R. 3834</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action><action-date date="20140109">January 9, 2014</action-date><action-desc><sponsor name-id="C001096">Mr. Cramer</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HBA00">Committee on Financial Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To ensure that certain communities may be granted exceptions for floodproofed residential basements for purposes of determining risk premium rates for flood insurance.</official-title></form><legis-body id="H32EDA0F30F584F7BBF5965033B8616F5" style="OLC"><section id="H574034CAC6074EBB9EB7F7853DD0CC61" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Flood Safe Basements Act</short-title></quote>.</text></section><section id="HEB8792FFC2A14B0796C4FADE3BE9251B"><enum>2.</enum><header>Treatment of floodproofed residential basements</header><subsection id="HDF0DC699671947BBAA982A088BA11610"><enum>(a)</enum><header>Definitions</header><text>In this section—</text><paragraph id="H307BD2251D5D4F12B387C589C30125E3"><enum>(1)</enum><text>for purposes of rating a floodproofed covered structure, the term <term>adjusted base flood elevation</term> means the base flood elevation for a covered structure on the applicable effective flood insurance rate map, plus 1 foot;</text></paragraph><paragraph id="HE450D7E4BAA4402B85A52B7BA1513D68"><enum>(2)</enum><text>the term <term>Administrator</term> means the Administrator of the Federal Emergency Management Agency;</text></paragraph><paragraph id="HB81F3DD6B19F4130A6D3B04EAC225BC5"><enum>(3)</enum><text>the term <term>applicable flood plain management measures</term> means flood plain management measures adopted by a community under <external-xref legal-doc="regulation" parsable-cite="cfr/44/60.3">section 60.3(c)</external-xref> of title 44, Code of Federal Regulations;</text></paragraph><paragraph id="H8F5B9815ECAE454FBFB702BA331AECF4"><enum>(4)</enum><text>the term <term>covered structure</term> means a residential structure—</text><subparagraph id="HD835A429B5A048E09BA04673474B4E0C"><enum>(A)</enum><text>that is located in a community that has adopted flood plain management measures that are approved by the Federal Emergency Management Agency and satisfy the requirements for an exception for floodproofed residential basements under <external-xref legal-doc="regulation" parsable-cite="cfr/44/60.6">section 60.6(c)</external-xref> of title 44, Code of Federal Regulations; and</text></subparagraph><subparagraph id="H7F84F8068C40485495563772DB4A3A47"><enum>(B)</enum><text>that was built in compliance with the applicable flood plain management measures;</text></subparagraph></paragraph><paragraph id="H376930387A2F49A8830AF89F82E232E4"><enum>(5)</enum><text>the term <term>floodproofed elevation</term> means the height of floodproofing on a structure, as identified on the Residential Basement Floodproofing Certificate for the structure; and</text></paragraph><paragraph id="HC59787183187466E9A1A78F228E1E09E"><enum>(6)</enum><text>the term <term>National Flood Insurance Program</term> means the program established under the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4001">42 U.S.C. 4001 et seq.</external-xref>).</text></paragraph></subsection><subsection id="H86D8740C13504B7D9D5467C96A47F11B"><enum>(b)</enum><header>Preservation of basement exception</header><text>Notwithstanding the Biggert-Waters Flood Insurance Reform Act of 2012 (<external-xref legal-doc="public-law" parsable-cite="pl/112/141">Public Law 112–141</external-xref>; 126 Stat. 916), the amendments made by that Act, or any other provision of law, the Administrator shall rate a covered structure using the elevation difference between the floodproofed elevation of the covered structure and the adjusted base flood elevation of the covered structure.</text></subsection></section></legis-body></bill>
