R. 3927</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action><action-date date="20140121">January 21, 2014</action-date><action-desc><sponsor name-id="G000556">Mr. Grayson</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend <external-xref legal-doc="usc" parsable-cite="usc/31/3716">section 3716</external-xref> of title 31, United States Code, to raise to at least the poverty line the amount of Social Security benefits that are exempt from being offset to satisfy student loan debt.</official-title></form><legis-body id="H3B9F11BD849E4457BD7FE5E7DDECDDA4" style="OLC"><section id="H859AEDDE8F054533A92D369E6D021DEA" section-type="section-one"><enum>1.</enum><header>Amendment to raise to the poverty line the amount of Social Security benefits that are exempt from being offset to satisfy student loan debt</header><subsection id="H560BB7AD89A440DF89F8ADC3A414F61E"><enum>(a)</enum><header>Amendment</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/31/3716">Section 3716(c)(3)</external-xref> of title 31, United States Code, is amended—</text><paragraph id="H76D68141B5B54A2F93CFA7D60C292CCA"><enum>(1)</enum><text>in clause (i), by inserting after <quote>except as provided in clause (ii)</quote> the following: <quote>or clause (iii)</quote>; and</text></paragraph><paragraph id="H1ADED6F8EE9749E98DA853A8795F6B5B"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following new clause:</text><quoted-block display-inline="no-display-inline" id="H940C567DB39741D3BA1E83AA0ABE427B" style="OLC"><clause id="HA2F5511400434C59880A56C8C0E386DE" indent="up3"><enum>(iii)</enum><text display-inline="yes-display-inline">For purposes of clause (ii), in the case of a claim for student loan debt, in lieu of the exemption amount of $9,000 applicable with respect to payments due an individual under the Social Security Act, the amount of the poverty line shall be the exemption amount. For purposes of this clause—</text><subclause id="H1834D2F29B824876B08399FF93F06D7B"><enum>(I)</enum><text>the term <term>student loan debt</term> means the outstanding balance of principal or interest owed on any loan made, insured, or guaranteed under title IV of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1070">20 U.S.C. 1070 et seq.</external-xref>); and</text></subclause><subclause id="HD7E4F37D537E494EB8EC84D229196F6D"><enum>(II)</enum><text>the term <term>poverty line</term> means the annual poverty guideline for the applicable calendar year (as updated annually in the Federal Register by the Department of Health and Human Services under the authority of section 673(2) of the Omnibus Budget Reconciliation Act of 1981) as applicable to a single individual for the year in which the exemption under clause (ii) is applied.</text></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H1FF61BE770B74ACDACB5221CD6AFC182"><enum>(b)</enum><header>Effective date</header><text>The amendment made by this Act shall apply with respect to payments made under the Social Security Act after the date that is 90 days after the date of the enactment of this Act.</text></subsection></section></legis-body></bill>
