which was referred to the <committee-name committee-id="">Select Committee on Intelligence (Permanent Select)</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Intelligence Authorization Act for Fiscal Year 2010 to facilitate access by the Comptroller General of the United States to information in the possession of the intelligence community, and for other purposes.</official-title></form><legis-body id="HDC45B18A0C2741C4B3A0F754F6068163" style="OLC"><section id="H5253B77B17DE42D8BFCC6DD6387310B5" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Intelligence Community Oversight Act of 2014</short-title></quote>.</text></section><section id="H2D396A885CF14F47BC127E42751CE1BA"><enum>2.</enum><header>Access to information by the Comptroller General of the United States</header><text display-inline="no-display-inline">Section 348 of the Intelligence Authorization Act for Fiscal Year 2010 (<external-xref legal-doc="usc" parsable-cite="usc/50/3308">50 U.S.C. 3308</external-xref>) is amended by adding at the end the following new subsections:</text><quoted-block display-inline="no-display-inline" id="H5F284B38071B49EAAB49832E320B27FF" style="OLC"><subsection id="H0EAE0B2944E94A06A5DF8747F91F297A"><enum>(e)</enum><header>Implementation of directive</header><text display-inline="yes-display-inline">In carrying out the directive issued under subsection (a)(1), the head of each element of the intelligence community shall—</text><paragraph id="H095165FD0FB74CD2B0BFF8AE5B45242F"><enum>(1)</enum><text display-inline="yes-display-inline">provide the Comptroller General with timely access to information concerning the programs and activities of the intelligence community for any audit, investigation, program evaluation, report, or review for which the Comptroller General considers such information necessary; and</text></paragraph><paragraph id="H03C4C4FCF58E4C8FBBFFDA2F5FBEDB21"><enum>(2)</enum><text>in providing such access—</text><subparagraph id="HAA149AF0130E432BA64A02687E4A0126"><enum>(A)</enum><text display-inline="yes-display-inline">cooperate with the Comptroller General to the fullest extent possible and provide timely responses to requests for information;</text></subparagraph><subparagraph id="HD10BD6923697452598515796D35629F1"><enum>(B)</enum><text>not categorically deny the Comptroller General access to information requested in furtherance of an audit or evaluation;</text></subparagraph><subparagraph id="H8E86FDDFB0F14B95BD12D34347E400A0"><enum>(C)</enum><text>carefully consider requests for information based on consultation with the Comptroller General;</text></subparagraph><subparagraph id="H74AF90F6C3074A8E901AC61E99402783"><enum>(D)</enum><text>work with the Comptroller General to explore alternative means to accommodate a request for access to specific information if the head of an element of the intelligence community determines that such element is unable to provide the Comptroller General with access to the specific information requested; and</text></subparagraph><subparagraph id="HEE2E4C6136BD420C89F6033470AFC703"><enum>(E)</enum><text>narrowly construe any limitation on access to information by the Comptroller General described in such directive.</text></subparagraph></paragraph></subsection><subsection id="H189982A92B2C4A4F8DD8900F828AD205"><enum>(f)</enum><header>Congressional notification of implementation</header><paragraph id="H870CEB890FB849E1B516A60D544547A3"><enum>(1)</enum><header>Denials of access</header><text display-inline="yes-display-inline">If, after following the requirements of this section and the directive issued under subsection (a)(1), the head of an element of the intelligence community determines that such element cannot comply with a request by the Comptroller General for access to information, the head of such element shall, in a timely manner and at the same time as the head of such element notifies the Comptroller General of the denial of access to such information, submit to the Director of National Intelligence, the Comptroller General, and Congress a written justification for denying such access.</text></paragraph><paragraph id="HD07D5B4FC842461DBE7E5C0D032D419B"><enum>(2)</enum><header>Semiannual reports</header><subparagraph id="H4B36F90AAF6D450AA52BE21469FCA464"><enum>(A)</enum><header>Director of National Intelligence</header><text>The Director of National Intelligence shall semiannually submit to Congress and the Comptroller General in electronic form a report describing any instances in which the head of an element of the intelligence community denied the Comptroller General access to information that the Comptroller General requested, including the written justification for such denial submitted to the Comptroller General in accordance with paragraph (1).</text></subparagraph><subparagraph id="HA8FEE6CA71AF4D0A8D895B147B0B64A0"><enum>(B)</enum><header>Comptroller General</header><text>Not later than 30 days after receiving a report in accordance with subparagraph (A), the Comptroller General shall submit to Congress in electronic form a report containing any comments the Comptroller General considers appropriate in response to such report.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
