</external-xref> of title 46, United States Code, is amended by adding at the end the following:</text>

<section id="H5798CB3835D54143BD6359729DFBC509"><enum>8108.</enum><header>Merchant Marine Personnel Advisory Committee</header> 
<subsection id="H31398BCA19CD4CC2990337E66806DEB5"><enum>(a)</enum><header>Establishment</header><text>The Secretary shall establish a Merchant Marine Personnel Advisory Committee (in this section referred to as <quote>the Committee</quote>). The Committee—</text> 
<paragraph id="HB7051A699B7945BB9F32084BCBC92274"><enum>(1)</enum><text>shall act solely in an advisory capacity to the Secretary through the Commandant of the Coast Guard on matters relating to personnel in the United States merchant marine, including training, qualifications, certification, documentation, and fitness standards, and other matters as assigned by the Commandant;</text></paragraph> 
<paragraph id="H4923C99F2EC743E8A54DC82F35D79B8B"><enum>(2)</enum><text>shall review and comment on proposed Coast Guard regulations and policies relating to personnel in the United States merchant marine, including training, qualifications, certification, documentation, and fitness standards;</text></paragraph> 
<paragraph id="H02C95278AABC4F1688512C38EB622B66"><enum>(3)</enum><text>may be given special assignments by the Secretary and may conduct studies, inquiries, workshops, and fact finding in consultation with individuals and groups in the private sector and with State or local governments;</text></paragraph> 
<paragraph id="HBBA2EB4E60354B418D39EA27BEC0272E"><enum>(4)</enum><text>shall advise, consult with, and make recommendations reflecting its independent judgment to the Secretary;</text></paragraph> 
<paragraph id="H1E162BFEB2F1419BAFFF55D69F09B552"><enum>(5)</enum><text>shall meet not less than twice each year; and</text></paragraph> 
<paragraph id="H502E68E1D4BA47D3988FA0AAC967CAD6"><enum>(6)</enum><text>may make available to the Congress recommendations that the Committee makes to the Secretary.</text></paragraph></subsection> 
<subsection id="H3270870055AB402C901AF150300D13A8"><enum>(b)</enum><header>Membership</header> 
<paragraph id="HBE2A118E54ED4E0B919B819BB8CF9D4C"><enum>(1)</enum><header>In general</header><text>The Committee shall consist of not more than 19 members who are appointed by and serve terms of a duration determined by the Secretary. Before filling a position on the Committee, the Secretary shall publish a notice in the Federal Register soliciting nominations for membership on the Committee.</text></paragraph> 
<paragraph id="H901C034786F94A9981EEEBCFAD8B9682"><enum>(2)</enum><header>Required members</header><text>The Secretary shall appoint as members of the Committee—</text> 
<subparagraph id="H4B142118AEF147ABB1ED6C72E4940C6F"><enum>(A)</enum><text>9 United States citizens with active licenses or certificates issued under chapter 71 or merchant mariner documents issued under chapter 73, including—</text> 
<clause id="H4BB5720CEA2B49B59387B8AA55557644"><enum>(i)</enum><text>3 deck officers who represent the viewpoint of merchant marine deck officers, of whom—</text> 
<subclause id="HC4A50DD71BE94646B0707314B11AA50A"><enum>(I)</enum><text>2 shall be licensed for oceans any gross tons;</text></subclause> 
<subclause id="HA1FB4DDF1DEF4E58972F379B6D06D2F0"><enum>(II)</enum><text display-inline="yes-display-inline">1 shall be licensed for inland river route with a limited or unlimited tonnage;</text></subclause> 
<subclause id="H68F55A7D81B04EB99845DCCD2CF41954"><enum>(III)</enum><text>2 shall have a master’s license or a master of towing vessels license;</text></subclause> 
<subclause id="HC08F74D6688A46B4A2C30F5FF205307D"><enum>(IV)</enum><text>1 shall have significant tanker experience; and</text></subclause> 
<subclause id="H1D2537A8116D414DA7ABE0EDE6837E9C"><enum>(V)</enum><text>to the extent practicable—</text> 
<item id="HDC0EB7AA71384A88A86D4F70273DAAD2"><enum>(aa)</enum><text>1 shall represent the viewpoint of labor; and</text></item> 
<item id="H865E377ADAC7441C924D64836A7DC897"><enum>(bb)</enum><text>another shall represent a management perspective;</text></item></subclause></clause> 
<clause id="H73E9EA34A5EC4556B436EFADB2E204CA"><enum>(ii)</enum><text>3 engineering officers who represent the viewpoint of merchant marine engineering officers, of whom—</text> 
<subclause id="HDA47014976AB44F78C47212D9C9FFC07"><enum>(I)</enum><text>2 shall be licensed as chief engineer any horsepower;</text></subclause> 
<subclause id="HA7D20E77D3864E5788BF87F19BCEFC2E"><enum>(II)</enum><text>1 shall be licensed as either a limited chief engineer or a designated duty engineer; and</text></subclause> 
<subclause id="HD8E52E81F62B44E7937CF562F708792B"><enum>(III)</enum><text>to the extent practicable—</text> 
<item id="HAE2C63EDF9B7491791EF5CA78F6A3ECE"><enum>(aa)</enum><text display-inline="yes-display-inline">1 shall represent a labor viewpoint; and</text></item> 
<item id="H8858276CF3E34C9991205291F4A06379"><enum>(bb)</enum><text>another shall represent a management perspective;</text></item></subclause></clause> 
<clause id="HCC065E8B56E548D3A2DF25C290140229"><enum>(iii)</enum><text>2 unlicensed seamen, of whom—</text> 
<subclause id="HA1A80DD1A51F40CD8FA334B3A102B9B4"><enum>(I)</enum><text>1 shall represent the viewpoint of able-bodied seamen; and</text></subclause> 
<subclause id="H0E2A60700B664E8D865D2CEE50281A82"><enum>(II)</enum><text>another shall represent the viewpoint of qualified members of the engine department; and</text></subclause></clause> 
<clause id="HE974EE4AC2634601870F0BA95ECEC006"><enum>(iv)</enum><text>1 pilot who represents the viewpoint of merchant marine pilots;</text></clause></subparagraph> 
<subparagraph id="H16D4FB5701754C2F860A964D20C02557"><enum>(B)</enum><text>6 marine educators, including—</text> 
<clause id="HADBC8BB15E67439495FFA23397B0DE1D"><enum>(i)</enum><text>3 marine educators who represent the viewpoint of maritime academies, including—</text> 
<subclause id="HE4DA579EF3B141E1A010F4BD41E3EAB7"><enum>(I)</enum><text>2 who represent the viewpoint of State maritime academies and are jointly recommended by such State maritime academies; and</text></subclause> 
<subclause id="H6AC3CA20DEC04DDFAE777B41C5CBC1C3"><enum>(II)</enum><text>1 who represents either the viewpoint of the State maritime academies or the United States Merchant Marine Academy; and</text></subclause></clause> 
<clause id="H974094153D91446783650F57478AD539"><enum>(ii)</enum><text>3 marine educators who represent the viewpoint of other maritime training institutions, 1 of whom shall represent the viewpoint of the small vessel industry;</text></clause></subparagraph> 
<subparagraph id="H3A55EAF6EEF747F1A5AB2CA5D623D8FF"><enum>(C)</enum><text>2 individuals who represent the viewpoint of shipping companies employed in ship operation management; and</text></subparagraph> 
<subparagraph id="H5DD589A0435746D0A9914CFD5ADED833"><enum>(D)</enum><text>2 members who are appointed from the general public.</text></subparagraph></paragraph></subsection> 
<subsection id="H8CF6688771E14E9098A4A23892947412"><enum>(c)</enum><header>Chairman and vice chairman</header><text>The Committee shall elect one of its members as the Chairman and one of its members as the Vice Chairman. The Vice Chairman shall act as Chairman in the absence or incapacity of the Chairman, or in the event of a vacancy in the office of the Chairman.</text></subsection> 
<subsection id="H9CB2483D9C3F47559CB121A53BDE073B"><enum>(d)</enum><header>Subcommittees</header><text display-inline="yes-display-inline">The Committee may establish and disestablish subcommittees and working groups for any purpose consistent with this section, subject to conditions imposed by the Committee. Members of the Committee and additional persons drawn from the general public may be assigned to such subcommittees and working groups. Only Committee members may chair subcommittee or working groups.</text></subsection> 
<subsection id="H5214EF38558642A0B4E33BE4CD0CC1E7"><enum>(e)</enum><header>Termination</header><text>The Committee shall terminate on September 30, 2020.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H08ACBB9A09BB446E85C8EE2CAD708374"><enum>(2)</enum><header>Clerical amendment</header><text>The analysis at the beginning of such chapter is amended by adding at the end the following:</text>

<paragraph id="H08BC57C0393240898187B4B3DFD4A0EB"><enum>(1)</enum><header>Requirement</header><text>Not later than 1 year after the date of enactment of this Act, the Merchant Marine Personnel Advisory Committee established under the amendment made by subsection (a) shall—</text> 
<subparagraph id="HE067FA47EE1E49F1B09A5136F62F0276"><enum>(A)</enum><text>review—</text> 
<clause id="H523DAE2C18544D9E95348ED6FC2B5137"><enum>(i)</enum><text>the merchant mariner licensing, certification, and documentation programs and STCW Convention implementation programs of the 3 flag-states; and</text></clause> 
<clause id="H842B0C58EF4840C1B40B8259C46A0B75"><enum>(ii)</enum><text>State maritime academy problems regarding implementation of the STCW Convention; and</text></clause></subparagraph> 
<subparagraph id="H132296B3A3394CA09A1DB2E99E25F86C"><enum>(B)</enum><text>report to the Commandant of the Coast Guard—</text> 
<clause id="H3A6C98307F6C413EA4FABE77F28C7A32"><enum>(i)</enum><text>a description of each specific provision for which United States merchant mariner license, certification, and document and STCW Convention implementation requirements are more stringent than the requirements of such flag-state programs, and a recommendation of whether such United States provision should be retained, modified, or eliminated;</text></clause> 
<clause id="H0FAA4FC51C134F358889BE97B2F9DE11"><enum>(ii)</enum><text>a description of which United States merchant mariner license, certification, and document evaluation requirements must be complied with separately from similar STCW Convention evaluation requirements, any statutory requirement for such separate compliance, and steps that can be taken by the Coast Guard or by the Congress to minimize such redundant requirements; and</text></clause> 
<clause id="H6A04283780F34180B4FA5090799ACA37"><enum>(iii)</enum><text>a description of problems State maritime academies are having in implementing the STCW Convention and recommendations on how to address such problems.</text></clause></subparagraph></paragraph> 
<paragraph id="HFC1E549C8B5245878C1D7BF9A6C3177A"><enum>(3)</enum><header>Report to Congress</header><text>Within 6 months from the date the Commandant receives the report under paragraph (1)(B), the Commandant shall forward to the Congress a copy of the report with recommendations for actions to implement the report’s recommendations.</text></paragraph> 
<paragraph id="H978C4114C59D4269B4B852CF7B397027"><enum>(4)</enum><header>Definitions</header><text>In this subsection:</text> 
<subparagraph id="HCAFE5F38900D4E59B7B719F56B78CF24"><enum>(A)</enum><header>3 flag states</header><text>The term <quote>3 flag states</quote> means the 3 countries that are parties to the Annex to the International Maritime Organization Maritime Safety Committee Circular MSC.1/Circ.1163/Rev.8 dated January 7, 2013, and, of all such countries, have the greatest vessel tonnage documented under the laws of each respective country.</text></subparagraph> 
<subparagraph id="H553804E601544EBBB9AF411369D80EB6"><enum>(B)</enum><header>STCW convention</header><text>The term <quote>STCW Convention</quote> means the amendments to the International Convention on Standards of Training, Certification and Watchkeeping for Seafarers, 1978 that entered into force on January 1, 2012.</text></subparagraph></paragraph></subsection></section> 
<section id="H02524288181B4AB5AD9133C00EA7C26F" section-type="subsequent-section"><enum>320.</enum><header>Report on effect of LNG export carriage requirements on job creation in the United States maritime industry</header><text display-inline="no-display-inline">No later than 180 days after the date of the enactment of this Act, the Comptroller General of the United States shall submit to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate a report on the number of jobs, including vessel construction and vessel operating jobs, that would be created in the United States maritime industry each year in 2015 through 2025 if liquified natural gas exported from the United States were required to be carried—</text> 
<paragraph id="H37BA3C9893D34A938F47CAE67367C18D"><enum>(1)</enum><text>before December 31, 2018, on vessels documented under the laws of the United States; and</text></paragraph> 
<paragraph id="HEBD9D3AF2FEA44599606AB776FA5AC78"><enum>(2)</enum><text>after such date, on vessels documented under the laws of the United States and constructed in the United States.</text></paragraph></section></title> 
<title id="H4FC1144ADE944319BD557F2C12FB2C24"><enum>IV</enum><header>Federal Maritime Commission</header> 
<section id="H600BD98B997642C7BDDEC25BD2977DA9"><enum>401.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There is authorized to be appropriated to the Federal Maritime Commission $24,700,000 for each of fiscal years 2015 and 2016.</text></section> 
<section id="H8D0988367ABC4CADB1BC9CD277F1D063"><enum>402.</enum><header>Terms of Commissioners</header> 
<subsection id="HADCFC752054D497BA3832D85050B9390"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/46/301">Section 301(b)</external-xref> of title 46, United States Code, is amended—</text>

<section id="H1BA25704454848EDA3A9C77668E45250" section-type="subsequent-section"><enum>501.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be cited as the <quote>Commercial Vessel Discharge Reform Act of 2014</quote>.</text></section> 
<section id="H448ACCD296C143F6AFD489847348B092"><enum>502.</enum><header>Discharges incidental to the normal operation of certain vessels</header><text display-inline="no-display-inline">Section 2(a) of <external-xref legal-doc="public-law" parsable-cite="pl/110/299">Public Law 110–299</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/33/1342">33 U.S.C. 1342</external-xref> note) is amended by striking <quote>during the period beginning on the date of the enactment of this Act and ending on December 18, 2014,</quote>.</text></section></title> 
<title id="HCC5E50C7DB5E46A49409EBAA733EB28C"><enum>VI</enum><header>Miscellaneous</header> 
<section id="HD876850321B84D909D99C3191896FEA4"><enum>601.</enum><header>Distant water tuna fleet</header><text display-inline="no-display-inline">Section 421 of the Coast Guard and Maritime Transportation Act of 2006 (<external-xref legal-doc="public-law" parsable-cite="pl/109/241">Public Law 109–241</external-xref>; 120 Stat. 547) is amended—</text>

<section id="HDC852034F66A4C499424DB897DCD8164"><enum>602.</enum><header>Vessel determination</header><text display-inline="no-display-inline">The vessel assigned United States official number 1205366 is deemed a new vessel effective on the date of delivery of the vessel after January 1, 2012, from a privately owned United States shipyard, if no encumbrances are on record with the Coast Guard at the time of the issuance of the new certificate of documentation for the vessel.</text></section> 
<section id="HC9C53726CD894898BF87D0B4586925F6" section-type="subsequent-section"><enum>603.</enum><header>Lease authority</header> 
<subsection id="H501D908B88D34D6D8387E8BC65180FF4"><enum>(a)</enum><header>Authority</header><text display-inline="yes-display-inline">The Commandant of the Coast Guard may lease under <external-xref legal-doc="usc" parsable-cite="usc/14/93">section 93(a)(13)</external-xref> of title 14, United States Code, submerged lands and tidelands under the control of the Coast Guard without regard to the limitation under that section with respect to lease duration.</text></subsection> 
<subsection id="HAF7B26673BD64017857DE644B9D68E64"><enum>(b)</enum><header>Limitation</header><text display-inline="yes-display-inline">The Commandant may lease submerged lands and tidelands under subsection (a) only if—</text> 
<paragraph id="H20E900078FEC42A2B79470B30BD6B109"><enum>(1)</enum><text>lease payments are—</text> 
<subparagraph id="H369C20A082D34BF2B7CB05BFD9E96B8C"><enum>(A)</enum><text>received exclusively in the form of cash;</text></subparagraph> 
<subparagraph id="H90779C38F9A6484C89FABB731FE7D431"><enum>(B)</enum><text>equal to the fair market value of the leased submerged lands or tidelands, as determined by the Commandant; and</text></subparagraph> 
<subparagraph id="HC450BD4486E54B1F9D9A0E29B1378F83"><enum>(C)</enum><text>deposited in the fund established under <external-xref legal-doc="usc" parsable-cite="usc/14/687">section 687</external-xref> of title 14, United States Code; and</text></subparagraph></paragraph> 
<paragraph id="H3BECBB3855DC4286B0E2AC2D42682880"><enum>(2)</enum><text>the lease does not provide authority to or commit the Coast Guard to use or support any improvements to such submerged lands or tidelands, or obtain goods or services from the lessee.</text></paragraph></subsection></section> 
<section commented="no" id="H47BF64C5136147308AAFC7564F60ACB3"><enum>604.</enum><header>National maritime strategy</header> 
<subsection commented="no" id="H4769293BA25F45CFB664EF1B70890B22"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 60 days after the date of enactment of this Act, the Secretary of Transportation, in consultation with the Secretary of the department in which the Coast Guard is operating, shall submit to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate a national maritime strategy.</text></subsection> 
<subsection commented="no" id="HD400CF53B0E6468293BD323F84096445"><enum>(b)</enum><header>Contents</header><text>The strategy required under subsection (a) shall—</text> 
<paragraph commented="no" id="HAFC98A1E40424019AC63FB77E10699BF"><enum>(1)</enum><text>identify—</text> 
<subparagraph commented="no" id="H3EF0C0CAAB374B9B93258ABAA16F9BAC"><enum>(A)</enum><text>Federal regulations and policies that reduce the competitiveness of United States flag vessels in the international trade; and</text></subparagraph> 
<subparagraph commented="no" id="H69F180E530D04461B7769219AA768BE7"><enum>(B)</enum><text>the impact of reduced cargo flow due to reductions in the number of members of the United States Armed Forces stationed or deployed outside of the United States; and</text></subparagraph></paragraph> 
<paragraph commented="no" id="HBB4B7C72557C4376B7E3C1E2149EE06C"><enum>(2)</enum><text>include recommendations to—</text> 
<subparagraph commented="no" id="H1BD38F4731DC4BDF924FD8C3A1EAD39C"><enum>(A)</enum><text>make United States flag vessels more competitive in shipping routes between United States and foreign ports;</text></subparagraph> 
<subparagraph commented="no" id="HBB3A85882D044EEAB74885EE1CFEEEC0"><enum>(B)</enum><text>increase the use of United States flag vessels to carry cargo imported to and exported from the United States;</text></subparagraph> 
<subparagraph commented="no" id="H702F99128D2B40EAA05660A66640F4EE"><enum>(C)</enum><text>assure compliance by Federal agencies with <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/46/553">chapter 553</external-xref> of title 46, United States Code;</text></subparagraph> 
<subparagraph commented="no" id="H3F9D59C1B66D4946B31DC2F4D632D5D5"><enum>(D)</enum><text>increase the use of third-party inspection and certification authorities to inspect and certify vessels;</text></subparagraph> 
<subparagraph commented="no" id="HB0468675D1104CF5835CE9C17C4B8E2C"><enum>(E)</enum><text>increase the use of short sea transportation routes designated under <external-xref legal-doc="usc" parsable-cite="usc/46/55601">section 55601(c)</external-xref> of title 46, United States Code, to enhance intermodal freight movements; and</text></subparagraph> 
<subparagraph commented="no" id="H19BD3902D61A4C228893D609189388AE"><enum>(F)</enum><text>enhance United States shipbuilding capability.</text></subparagraph></paragraph></subsection></section> 
<section id="H30A6D5091DA949D6AB2BF971BB2948A5"><enum>605.</enum><header>IMO Polar Code negotiations</header><text display-inline="no-display-inline">Not later than 30 days after the date of the enactment of this Act, and thereafter with the submission of the budget proposal submitted for each of fiscal years 2016, 2017, and 2018 under <external-xref legal-doc="usc" parsable-cite="usc/31/1105">section 1105</external-xref> of title 31, United States Code, the Secretary of the department in which the Coast Guard is operating shall submit to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate, a report on—</text> 
<paragraph id="HDE6209E4A3334988A30CE5841A252493"><enum>(1)</enum><text>the status of the negotiations at the International Maritime Organization regarding the establishment of a draft international code of safety for ships operating in polar waters, popularly known as the Polar Code, and any amendments proposed by such a code to be made to the International Convention for the Safety of Life at Sea and the International Convention for the Prevention of Pollution from Ships;</text></paragraph> 
<paragraph id="H74F276C8831643C19875C5AFFB3381AC"><enum>(2)</enum><text display-inline="yes-display-inline">the coming into effect of such a code and such amendments for nations that are parties to those conventions;</text></paragraph> 
<paragraph id="H7D6AC49783264C008F62956DB8A3586F"><enum>(3)</enum><text display-inline="yes-display-inline">impacts, for coastal communities located in the Arctic (as that term is defined in the section 112 of the Arctic Research and Policy Act of 1984 (<external-xref legal-doc="usc" parsable-cite="usc/15/4111">15 U.S.C. 4111</external-xref>)) of such a code or such amendments, on—</text> 
<subparagraph id="HF4F4F58C8123487C847349D387FC4C3D"><enum>(A)</enum><text>the costs of delivering fuel and freight; and</text></subparagraph> 
<subparagraph id="H3881FF3D3DA04A928D38B4DB4CB3C075"><enum>(B)</enum><text>the safety of maritime transportation; and</text></subparagraph></paragraph> 
<paragraph id="HAC738FEBCD834590BAB309ED3487150A"><enum>(4)</enum><text>actions the Secretary must take to implement the requirements of such a code and such amendments.</text></paragraph></section> 
<section id="HB7980233CD064135B761BC60317ACA26"><enum>606.</enum><header>Valley View Ferry</header> 
<subsection id="H6652C8A97AB94273BA3EA54A4C4C5E6E"><enum>(a)</enum><header>Exemption</header><text><external-xref legal-doc="usc" parsable-cite="usc/46/8902">Section 8902</external-xref> of title 46, United States Code, shall not apply to the vessel John Craig (United States official number D1110613) when such vessel is operating on the portion of the Kentucky River, Kentucky, located at approximately mile point 158, in Pool Number 9, between Lock and Dam Number 9 and Lock and Dam Number 10.</text></subsection> 
<subsection id="HED490D3033944578B9940F4603D27F10"><enum>(b)</enum><header>Application</header><text display-inline="yes-display-inline">Subsection (a) shall apply on and after the date on which the Secretary determines that a licensing requirement has been established under Kentucky State law that applies to an operator of the vessel John Craig.</text></subsection></section> 
<section id="H41AFFEC5D3EB45FEA4BB46F8036F9DAC"><enum>607.</enum><header>Competition by United States flag vessels</header> 
<subsection id="H1750D5C71CF8495FB11C409DD779534E"><enum>(a)</enum><header>In general</header><text>The Commandant of the Coast Guard shall enter into an arrangement with the National Academy of Sciences to conduct an assessment of authorities under subtitle II of title 46, United States Code, that have been delegated to the Coast Guard that impact the ability of vessels documented under the laws of the United States to effectively compete in the carriage of merchandise and passengers in the international trade.</text></subsection> 
<subsection id="H69C103C10BC24349B539259931F85CE0"><enum>(b)</enum><header>Review of differences with IMO standards</header><text>The assessment under subsection (a) shall include a review of differences between United States laws, policies, regulations, and guidance governing the inspection of vessels documented under the laws of the United States and standards set by the International Maritime Organization governing the inspection of vessels.</text></subsection> 
<subsection id="H5486D14C4FD64F54B4EDBB68879A5A62"><enum>(c)</enum><header>Deadline</header><text>Not later than 180 days after the date on which the Commandant enters into an arrangement with the National Academy of Sciences under subsection (a), the Commandant shall submit the assessment required under such subsection to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate.</text></subsection></section> 
<section id="H96C22CE217B5411B9416206DBC66F5CB" section-type="subsequent-section"><enum>608.</enum><header>Survey</header><text display-inline="no-display-inline">Not later than 30 days after the date of enactment of this Act, the Commandant of the Coast Guard shall submit to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate a survey of the parcel of real property under the administrative control of the Coast Guard, consisting of approximately 1.95 acres (measured at the mean low-water mark) located at the entrance to Gig Harbor, Washington, and commonly known as the Gig Harbor Sand Spit Area.</text></section>
