		<section id="HB86D861C1FEB4749A3D3016847366400" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Federal Spectrum Incentive Act of 2013</short-title></quote>.</text>
		</section><section id="H80FE6458A0F24809B68B4C4CA9AE2306"><enum>2.</enum><header>Federal spectrum incentives</header>
			<subsection id="H5385B4372BAB409D8982D346F072283D"><enum>(a)</enum><header>Notice to Commission</header>
				<paragraph id="H63DE55C66DDF49FD8A4FE5519F36D3DC"><enum>(1)</enum><header>In general</header><text>Section 113(g)(4) of the National Telecommunications and Information Administration Organization
			 Act (<external-xref legal-doc="usc" parsable-cite="usc/47/923">47 U.S.C. 923(g)(4)</external-xref>) is amended—</text>
					<subparagraph id="H00FDFAA5C7AB45B7AAB50218494773C5"><enum>(A)</enum><text display-inline="yes-display-inline">by striking the heading and inserting <quote><header-in-text level="paragraph" style="OLC">Notice to Commission.—</header-in-text></quote>;</text>
					</subparagraph><subparagraph id="H4FD0E069DC324CB3B8603C1912B1D8A9"><enum>(B)</enum><text>in the second sentence of subparagraph (A), by striking <quote>shall notify the Commission</quote> and all that follows and inserting the following:</text>
						<quoted-block display-inline="yes-display-inline" id="HD04F1CC4DFBE43418A80035AA18E42E6" style="OLC"><text>shall notify the Commission—</text><clause id="H1763E986BFE34C1B95866EECF97B2E4C"><enum>(i)</enum><text display-inline="yes-display-inline">of estimated relocation or sharing costs and timelines for such relocation or sharing; or</text>
							</clause><clause id="HC907E3259E954351B0CC8D05F59F1162"><enum>(ii)</enum><text>that, instead of relocation or sharing costs under this subsection and section 118, a Federal
			 entity will receive payment under section 120 because such entity is—</text>
								<subclause id="HB8264D83C736418DB32F604E7EA30F95"><enum>(I)</enum><text>discontinuing the operations that the Federal entity conducts on such eligible frequencies without
			 relocating such operations to other frequencies; or</text>
								</subclause><subclause id="H13E1FE9D4547466C9365B762456D692F"><enum>(II)</enum><text>relocating such operations to frequencies assigned to another Federal entity in order for such
			 entities to share such frequencies.</text></subclause></clause><after-quoted-block>; and</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="H8BA5403F74114BBBA1B1476379A2E0F0"><enum>(C)</enum><text>by adding at the end the following:</text>
						<quoted-block display-inline="no-display-inline" id="H9FDDD08C5780462694B36906A7A6575E" style="OLC">
							<subparagraph id="HECB1AEB66591470EA9277D27211D20E7"><enum>(D)</enum><text display-inline="yes-display-inline">This subsection and section 118 shall not apply with respect to the discontinuance of operations on
			 eligible frequencies or the relocation of such operations by a Federal
			 entity after the Commission receives notice under subparagraph (A)(ii)
			 with respect to such discontinuance or relocation.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="H077527EED6BC4C8E940E1B163C32A1B0"><enum>(2)</enum><header>Conforming amendments</header><text>Section 113(g) of the National Telecommunications and Information Administration Organization Act
			 (<external-xref legal-doc="usc" parsable-cite="usc/47/923">47 U.S.C. 923(g)</external-xref>) is amended—</text>
					<subparagraph id="HF1BF7D29963746ED90E384BCC96B2BEA"><enum>(A)</enum><text>in paragraph (3)(A)(iii)(I), by striking <quote>paragraph (4)(A)</quote> and inserting <quote>paragraph (4)(A)(i)</quote>;</text>
					</subparagraph><subparagraph id="HADAFCA9833FD47DC8FCD27DB6C8110B0"><enum>(B)</enum><text>in paragraph (4)—</text>
						<clause id="H7453137FF7E74E52910B558C49F128A5"><enum>(i)</enum><text>in subparagraph (B), by striking <quote>subparagraph (A)</quote> and inserting <quote>subparagraph (A)(i)</quote>; and</text>
						</clause><clause id="HDD59DB97E46543198B70A6017E9FCCBD"><enum>(ii)</enum><text>in subparagraph (C), by striking <quote>subparagraphs (A) and (B)</quote> and inserting <quote>subparagraphs (A)(i) and (B)</quote>; and</text>
						</clause></subparagraph><subparagraph id="H10EBBEAC1EE84E60B600E40F1802322D"><enum>(C)</enum><text>in paragraph (5), by striking <quote>paragraph (4)(A)</quote> and inserting <quote>paragraph (4)(A)(i)</quote>.</text>
					</subparagraph></paragraph></subsection><subsection id="H9C5473CF73C24D8BA631F936C3712ACE"><enum>(b)</enum><header>Transition plans</header><text display-inline="yes-display-inline">Section 113(h) of the National Telecommunications and Information Administration Organization Act
			 (<external-xref legal-doc="usc" parsable-cite="usc/47/923">47 U.S.C. 923(h)</external-xref>) is amended—</text>
				<paragraph id="HC9F58BCA1F6640F48A47E14B75921904"><enum>(1)</enum><text>in the heading, by striking <quote><header-in-text level="subsection" style="OLC">relocation or sharing</header-in-text></quote>;</text>
				</paragraph><paragraph id="H48BE46966ED6488683AF8901A39E75DA"><enum>(2)</enum><text>by amending paragraph (1) to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="H53A8086EF5FF4DD3BF506F985B9F49A2" style="OLC">
						<paragraph id="HC2BF69A05700460980AE8F74C9F656C3"><enum>(1)</enum><header>Development of transition plan by Federal entity</header>
							<subparagraph id="HA37452B3F2344EDF89A65468D4FC2555"><enum>(A)</enum><header>In general</header><text>Not later than 240 days before the commencement of any auction of eligible frequencies described in
			 subsection (g)(2), a Federal entity authorized to use any such frequency
			 shall submit to the NTIA and to the Technical Panel established by
			 paragraph (3) a transition plan in which the Federal entity—</text>
								<clause id="H2EC596250FC343DB9152F588A1F7DE14"><enum>(i)</enum><text>declares the intention of such entity—</text>
									<subclause id="H593F5FAB7AD94F3C9C992894C2BC3FDF"><enum>(I)</enum><text>to share such eligible frequencies with a non-Federal user or to relocate to other frequencies, and
			 to receive relocation or sharing costs from the Spectrum Relocation Fund
			 established by section 118; or</text>
									</subclause><subclause id="H77383B349A504390AD9745F177837C01"><enum>(II)</enum><text display-inline="yes-display-inline">to discontinue the operations that the Federal entity conducts on such eligible frequencies without
			 relocating such operations to other frequencies or to relocate such
			 operations to frequencies assigned to another Federal entity in order for
			 such entities to share such frequencies, and to receive payment from the
			 Federal Spectrum Incentive Fund established by section 120; and</text>
									</subclause></clause><clause id="H34468D5BA6C2461C9D837C19B2ACEE38"><enum>(ii)</enum><text>describes how the entity will implement the relocation, sharing, or discontinuance arrangement.</text>
								</clause></subparagraph><subparagraph id="HFE7324BFF5914C008D079A6DEF2D8200"><enum>(B)</enum><header>Common format</header><text>The NTIA shall specify, after public input, a common format for all Federal entities to follow in
			 preparing transition plans under this paragraph.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H56A1DEF02137472786E6FAB25601C1D0"><enum>(3)</enum><text>in paragraph (2)—</text>
					<subparagraph id="H0210310D3F8B43DDAA12FD48ABEA0446"><enum>(A)</enum><text>in subparagraph (D), by inserting <quote>, to discontinue such use,</quote> after <quote>from such frequencies</quote>;</text>
					</subparagraph><subparagraph id="HC749155E012846CF9AEF84096165AB81"><enum>(B)</enum><text>in subparagraph (F), by inserting <quote>, discontinuance,</quote> after <quote>relocation</quote>; and</text>
					</subparagraph><subparagraph id="H11AD5D7AF8E4439094D1F291405B8E17"><enum>(C)</enum><text>in subparagraph (G), by striking <quote>The plans</quote> and inserting <quote>To the extent applicable given the intention declared by the entity under paragraph (1)(A)(i), the
			 plans</quote>;</text>
					</subparagraph></paragraph><paragraph id="H5E66619A9186481F948E489F9D5A332B"><enum>(4)</enum><text>in paragraph (4)(A), by inserting <quote>(if applicable)</quote> after <quote>timelines and</quote>;</text>
				</paragraph><paragraph id="HBE7D1A3454734F46B68E27C742CD50AE"><enum>(5)</enum><text>in paragraph (6)—</text>
					<subparagraph id="HD1F6E9727EA143F499DBD30410EBCB8F"><enum>(A)</enum><text>by inserting <quote>(if applicable)</quote> after <quote>costs</quote>; and</text>
					</subparagraph><subparagraph id="H8C600406A88F4976B4E710B8076830D0"><enum>(B)</enum><text>by inserting <quote>, discontinuance,</quote> after <quote>relocation</quote> the second place it appears; and</text>
					</subparagraph></paragraph><paragraph id="H7AC68FDC38D84E0D97C544645467A455"><enum>(6)</enum><text display-inline="yes-display-inline">in paragraph (7)(A)(ii), by inserting <quote>, discontinuance,</quote> after <quote>relocation</quote>.</text>
				</paragraph></subsection><subsection id="H3BC8DC41DF78494CA7270FBCF88E8EFF"><enum>(c)</enum><header>Relocation or discontinuance prioritized over sharing</header><text display-inline="yes-display-inline">Section 113(j) of the National Telecommunications and Information Administration Organization Act
			 (<external-xref legal-doc="usc" parsable-cite="usc/47/923">47 U.S.C. 923(j)</external-xref>) is amended—</text>
				<paragraph id="HE17109D20674474EA4B8B597BE90F317"><enum>(1)</enum><text>in the heading, by inserting <quote><header-in-text level="subsection" style="OLC">or discontinuance</header-in-text></quote> after <quote><header-in-text level="subsection" style="OLC">Relocation</header-in-text></quote>; and</text>
				</paragraph><paragraph id="H3231522A5FF34C459CE3D9B0382C5B0D"><enum>(2)</enum><text>by inserting <quote>or discontinuance of the operations that the Federal entity conducts on the band</quote> after <quote>from the band</quote> each place it appears.</text>
				</paragraph></subsection><subsection id="HDDAC9BF1DC8F4AB88E5D6725D9FA6608"><enum>(d)</enum><header>Deposit of auction proceeds</header><text>Section 309(j)(8) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/309">47 U.S.C. 309(j)(8)</external-xref>) is amended—</text>
				<paragraph id="H8AC935C4AFC14EFA9362C1A182BE7F97"><enum>(1)</enum><text>in subparagraph (C)(i), by striking <quote>(D)(ii)</quote> and inserting <quote>(D)(ii), (D)(iii)</quote>; and</text>
				</paragraph><paragraph id="H41E5E5676A57462387CB980CA4B14EDA"><enum>(2)</enum><text>in subparagraph (D)—</text>
					<subparagraph id="HD8BF3D812D78425DA85380644966E4E0"><enum>(A)</enum><text>in clause (i), by striking <quote>clause (ii)</quote> and inserting <quote>clauses (ii) and (iii)</quote>; and</text>
					</subparagraph><subparagraph id="HAA819785F15843D592511A585D896129"><enum>(B)</enum><text>by adding at the end the following:</text>
						<quoted-block display-inline="no-display-inline" id="H474AC3A9A70A428B8C80A1C07DC75770" style="OLC">
							<clause id="H187AA9BB6FD442BC94B1F3386BA02652"><enum>(iii)</enum><header>Federal spectrum incentives</header><text display-inline="yes-display-inline">Notwithstanding subparagraph (A) and except as provided in subparagraph (B) and clause (ii) of this
			 subparagraph, in the case of proceeds (including deposits and upfront
			 payments from successful bidders) attributable to the auction of eligible
			 frequencies described in section 113(g)(2) of the National
			 Telecommunications and Information Administration Organization Act with
			 respect to which the Commission has received notice under section
			 113(g)(4)(A)(ii) of such Act, 1 percent of such proceeds shall be
			 deposited in the Federal Spectrum Incentive Fund established by section
			 120 of such Act and shall be available in accordance with such section.
			 The remainder of such proceeds shall be deposited in the general fund of
			 the Treasury, where such proceeds shall be dedicated for the sole purpose
			 of deficit reduction.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph></subsection><subsection id="H7C4261A9A71F4A8CAFDCC2EC73B62298"><enum>(e)</enum><header>Federal Spectrum Incentive Fund</header><text display-inline="yes-display-inline">Part B of the National Telecommunications and Information Administration Organization Act (47
			 U.S.C. 921 et seq.) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HE15F16B1367C4F2BAEA4FA26E3F5E036" style="OLC">
					<section id="H92507910CB8F4E58875DB985EC3D4F59"><enum>120.</enum><header>Federal Spectrum Incentive Fund</header>
						<subsection id="H803DC0F2EC024EF5BCDFE73F618DC8EF"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">There is established in the Treasury of the United States a fund to be known as the Federal
			 Spectrum Incentive Fund (in this section referred to as the <quote>Fund</quote>), which shall be administered by the Office of Management and Budget (in this section referred to
			 as <quote>OMB</quote>), in consultation with the NTIA.</text>
						</subsection><subsection id="HBE1683B9C4DA430F83B5C806ED9B3F82"><enum>(b)</enum><header>Transfer of funds</header><text display-inline="yes-display-inline">The Director of OMB shall transfer from the Fund to a Federal entity an amount equal to the amount
			 deposited in accordance with section 309(j)(8)(D)(iii) of the
			 Communications Act of 1934 that is attributable to the auction of eligible
			 frequencies described in section 113(g)(2) of this Act being vacated by
			 such entity. Such amount shall be available to the Federal entity in
			 accordance with subsection (c) and shall remain available until expended.</text>
						</subsection><subsection id="H6BBBA2CC3D7C443192BEA24103605D9D"><enum>(c)</enum><header>Use of funds</header><text>A Federal entity may use an amount transferred under subsection (b) for the following purposes:</text>
							<paragraph id="HB0113A0D76994623A32000D402E3B1EC"><enum>(1)</enum><header>Offset of sequestration</header><text>Any purposes permitted under the terms and conditions of an appropriations account of the Federal
			 entity that was subject to sequestration for any fiscal year under the
			 Balanced Budget and Emergency Deficit Control Act of 1985. The amount used
			 for such purposes under this paragraph may not exceed the amount by which
			 the amount available to such entity under such account was reduced by
			 sequestration for such fiscal year.</text>
							</paragraph><paragraph id="H43A453AD92B04695906093379CC4BB0D"><enum>(2)</enum><header>Transfer to incumbent Federal entity</header><text display-inline="yes-display-inline">In the case of a Federal entity that is relocating operations to frequencies assigned to an
			 incumbent Federal entity in order for such entities to share such
			 frequencies, to transfer an amount to the incumbent Federal entity for any
			 purposes permitted under this subsection (except this paragraph). The
			 transferred amount shall remain available to the incumbent Federal entity
			 until expended.</text>
							</paragraph></subsection><subsection id="H0F4D339B627A411E90434CF1FFBB2277"><enum>(d)</enum><header>Prohibition on duplicative payments</header><text display-inline="yes-display-inline">If the Commission receives notice under section 113(g)(4)(A)(ii) of a discontinuance of operations
			 on or relocation from eligible frequencies by a Federal entity that has
			 received, from the Spectrum Relocation Fund in accordance with section
			 118(d)(3), relocation or sharing costs related to pre-auction estimates or
			 research with respect to such frequencies, the Director of OMB shall
			 deduct from the amount to be transferred to such entity under subsection
			 (b) an amount equal to such costs and shall transfer such amount to the
			 Spectrum Relocation Fund.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HA549771CD8894C25BDAD3E631CC3048F"><enum>(f)</enum><header>Department of Defense spectrum</header><text display-inline="yes-display-inline">Section 1062(b) of the National Defense Authorization Act for Fiscal Year 2000 (<external-xref legal-doc="public-law" parsable-cite="pl/106/65">Public Law 106–65</external-xref>)
			 does not apply to frequencies with respect to which the Commission has
			 received notice under section 113(g)(4)(A)(ii) of the National
			 Telecommunications and Information Administration Organization Act (47
			 U.S.C. 923(g)(4)(A)(ii)).</text>
			</subsection></section><section id="H88E2FE8CEDD3455284CD41F0466602D5"><enum>3.</enum><header>Costs of incumbent Federal entities related to spectrum sharing</header>
			<subsection id="HBC13BB3255D744DAB6B04ABEA61DC8CE"><enum>(a)</enum><header>Description of eligible Federal entities</header><text display-inline="yes-display-inline">Section 113(g)(1) of the National Telecommunications and Information Administration Organization
			 Act (<external-xref legal-doc="usc" parsable-cite="usc/47/923">47 U.S.C. 923(g)(1)</external-xref>) is amended—</text>
				<paragraph id="HD23D6246ADD24338A129A043A6931533"><enum>(1)</enum><text>by striking <quote>authorized to use a band of eligible frequencies described in paragraph (2)</quote>;</text>
				</paragraph><paragraph id="H24A57CE90C9648B686E0484D8598AD2A"><enum>(2)</enum><text>by striking <quote>spectrum frequencies</quote> the first place it appears and inserting <quote>eligible frequencies described in paragraph (2)</quote>; and</text>
				</paragraph><paragraph id="HE814676E94B14D96B19202C52A03636D"><enum>(3)</enum><text>by striking <quote>spectrum frequencies</quote> the second place it appears and inserting <quote>eligible frequencies described in such paragraph</quote>.</text>
				</paragraph></subsection><subsection id="H4313F80B23154FBA82037C9EBE14E4C2"><enum>(b)</enum><header>Definition of relocation or sharing costs</header><text display-inline="yes-display-inline">Section 113(g)(3)(A) of the National Telecommunications and Information Administration Organization
			 Act (<external-xref legal-doc="usc" parsable-cite="usc/47/923">47 U.S.C. 923(g)(3)(A)</external-xref>) is amended—</text>
				<paragraph id="H734FA4D3302945F7988BB064D3D77ACD"><enum>(1)</enum><text>in clause (iv)(II), by striking <quote>and</quote> at the end;</text>
				</paragraph><paragraph id="HBB0EA0119AF94F45BD7F083A6484B663"><enum>(2)</enum><text>in clause (v), by striking the period and inserting <quote>; and</quote>; and</text>
				</paragraph><paragraph id="H81B5C1098EB24D009D841A710071D958"><enum>(3)</enum><text>by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H453EC60268CA4E38BD875876A4C1ED03" style="OLC">
						<clause id="H94433382986644799AE8DBE51A197776"><enum>(vi)</enum><text display-inline="yes-display-inline">the costs incurred by an incumbent Federal entity to accommodate sharing the spectrum frequencies
			 assigned to such entity with a Federal entity the operations of which are
			 being relocated from eligible frequencies described in paragraph (2),
			 unless the Commission receives notice under paragraph (4)(A)(ii)(II) with
			 respect to the relocation of such operations.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H50446BA697744C00A317B39EEBB6ADD3"><enum>(c)</enum><header>Spectrum Relocation Fund</header><text display-inline="yes-display-inline">Section 118 of the National Telecommunications and Information Administration Organization Act (47
			 U.S.C. 928) is amended—</text>
				<paragraph id="HC6E7B3873C6C468AAB1F4BDBD61A650D"><enum>(1)</enum><text>in subsection (c), by striking <quote>with respect to</quote> and all that follows and inserting the following:</text>
					<quoted-block display-inline="yes-display-inline" id="H47AC647169E946598903EACB31455131" style="OLC"><text>with respect to—</text><paragraph id="H6864CD27CE3846E9A94ABEAF8CE9217B"><enum>(1)</enum><text display-inline="yes-display-inline">relocation from or sharing of such eligible frequencies; or</text>
						</paragraph><paragraph id="HE5DD8E39D3A54CE58D95EF0258CCD655"><enum>(2)</enum><text>in the case of an incumbent Federal entity described in section 113(g)(3)(A)(vi), accommodating
			 sharing the spectrum frequencies assigned to such entity with a Federal
			 entity the operations of which are being relocated from such eligible
			 frequencies.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H4CC4CDD42C144BED8FCF34A0A9F982F7"><enum>(2)</enum><text>in subsection (d)—</text>
