which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To encourage benchmarking and disclosure of energy information for commercial buildings.</official-title></form><legis-body id="HAF875113752841AAA67A496A27B0A126" style="OLC"><section id="HDC9844EE6548476E8567B22EEF622DAF" section-type="section-one"><enum>1.</enum><header>Energy information for commercial buildings</header><subsection id="H00E34F68611241BEBAFD1AEB9D006A75"><enum>(a)</enum><header>Requirement of benchmarking and disclosure for leasing buildings without energy star labels</header><text>Section 435(b)(2) of the Energy Independence and Security Act of 2007 (<external-xref legal-doc="usc" parsable-cite="usc/42/17091">42 U.S.C. 17091(b)(2)</external-xref>) is amended—</text><paragraph id="HC56AAED42B324892AF5F4C27C9CECAF0"><enum>(1)</enum><text>by striking <quote>paragraph (2)</quote> and inserting <quote>paragraph (1)</quote>; and</text></paragraph><paragraph id="HE5235D3B76BE4664846CCC386FE9444B"><enum>(2)</enum><text>by striking <quote>signing the contract,</quote> and all that follows through the period at the end and inserting the following:</text><quoted-block display-inline="no-display-inline" id="HA555F33C986D40739D451CCFF0DDC45A" style="OLC"><quoted-block-continuation-text quoted-block-continuation-text-level="paragraph">signing the contract, the following requirements are met:</quoted-block-continuation-text><subparagraph id="H8B05C45CFCF143F09B03CA8C365EFC89"><enum>(A)</enum><text>The space is renovated for all energy efficiency and conservation improvements that would be cost effective over the life of the lease, including improvements in lighting, windows, and heating, ventilation, and air conditioning systems.</text></subparagraph><subparagraph id="H2FDD4DB68960444291D303DFC66E0C87"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="HDA610206CB2C4A38B12A809C701B3C05"><enum>(i)</enum><text>Subject to clause (ii), the space is benchmarked under a nationally recognized, online, free benchmarking program, with public disclosure, unless the space is a space for which owners cannot access whole building utility consumption data, including spaces—</text><subclause id="H1634099A21A340AF8C18931F32486724" indent="up1"><enum>(I)</enum><text>that are located in States with privacy laws that provide that utilities shall not provide such aggregated information to multitenant building owners; and</text></subclause><subclause id="HE36C46618C714321B5069314A6EC3075" indent="up1"><enum>(II)</enum><text>for which tenants do not provide energy consumption information to the commercial building owner in response to a request from the building owner.</text></subclause></clause><clause id="H8E844E24AF364889A94FD48450BCA2B4" indent="up1"><enum>(ii)</enum><text>A Federal agency that is a tenant of the space shall provide to the building owner, or authorize the owner to obtain from the utility, the energy consumption information of the space for the benchmarking and disclosure required by this subparagraph.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HABF2B8908E924BBB8135595EF516A22C"><enum>(b)</enum><header>Department of Energy study</header><paragraph id="H0FD2039353A543D5A20408A4F4456F33"><enum>(1)</enum><header>In general</header><text>Not later than 2 years after the date of enactment of this Act, the Secretary shall complete a study, with opportunity for public comment—</text><subparagraph id="H8129695869DE42658BC4DF5EC184025F"><enum>(A)</enum><text>on the impact of—</text><clause id="H2E40526046254514831E2E20D804ADDE"><enum>(i)</enum><text>State and local performance benchmarking and disclosure policies, and any associated building efficiency policies, for commercial and multifamily buildings; and</text></clause><clause id="H56BD2450DBD243D9BD4BA07AF18D72A5"><enum>(ii)</enum><text>programs and systems in which utilities provide aggregated information regarding whole building energy consumption and usage information to owners of multitenant commercial, residential, and mixed-use buildings;</text></clause></subparagraph><subparagraph id="HA1E48B4B6E654446A9E22E2BFD5117C6"><enum>(B)</enum><text>that identifies best practice policy approaches studied under subparagraph (A) that have resulted in the greatest improvements in building energy efficiency; and</text></subparagraph><subparagraph id="H1C5F3CA8EF514FF4841EBF02AA1EAF53"><enum>(C)</enum><text>that considers—</text><clause id="H50441C6D602C4E87899817AE9F432F34"><enum>(i)</enum><text>compliance rates and the benefits and costs of the policies and programs on building owners, utilities, tenants, and other parties;</text></clause><clause id="HC249C9C4817243ED9A62CAE41BD0D695"><enum>(ii)</enum><text>utility practices, programs, and systems that provide aggregated energy consumption information to multitenant building owners, and the impact of public utility commissions and State privacy laws on those practices, programs, and systems;</text></clause><clause id="H69E895FF29BE4156B7DE876F359A153E"><enum>(iii)</enum><text>exceptions to compliance in existing laws where building owners are not able to gather or access whole building energy information from tenants or utilities;</text></clause><clause id="H67672F771FF549598B35963DEADBCA73"><enum>(iv)</enum><text>the treatment of buildings with—</text><subclause id="HEB331EB2C12C4294AC5CE0317EFCCE59"><enum>(I)</enum><text>multiple uses;</text></subclause><subclause id="H07CBD74D7FF941E78F9EB6090E3AA7D3"><enum>(II)</enum><text>uses for which baseline information is not available; and</text></subclause><subclause id="H0EF16A28C65D4E328CC092ADC011CED2"><enum>(III)</enum><text>uses that require high levels of energy intensities, such as data centers, trading floors, and televisions studios;</text></subclause></clause><clause id="HE41FDEECA6C14BC2967B7A49531D3CDE"><enum>(v)</enum><text>implementation practices, including disclosure methods and phase-in of compliance;</text></clause><clause id="H6A04AC009D5248779E3BF3BA6237F1FB"><enum>(vi)</enum><text>the safety and security of benchmarking tools offered by government agencies, and the resiliency of those tools against cyber-attacks; and</text></clause><clause id="HD05ACD7A555F4D248D31400A1406AAB7"><enum>(vii)</enum><text>international experiences with regard to building benchmarking and disclosure laws and data aggregation for multitenant buildings.</text></clause></subparagraph></paragraph><paragraph id="H05E837AB06434D179855027D47BBF1D7"><enum>(2)</enum><header>Submission to Congress</header><text>At the conclusion of the study, the Secretary shall submit to Congress a report on the results of the study.</text></paragraph></subsection><subsection id="HB52F8FB2EE10478B83E82E82881FF6FF"><enum>(c)</enum><header>Creation and maintenance of databases</header><paragraph id="HA4D3FB2499B941B3970C029AC109C01B"><enum>(1)</enum><header>In general</header><text>Not later than 18 months after the date of enactment of this Act and following opportunity for public notice and comment, the Secretary, in coordination with other relevant agencies shall, to carry out the purpose described in paragraph (2)—</text><subparagraph id="H09A18D6DDA7F4FDBABD7619F9BED2C6C"><enum>(A)</enum><text>assess existing databases; and</text></subparagraph><subparagraph id="H1BF01E8EA4964A1CAF7FB2737F94C2F1"><enum>(B)</enum><text>as necessary—</text><clause id="HD2319D34486645DDB44F0BF65B450BFB"><enum>(i)</enum><text>modify and maintain existing databases; or</text></clause><clause id="HE3796C7145E84E1DAC2AC978D557F213"><enum>(ii)</enum><text>create and maintain a new database platform.</text></clause></subparagraph></paragraph><paragraph id="H9B9494438AF545BC871484DE0EA8D6F7"><enum>(2)</enum><header>Purpose</header><text>The maintenance of existing databases or creation of a new database platform under paragraph (1) shall be for the purpose of storing and making available public energy-related information on commercial and multifamily buildings, including—</text><subparagraph id="H94C0F5F1F19549EF8C45F33214EF19B3"><enum>(A)</enum><text>data provided under Federal, State, local, and other laws or programs regarding building benchmarking and energy information disclosure;</text></subparagraph><subparagraph id="HC842A0C4D75F401AA5E258645517B13A"><enum>(B)</enum><text>buildings that have received energy ratings and certifications; and</text></subparagraph><subparagraph id="HB42740B3FBD140CAA344B2B2256DA1C6"><enum>(C)</enum><text>energy-related information on buildings provided voluntarily by the owners of the buildings, in an anonymous form, unless the owner provides otherwise.</text></subparagraph></paragraph></subsection><subsection id="H64D05FBD1BC44814B637472E8BE2ADE8"><enum>(d)</enum><header>Competitive awards</header><text>Based on the results of the research for the portion of the study described in subsection (b)(1)(A)(ii), and with criteria developed following public notice and comment, the Secretary may make competitive awards to utilities, utility regulators, and utility partners to develop and implement effective and promising programs to provide aggregated whole building energy consumption information to multitenant building owners.</text></subsection><subsection id="HB06697529B174EDE9D75E0CD19187488"><enum>(e)</enum><header>Input from stakeholders</header><text>The Secretary shall seek input from stakeholders to maximize the effectiveness of the actions taken under this section.</text></subsection><subsection id="H0CE49B60DDDD486BB91370E190D5435A"><enum>(f)</enum><header>Report</header><text>Not later than 2 years after the date of enactment of this Act, and every 2 years thereafter, the Secretary shall submit to Congress a report on the progress made in complying with this section.</text></subsection><subsection id="HBB46A7EDAFE34E4D85BDCECF2335F10E"><enum>(g)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out subsection (b) $2,500,000 for each of fiscal years 2014 through 2018, to remain available until expended.</text></subsection></section></legis-body></bill>
