which was referred to the <committee-name committee-id="HWM00">Committee on Ways and Means</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Internal Revenue Code of 1986 to adjust the phaseout of the health insurance tax credit for geographic variations in the cost-of-living.</official-title></form><legis-body id="H6258A8ADF249406EAD846FD7BB90F72D" style="OLC"><section id="H14087D68628940098AADF9E8A3589C76" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Fair Access to Health Care Act</short-title></quote>.</text></section><section id="H2C47956E68E5402CA0FB52C45B053C85"><enum>2.</enum><header>Phaseout of health insurance tax credit adjusted to take into account geographic variation in the cost-of-living</header><subsection id="H65EAFF1D1EA14F4886D9F7639EC40EFE"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/36B">Section 36B(b)</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following new paragraph:</text><quoted-block display-inline="no-display-inline" id="H7B170497C6644B79870A6B6708A5643D" style="OLC"><paragraph id="H632BCE9574214679918E6F5F14F2E819"><enum>(4)</enum><header>Geographic adjustment for cost-of-living</header><subparagraph id="H4DCAE019CC734360835E253517D715EA"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">In the case of a taxpayer whose principal place of residence for any taxable year is located in a high cost area, there shall be substituted for each specified amount an amount which bears the same proportion to such specified amount as the SPM with respect to such high cost area bears to the national average SPM.</text></subparagraph><subparagraph id="HAF8FC949A3684315A4242369036DABCF"><enum>(B)</enum><header>High cost area</header><text>For purposes of this paragraph, the term <term>high cost area</term> means any metropolitan statistical area or non-metropolitan area the SPM for which exceeds the national average SPM.</text></subparagraph><subparagraph id="H6BAFEC1BF9274DC691BF833E43C58363"><enum>(C)</enum><header>Specified amounts</header><text>For purposes of this paragraph, the term <term>specified amount</term> means each of the following:</text><clause id="H94DECE8D001E46D493D262142780534C"><enum>(i)</enum><text>The <quote>400</quote> amount contained in the table in paragraph (3)(A)(i).</text></clause><clause id="HB65B57B9484F42849B27E2DE0D8278D3"><enum>(ii)</enum><text>The <quote>400</quote> amount contained in subsection (c)(1)(A).</text></clause></subparagraph><subparagraph id="H9B4CE68AF1C543D196176B6FFDF021F2"><enum>(D)</enum><header>SPM</header><text display-inline="yes-display-inline">For purposes of this paragraph—</text><clause id="H005E4F7A53C74958B96843EF51572343"><enum>(i)</enum><header>In general</header><text>The term <term>SPM</term> means, with respect to each calendar year, the Supplemental Poverty Measure as determined by the Bureau of the Census.</text></clause><clause id="H1D4B843487AA41E7AC242C8CE73BDC9F"><enum>(ii)</enum><header>National average SPM</header><text display-inline="yes-display-inline">The national average SPM shall be determined without regard to Alaska and Hawaii.</text></clause><clause id="HB8174FFE1BF14359B2CB8CA2A90564C5"><enum>(iii)</enum><header>Determination for taxable year based on preceding calendar year</header><text>SPM with respect to any taxable year shall be determined on the basis of the calendar year preceding the calendar year in which the taxable year begins.</text></clause></subparagraph><subparagraph id="H83125EFD7D4D44B4BEDA6D4576B03840"><enum>(E)</enum><header>Alternative measure of cost-of-living</header><text>If the Secretary determines that another measure of cost-of-living is more appropriate than the SPM for purposes of this paragraph, the Secretary shall use such measure in lieu of the SPM.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HA9635823B6724411B70023B0D8102AA6"><enum>(b)</enum><header>Effective date</header><text>The amendment made by this section shall apply to taxable years beginning after the date of the enactment of this Act.</text></subsection></section></legis-body></bill>
