nonpartisan service agencies of the legislative branch of State governments, and for other purposes.</official-title></form><legis-body id="H74D15A70365447A0B20DF9EF6B95461B" style="OLC"><section id="H14DB10C04D354EA781E9C549F6ECD83E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Fixing America’s Inconsistent Redistricting (FAIR) Act</short-title></quote>.</text></section><section id="HCC3FD44DC760435EA7B0E86FE1BFC391"><enum>2.</enum><header>Requiring Redistricting to be Conducted Through Plan of Nonpartisan Service Agencies of State Legislatures</header><subsection id="HA5BECE4BEF224FA1B9DCF8563626C3D5"><enum>(a)</enum><header>Use of Nonpartisan Plan</header><text>Notwithstanding any other provision of law, any Congressional redistricting conducted by a State shall be conducted in accordance with a redistricting plan—</text><paragraph id="H590A593CCBA54CBFBE44C295146CE6E9"><enum>(1)</enum><text>developed by a nonpartisan agency of the legislative branch of the State government in accordance with section 3; and</text></paragraph><paragraph id="HCE1C28AFDBB348FB8CA02C8A3889BAF5"><enum>(2)</enum><text>enacted into law by the State in accordance with section 4.</text></paragraph></subsection><subsection id="H2D954293EDCA4D65A087C164EAF2FCF8"><enum>(b)</enum><header>Conforming Amendment</header><text>Section 22(c) of the Act entitled <quote>An Act to provide for the fifteenth and subsequent decennial censuses and to provide for an apportionment of Representatives in Congress</quote>, approved June 18, 1929 (<external-xref legal-doc="usc" parsable-cite="usc/2/2a">2 U.S.C. 2a(c)</external-xref>), is amended by striking <quote>in the manner provided by the law thereof</quote> and inserting: <quote>in the manner provided by the Fixing America’s Inconsistent Redistricting (FAIR) Act</quote>.</text></subsection></section><section id="HD2262A2EB6DC49D699A7FA4C7E66CF0C"><enum>3.</enum><header>Development of plan</header><subsection id="H27D3B3E67E6F4385805FCE4B4B607E94"><enum>(a)</enum><header>Establishment or Designation of Nonpartisan Agency of State Legislature</header><paragraph id="H05EBF14827B647FC877154DDC23E9AC2"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than each December 31 of the year preceding a redistricting year, each State shall establish a nonpartisan agency in the legislative branch of the State government to develop the redistricting plan for the State for the redistricting year.</text></paragraph><paragraph id="H8F955ADCD74146C0AD1FA3109203B998"><enum>(2)</enum><header>Nonpartisanship described</header><text>For purposes of this subsection, an agency shall be considered to be nonpartisan if under law the agency—</text><subparagraph id="HCEFF8A235DE24DBF961696EC1B27C296"><enum>(A)</enum><text>is required to provide services on a nonpartisan basis;</text></subparagraph><subparagraph id="HFD97CB1E02BD47CFAF47E47BF14BA9C4"><enum>(B)</enum><text>is required to maintain impartiality; and</text></subparagraph><subparagraph id="H17FA0A045BCC475DB0436D9F1B46B898"><enum>(C)</enum><text>is prohibited from advocating for the adoption or rejection of any proposal.</text></subparagraph></paragraph><paragraph id="H9BBC69E835514C208A7199D9A3BDF80F"><enum>(3)</enum><header>Designation of existing agency</header><text>At its option, a State may designate an existing agency in the legislative branch of its government to develop the redistricting plan for the State under this Act, so long as the agency meets the requirements for nonpartisanship under this subsection.</text></paragraph><paragraph id="HD02DBF07F7734B09929BECF11438A40A"><enum>(4)</enum><header>Termination of agency specifically established for redistricting</header><text display-inline="yes-display-inline">If a State does not designate an existing agency under paragraph (3) but instead establishes a new agency to serve as the nonpartisan agency under this section, the new agency shall terminate upon the enactment into law of the redistricting plan for the State.</text></paragraph></subsection><subsection id="H0F22535744FA4F7FBAF2808B2503D063"><enum>(b)</enum><header>Development of Redistricting Plan</header><paragraph id="HF15039DB16464A19B1563FBD17A9F803"><enum>(1)</enum><header>Criteria</header><text>The nonpartisan agency established or designated by a State under this section shall develop a redistricting plan for the State in accordance with the following criteria:</text><subparagraph id="HE511672AE57846EA9CFF3B7B4C6969F3"><enum>(A)</enum><text>Adherence to the <quote>one person, one vote</quote> standard and other requirements imposed under the Constitution of the United States.</text></subparagraph><subparagraph id="H5D4E482FA88A4E47AF29C66A2B52D51F"><enum>(B)</enum><text display-inline="yes-display-inline">To the greatest extent mathematically possible, ensuring that the population of each Congressional district in the State does not vary by more than one percent from the population of any other Congressional district in the State (as determined on the basis of the total count of persons of the most recent decennial census conducted by the Bureau of the Census).</text></subparagraph><subparagraph id="HA3A726E92BEC4522BA97B82C5F501592"><enum>(C)</enum><text>Consistency with any applicable requirements of the Voting Rights Act of 1965 and other Federal laws.</text></subparagraph><subparagraph id="H66BB3A34F7D848D2ADC41230C87D53B7"><enum>(D)</enum><text>Ensuring that districts are contiguous (except to the extent necessary to include any area which is surrounded by a body of water).</text></subparagraph><subparagraph id="HF42ABE7B9B044537AED98E73F97A52DA"><enum>(E)</enum><text>To the greatest extent practicable, the maintenance of the geographic continuity of the political subdivisions of the State which are included in the same Congressional district.</text></subparagraph><subparagraph id="HB5EEEC8EDD774D72BA577D6B8CBCB0B8"><enum>(F)</enum><text>To the greatest extent practicable, maintaining compact districts.</text></subparagraph></paragraph><paragraph id="H990719F81F814AE691D4DFBD9E89BC5B"><enum>(2)</enum><header>Factors prohibited from consideration</header><text>In developing the redistricting plan for the State, the nonpartisan agency may not take into consideration any of the following factors, except to the extent necessary to comply with the Voting Rights Act of 1965:</text><subparagraph id="HF16A1F0135D74392AB9B199B61626EDF"><enum>(A)</enum><text>The residence of incumbent Members of the House of Representatives in the State.</text></subparagraph><subparagraph id="HC1056ECB3BC5444E9126CF0296B2E76F"><enum>(B)</enum><text>The voting history of the population of a Congressional district, except that the agency may take such history into consideration to the extent necessary to comply with any State law which requires the establishment of competitive Congressional districts.</text></subparagraph><subparagraph id="H97FD55A6F5DC4373ADDBAD427BE53924"><enum>(C)</enum><text>The political party affiliation of the population of a district.</text></subparagraph></paragraph></subsection><subsection id="H5229CC8CD53B4ECE87AF0B590925F47F"><enum>(c)</enum><header>Submission of Plan to Legislature and Temporary Redistricting Advisory Commission</header><text>Not later than April 1 of the redistricting year, the nonpartisan agency shall submit the redistricting plan developed under this section to the State legislature and to the Temporary Redistricting Advisory Commission of the legislature established under section 4(a).</text></subsection></section><section id="H7759F057A81B4236AAB2F7C187F8D729"><enum>4.</enum><header>Enactment of plan by State legislature</header><subsection id="H44F010E399A942808879CC30485ADC61"><enum>(a)</enum><header>Role of Temporary Redistricting Advisory Commission</header><paragraph id="H105CAED82D9F4BA3ACECC13B2F573343"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than February 15 of each redistricting year, each State shall appoint a commission to be known as the <term>Temporary Redistricting Advisory Commission</term> (hereafter referred to as the <term>Commission</term>), consisting of—</text><subparagraph id="HB98458B4CA6F4ECE8CF93A81928623D2"><enum>(A)</enum><text>2 members, of whom 1 shall be appointed by the majority leader of the upper house of the State legislature and 1 shall be appointed by the majority leader of the lower house of the State legislature (or, in the case of a State with a unicameral legislature, both of whom shall be appointed by the majority leader of the legislature);</text></subparagraph><subparagraph id="H3DF454EF067140038C525D79ACFFA9B6"><enum>(B)</enum><text display-inline="yes-display-inline">2 members, of whom 1 shall be appointed by the minority leader of the upper house of the State legislature and 1 shall be appointed by the minority leader of the lower house of the State legislature (or, in the case of a State with a unicameral legislature, both of whom shall be appointed by the minority leader of the legislature); and</text></subparagraph><subparagraph id="HD23168C368BA4D0AB257AE86A0727C29"><enum>(C)</enum><text>1 member appointed by a majority vote of the members appointed under the previous subparagraphs.</text></subparagraph></paragraph><paragraph id="HAA5F8DFEF4A9499B90523D8D9E49C0BF"><enum>(2)</enum><header>Qualifications</header><text>An individual is eligible to serve as a member of the Commission if the individual meets each of the following requirements:</text><subparagraph id="H61108AF1F355433794D56B9430F520A9"><enum>(A)</enum><text>The individual is an eligible elector of the State at the time of appointment.</text></subparagraph><subparagraph id="HC2E07574B92944FCA9EB5A7250368EFD"><enum>(B)</enum><text>The individual does not hold a partisan political office or serve as an officer of a political party.</text></subparagraph><subparagraph id="HB7660EB3F9484896A179962DE399C907"><enum>(C)</enum><text display-inline="yes-display-inline">The individual is not an employee or an immediate family member of a member of the State legislature or member of Congress, or an employee of the State legislature or Congress. In this subparagraph, the term <term>immediate family member</term> means, with respect to an individual, a father, mother, son, daughter, brother, sister, husband, wife, father-in-law, or mother-in-law.</text></subparagraph></paragraph><paragraph id="H824DCFFDD8AA49EDA9A07E5B9686C793"><enum>(3)</enum><header>Assistance to nonpartisan agency</header><text>At the request of the nonpartisan agency established or designated under section 3, the Commission shall provide guidance to the agency in its development of the redistricting plan for the State.</text></paragraph><paragraph id="HF85AA697B3C74BD591AD242F507B8023"><enum>(4)</enum><header>Review of nonpartisan agency plan</header><subparagraph id="HA4EC73246C1944C0A5CB957696CA494E"><enum>(A)</enum><header>Hearings</header><text display-inline="yes-display-inline">Upon receiving the redistricting plan from the nonpartisan agency under section 3(c), the Commission shall analyze and review the plan, and shall hold at least 3 public hearings in various geographic areas of the State to solicit comments on the plan.</text></subparagraph><subparagraph id="HD579BFA6C78741C095ACD6854118935A"><enum>(B)</enum><header>Report to legislature</header><text>Not later than 14 days after receiving the redistricting plan from the nonpartisan agency under section 3, the Commission shall submit a report to the State legislature which includes the Commission’s recommendation regarding whether the legislature should adopt or reject the plan, taking into account any comments provided at the hearings held under subparagraph (A), as well as any other comments and conclusions regarding the plan which the Commission considers appropriate.</text></subparagraph></paragraph><paragraph id="H97608FCD8DA447779DBDD41C70422F0A"><enum>(5)</enum><header>Termination</header><text>The Commission shall terminate upon the enactment into law of the redistricting plan for the State.</text></paragraph></subsection><subsection id="H6CD9C70C689B4BFAB208FA5E3731AA61"><enum>(b)</enum><header>Action by State Legislature and Chief Executive To Enact Plan</header><paragraph id="H53A8E958AA8549FDADB09F52761E1573"><enum>(1)</enum><header>Consideration of plan by legislature</header><text display-inline="yes-display-inline">Not later than 3 days after receiving the Commission’s report under subsection (a) on the redistricting plan developed by the nonpartisan agency, the State legislature shall either—</text><subparagraph id="H67FF110A848E4F7399A35028207D0032"><enum>(A)</enum><text>approve the plan as submitted by the nonpartisan agency without amendment and forward the plan to the chief executive of the State; or</text></subparagraph><subparagraph id="HD6C829311A434416951742A0DC552E72"><enum>(B)</enum><text>reject the plan.</text></subparagraph></paragraph><paragraph id="HCFAFDA8986BE48688BFED5BEC097168C"><enum>(2)</enum><header>Enactment of plan</header><subparagraph id="H1D7483FD4CE04120BEC26618C8C7962B"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">A redistricting plan developed by the nonpartisan agency shall be considered to be enacted into law if the plan is forwarded to the chief executive of the State pursuant to paragraph (1)(A) and—</text><clause id="HB10060350F8C407A8C99F1996994FBF0"><enum>(i)</enum><text>the chief executive approves the plan as forwarded by the legislature without amendment; or</text></clause><clause id="HFD20C978FCBB4E0BA44F5E54D660B9AC"><enum>(ii)</enum><text>the chief executive vetoes the plan and the legislature overrides the veto in accordance with the applicable law of the State, except that at no time may the plan be amended.</text></clause></subparagraph><subparagraph id="HF747B019FC854D14A81848598B06A4F6"><enum>(B)</enum><header>Special rule</header><text display-inline="yes-display-inline">In the case of a State in which the chief executive is prohibited under State law from acting on a redistricting plan, a redistricting plan developed by the nonpartisan agency shall be considered to be enacted into law if the State legislature approves the plan as submitted by the nonpartisan agency without amendment.</text></subparagraph></paragraph></subsection><subsection id="HF4DD306952544D72AA5752D0754086B6"><enum>(c)</enum><header>Effect of Rejection of Plan</header><paragraph id="H1343017FEA204134AD61E4A4BF8E38F5"><enum>(1)</enum><header>Rejection by legislature</header><text display-inline="yes-display-inline">If the State legislature votes under subsection (b)(1) to reject the redistricting plan of the nonpartisan agency, not later than 7 days after the vote to reject the plan the legislature shall submit to the nonpartisan agency and disseminate publicly a statement of the legislature’s reasons for rejecting the plan.</text></paragraph><paragraph id="HB7AA1457168B44FF981310A3E7950D78"><enum>(2)</enum><header>Veto by chief executive</header><text display-inline="yes-display-inline">If the chief executive vetoes the redistricting plan of the nonpartisan agency and the State legislature fails to override the veto, not later than 7 days after the failed vote to override the veto the chief executive shall submit to the nonpartisan agency and disseminate publicly a statement of the chief executive’s reasons for vetoing the plan.</text></paragraph><paragraph id="H37A52CE4CC5145E5985ACDB61DF19E0E"><enum>(3)</enum><header>Development and submission of revised plan</header><text>Not later than 35 days after receiving a statement from the State legislature under paragraph (1) or a statement from the chief executive of the State under paragraph (2) (as the case may be), the nonpartisan agency established or designated under section 3 shall develop a revised redistricting plan for the State which is consistent with the criteria set forth in section 3(b) but which addresses the reasons provided under paragraph (1) or paragraph (2) (as the case may be) for the rejection of the plan, and shall submit the revised plan to the State legislature.</text></paragraph><paragraph id="HB6AE3BC3EDBD462498C5815C02D20065"><enum>(4)</enum><header>Consideration of revised plan by legislature</header><text display-inline="yes-display-inline">Not later than 7 days after receiving the revised redistricting plan under paragraph (3), the State legislature shall either—</text><subparagraph id="H533F926D37494FB083FC9EB3B57A74E4"><enum>(A)</enum><text>approve the revised plan as submitted by the nonpartisan agency without amendment and forward the plan to the chief executive of the State; or</text></subparagraph><subparagraph id="HEA11F468B70140E0B941C919F0BB92BB"><enum>(B)</enum><text>reject the plan.</text></subparagraph></paragraph><paragraph id="H582DD2A800C540A1B21E7C0FEC275C31"><enum>(5)</enum><header>Enactment of revised plan</header><text>Subsection (b)(2) shall apply with respect to the enactment of the revised plan developed and submitted by the nonpartisan agency under paragraph (3) in the same manner as such subsection applies with respect to the initial redistricting plan developed and submitted by the agency under such subsection.</text></paragraph></subsection><subsection id="H993A6106FF7D4F8BBF2FEF9AEEB67EE9"><enum>(d)</enum><header>Effect of Rejection of Revised Plan; Permitting Legislature To Amend Second Revised Plan</header><paragraph id="H1D654DE520F94AADA8B8D2D1762306E2"><enum>(1)</enum><header>Rejection by legislature</header><text display-inline="yes-display-inline">If the State legislature votes under subsection (c)(4) to reject the revised redistricting plan of the nonpartisan agency, not later than 7 days after the vote to reject the plan the legislature shall submit to the nonpartisan agency and disseminate publicly a statement of the legislature’s reasons for rejecting the revised plan.</text></paragraph><paragraph id="H61566A94515B461E99D139CA1350140D"><enum>(2)</enum><header>Veto by chief executive</header><text display-inline="yes-display-inline">If the chief executive vetoes the revised redistricting plan of the nonpartisan agency and the State legislature fails to override the veto, not later than 7 days after the failed vote to override the veto the chief executive shall submit to the nonpartisan agency and disseminate publicly a statement of the chief executive’s reasons for vetoing the revised plan.</text></paragraph><paragraph id="HEB7840D03AED4A8CB760BE41543B04B9"><enum>(3)</enum><header>Development and submission of second revised plan</header><text>Not later than 35 days after receiving a statement from the State legislature under paragraph (1) or a statement from the chief executive of the State under paragraph (2) (as the case may be), the nonpartisan agency established or designated under section 3 shall develop a second revised redistricting plan for the State which is consistent with the criteria set forth in section 3(b) but which addresses the reasons provided under paragraph (1) or paragraph (2) (as the case may be) for the rejection of the revised plan, and shall submit the second revised plan to the State legislature.</text></paragraph><paragraph id="HA12DA2F3ED0C42FB8D639C4ADF5D1A0C"><enum>(4)</enum><header>Consideration of second revised plan by legislature</header><text display-inline="yes-display-inline">Not later than 7 days after receiving the second revised redistricting plan under paragraph (3), the State legislature shall either—</text><subparagraph id="H84403AEA0B964644B117D6CC6C7E3A82"><enum>(A)</enum><text>approve the second revised plan as submitted by the nonpartisan agency with or without amendment and forward the plan to the chief executive of the State; or</text></subparagraph><subparagraph id="H964F429E68924A60B029FAC9E005517E"><enum>(B)</enum><text>reject the plan.</text></subparagraph></paragraph><paragraph id="HF4F2623DF2C6492FA335A4FDC41D0378"><enum>(5)</enum><header>Enactment of second revised plan</header><text>Subsection (b)(2) shall apply with respect to the enactment of the second revised plan developed and submitted by the nonpartisan agency under paragraph (3) in the same manner as such subsection applies with respect to the initial redistricting plan developed and submitted by the agency under such subsection.</text></paragraph></subsection><subsection id="HE213D54C7CE4446195D6A8632CA4A6F9"><enum>(e)</enum><header>Rejection of Second Revised Plan</header><paragraph id="HDA4C3F15B6E7492D8A895219091BE9EA"><enum>(1)</enum><header>Development of plan by highest court of State</header><text display-inline="yes-display-inline">If the second revised redistricting plan developed and submitted under subsection (d) is not enacted into law, the highest court of the State shall assume sole responsibility for the development and enactment of the redistricting plan for the State, and shall publish the plan it develops not later than November 15 of the redistricting year.</text></paragraph><paragraph id="HC2989DC4D721426094B5E84974033DCE"><enum>(2)</enum><header>Application of same criteria used by nonpartisan agency</header><text>Section 3(b) shall apply with respect to the development of the redistricting plan by a court under this subsection in the same manner as such section applies to the development of the plan by the nonpartisan agency under section 3.</text></paragraph><paragraph id="HE0D65946173A4210B6CDE09B63501655"><enum>(3)</enum><header>Enactment upon publication</header><text>Upon the publication by the highest court of the State of the redistricting plan under this subsection, the plan shall be deemed to be enacted into law.</text></paragraph></subsection></section><section id="H1EA491967BD34B4BB5C509CEB5CBAE35"><enum>5.</enum><header>Redistricting year defined</header><text display-inline="no-display-inline">In this Act, the term <term>redistricting year</term> means, with respect to a State, the year in which the chief executive officer of the State receives the notice from the Clerk of the House of Representatives under section 22(b) of the Act entitled <quote>An Act to provide for the fifteenth and subsequent decennial censuses and to provide for an apportionment of Representatives in Congress</quote>, approved June 18, 1929 (<external-xref legal-doc="usc" parsable-cite="usc/2/2a">2 U.S.C. 2a</external-xref>), of the number of Representatives to which the State is entitled.</text></section><section id="H1394F4CC4572498FA2D921C2D1DD14C9"><enum>6.</enum><header>No effect on elections for State and local office</header><text display-inline="no-display-inline">Nothing in this Act or in any amendment made by this Act may be construed to affect the manner in which a State carries out elections for State or local office, including the process by which a State establishes the districts used in such elections.</text></section><section id="H7D7A6FD04EBB48B1821CAFF0F4CE10EA"><enum>7.</enum><header>Effective date</header><text display-inline="no-display-inline">This Act and the amendments made by this Act shall apply with respect to any Congressional redistricting which occurs after the regular decennial census conducted during 2020.</text></section></legis-body></bill>
