Davis of Illinois</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HED00">Committee on Education and the Workforce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Safe and Drug-Free Schools and Communities Act to include bullying and harassment prevention programs.</official-title></form><legis-body id="H4636885731274067BB169C964A10E3E9" style="OLC"><section display-inline="no-display-inline" id="H13503DD2363C41E1ACE6D632AD78FD3D" section-type="section-one"><enum>1.</enum><header>Bullying and Harassment Prevention Policies, Programs, and Statistics</header><subsection id="H7BEBDBD6D97B46798ABBFB16090EAA6A"><enum>(a)</enum><header>State Reporting Requirements</header><text>Section 4112(c)(3)(B)(iv) of the Safe and Drug-Free Schools and Communities Act (<external-xref legal-doc="usc" parsable-cite="usc/20/7112">20 U.S.C. 7112(c)(3)(B)(iv)</external-xref>) is amended by inserting <quote>, including bullying and harassment,</quote> after <quote>violence</quote>.</text></subsection><subsection id="H374FC5A05B76449597C2A9BF97062A94"><enum>(b)</enum><header>State Application</header><text>Section 4113(a) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/20/7113">20 U.S.C. 7113(a)</external-xref>) is amended—</text><paragraph id="HC68693F83890438B87E44863B300B792"><enum>(1)</enum><text>in paragraph (9)—</text><subparagraph id="H0E3152EDEC2A4FEEBF1413C09212975B"><enum>(A)</enum><text>in subparagraph (C), by striking <quote>and</quote> at the end; and</text></subparagraph><subparagraph id="H1581A505B24149DBA32572BD821CA296"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H5C53BF27928344AD876803B1F58CE5F0" style="OLC"><subparagraph id="H5A530D4CF9BB4548BD95CA3DF4332DE1"><enum>(E)</enum><text>the incidence and prevalence of reported incidents of bullying and harassment; and</text></subparagraph><subparagraph id="H669493A9506A42BBAFF37BCA41A62EBE"><enum>(F)</enum><text>the perception of students regarding their school environment, including with respect to the prevalence and seriousness of incidents of bullying and harassment and the responsiveness of the school to those incidents;</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H5D57F884A77F4F869C92CF5AAE5E72CA"><enum>(2)</enum><text>in paragraph (18), by striking <quote>and</quote> at the end;</text></paragraph><paragraph id="H322992914510404CB10E2F8A09DE61EF"><enum>(3)</enum><text>in paragraph (19), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="H395D8FF092F841628272C520F6A78214"><enum>(4)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HE90DC660D5814AD593A860435D955742" style="OLC"><paragraph id="HF8B877BD421849CCA2027F5BDCB47750"><enum>(20)</enum><text>provides an assurance that the State educational agency will provide assistance to districts and schools in their efforts to prevent and appropriately respond to incidents of bullying and harassment and describes how the agency will meet this requirement.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H67C6E7435D22430D9CD038C0E5BFCDF4"><enum>(c)</enum><header>Local Educational Agency Program Application</header><text>Section 4114(d) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/20/7114">20 U.S.C. 7114(d)</external-xref>) is amended—</text><paragraph id="H312E3A36332F4741B580E9D8C851F795"><enum>(1)</enum><text>in paragraph (2)(B)(i)—</text><subparagraph id="H58F33D14D6E740AEB4AEEB6C1A19A68A"><enum>(A)</enum><text>in the matter preceding subclause (I), by striking the semicolon and inserting a comma;</text></subparagraph><subparagraph id="H0B84F286067E429BA8D4508CDC9EBBD3"><enum>(B)</enum><text>in subclause (I), by striking <quote>and</quote> at the end; and</text></subparagraph><subparagraph id="H3C1E0B7A048E44C5A1CE532DF0313C5C"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HE16707D3FD984E69AA3010846839DE6F" style="OLC"><subclause id="HCF2AA592CD41453898440F23DE018730"><enum>(III)</enum><text>performance indicators for bullying and harassment prevention programs and activities; and</text></subclause><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HBEE3912B65E042988CAC3D7C2B5C761A"><enum>(2)</enum><text>in paragraph (7)—</text><subparagraph id="H23F1B50B3CA342B7859F9FD94E11F863"><enum>(A)</enum><text>in subparagraph (A), by inserting <quote>, including bullying and harassment</quote> after <quote>disorderly conduct</quote>;</text></subparagraph><subparagraph id="HBD0186B0CB2745B3AB02D7E456F5DAFF"><enum>(B)</enum><text>in subparagraph (D), by striking <quote>and</quote> at the end; and</text></subparagraph><subparagraph id="H21E85845F50642EE9534B0D69767FB68"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H6F191F12B4194F35A2557D4F3E8A6B9F" style="OLC"><subparagraph id="H50487E28C10B4DA2A60C380BDB45EFA5"><enum>(F)</enum><text>annual notice to parents and students describing the full range of prohibited conduct contained in the discipline policies described in subparagraph (A); and</text></subparagraph><subparagraph id="H5F8EE69D2DC3472EA7A2D2CBC609D04B"><enum>(G)</enum><text>complaint procedures for students or parents that seek to register complaints regarding the prohibited conduct contained in the discipline policies described in subparagraph (A), including—</text><clause id="HFEA54E2BE9B34B3D9E75D5C42F2F472C"><enum>(i)</enum><text>the name of the school or district officials who are designated as responsible for receiving such complaints; and</text></clause><clause id="H28ED096A21154D8EA8041677A27104C1"><enum>(ii)</enum><text>timelines that the school or district will follow in the resolution of such complaints;</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="H2F0BFAC0C4F34454AA29C3995BC59316"><enum>(d)</enum><header>Authorized Activities</header><text>Section 4115(b)(2) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/20/7115">20 U.S.C. 7115(b)(2)</external-xref>) is amended—</text><paragraph id="HBCA150A3E8E5434C944A3B603A479635"><enum>(1)</enum><text>in subparagraph (A)—</text><subparagraph id="H6A0939D965C541A7BFC4D31F735BE951"><enum>(A)</enum><text>in clause (vi), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="H8F73A6681B484F29B21E96798D8B763C"><enum>(B)</enum><text>in clause (vii), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph id="HAC9D9CE45F574C0991A3A4A83A48C67B"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H0D1ADCE0D59A42A1A2FD634DB73A944C" style="OLC"><clause id="H1B21C0E6B47A4189A0FEA4F263A20F15"><enum>(viii)</enum><text>teach students about the consequences of bullying and harassment.</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H756579F1454246DE809F9FB3378D444E"><enum>(2)</enum><text>in subparagraph (E), by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H2296E8C193C646808DA6D5F6ED116930" style="OLC"><clause id="HCA21EE0071E2486C955FB270324B6E14"><enum>(xxiii)</enum><text>Programs that address the causes of bullying and harassment and that train teachers, administrators, and counselors regarding strategies to prevent bullying and harassment and to effectively intervene when such incidents occur.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H436390036D954C8A91EECEBAC9EA016A"><enum>(e)</enum><header>Reporting</header><text>Section 4116(a)(2)(B) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/20/7116">20 U.S.C. 7116(a)(2)(B)</external-xref>) is amended by inserting <quote>, including bullying and harassment,</quote> after <quote>drug use and violence</quote>.</text></subsection><subsection id="H67C84F8829834A408E03D7E927F342FC"><enum>(f)</enum><header>Impact Evaluation</header><text>Section 4122 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/20/7132">20 U.S.C. 7132</external-xref>) is amended—</text><paragraph id="H976B74600C6642E081D60C458A2DDAA5"><enum>(1)</enum><text>in subsection (a)(2), by striking <quote>and school violence</quote> and inserting <quote>school violence, including bullying and harassment,</quote>; and</text></paragraph><paragraph id="H24FED5D42E26467FAC9F22CD9F3E4EFA"><enum>(2)</enum><text>in the first sentence of subsection (b), by inserting <quote>, including bullying and harassment,</quote> after <quote>drug use and violence</quote>.</text></paragraph></subsection><subsection id="HE42614D0B21642D78326D24DFD484D2F"><enum>(g)</enum><header>Definitions</header><paragraph id="HB5C5B3E6EDFC4C74BF01421ECEA15937"><enum>(1)</enum><header>Drug and Violence Prevention</header><text>Paragraph (3)(B) of section 4151 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/20/7151">20 U.S.C. 7151</external-xref>) is amended by inserting <quote>, bullying, and other harassment</quote> after <quote>sexual harassment and abuse</quote>.</text></paragraph><paragraph id="H50BA196B4F914419B91203E689D4B956"><enum>(2)</enum><header>Protective Factor, Buffer, or Asset</header><text>Paragraph (6) of such section is amended by inserting <quote>, including bullying and harassment</quote> after <quote>violent behavior</quote>.</text></paragraph><paragraph id="H1C1F6AA0DFE64BD299CF84EB9F77EC0B"><enum>(3)</enum><header>Risk Factor</header><text>Paragraph (7) of such section is amended by inserting <quote>, including bullying and harassment</quote> after <quote>violent behavior</quote>.</text></paragraph><paragraph id="HC302FFB8B1544650BD0386AA4DD254A0"><enum>(4)</enum><header>Bullying, Harassment, and Violence</header><text>Such section is further amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H478CCE3C3DB6403A83F49754C9A586A4" style="OLC"><paragraph id="H96A7603FFEB24EA4A934841367191BA9"><enum>(12)</enum><header>Bullying</header><subparagraph id="H564B94B0B95F4F819CC1FB1DD9729C87"><enum>(A)</enum><header>In general</header><text>The term <quote>bullying</quote> means aggressive behavior that is intended to cause distress or harm, involves an imbalance of power or strength between the aggressor and the victim and that favors the aggressor, and typically occurs repeatedly over time. Bullying may take many forms, including physical, verbal, relational, and cyber. Bullying can be conduct or behavior or that is based on, but not limited to, a student’s actual or perceived identity with regard to race, color, national origin, sex, gender identity, disability, sexual orientation, religion, or other distinguishing characteristics that may be defined by a State or local educational agency that—</text><clause id="HA9CEACDA306342118926E1CCFCFBCC05"><enum>(i)</enum><text>is directed at one or more students;</text></clause><clause id="H42F1FE19F7EE4AE6B23ECE1C4677B544"><enum>(ii)</enum><text>substantially interferes with educational opportunities or programs of such students; and</text></clause><clause id="H497C346E5FDB4E2F8F1F0F9C63B6FE42"><enum>(iii)</enum><text>adversely affects the ability of a student to participate in or benefit from the school’s educational programs or activities by placing a student in reasonable fear of physical or mental harm.</text></clause></subparagraph><subparagraph id="HB4A4540EDFEF462E8723F058B46F6270"><enum>(B)</enum><header>Association</header><text>Such term includes conduct described in clauses (i), (ii), and (iii) of subparagraph (A) that is based on—</text><clause id="H8A79A845370A4D7DBAE8DF824FB75538"><enum>(i)</enum><text>a student’s association with another individual; and</text></clause><clause id="H66F9144DED8848A68EE50268D0A381DD"><enum>(ii)</enum><text>a characteristic of the other individual that is referred to in subparagraph (A).</text></clause></subparagraph><subparagraph id="H673E82729E7D465CAFC7DF82D1D2A77F"><enum>(C)</enum><header>Cyberbullying</header><clause id="H5D28A2DAFB7248CAAED0323CE7081DC6"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">Such term includes conduct described in subparagraph (A) that is undertaken, in whole or in part, through use of technology or electronic communications (including electronic mail, Internet communications, instant messages, or facsimile communications) to transmit images, text, sounds, or other data.</text></clause><clause id="H9C3882EF210F4DBD9B0FAAECD2B7928A"><enum>(ii)</enum><header>Sexting</header><text>Such term includes transmitting a nude picture by a means described in clause (i) if such transmission constitutes conduct described in subparagraph (A).</text></clause><clause id="H46BF966BC6754367BAA349E3C6C7A81E"><enum>(iii)</enum><header>False identity</header><text display-inline="yes-display-inline">Such term includes knowingly impersonating another person as the author of posted content or messages on the Internet in order to trick, tease, harass, or spread rumors about the other person.</text></clause></subparagraph></paragraph><paragraph id="H50B1BCCC994F474985F86DA1971ABA0A"><enum>(13)</enum><header>Harassment</header><text>The term <term>harassment</term> means conduct, including conduct that is based on a student’s actual or perceived identity with regard to race, color, national origin, gender identity, disability, sexual orientation, religion, or any other distinguishing characteristics that may be defined by a State or local educational agency, that—</text><subparagraph id="HA948325D264040D89934F267EF90FE37"><enum>(A)</enum><text>is directed at one or more students;</text></subparagraph><subparagraph id="HABD982FD8E5F41F2A6449E5B1E37E045"><enum>(B)</enum><text>substantially interferes with educational opportunities or educational programs of such students; and</text></subparagraph><subparagraph id="HE584096C48754FE59C4AFC593A451FB5"><enum>(C)</enum><text>adversely affects the ability of a student to participate in or benefit from the school’s educational programs or activities because the conduct as reasonably perceived by the student is so severe, persistent, or pervasive.</text></subparagraph></paragraph><paragraph id="H4E191C626F5A4C8196F0F262CE44EEB7"><enum>(14)</enum><header>Violence</header><text>The term <term>violence</term> includes bullying and harassment.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H7C3BAFF554114A47AAD6B436E461F835"><enum>(h)</enum><header>Effect on Other Laws</header><paragraph id="HF14A8BC3597E46A58A22DE0231B42D7A"><enum>(1)</enum><header>Amendment</header><text>The Safe and Drug-Free Schools and Communities Act (<external-xref legal-doc="usc" parsable-cite="usc/20/7101">20 U.S.C. 7101 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HE7E9A7FA432E475FA835AC79666DBE8B" style="OLC"><section id="HCCC6B2A0B8D648B3805EC9F638B59DE0"><enum>4156.</enum><header>Effect on Other Laws</header><subsection id="HCAB504CB655B41F3BC165EF463024646"><enum>(a)</enum><header>Federal and State Nondiscrimination Laws</header><text>Nothing in this part shall be construed to alter legal standards regarding, or limit rights available to victims of, bullying or harassment under other Federal or State laws, including title VI of the Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000d">42 U.S.C. 2000d et seq.</external-xref>), title IX of the Education Amendments of 1972 (<external-xref legal-doc="usc" parsable-cite="usc/20/1681">20 U.S.C. 1681 et seq.</external-xref>), section 504 of the Rehabilitation Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/29/794">29 U.S.C. 794</external-xref>), or the Americans with Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12101">42 U.S.C. 12101 et seq.</external-xref>).</text></subsection><subsection id="H1E5279C823944FA0BAB026528C94DF09"><enum>(b)</enum><header>Free Speech and Expression Laws</header><text>Nothing in this part shall be construed to alter legal standards regarding, or affect the rights available to individuals under, other Federal laws that establish protections for freedom of speech and expression.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H1933A64E01654E158FF0A157D1FBA10F"><enum>(2)</enum><header>Clerical Amendment</header><text>The table of contents of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6301">20 U.S.C. 6301 et seq.</external-xref>) is amended by adding after the item relating to section 4155 the following:</text><quoted-block display-inline="no-display-inline" id="HA8EA7154B07741E888FB3983AB8B6EA0" style="OLC"><toc regeneration="no-regeneration"><toc-entry level="section">Sec. 4156.
