		<section id="HBE32725983F74814BD0E412363B3D936" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Longshore and Harbor Workers’ Compensation Clarification Act of 2014</short-title></quote>.</text>
		</section><section id="H694867E683BE467EB4E49A3ACD734EEF"><enum>2.</enum><header>Definition of Recreational vessel</header>
			<subsection id="H59B1A6A425D14F76A93503CE09552F66"><enum>(a)</enum><header>Definition</header><text display-inline="yes-display-inline">Section 2 of the Longshore and Harbor Workers' Compensation Act (<external-xref legal-doc="usc" parsable-cite="usc/33/902">33 U.S.C. 902</external-xref>) is amended—</text>
				<paragraph id="H56F4DE3321164FF4BAC75240039B851A"><enum>(1)</enum><text>by redesignating paragraph (22) as paragraph (23); and</text>
				</paragraph><paragraph id="H774F491FD218457FA5861149DC270AE5"><enum>(2)</enum><text>by inserting after paragraph (21) the following:</text>
					<quoted-block display-inline="no-display-inline" id="HCCFD8D27AF6A442A8D3E0C094F6986CA" style="OLC">
						<paragraph id="HD2008E375C254FD588897907201EC8D0"><enum>(22)</enum>
							<subparagraph commented="no" display-inline="yes-display-inline" id="H60B182E45F7F4C67807A01EFF1625C61"><enum>(A)</enum><text>The term <term>recreational vessel</term> means a vessel—</text>
								<clause id="HC55B371CE5624E60AA1D41E75CEE2398" indent="up1"><enum>(i)</enum><text>being manufactured or operated primarily for pleasure; or</text>
								</clause><clause id="HD5DB5AAF87F74A45BC7F2ADCB1E0EE0A" indent="up1"><enum>(ii)</enum><text>leased, rented, or chartered to another for the latter's pleasure.</text>
								</clause></subparagraph><subparagraph id="HE425708B3B4346FEB429B43CEC390C23" indent="up1"><enum>(B)</enum><text>In applying the definition in subparagraph (A), the following rules apply:</text>
								<clause id="HFE042A10147140F499F38C57E09FE8DB"><enum>(i)</enum><text>A vessel being manufactured or built, or being repaired under warranty by its manufacturer or
			 builder, is a recreational vessel if the vessel appears intended, based on
			 its design and construction, to be for ultimate recreational uses. The
			 manufacturer or builder bears the burden of establishing that a vessel is
			 recreational under this standard.</text>
								</clause><clause id="H10B09BD6EDAC41C091638240B09BE293"><enum>(ii)</enum><text>A vessel being repaired, dismantled for repair, or dismantled at the end of its life will be
			 treated as recreational at the time of repair, dismantling for repair, or
			 dismantling, provided that such vessel shares elements of design and
			 construction of traditional recreational vessels and is not normally
			 engaged in a military, commercial, or traditionally commercial
			 undertaking.</text>
								</clause><clause id="HD3F05EDF99B64F358C37A8CD11AD1461"><enum>(iii)</enum><text>A vessel will be treated as a recreational vessel if it is a public vessel, such as a vessel owned
			 or chartered and operated by the United States, or by a State or political
			 subdivision thereof, at the time of repair, dismantling for repair, or
			 dismantling, provided that such vessel shares elements of design and
			 construction with traditional recreational vessels and is not normally
			 engaged in a military, commercial, or traditionally commercial
			 undertaking.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HD38C8200438E40598F598586564DE812"><enum>(b)</enum><header>Regulations</header><text display-inline="yes-display-inline">Not later than 90 days after the date of enactment of this Act, the Secretary of Labor shall—</text>
				<paragraph id="H3B17581DCA094C27A44F1257CA61597C"><enum>(1)</enum><text display-inline="yes-display-inline">amend the regulations in <external-xref legal-doc="regulation" parsable-cite="cfr/20/701.501">section 701.501</external-xref> of title 20, Code of Federal Regulations, by deleting the
			 text of subsections (a) and (b) of such section and replacing it with only
			 the text of the definition of recreational vessel in section 2(22) of the
			 Longshore and Harbor Workers' Compensation Act, as added by subsection
			 (a); and</text>
				</paragraph><paragraph id="HE6D1B5200F5F493C829D23676FEEFA65"><enum>(2)</enum><text display-inline="yes-display-inline">make no further modification to such definition in another regulation or any administrative
			 directive.</text>
