which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To provide for the suspension of Federal funding for the California High Speed Rail Project until sufficient non-Federal funds are available.</official-title></form><legis-body id="HC037AD53136D47A7A28A0464A985A8E2" style="OLC"><section id="H45059EC8A23C4264BF0CED67E65FAFCD" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Responsible Rail and Deterring Deficiency Act</short-title></quote>.</text></section><section id="H7E9A4B2BC38A402FA71C955A5E678F33"><enum>2.</enum><header>Suspension of Federal funding</header><subsection id="HC3A7615F1C4748BDB7CCADFBA36A5AA5"><enum>(a)</enum><header>Congressional determination</header><text display-inline="yes-display-inline">The Congress determines that—</text><paragraph id="H684DA1DB2B874FFAA4435C49486D0A33"><enum>(1)</enum><text>the purposes of the statute under which the Project is authorized would not be adequately served by continuation of Federal financial assistance for the Project; and</text></paragraph><paragraph commented="no" id="H6BAC716941824976A0F8323A8FE27F44"><enum>(2)</enum><text>the Authority may be unable to—</text><subparagraph commented="no" id="H436048AAFEBD4CFBB2CB991CA47BBD2E"><enum>(A)</enum><text>meet the contributory match percentage identified in Attachment 1, section 5, of the grant agreement; and</text></subparagraph><subparagraph commented="no" id="H6F2E0AA7C1524F959283983280747FDC"><enum>(B)</enum><text>complete the Project according to the Project schedules included in Attachment 3 or Attachment 3A of the grant agreement.</text></subparagraph></paragraph></subsection><subsection id="HC6DDBA0C33FD420EB96FBF16A648399B"><enum>(b)</enum><header>Suspension requirement</header><text display-inline="yes-display-inline">Based on the determination made under subsection (a), not later than 5 days after the date of enactment of this Act the Federal Railroad Administration shall exercise its right under Attachment 1, section 23, of the grant agreement to suspend any further financial assistance for the Project under the grant agreement until—</text><paragraph id="H21148BC9FE4E4238BF458024B7A7E1E9"><enum>(1)</enum><text display-inline="yes-display-inline">the Authority certifies in writing to the Federal Railroad Administration that—</text><subparagraph id="H808B7F7B3D69412980A309155C174EB5"><enum>(A)</enum><text>it has access to State funds, or other non-Federal funds, in the amounts specified in Attachment 1, section 5, of the grant agreement;</text></subparagraph><subparagraph id="H2B45C0D430B14DD39FE4D1F0DAB48BCE"><enum>(B)</enum><text>those State or other non-Federal funds are free and clear of any legal challenge or other hindrance to the expenditure of the funds by the Authority; and</text></subparagraph><subparagraph id="HE5908C0D17424D0DAF2048DA83DE7646"><enum>(C)</enum><text>the funds are or will be available at the time necessary to meet the Authority’s financial obligations as described in the grant agreement; or</text></subparagraph></paragraph><paragraph id="H4F7345028E1344278CF7CBEA9438A6FA"><enum>(2)</enum><text>September 30, 2017.</text></paragraph></subsection><subsection id="H46BF9DE46E7E4B6A9FAB5812FEC1BE07"><enum>(c)</enum><header>Changes to agreement prohibited</header><text display-inline="yes-display-inline">Until the conditions described in subsection (b) have been met, the Federal Railroad Administration shall not amend, supplement, or otherwise change the terms of the grant agreement.</text></subsection><subsection id="H995E213A531A427EB837E9FE393B48CF"><enum>(d)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H92CE92A3D9334AC4B6E641F6225B6060"><enum>(1)</enum><header>Authority</header><text display-inline="yes-display-inline">The term <quote>Authority</quote> means the California High Speed Rail Authority.</text></paragraph><paragraph id="HC1F2150F264448349B25377DEA446E2C"><enum>(2)</enum><header>Grant agreement</header><text display-inline="yes-display-inline">The term <quote>grant agreement</quote> means the Federal Railroad Administration’s grant/cooperative agreement with the Authority numbered FR–HSR–0009–10–01–05 made on December 5, 2012.</text></paragraph><paragraph id="H0DE77C2A72E14BC2B3AD1E5F0B26FFEC"><enum>(3)</enum><header>Project</header><text display-inline="yes-display-inline">The term <quote>Project</quote> has the meaning given that term in the grant agreement.</text></paragraph></subsection></section></legis-body></bill>
