R. 3921</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action><action-date date="20140116">January 16, 2014</action-date><action-desc><sponsor name-id="P000598">Mr. Polis</sponsor> (for himself, <cosponsor name-id="C001091">Mr. Castro of Texas</cosponsor>, and <cosponsor name-id="D000617">Ms. DelBene</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HED00">Committee on Education and the Workforce</committee-name>, and in addition to the Committee on the <committee-name committee-id="HJU00">Judiciary</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title>To incentivize State support for postsecondary education and to promote increased access and affordability for higher education for students, including Dreamer students.</official-title></form><legis-body id="H287AE558FC974E6DA0597417C025E1B0" style="OLC"><section id="HC8AC674F096D471B9FB9A7F06AFB2CD2" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Investing in States to Achieve Tuition Equality for Dreamers Act of 2014</short-title></quote> or <quote><short-title>IN STATE Act of 2014</short-title></quote>.</text></section><section id="H929C3DBC983E4B8195F2BCE837473167"><enum>2.</enum><header>Findings and purposes</header><subsection id="H174ED708976441D898645A76E410E311"><enum>(a)</enum><header>Findings</header><text>Congress makes the following findings:</text><paragraph id="HACA5D36B2C0549158F6D19932E4C9AF8"><enum>(1)</enum><text>The non-partisan Congressional Budget Office found that comprehensive immigration reform would reduce the national deficit by billions, strengthen Social Security solvency, increase the number of jobs, and raise Gross Domestic Product.</text></paragraph><paragraph id="H4946296B1A734CC2B4FA133421F02BA5"><enum>(2)</enum><text>According to a report by the Partnership for a New American Economy, in 2010 more than 40 percent of Fortune 500 companies were founded by immigrants or their children, generating a combined revenue of $4,200,000,000,000.</text></paragraph><paragraph id="HE10C6C9206FC4D1EA88800206A60F792"><enum>(3)</enum><text>Thousands of deferred action childhood arrival students graduate from high schools in the United States every year but only a small fraction of those students enroll in higher education.</text></paragraph><paragraph id="HB2538365D0DE4B5FB336835C215497D7"><enum>(4)</enum><text>Many jobs in the 21st century economy require some form of postsecondary education.</text></paragraph><paragraph id="HE1F3293AE91B4A6EA0B181E08C49DB14"><enum>(5)</enum><text>Education provides an important pathway to the middle class; college graduates have higher earnings and lower unemployment rates than their less educated peers.</text></paragraph><paragraph id="H9F71DC97FDFC4319BAAC3E42566E33A8"><enum>(6)</enum><text>Since 2008, States are spending 28 percent less per student in higher education, and tuition and fees continue to rise. The increased costs are being shifted to students and student loan debt continues to grow.</text></paragraph><paragraph id="H1B1911DD7DE348F98462166530540A39"><enum>(7)</enum><text>Investments in higher education provide youth a ladder to achieving the American dream.</text></paragraph></subsection><subsection id="H1ECD9EBD29164180866E0F6EBF5F337E"><enum>(b)</enum><header>Purposes</header><text>The purposes of this Act are to—</text><paragraph id="HEFE5E73FF5854E51964C5525668F260E"><enum>(1)</enum><text>allow States to provide immigrant students timely and affordable access to higher education;</text></paragraph><paragraph id="H22BE88280AD94D8DB0672623BCC5C54D"><enum>(2)</enum><text>incentivize States to maintain support for higher education; and</text></paragraph><paragraph id="HDA36E940E6C745B5890DAE2AA5636F6D"><enum>(3)</enum><text>promote increased access and affordability to postsecondary education for students through State need-based financial aid.</text></paragraph></subsection></section><section id="HA187A131D40048E0BFF332401F041A55"><enum>3.</enum><header>American dream grants</header><subsection id="H316014FBE07244668709167DBB142106"><enum>(a)</enum><header>In general</header><text>Subpart 4 of part A of title IV of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1070c">20 U.S.C. 1070c et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H3B86BC8D54F043B79A5052679D713A80" style="OLC"><section id="H5866C340AE43448CA5CB506481F6E44A"><enum>415G.</enum><header>American dream grants</header><subsection id="H5A40796B5FE64B498FCE4FF7D003AAD8"><enum>(a)</enum><header>Dreamer students</header><paragraph id="H07712800698D4000B5E4064512F70388"><enum>(1)</enum><header>In general</header><text>In this section, the term <term>Dreamer student</term> means an individual who—</text><subparagraph id="HC022C4BD610A4CBC95235988133D9E0F"><enum>(A)</enum><text>was younger than 16 years of age on the date on which the individual initially entered the United States;</text></subparagraph><subparagraph id="H1E34FE34F7144F80AA486ABBCC3D59E3"><enum>(B)</enum><text>has provided a list of each secondary school (as that term is defined in section 9101 of the Elementary and Secondary Education Act of 1965) that the student attended in the United States; and</text></subparagraph><subparagraph id="H232F8F24088144B7B5A1FDBC6660CE1E"><enum>(C)</enum><clause commented="no" display-inline="yes-display-inline" id="H137B035B9A0B41CD970A5146B8507B35"><enum>(i)</enum><text>has earned a high school diploma or a commensurate alternative award from a public or private high school or secondary school, has obtained a general education development certificate recognized under State law, has obtained a high school equivalency diploma in the United States, or is scheduled to complete the requirements for such a credential before the next academic year begins;</text></clause><clause id="H18ACD4177F6C4F64BA55F63D7B4645A7" indent="up1"><enum>(ii)</enum><text>has acquired a degree from an institution of higher education or has completed not less than 2 years, in good standing, in a program for a bachelor’s degree or higher degree in the United States; or</text></clause><clause id="HA79937A952604E84861120CB54335360" indent="up1"><enum>(iii)</enum><text>has served in the uniformed services for not less than 4 years and, if discharged, received an honorable discharge.</text></clause></subparagraph></paragraph><paragraph id="HD8A078D7D3ED4B0AA2B5E48D4EAD322E"><enum>(2)</enum><header>Hardship exception</header><text>The Secretary shall issue regulations that direct when a State shall waive the requirement of subparagraph (A) or (B), or both, of paragraph (1) to qualify as a Dreamer student under paragraph (1), if the individual—</text><subparagraph id="HC093A82BF3EB4B4EB4BF7CAC3B5363A0"><enum>(A)</enum><text>demonstrates compelling circumstances for the inability to satisfy the requirement of such subparagraph (A) or (B), or both; and</text></subparagraph><subparagraph id="H1854C7D63F79410BB2D007816CA557B4"><enum>(B)</enum><text>satisfies the requirement under subparagraph (C) of paragraph (1).</text></subparagraph></paragraph></subsection><subsection id="HACF679F81A67465D95B153DC33C76298"><enum>(b)</enum><header>Grants to States</header><paragraph id="HEDC7D99ECFF74563A988060C5010C9D2"><enum>(1)</enum><header>Reservation for administration</header><text>From the amounts appropriated to carry out this section for each fiscal year, the Secretary may reserve not more than 1 percent of such amounts to administer this section.</text></paragraph><paragraph id="H0BEB52A40FFC4C01909CFAD1498F40BB"><enum>(2)</enum><header>Grants authorized to eligible States</header><text>From the amounts appropriated to carry out this section for each fiscal year and not reserved under paragraph (1), the Secretary shall award grants to eligible States to enable the States to carry out the activities described in this section.</text></paragraph><paragraph id="HD453885A46494F449B61CA402642459D"><enum>(3)</enum><header>Eligibility</header><text>A State is eligible to receive a grant under this section if the State—</text><subparagraph id="HB62D4E183F3D44818A381B1DC40A6393"><enum>(A)</enum><text>increases access and affordability to higher education for students by—</text><clause id="H03205E9074D643179013C522E30A0B6E"><enum>(i)</enum><text>offering in-State tuition for Dreamer students; or</text></clause><clause id="HC2BB55BFFA2A461BBAF651CB320E54E6"><enum>(ii)</enum><text>expanding in-State financial aid to Dreamer students; and</text></clause></subparagraph><subparagraph id="HBFAF15AD802F41899DE8E4E2984285EE"><enum>(B)</enum><text>submits an application to the Secretary that contains an assurance that—</text><clause id="HEEA758B4101E407B8676820772982D11"><enum>(i)</enum><text>the State has made significant progress establishing a longitudinal data system that includes the elements described in section 6201(e)(2)(D) of the America COMPETES Act (<external-xref legal-doc="usc" parsable-cite="usc/20/9871">20 U.S.C. 9871(e)(2)(D)</external-xref>); and</text></clause><clause id="HE87993D5D6374639A754D478123D6761"><enum>(ii)</enum><text>notwithstanding any other provision of law, the State will not discriminate, in awarding student financial assistance or determining who is eligible for in-State tuition, against a Dreamer student if the student would otherwise be eligible for in-State financial aid.</text></clause></subparagraph></paragraph><paragraph id="H8963E4E4C57241ADB4571AF3BB055EEA"><enum>(4)</enum><header>Allotments</header><text>The Secretary shall allot the amount appropriated to carry out this section for each fiscal year and not reserved under paragraph (1) among the eligible States in proportion to the number of Dreamer students enrolled at least half-time in postsecondary education who reside in the State for the most recent fiscal year for which satisfactory data are available, compared to the number of such students who reside in all eligible States for that fiscal year.</text></paragraph></subsection><subsection id="HB1AFF3A8FBB84DE5984F028BF1B50C90"><enum>(c)</enum><header>Supplement not supplant</header><text>Grant funds awarded under this section shall be used to supplement, and not supplant, non-Federal funds that would otherwise be used for activities authorized under this section.</text></subsection><subsection id="H6B692533A7674516A1DAB441DACF8901"><enum>(d)</enum><header>Authorization and appropriation of funds</header><text>There are authorized to be appropriated, and there are appropriated, to carry out this section—</text><paragraph id="H873A68F38441430B89AF6AEF2AD840E2"><enum>(1)</enum><text>$55,000,000 for fiscal year 2015;</text></paragraph><paragraph id="HF24948C6D1EF430A86614ADA217D5907"><enum>(2)</enum><text>$55,000,000 for fiscal year 2016;</text></paragraph><paragraph id="HD6751A1DA89A4312B0F1B2120F1321FF"><enum>(3)</enum><text>$60,000,000 for fiscal year 2017;</text></paragraph><paragraph id="HC2E8641A396845D7931145F5657907BB"><enum>(4)</enum><text>$60,000,000 for fiscal year 2018;</text></paragraph><paragraph id="H4D2A95A21C2E4BCD84947D761ACA0C9D"><enum>(5)</enum><text>$75,000,000 for fiscal year 2019;</text></paragraph><paragraph id="HDACA6E40554245158E9F5B6D8323C5BF"><enum>(6)</enum><text>$75,000,000 for fiscal year 2020;</text></paragraph><paragraph id="H9BDD255B09514E23B18821C17BBE3887"><enum>(7)</enum><text>$85,000,000 for fiscal year 2021;</text></paragraph><paragraph id="HAA7CABD4271A44C4926BD3515A314ED9"><enum>(8)</enum><text>$85,000,000 for fiscal year 2022;</text></paragraph><paragraph id="H9C90A8F2889D476F8A756C66065B608E"><enum>(9)</enum><text>$100,000,000 for fiscal year 2023; and</text></paragraph><paragraph id="H084F46F46A1E4452A1CAAAA3C8C558BF"><enum>(10)</enum><text>$100,000,000 for fiscal year 2024.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H10B891E86C55464F8C6241E1BB33BA4B"><enum>(b)</enum><header>Offset</header><text>Section 281 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1351">8 U.S.C. 1351</external-xref>) is amended—</text><paragraph id="H9E2E324BC1034D24AF0A17853A86D458"><enum>(1)</enum><text>by striking <quote>The fees</quote> and inserting the following:</text><quoted-block display-inline="no-display-inline" id="HFA1B4F42542E405FAB0030F06F59B444" style="OLC"><subsection id="HA3B60A589F2D4633BD77D2ACA72C6956"><enum>(a)</enum><header>In general</header><text>The fees</text></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="HFF5EDA083AD74875BD35FA9992B15569"><enum>(2)</enum><text>by striking <quote>: 
<proviso><italic>Provided</italic></proviso>, That nonimmigrant visas</quote> and inserting the following:</text><quoted-block display-inline="no-display-inline" id="H452048E99DCA4FA497BB74C250BA44B5" style="OLC"><subsection id="H4DDA8BA33B0A44448A1BC375EFE31ABE"><enum>(b)</enum><header>United Nations visitors</header><text>Nonimmigrant visas</text></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="H396851105B23430BA02A06F6F292A1DE"><enum>(3)</enum><text>by striking <quote>Subject to</quote> and inserting the following:</text><quoted-block display-inline="no-display-inline" id="H4DBBB39F098B4A03AAE8810427EE95FC" style="OLC"><subsection id="HD9C2E7AAA25049CEB323ADF24AA33817"><enum>(c)</enum><header>Fee waivers or reductions</header><text>Subject to</text></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H2211188759674C9A9BADEBE1BB536B26"><enum>(4)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HBB017009DE2B434590D306104EC37B48" style="OLC"><subsection id="HA786DBFF62614D64A909B35177B01106"><enum>(d)</enum><header>F–1 visa fee</header><text>In addition to the fees authorized under subsection (a), the Secretary of Homeland Security shall collect a $150 fee from each nonimmigrant admitted under section 101(a)(15)(F)(i), which fee shall be deposited in the general fund of the Treasury.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HD8BED19250A64F2594F55BFEDDCBD5D0"><enum>(c)</enum><header>Restoration of State option To determine residency for purposes of higher education</header><paragraph id="H109B9B0C8B8F438794BFDCF6CE86AF4A"><enum>(1)</enum><header>Repeal</header><text>Section 505 of the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/8/1623">8 U.S.C. 1623</external-xref>) is repealed.</text></paragraph><paragraph commented="no" id="HF13E99A61FC849529A20189E35A70DD6"><enum>(2)</enum><header>Effective date</header><text>The repeal under paragraph (1) shall take effect as if included in the original enactment of the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 (division C of <external-xref legal-doc="public-law" parsable-cite="pl/104/208">Public Law 104–208</external-xref>).</text></paragraph></subsection><subsection id="H6ACB5FF9A555485AB5C5A9C0CAFC9192"><enum>(d)</enum><header>Naturalization</header><text>Section 328(a) (<external-xref legal-doc="usc" parsable-cite="usc/8/1439">8 U.S.C. 1439(a)</external-xref>) is amended by inserting <quote>, without having been lawfully admitted to the United States for permanent residence, and</quote> after <quote>naturalized</quote>.</text></subsection></section></legis-body></bill>
