R. 3835</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action><action-date date="20140109">January 9, 2014</action-date><action-desc><sponsor name-id="D000614">Mr. Duffy</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require new procedures for health care Exchange Web sites with regard to personal information, and for other purposes.</official-title></form><legis-body id="HBEDCD61646E54BE2A28881C930271F45" style="OLC"><section id="HE7AB4F09752B42C48F61D9B91604443B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Before Registering for Obamacare, Window Shop Exchanges Act of 2014</short-title></quote> and as the <quote><short-title>BROWSE Act of 2014</short-title></quote> .</text></section><section id="H89B0381BDEC14F8FBFB09F6A689FF335"><enum>2.</enum><header>Exchange Web site requirements</header><subsection id="H2C8D56FDD50744AA84B3BAF2ED0488EC"><enum>(a)</enum><header>Web site requirements</header><text display-inline="yes-display-inline">An Exchange established pursuant to section 1321(c) of the Patient Protection and Affordable Care Act (<external-xref legal-doc="usc" parsable-cite="usc/42/18041">42 U.S.C. 18041(c)</external-xref>)—</text><paragraph commented="no" id="HCD57942400984FDC8849297113261D92"><enum>(1)</enum><text display-inline="yes-display-inline">may not request personal information of an individual through a Web site maintained by such Exchange (including a Web site maintained in accordance with section 1311(d)(4)(C) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/18031">42 U.S.C. 18031(d)(4)(C)</external-xref>)) unless—</text><subparagraph id="H575ED2B4DDA044C5A6A6108DC39A7A78"><enum>(A)</enum><text display-inline="yes-display-inline">such information is necessary to calculate an estimated premium amount for the individual for a period; and</text></subparagraph><subparagraph id="H0FA630D21DF54C898DBC6A114FE90177"><enum>(B)</enum><text>the individual has access through such Exchange to compare health care plans offered through such Exchange before the collection through such Web site of such personal information of such individual;</text></subparagraph></paragraph><paragraph commented="no" id="H82F9E5405DB3488895393A755FA62B0E"><enum>(2)</enum><text display-inline="yes-display-inline">may not provide to an individual, through such a Web site, an estimated premium amount for the individual for a period if such premium amount is calculated prior to the submission by the individual of personal information to the Exchange through the Web site; and</text></paragraph><paragraph id="H315834ACF64F49369F76176896507F7C"><enum>(3)</enum><text display-inline="yes-display-inline">shall require that any employee who has access to personal information passes a criminal background check, has not been convicted of a crime, and enters into an agreement not to disclose any such personal information to any person who is not authorized to access such personal information.</text></paragraph></subsection><subsection id="HF38D96B4BD6B406598E3D8D3D45AE3CD"><enum>(b)</enum><header>Personal information defined</header><text display-inline="yes-display-inline">In this section, the term <term>personal information</term> means any information that identifies an individual and can be associated with such individual (including a Social Security account number, taxpayer identification number, State identification number or other identifier, or account information with respect to credit cards (as defined under section 103 of the Truth in Lending Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1602">15 U.S.C. 1602</external-xref>)) or with respect to an account held by the individual at a depository institution (as defined under section 3 of the Federal Deposit Insurance Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1813">12 U.S.C. 1813</external-xref>)) or a credit union) that is not information necessary to contact an individual.</text></subsection><subsection id="H80196F44337A47EF8DBD8145F2BBF1F8"><enum>(c)</enum><header>Effective date</header><text>This Act shall take effect 6 months after the date of the enactment of this Act.</text></subsection></section></legis-body></bill>
