<official-title display="yes">To provide for the upgrade of the vehicle fleet of the United States Postal Service, and for other purposes.</official-title>

<section id="H479E437180CE441392C5ED384E6FFF8A" section-type="section-one" commented="no"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Federal Leadership in Energy Efficient Transportation Act of 2014</short-title></quote> or the <quote>FLEET Act</quote>.</text></section> 
<section id="H5CB1E3029CC4487383E69E81AF859629"><enum>2.</enum><header>Purposes</header> <text display-inline="no-display-inline">The purposes of this Act are to provide for the upgrade of the vehicle fleet of the United States Postal Service, to improve mail delivery services to benefit customers and the environment, to increase savings by reducing maintenance or other costs, and to set benchmarks to maximize fuel economy and reduce emissions for the Postal fleet with the goal of making the Postal Service a national leader in efficiency and technology innovation. </text></section> 
<section id="HE18A8D61C5D5406BA4201241052D620B"><enum>3.</enum><header>Authority to enter into energy savings performance contracts</header><text display-inline="no-display-inline">Section 804(4) of the National Energy Conservation Policy Act (<external-xref legal-doc="usc" parsable-cite="usc/42/8287c">42 U.S.C. 8287c(4)</external-xref>) is amended—</text> 
<paragraph id="H00CF9C9FD6E2417BA444763BC4A915E2"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (A), by striking <quote>or</quote> after the semicolon;</text></paragraph> 
<paragraph id="HC7847CD413E4414B81513545C3DB309C"><enum>(2)</enum><text display-inline="yes-display-inline">in subparagraph (B), by striking the period at the end and inserting <quote>; or</quote>; and</text></paragraph> 
<paragraph id="H346A97D054CD4759B0968575C38AAA92"><enum>(3)</enum><text>by adding at the end the following new subparagraph:</text> 
<quoted-block style="OLC" id="HF98A90FA2FD64AE1A9A1965F18E0E083" display-inline="no-display-inline"> 
<subparagraph id="H94A17E96D1D74F0D939F7DC5A9E6878F"><enum>(c)</enum><text display-inline="yes-display-inline">in the case of a contract in which the United States Postal Service is a party—</text> 
<clause id="H391B1F9C20E74609BDA96EFD014AF56F"><enum>(i)</enum><text>the purchase or lease of low emission and fuel efficient vehicles;</text></clause> 
<clause id="HD750E146076041DBA15EDACE4402A169"><enum>(ii)</enum><text display-inline="yes-display-inline">a measure to upgrade a vehicle owned, operated, leased, or otherwise controlled by or assigned to the United States Postal Service to increase average fuel economy and reduce the emissions of carbon dioxide of such vehicle; or</text></clause> 
<clause id="H87C8F6BAEE194658A3065B35BA77EED7"><enum>(iii)</enum><text>the construction of infrastructure, including electric vehicle charging stations, to support vehicles described in clauses (i) and (ii).</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></section> 
<section id="H48A872DDC0E94DBABB03316C36749B46" commented="no"><enum>4.</enum><header>Upgrade of Postal fleet</header> 
<subsection id="HCBFF5C6E78FC43C78B424EDBBEF9A769" commented="no"><enum>(a)</enum><header>Postal fleet requirements</header> 
<paragraph id="HBC69429A9DC7416A96F2CBD8027D362D"><enum>(1)</enum><header>Motor vehicle standards</header><text display-inline="yes-display-inline">The Postmaster General shall develop guidelines for contracted vehicles and vehicles purchased or leased for use by the Postal Service, that, at a minimum, provide—</text> 
<subparagraph id="H1ADCA4BF4C30467381E62480C332A558"><enum>(A)</enum><text display-inline="yes-display-inline">for light-duty vehicles—</text> 
<clause id="HB6A57AC67D11407791BC2E57B445F104"><enum>(i)</enum><text display-inline="yes-display-inline">that emissions of carbon dioxide comply with applicable standards developed by the Environmental Protection Agency under title II of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7521">42 U.S.C. 7521 et seq.</external-xref>) and may not exceed, on average, 250 grams per mile; and</text></clause> 
<clause id="H4AAF840B58BE45FB886B0E40948B0F9F"><enum>(ii)</enum><text display-inline="yes-display-inline">to meet applicable average fuel economy standards developed by the National Highway Traffic Safety Administration under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/329">chapter 329</external-xref> of title 49, United States Code, of 34.1 miles per gallon; and</text></clause></subparagraph> 
<subparagraph id="H1AB09200E1FB47B3A3219D45B131062C" commented="no"><enum>(B)</enum><text>for medium-duty and heavy-duty vehicles, that comply with applicable standards—</text> 
<clause id="HC061680248194EDB9BE27762F9AE99F5" commented="no"><enum>(i)</enum><text>for emissions of carbon dioxide developed by the Environmental Protection Agency under title II of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7521">42 U.S.C. 7521 et seq.</external-xref>); and</text></clause> 
<clause id="HB39137852D744992A73F52F94A892989" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">for average fuel economy developed by the National Highway Traffic Safety Administration under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/329">chapter 329</external-xref> of title 49, United States Code. </text></clause></subparagraph></paragraph> 
<paragraph id="H3BD7FC108C9547BCA00F80E40111844A"><enum>(2)</enum><header>Applicability</header><text display-inline="yes-display-inline">The standards described in paragraph (1) shall apply to contracted vehicles and vehicles purchased or leased for use by the Postal Service after the date that is 1 year after the date of enactment of this Act.</text> </paragraph> 
<paragraph id="HEC3636A72CFC4EC1BE66FD3DE8B84B12" commented="no"><enum>(3)</enum><header>Reduction in consumption of petroleum products</header><text display-inline="yes-display-inline">The Postmaster General shall reduce the total consumption of petroleum products by vehicles in the Postal fleet by a minimum of 2 percent annually through the end of fiscal year 2025, relative to the baseline established for fiscal year 2005. </text></paragraph></subsection> 
<subsection id="HADFBEA3A0EB44E0B819BF0B66C7DE9FF" commented="no"><enum>(b)</enum><header>Replacing vehicles within the Postal fleet</header><text display-inline="yes-display-inline">The Postmaster General shall conduct a cost-benefit analysis of vehicles in the Postal fleet to determine if the cost to maintain any such vehicle outweighs the benefit or savings of replacing the vehicle. </text></subsection> 
<subsection id="HBC69CA9B5A1E44A4AC1AACE5A7F4131B" commented="no"><enum>(c)</enum><header>Route requirements</header><text display-inline="yes-display-inline">To inform and prioritize purchases, the Postmaster General shall review and identify Postal delivery routes to determine if motor vehicles used on such routes can be replaced with technologies that increase average fuel economy or reduce emissions of carbon dioxide. </text></subsection> 
<subsection id="H4F7E7F69B75B4F1FA10FD27B64490F37" commented="no"><enum>(d)</enum><header>Reporting requirements</header><text display-inline="yes-display-inline">The Postmaster General shall submit a report to Congress—</text> 
<paragraph id="H47090D1D027A4DBA9743C12156AEDF60"><enum>(1)</enum><text display-inline="yes-display-inline">not later than 1 year after the date of enactment of this Act, that contains a plan to achieve the requirements of subsection (a) and recommendations for vehicle body design specifications for vehicles purchased for the Postal fleet that would increase average fuel economy and reduce emissions of carbon dioxide of any such vehicle; and</text> </paragraph> 
<paragraph id="HEDB88E73C2E045CB9112EC4B29C22616"><enum>(2)</enum><text display-inline="yes-display-inline">annually, that describes—</text> 
<subparagraph id="H00752DA12AB9437688D618F4AF72A971"><enum>(A)</enum><text>the progress in meeting the annual target described in subsection (a)(3); and</text></subparagraph> 
<subparagraph id="H4A2E73EFD4254785B3FEDB255C31EF54"><enum>(B)</enum><text>any changes to Postal delivery routes or vehicle purchase strategies made pursuant to subsection (c).</text></subparagraph></paragraph></subsection> 
<subsection id="HEC84402B5CE444E88780A84DE1F9F07F"><enum>(e)</enum><header>Restrictions</header><text display-inline="yes-display-inline">To meet the requirements of this Act, the Postmaster General may not—</text> 
<paragraph id="HF21696C5150F4558A98AB4E5263BAA59"><enum>(1)</enum><text display-inline="yes-display-inline">reduce the frequency of delivery of mail to fewer than 6 days each week; </text></paragraph> 
<paragraph id="H3D9B9F916F4F4BE1BAD3B88F7DA07A26"><enum>(2)</enum><text display-inline="yes-display-inline">close post offices or postal distribution facilities; </text></paragraph> 
<paragraph id="H8640FEC206534DB3BA9B02269F918EC3"><enum>(3)</enum><text display-inline="yes-display-inline">take any action that would restrict or diminish a collective bargaining agreement or eliminate or reduce any employee benefits; or</text></paragraph> 
<paragraph id="HC2659BACFA3C45EFA102EBEBD3107809"><enum>(4)</enum><text display-inline="yes-display-inline">enter into a contract with a private company to perform duties that, as of the date of enactment of this Act, are performed by bargaining unit employees.</text> </paragraph></subsection> </section> 
<section id="H1AEDF90210D04A108B1B5D08744CD981"><enum>5.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act the following definitions apply:</text> 
<paragraph id="H1807A64681434E7DA2F7DA28336310B7" commented="no"><enum>(1)</enum><header>Contracted vehicle</header><text display-inline="yes-display-inline">The term <term>contracted vehicle</term>—</text> 
<subparagraph id="H45597D8FCA064BAA8BD419578E6885F4"><enum>(A)</enum><text>means any motor vehicle used in carrying out a contract for surface mail delivery pursuant to <external-xref legal-doc="usc" parsable-cite="usc/39/5005">section 5005(a)(3)</external-xref> of title 39, United States Code; and</text></subparagraph> 
<subparagraph id="HB2698C346CF7485B8C451EFDE53C0FB1"><enum>(B)</enum><text display-inline="yes-display-inline">does not include any motor vehicle used in carrying out a contract for surface mail delivery pursuant to sections 406 and 407 of such title. </text></subparagraph></paragraph> 
<paragraph id="HEF914F1E3E3E424D8E9DC36DFBFE6080"><enum>(2)</enum><header>Motor vehicle</header><text display-inline="yes-display-inline">The term <term>motor vehicle</term> means any self-propelled vehicle designed for transporting persons or property on a street or highway.</text></paragraph> 
<paragraph id="H5BBF9A76FF754EB8BD88B27FA06C39AB"><enum>(3)</enum><header>Postal delivery route</header><text display-inline="yes-display-inline">The term <term>Postal delivery route</term> means the transportation route for surface mail delivery.</text></paragraph> 
<paragraph id="H4BCF6A0201EE48ECBC014FE9CC1F5197"><enum>(4)</enum><header>Postal fleet</header><text>The term <term>Postal fleet</term> means any vehicle that is owned, operated, leased, or otherwise controlled by or assigned to the Postal Service. </text></paragraph> 
<paragraph id="HA721987DF72C4E5698CC60C94329EEB1"><enum>(5)</enum><header>Postal Service</header><text>The term <term>Postal Service</term> means the United States Postal Service.</text></paragraph> </section>
