		<section id="H4D3958107E3C4028A5F8A6DD6358F7B3" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Capital Access for Small Community Financial Institutions Act of 2014</short-title></quote>.</text>
		</section><section id="HAE729FA2D5FF4F23A6F09057A0EFD340"><enum>2.</enum><header>Privately insured credit unions authorized to become members of a Federal home loan bank</header>
			<subsection id="HCEB137BF22BD4A56A1424C8AFAF5E32C"><enum>(a)</enum><header>In general</header><text>Section 4(a) of the Federal Home Loan Bank Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1424">12 U.S.C. 1424(a)</external-xref>) is amended by adding at the end
			 the following new paragraph:</text>
				<quoted-block id="H4F9BE02169A947AA9D00F17802418168" style="OLC">
					<paragraph id="H1BEF81A8D686472D8A4EA89BC967DF68"><enum>(5)</enum><header>Certain privately insured credit unions</header>
						<subparagraph id="HD62DF041777846AB8B0F0D715DFF0AAB"><enum>(A)</enum><header>In general</header><text>Subject to the requirements of subparagraph (B), a credit union shall be treated as an insured
			 depository institution for purposes of determining the eligibility of such
			 credit union for membership in a Federal home loan bank under paragraphs
			 (1), (2), and (3).</text>
						</subparagraph><subparagraph id="HADDB39199B7C49B597F421AC5DCBDDB8"><enum>(B)</enum><header>Certification by appropriate supervisor</header>
							<clause id="HA84466D40A8E46419AD115F7743F9296"><enum>(i)</enum><header>In general</header><text>For purposes of this paragraph and subject to clause (ii), a credit union which lacks Federal
			 deposit insurance and which has applied for membership in a Federal home
			 loan bank may be treated as meeting all the eligibility requirements for
			 Federal deposit insurance only if the appropriate supervisor of the State
			 in which the credit union is chartered has determined that the credit
			 union meets all the eligibility requirements for Federal deposit insurance
			 as of the date of the application for membership.</text>
							</clause><clause id="H53E77524BD5C4522AF27F9E40D242774"><enum>(ii)</enum><header>Certification deemed valid</header><text>If, in the case of any credit union to which clause (i) applies, the appropriate supervisor of the
			 State in which such credit union is chartered fails to make a
			 determination pursuant to such clause by the end of the 6-month period
			 beginning on the date of the application, the credit union shall be deemed
			 to have met the requirements of clause (i).</text>
							</clause></subparagraph><subparagraph id="H3F5DA54B19034A61B20BAE2FE7EACF03"><enum>(C)</enum><header>Security interests of federal home loan bank not avoidable</header><text>Notwithstanding any provision of State law authorizing a conservator or liquidating agent of a
			 credit union to repudiate contracts, no such provision shall apply with
			 respect to—</text>
							<clause id="H78AEC7422DEF4E6D99C3C469523906BF"><enum>(i)</enum><text>any extension of credit from any Federal home loan bank to any credit union which is a member of
			 any such bank pursuant to this paragraph; or</text>
							</clause><clause id="HE58EE6CE5E2045FFB6F6272CD5134DA2"><enum>(ii)</enum><text>any security interest in the assets of such credit union securing any such extension of credit.</text>
							</clause></subparagraph><subparagraph id="H2CD942649B954E1AAD8FE3D8D3C014B0"><enum>(D)</enum><header>Protection for certain Federal home loan bank advances</header><text display-inline="yes-display-inline">Notwithstanding any State law to the contrary, if a Bank makes an advance under section 10 to a
			 State-chartered credit union that is not federally insured—</text>
							<clause id="HDE5ECBC1B23F4D769B2E881DB0488C5B"><enum>(i)</enum><text>the Bank’s interest in any collateral securing such advance has the same priority and is afforded
			 the same standing and rights that the security interest would have had if
			 the advance had been made to a federally-insured credit union; and</text>
							</clause><clause id="H38AB20C2F2DC4AA693C19F8D4B217B6B"><enum>(ii)</enum><text>the Bank has the same right to access such collateral that the Bank would have had if the advance
			 had been made to a federally-insured credit union.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection display-inline="no-display-inline" id="H1A71C226DB1B4E1AB775DFBC3C92E441"><enum>(b)</enum><header>Copies of audits of private insurers of certain depository institutions required To be provided to
			 supervisory agencies</header><text>Section 43(a)(2)(A) of the Federal Deposit Insurance Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1831t">12 U.S.C. 1831t(a)(2)(A)</external-xref>) is amended—</text>
				<paragraph id="H2360A6C81F8741F69DC34F49C4754B8F"><enum>(1)</enum><text>in clause (i), by striking <quote>and</quote> at the end;</text>
				</paragraph><paragraph id="H8A66464BDCA94C26AE38C1A34A03DF1C"><enum>(2)</enum><text>in clause (ii), by striking the period at the end and inserting a semicolon; and</text>
				</paragraph><paragraph id="HC4984C046A284F889E3464AB0E750643"><enum>(3)</enum><text>by inserting at the end the following new clause:</text>
					<quoted-block id="H68BDDE8A2E5F42A0B8CB1643D63AB31A" style="OLC">
						<clause id="HCCAF997D24704621958AE55BB7CC92CE"><enum>(iii)</enum><text>in the case of depository institutions described in subsection (e)(2)(A) the deposits of which are
			 insured by the private insurer which are members of a Federal home loan
			 bank, to the Federal Housing Finance Agency, not later than 7 days after
			 the audit is completed.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection></section><section id="HE64DBC149DB442BDB0536F664D2C0308"><enum>3.</enum><header>GAO Report</header><text display-inline="no-display-inline">Not later than 18 months after the date of enactment of this Act, the Comptroller General of the
			 United States shall conduct a study and submit a report to Congress—</text>
			<paragraph id="HE96468E414E94628834D67FFCA0BDC08"><enum>(1)</enum><text>on the adequacy of insurance reserves held by a private deposit insurer that insures deposits in an
			 entity described in section 43(e)(2)(A) of the Federal Deposit Insurance
			 Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1831t">12 U.S.C. 1831t(e)(2)(A)</external-xref>); and</text>
			</paragraph><paragraph id="H396BB3D87B2749778BE4A64F859D908D"><enum>(2)</enum><text>for an entity described in paragraph (1) the deposits of which are insured by a private deposit
			 insurer, information on the level of compliance with Federal regulations
			 relating to the disclosure of a lack of Federal deposit insurance.</text>
			</paragraph></section></legis-body>
