<official-title display="yes">To amend the Communications Act of 1934 to expand and clarify the prohibition on provision of inaccurate caller identification information, and for other purposes.</official-title>

<section id="H90200938EF6F4071B8B71F66B8AD9D2E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Anti-Spoofing Act of 2014</short-title></quote>.</text></section> 
<section id="HD4B3F783CBE14BF5B5989F0B54D520B8"><enum>2.</enum><header>Expanding and clarifying prohibition on inaccurate caller ID information</header> 
<subsection id="HEE4CA4690E88453D9DD5AA5B90F1C88C"><enum>(a)</enum><header>Communications from outside United States</header><text display-inline="yes-display-inline">Section 227(e)(1) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/227">47 U.S.C. 227(e)(1)</external-xref>) is amended by inserting <quote>or any person outside the United States if the recipient is within the United States,</quote> after <quote>United States,</quote>.</text></subsection> 
<subsection id="HCF5DCD643FFE4B248BF24ACABFDB7BDA"><enum>(b)</enum><header>Text messaging service</header><text>Section 227(e)(8) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/227">47 U.S.C. 227(e)(8)</external-xref>) is amended—</text> 
<paragraph id="H39A98E10B69D492D8786D9D56DFBC281"><enum>(1)</enum><text>in subparagraph (A), by inserting <quote>(including a text message sent using a text messaging service)</quote> before the period at the end;</text></paragraph> 
<paragraph id="HFB3BC137C8AB49B6BBE0E0639BCAEF6B"><enum>(2)</enum><text display-inline="yes-display-inline">in the first sentence of subparagraph (B), by inserting <quote>(including a text message sent using a text messaging service)</quote> before the period at the end; and</text></paragraph> 
<paragraph id="HB1B1A7E9C0F44D4581708D947A9C5E1E"><enum>(3)</enum><text>by adding at the end the following:</text>

<subparagraph commented="no" id="H210E3E99947E4C0D83190AFB72332344"><enum>(D)</enum><header>Text message</header><text display-inline="yes-display-inline">The term <term>text message</term> means a real-time or near real-time message consisting of text, images, sounds, or other information that is transmitted from or received by a device that is identified as the transmitting or receiving device by means of a telephone number. Such term—</text> 
<clause commented="no" id="HB2B01DC673244E0C90C54AF3A544F1A9"><enum>(i)</enum><text>includes a short message service (SMS) message, an enhanced message service (EMS) message, and a multimedia message service (MMS) message; and</text></clause> 
<clause commented="no" id="H1813122F91344B77BD9EB52A3EFD95BD"><enum>(ii)</enum><text>does not include a real-time, two-way voice or video communication.</text></clause></subparagraph> 
<subparagraph id="H8FBD0B7C6AFB4AC3B742C8D9588058BC"><enum>(E)</enum><header>Text messaging service</header><text>The term <term>text messaging service</term> means a service that permits the transmission or receipt of a text message, including a service provided as part of or in connection with a telecommunications service or an IP-enabled voice service.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HE28286E396D74EF8BA7CD29C5990EE0D"><enum>(c)</enum><header>Coverage of outgoing-Call-Only IP-Enabled voice service</header><text>Section 227(e)(8)(C) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/227">47 U.S.C. 227(e)(8)(C)</external-xref>) is amended by striking <quote>has the meaning</quote> and all that follows and inserting <quote>means the provision of real-time voice communications offered to the public, or such class of users as to be effectively available to the public, transmitted using Internet protocol, or a successor protocol, (whether part of a bundle of services or separately) with interconnection capability such that the service can originate traffic to, or terminate traffic from, the public switched telephone network, or a successor network.</quote>.</text></subsection> 
<subsection id="HDA2A850947324C4FBF4A289E4ED95993"><enum>(d)</enum><header>Regulations</header> 
<paragraph id="H12DBB01100044042BC22A51F25414844"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Section 227(e)(3)(A) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/227">47 U.S.C. 227(e)(3)(A)</external-xref>) is amended by striking <quote>Not later than 6 months after the date of enactment of the Truth in Caller ID Act of 2009, the Commission</quote> and inserting <quote>The Commission</quote>.</text></paragraph> 
<paragraph id="HF05CDE7F243C44A183B5C0ABA6008B3C"><enum>(2)</enum><header>Deadline</header><text display-inline="yes-display-inline">The Federal Communications Commission shall prescribe regulations to implement the amendments made by this section not later than 18 months after the date of the enactment of this Act.</text></paragraph></subsection> 
<subsection id="HB950F382D3DD4ECBB14EDC6213883FC8"><enum>(e)</enum><header>Effective date</header><text>The amendments made by this section shall take effect on the date that is 6 months after the date on which the Federal Communications Commission prescribes regulations to implement the amendments made by this section.</text></subsection></section>
