display-inline="no-display-inline">Except as otherwise expressly provided, whenever in this Act an amendment or repeal is expressed in terms of an amendment to, or a repeal of, a section or other provision, the reference shall be considered to be made to a section or other provision of title 38, United States Code.</text></section><section display-inline="no-display-inline" id="H3AF139D1815B41568FC19949AF5E5286"><enum>3.</enum><header>Scoring of budgetary effects</header><text display-inline="no-display-inline">The budgetary effects of this Act, for the purpose of complying with the Statutory Pay-As-You-Go Act of 2010, shall be determined by reference to the latest statement titled <quote>Budgetary Effects of PAYGO Legislation</quote> for this Act, submitted for printing in the Congressional Record by the Chairman of the House Budget Committee, provided that such statement has been submitted prior to the vote on passage.</text></section><section display-inline="no-display-inline" id="H81F163E893A246A5909B6ECEDDD3044C" section-type="subsequent-section"><enum>4.</enum><header>Approval of courses of education provided by public institutions of higher education for purposes of All-Volunteer Force Educational Assistance Program and Post-9/11 Educational Assistance conditional on in-State tuition rate for veterans</header><subsection id="H91B5571D06404E0988378B23D5B749C0"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/38/3679">Section 3679</external-xref> is amended by adding at the end the following new subsection:</text><quoted-block display-inline="no-display-inline" id="H49C1F01D0BEA4D85A0541ACA2B373D51" style="USC"><subsection id="H4A009F3430364A98B64D2F51F83CCB78"><enum>(c)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H73B64D2F661345B29FAAC2D1D51B8457"><enum>(1)</enum><text display-inline="yes-display-inline">Notwithstanding any other provision of this chapter and subject to paragraphs (3) through (6), the Secretary shall disapprove a course of education provided by a public institution of higher education to a covered individual pursuing a course of education with educational assistance under chapter 30 or 33 of this title while living in the State in which the public institution of higher education is located if the institution charges tuition and fees for that course for the covered individual at a rate that is higher than the rate the institution charges for tuition and fees for that course for residents of the State in which the institution is located, regardless of the covered individual’s State of residence.</text></paragraph><paragraph id="HD7B6FC38798647C185FBCAB843ADF0D0" indent="up1"><enum>(2)</enum><text>For purposes of this subsection, a covered individual is a veteran who was discharged or released from a period of not fewer than 90 days of service in the active military, naval, or air service less than three years before the date of enrollment in the course concerned.</text></paragraph><paragraph id="H19E7203DD66146719ED4ED284376ABC3" indent="up1"><enum>(3)</enum><text>If after enrollment in a course of education that is subject to disapproval under paragraph (1) a covered individual pursues one or more courses of education at the same public institution of higher education while remaining continuously enrolled (other than during regularly scheduled breaks between courses, semesters or terms) at that institution of higher education, any course so pursued by the covered individual at that institution of higher education while so continuously enrolled shall also be subject to disapproval under paragraph (1).</text></paragraph><paragraph id="H056F5E5FCE83419B8C341CEC47681542" indent="up1"><enum>(4)</enum><text display-inline="yes-display-inline">It shall not be grounds to disapprove a course of education under paragraph (1) if a public institution of higher education requires a covered individual pursuing a course of education at the institution to demonstrate an intent, by means other than satisfying a physical presence requirement, to establish residency in the State in which the institution is located, or to satisfy other requirements not relating to the establishment of residency, in order to be charged tuition and fees for that course at a rate that is equal to or less than the rate the institution charges for tuition and fees for that course for residents of the State.</text></paragraph><paragraph id="HDB3CC7D30A4F4A57B91111AE71A51130" indent="up1"><enum>(5)</enum><text>The Secretary may waive such requirements of paragraph (1) as the Secretary considers appropriate.</text></paragraph><paragraph id="H6E99B4D2DB5E4EB59E154EE3B58B7C7D" indent="up1"><enum>(6)</enum><text display-inline="yes-display-inline">Disapproval under paragraph (1) shall apply only with respect to educational assistance under chapters 30 and 33 of this title.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="H8A5AE74514454D7AB536DF005E1D45F1"><enum>(b)</enum><header>Effective date</header><text display-inline="yes-display-inline">Subsection (c) of <external-xref legal-doc="usc" parsable-cite="usc/38/3679">section 3679</external-xref> of title 38, United States Code (as added by subsection (a) of this section), shall apply with respect to educational assistance provided for pursuit of programs of education during academic terms that begin after July 1, 2016, through courses of education that commence on or after that date.</text></subsection></section><section display-inline="no-display-inline" id="HAB2E83151B424062B641FEEC77327560" section-type="subsequent-section"><enum>5.</enum><header>Clarification of eligibility for services under the Homeless Veterans Reintegration Program</header><text display-inline="no-display-inline">Subsection (a) of <external-xref legal-doc="usc" parsable-cite="usc/38/2021">section 2021</external-xref> is amended by striking <quote>reintegration of homeless veterans into the labor force.</quote> and inserting the following: “reintegration into the labor force of—</text><quoted-block display-inline="no-display-inline" id="HB197C46802FA443687C733B9E14342F8" style="OLC"><paragraph id="H2622736A625F4D5A852F53DD36231261"><enum>(1)</enum><text display-inline="yes-display-inline">homeless veterans;</text></paragraph><paragraph id="H8AF02AADFE4143A18EA5971CACB1721A"><enum>(2)</enum><text display-inline="yes-display-inline">veterans participating in the Department of Veterans Affairs supported housing program for which rental assistance provided pursuant to section 8(o)(19) of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f(o)(19)</external-xref>); and</text></paragraph><paragraph id="HABA3079B031142BF82E59083E1587202"><enum>(3)</enum><text>veterans who are transitioning from being incarcerated.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H7DECC07F87EE476FAB03FE700841BBDC" section-type="subsequent-section"><enum>6.</enum><header>Extension of eligibility period for vocational rehabilitation programs</header><subsection id="HF7F94FE9EB0B45E78A982B0F50DEBF75"><enum>(a)</enum><header>Extension</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/38/3103">Section 3103</external-xref> is amended by striking <quote>twelve-year period</quote> and inserting <quote>17-year period</quote> each place it appears.</text></subsection><subsection commented="no" id="H280AA3DF6BA346398D051C85EACE4110"><enum>(b)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendment made by subsection (a) shall apply with respect to a veteran applying for assistance under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/31">chapter 31</external-xref> of title 38, United States Code, on or after the date of the enactment of this Act.</text></subsection></section><section id="H0ECD32F306E043D5AC65577EFFDB6919"><enum>7.</enum><header>Work-study allowance</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/38/3485">Section 3485(a)(4)</external-xref> is amended by striking <quote>June 30, 2013</quote> each place it appears and inserting <quote>June 30, 2018</quote>.</text></section><section id="H9A965EED4B3346C588248B0E2B57098F" section-type="subsequent-section"><enum>8.</enum><header>Responsibilities of the Directors of Veterans’ Employment and Training</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/38/4103">Section 4103</external-xref> is amended—</text><paragraph id="HA403879EB1AD4D9D810DCBC24ECDAC11"><enum>(1)</enum><text>by redesignating subsection (b) as subsection (c); and</text></paragraph><paragraph id="HAE70F3BDBF0540EAAF64135B8C8CEA87"><enum>(2)</enum><text>by inserting after subsection (a) the following new subsection (b):</text><quoted-block display-inline="no-display-inline" id="H4547B58F78CB458584D3C4301F945B95" style="USC"><subsection id="HB8BCF519889C4519973729FB53C70425"><enum>(b)</enum><header>Responsibilities</header><text display-inline="yes-display-inline">Each Director assigned to a State under subsection (a) shall carry out the following responsibilities:</text><paragraph id="H60296118B983481290E08C5BE8668DA2"><enum>(1)</enum><text display-inline="yes-display-inline">Monitoring the performance of veterans’ training and employment programs in the State, with special emphasis on services to disabled veterans.</text></paragraph><paragraph id="H6103DE4F8CC64F2A8E0C9A4DF8AC6048"><enum>(2)</enum><text>Monitoring the performance of the State workforce agency in complying with <external-xref legal-doc="usc" parsable-cite="usc/38/4212">section 4212</external-xref> of this title.</text></paragraph><paragraph id="HA2BDD6AFBB864B26A0361BDD1D7A381A"><enum>(3)</enum><text display-inline="yes-display-inline">Suggesting to the Assistant Secretary of Labor for Veterans’ Employment and Training corrective actions that could be taken by the State workforce agency to address deficiencies in the performance of veterans’ training and employment programs in the State.</text></paragraph><paragraph id="H356CEB667AB84B9BA01659D7D3AEB26C"><enum>(4)</enum><text>Annually negotiating with the State workforce agency to establish performance goals for veterans’ training and employment programs in the State.</text></paragraph><paragraph id="HD4829FF2A9694EF3A1211047661E9D8B"><enum>(5)</enum><text>Reviewing the State’s requests for funding for veterans’ training and employment programs and providing advice to the State workforce agency and the Assistant Secretary regarding such funding requests.</text></paragraph><paragraph id="H3762CB833B5444D4971FD4D662E3E011"><enum>(6)</enum><text>Forwarding complaints regarding possible violations of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/43">chapter 43</external-xref> of this title to the appropriate Regional Administrator or to the to the Assistant Secretary, as required.</text></paragraph><paragraph id="H04317BB57948411388CCECFDD3180C2F"><enum>(7)</enum><text>Carrying out grant officer technical representative responsibilities for grants issued under programs administered by the Department.</text></paragraph><paragraph id="H34B002C55F4E4A6F8D8790D5B0BAE911"><enum>(8)</enum><text>Providing advice to the State workforce agency on strategies to market veterans to employers.</text></paragraph><paragraph id="H83C131E2459443BA8098E53BFD04E73D"><enum>(9)</enum><text>Supervising and managing all support staff, including Assistant Directors, establishing workload priorities, managing all personnel actions, and evaluating all assigned personnel.</text></paragraph><paragraph id="HCB5564861AF840CCB6C857831EA4016B"><enum>(10)</enum><text display-inline="yes-display-inline">Submitting to the Assistant Secretary regular reports on the matters described in paragraphs (1), (2), (4), and (8), and any other matters the Assistant Secretary determine appropriate.</text></paragraph><paragraph id="H86F2488CA2204D26BE2D2E94ECA6D272"><enum>(11)</enum><text>Performing such other related duties as directed by the Assistant Secretary.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="HD0A9867208CF424496509BF6B2E05DFC" section-type="subsequent-section"><enum>9.</enum><header>Contents of Transition Assistance Program</header><subsection id="H59D7D06F82354FF7BC427A7BF558F021"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/10/1144">Section 1144</external-xref> of title 10, United States Code, is amended—</text><paragraph id="HDD8103B8B9D244F295A61149EB782A14"><enum>(1)</enum><text>in subsection (b), by adding at the end the following new paragraph:</text><quoted-block display-inline="no-display-inline" id="H128B2868AEDD4E7ABB73BAF216A11B71" style="USC"><paragraph id="H85BA97456500417E86321E265F918193"><enum>(9)</enum><text display-inline="yes-display-inline">Provide information about disability-related employment and education protections.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H5254824B7A5E44DBBBC2BC1B763E0361"><enum>(2)</enum><text>by redesignating subsections (c), (d), and (e), as subsections (d), (e), and (f), respectively; and</text></paragraph><paragraph id="HAD6D55B4BED34E299AAF5E0929B2FC6E"><enum>(3)</enum><text>by inserting after subsection (b) the following new subsection (c):</text><quoted-block display-inline="no-display-inline" id="H29A3ED3573D3453CB69211A31D3EA2DA" style="USC"><subsection display-inline="no-display-inline" id="H6F5782E9485B4006B3A398C931E23952"><enum>(c)</enum><header>Additional elements of program</header><text>The mandatory program carried out by this section shall include—</text><paragraph display-inline="no-display-inline" id="HA23A600C21D34B9D8C0412EFD8AA789F"><enum>(1)</enum><text>for any such member who plans to use the member’s entitlement to educational assistance under title 38—</text><subparagraph id="HFAFEF572D3A94AEABBE9451CF6AEFE5C"><enum>(A)</enum><text>instruction providing an overview of the use of such entitlement; and</text></subparagraph><subparagraph id="H0406BA37D4A24C9BBD24C7EBEE2AF34F"><enum>(B)</enum><text>courses of post-secondary education appropriate for the member, courses of post-secondary education compatible with the member’s education goals, and instruction on how to finance the member’s post-secondary education; and</text></subparagraph></paragraph><paragraph display-inline="no-display-inline" id="H8BF5A3848F874295B124B6DEC5302780"><enum>(2)</enum><text>instruction in the benefits under laws administered by the Secretary of Veterans Affairs and in other subjects determined by the Secretary concerned.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HB78D96FF2B964DB0B3DBB906732E8D79"><enum>(b)</enum><header>Deadline for implementation</header><text>The program carried out under <external-xref legal-doc="usc" parsable-cite="usc/10/1144">section 1144</external-xref> of title 10, United States Code, shall comply with the requirements of subsections (b)(9) and (c) of such section, as added by subsection (a), by not later than April 1, 2015.</text></subsection><subsection id="HFE91351C989C4D84ABC5F74537F7DE23"><enum>(c)</enum><header>Feasibility study</header><text display-inline="yes-display-inline">Not later than 270 days after the date of the enactment of this Act, the Secretary of Veterans Affairs shall submit to the Committee on Veterans’ Affairs and the Committee on Armed Services of the Senate and the Committee on Veterans’ Affairs and the Committee on Armed Services of the House of Representatives the results of a study carried out by the Secretary to determine the feasibility of providing the instruction described in subsection (b) of <external-xref legal-doc="usc" parsable-cite="usc/10/1142">section 1142</external-xref> of title 10, United States Code, at all overseas locations where such instruction is provided by entering into a contract jointly with the Secretary of Labor for the provision of such instruction.</text></subsection></section><section id="H85C32059B85F4879BC60DBEF91E243FF"><enum>10.</enum><header>Rounding down of increase in rates of disability compensation and dependency and indemnity compensation</header><subsection id="HABC2201EB59042D6A29D5BEAEEF11CF7"><enum>(a)</enum><header>Rounding</header><text display-inline="yes-display-inline">Each dollar amount increased under section 2 of the Veterans’ Compensation Cost- of-Living Adjustment Act of 2013 (<external-xref legal-doc="public-law" parsable-cite="pl/113/52">Public Law 113–52</external-xref>), if not a whole dollar amount, shall be rounded to the next lower whole dollar amount.</text></subsection><subsection id="H16FD788ECD5345D3B678D208F325BBE9"><enum>(b)</enum><header>Applicability</header><text>Subsection (a) shall apply with respect to a payment made after the date of the enactment of this Act.</text></subsection></section><section id="H6478D1F121B44C959F34E8628C45F5EB"><enum>11.</enum><header>Limitation on performance awards in the senior executive service</header><text display-inline="no-display-inline">For each of fiscal years 2014 through 2018, the Secretary of Veterans Affairs may not make any performance awards under <external-xref legal-doc="usc" parsable-cite="usc/5/5384">section 5384</external-xref> of title 5, United States Code.</text></section><section id="H94543FF035AC40B2B2A6A716EB07E6E8"><enum>12.</enum><header>Semiannual reports to Congress on cost of certain travel</header><subsection id="HB8BFEA01AF404134B9B6D870B628C4CA"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/5">chapter 5</external-xref> is amended by adding at the end the following new section:</text><quoted-block display-inline="no-display-inline" id="HD2AD1E82ED334080861146D88F406993" style="USC"><section id="H72C8A8CED10A456FA52C42D9164E97DA"><enum>518.</enum><header>Semiannual reports to Congress on cost of certain travel</header><subsection id="H98D7A7E87DC54A278CB36327AF664176"><enum>(a)</enum><header>Semiannual reports</header><text display-inline="yes-display-inline">Not later than June 30, 2014, and not later than 60 days after each 180-day period thereafter, the Secretary shall submit to the Committee on Veterans' Affairs of the House of Representatives and the Committee on Veterans' Affairs of the Senate a semiannual report on covered travel made during the 180-day period covered by the report.</text></subsection><subsection id="H6C35A2FE3BDD4E2299078633F4BB0ED2"><enum>(b)</enum><header>Matters included</header><text display-inline="yes-display-inline">Each report under subsection (a) shall include the following:</text><paragraph id="H06AAFF783C984AE8B0E5A6D47F273944"><enum>(1)</enum><text display-inline="yes-display-inline">With respect to each instance of covered travel made during the period covered by the report—</text><subparagraph id="H8FF9F3E60B324660A90D105DED41FEAF"><enum>(A)</enum><text>the purpose of such travel;</text></subparagraph><subparagraph id="HF8BC3C5081634AAA99670B07E3A42913"><enum>(B)</enum><text>the destination;</text></subparagraph><subparagraph id="H50FCA004792049CCABC9616CE938FC04"><enum>(C)</enum><text>the name and title of each employee included on such travel;</text></subparagraph><subparagraph id="HF82DF4B42A014F1993B351DF91CB1DA4"><enum>(D)</enum><text>the duration of such travel;</text></subparagraph><subparagraph id="HDD8643FAEC764C7A9096EF4F3790F33C"><enum>(E)</enum><text>the total cost to the Department of such travel; and</text></subparagraph><subparagraph id="H5282EBA3C7D646A88926E9698315E76A"><enum>(F)</enum><text>with respect to covered travel described in subsection (d)(2), the identity of the person or entity that paid or reimbursed for such travel.</text></subparagraph></paragraph><paragraph id="H6D8F3717F9074CE088C0D52A9A6881DE"><enum>(2)</enum><text>The final costs to the Department with respect to all covered travel made during the period covered by the report, including costs relating to—</text><subparagraph id="HB3EF430BDB4243A1818DEAB3370763E8"><enum>(A)</enum><text display-inline="yes-display-inline">transportation, including fares for travel by air, rail, bus, ferry, cruise ship, taxi, mass transit, or other mode of transportation;</text></subparagraph><subparagraph id="HB1376363209E496290B6AAE62A6A4D19"><enum>(B)</enum><text>expenses or reimbursements relating to operating and maintaining a car, including the costs of fuel and mileage;</text></subparagraph><subparagraph id="HF6DD5244C3684E8DB807EA19F62BEC5D"><enum>(C)</enum><text>passport and visa fees;</text></subparagraph><subparagraph id="H9096DBCAD5C64326B2145B19674BCD51"><enum>(D)</enum><text>lodging;</text></subparagraph><subparagraph id="HE7C7F87FCDCD4CD2B85EA55598C5D5D4"><enum>(E)</enum><text>per diem payments;</text></subparagraph><subparagraph id="H9E1A326BBF4548D0B23C9CD4C0ED1A54"><enum>(F)</enum><text>baggage charges;</text></subparagraph><subparagraph id="H4B217E33333243199E27D4B5C7151FA0"><enum>(G)</enum><text>computer rental fees;</text></subparagraph><subparagraph id="HC592DA36E87C4444A42F28F36D4945E9"><enum>(H)</enum><text>rental of halls, auditoriums, or other spaces;</text></subparagraph><subparagraph id="HB66EBDBEBF6946E796235729022B284D"><enum>(I)</enum><text>entertainment;</text></subparagraph><subparagraph id="HC3ADFAF63D864B5F833DDD2EFB4F15E1"><enum>(J)</enum><text>contractors;</text></subparagraph><subparagraph id="H3B4D9B94FD434A7BA581A9D0AA8A801F"><enum>(K)</enum><text>registration fees; and</text></subparagraph><subparagraph id="HF18E86C9BC4648949CEE3984FFA86771"><enum>(L)</enum><text>promotional items.</text></subparagraph></paragraph></subsection><subsection id="HBD506E0E7E52408C891565DF321FF392"><enum>(c)</enum><header>Duplicative information</header><text display-inline="yes-display-inline">Each report under subsection (a) shall include the information described in subsection (b) regardless of whether such information is also included in a report under <external-xref legal-doc="usc" parsable-cite="usc/38/517">section 517</external-xref> of this title.</text></subsection><subsection id="H631A4F5CB67A4DADACE323B8330CED97"><enum>(d)</enum><header>Covered travel defined</header><text display-inline="yes-display-inline">In this section, the term <term>covered travel</term> means travel made by an employee of the Department of Veterans Affairs, including an employee who is stationed in a foreign country, on official business to any of the following locations:</text><paragraph id="HFC0DEBF8884944F78CAF04F353EF1033"><enum>(1)</enum><text>If the Department or other element of the Federal Government pays for such travel, a location outside of—</text><subparagraph id="HAB77833560A741658BEBF68209936FFF"><enum>(A)</enum><text>the several States;</text></subparagraph><subparagraph id="H05C865586DC241A2B7AE025BD59F43E6"><enum>(B)</enum><text>the District of Columbia;</text></subparagraph><subparagraph id="H5397918495474C3F86BE4EEB9369AFAB"><enum>(C)</enum><text>a territory, commonwealth, or possession of the United States;</text></subparagraph><subparagraph id="HEB21DDF423D243749162C80128793AD0"><enum>(D)</enum><text display-inline="yes-display-inline">Indian lands (as defined in section 4(4) of the Indian Gaming Regulatory Act (<external-xref legal-doc="usc" parsable-cite="usc/25/2703">25 U.S.C. 2703(4)</external-xref>)); or</text></subparagraph><subparagraph id="HF7E30A2538194D04BB7C8575B7035091"><enum>(E)</enum><text>the territorial waters of the United States.</text></subparagraph></paragraph><paragraph id="H89A9100933374B6BB8411E9917D2C32A"><enum>(2)</enum><text>If any person or entity other than the Federal Government pays (or reimburses) for such travel, any location, regardless of whether the location is inside or outside of the United States.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HD752D9E310D340A6BA462E24771C515C"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of such chapter is amended by adding after the item relating to section 517 the following new item:</text><quoted-block display-inline="no-display-inline" id="H8C0512704C6B4C949B9A4C4B9B53E148" style="USC"><toc regeneration="no-regeneration"><toc-entry level="section">518. Semiannual reports to Congress on cost of certain travel.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="HBFD842946CDC4389916F324ADA90D585" section-type="subsequent-section"><enum>13.</enum><header>Report of infectious disease at medical facilities of Department of Veterans Affairs</header><subsection id="H2BE9DA1502684A4A854ED3587371CBC0"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/38/7311">Section 7311</external-xref> is amended by adding at the end the following new subsection:</text><quoted-block display-inline="no-display-inline" id="H597E679880CB4CB4A46D8722FB2BEF33" style="USC"><subsection id="HC752A4E9F4EB40E297676C9E05853DCD"><enum>(f)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H910C101F096C41CC8F40051E7743BDED"><enum>(1)</enum><text display-inline="yes-display-inline">The Secretary shall report to the appropriate entity each case of a notifiable infectious disease or condition that is diagnosed at a medical facility of the Department of Veterans Affairs in accordance with the laws of the State in which the facility is located.</text></paragraph><paragraph commented="no" id="HE31A883EF4C54DEDA49B4C5782FE9AAC" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">In addition to reporting each case of a notifiable infectious disease or condition at a medical facility of the Department pursuant to paragraph (1), the Secretary shall report each such case that is classified as a health-care-associated infection sentinel event to the accrediting organization of such facility.</text></paragraph><paragraph commented="no" id="H94E005A1BE0944C6924B2923777D8545" indent="up1"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H519B791B02694B9A95D5BDB6CE66B64D"><enum>(A)</enum><text display-inline="yes-display-inline">If the Secretary fails to report a case of a notifiable infectious disease or condition at a medical facility of the Department in accordance with State law pursuant to paragraph (1), the Secretary shall—</text><clause id="H44FED630469D4632B10D385D9A891DDE" indent="up1"><enum>(i)</enum><text>take any remedial action required under the laws of the State to correct such failure; and</text></clause><clause id="HB4508260CBB74777A1A74E55D18FA752" indent="up1"><enum>(ii)</enum><text>if the Secretary does not correct such failure pursuant to clause (i), pay to the State an amount equal to the amount that a medical facility not owned by the Federal Government that is located in the same State would pay as a penalty to such State for such failure.</text></clause></subparagraph><subparagraph commented="no" id="H5AF43D61B9354D3381754F68419B64A7" indent="up1"><enum>(B)</enum><text>The State may file a civil action against the Secretary in the United States district court for the district in which the medical facility is located to recover from the United States the amount described in subparagraph (A)(ii).</text></subparagraph><subparagraph id="H5CA3A33FFA8540BC9F85CCEC17020D30" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">A civil action under subparagraph (B) may not be commenced later than two years after the cause of action accrues.</text></subparagraph></paragraph><paragraph commented="no" id="H95ACD8A137CB4E139C39A3389CFC5F56" indent="up1"><enum>(4)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H8FBBAE2EC115434BBDD308BEEEE2DD22"><enum>(A)</enum><text>In any case in which the Inspector General of the Department suspects that a director of a Veterans Integrated Service Network has failed to comply with an applicable provision of this subsection, the Inspector General shall conduct an investigation to determine whether such director failed to comply with an applicable provision of this section.</text></subparagraph><subparagraph commented="no" id="H8B2F4E293C66402EBB2AA2F9F8F106A8" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">If the Inspector General determines under subparagraph (A) that a director has failed to comply with a provision of this subsection, the Secretary shall suspend such director for such period as the Secretary considers appropriate under subchapter I or subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/75">chapter 75</external-xref> of title 5, as the case may be. In addition to such suspension, the Secretary may impose such other administrative disciplinary action on the director as the Secretary considers appropriate and for which the Secretary is otherwise authorized.</text></subparagraph></paragraph><paragraph id="HB008D336711541DEAC515E04858F5B6A" indent="up1"><enum>(5)</enum><text display-inline="yes-display-inline">The Secretary shall—</text><subparagraph id="H974F7B0C10DA4A24AB425E2B6A7B771C"><enum>(A)</enum><text>maintain records of each notifiable infectious disease or condition reported pursuant to paragraph (1); and</text></subparagraph><subparagraph id="H447EA00AF6074E978545478C0BB4BD66"><enum>(B)</enum><text display-inline="yes-display-inline">submit to the Committees on Veterans’ Affairs of the House of Representatives and the Senate a notification of each such notifiable infectious disease or condition.</text></subparagraph></paragraph><paragraph id="H975AEFE720B74C38A0CBA7FD3D609BEC" indent="up1"><enum>(6)</enum><text display-inline="yes-display-inline">In this subsection, the term <term>notifiable infectious disease or condition</term> means any infectious disease or condition that is—</text><subparagraph id="H9EF20033BFAA4B94AFE84D47E3758F7F"><enum>(A)</enum><text>on the list of nationally notifiable diseases or conditions published by the Council of State and Territorial Epidemiologists and the Centers for Disease Control and Prevention; or</text></subparagraph><subparagraph id="HF3A8636C24C34982B7AC84EE5EFA1B28"><enum>(B)</enum><text>covered by a provision of law of a State that requires the reporting of infectious diseases or conditions.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H9CF453BCF5D741A88BD8735F5BCE1C4B"><enum>(b)</enum><header>Effective date</header><text>The reporting requirement under <external-xref legal-doc="usc" parsable-cite="usc/38/7311">section 7311(f)</external-xref> of title 38, United States Code, as added by subsection (a), shall apply with respect to a case of a notifiable infectious disease or condition diagnosed at a medical facility of the Department of Veterans Affairs on or after the date that is 60 days after the date of the enactment of this Act.</text></subsection></section><section id="HCBC95CD1A3DF46E4A4A85ACDE7A951E4" section-type="subsequent-section"><enum>14.</enum><header>Prohibition of visual recording without informed consent</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/38/7331">Section 7331</external-xref> is amended—</text><paragraph id="HCBE167BA2A4D4DCEA5BBED0AF11EBB69"><enum>(1)</enum><text>by striking <quote>The Secretary, upon</quote> and inserting <quote>(a) <header-in-text level="subsection" style="USC">In general.—</header-in-text>The Secretary, upon</quote>; and</text></paragraph><paragraph id="HDE4E2662259F4139A8B0CBCD83577F22"><enum>(2)</enum><text>by adding at the end the following new subsection:</text><quoted-block display-inline="no-display-inline" id="H6DFB29B4FC044E7BBE41F7B066FA046B" style="USC"><subsection id="H51567A62B82E421B94CD327D084479C9"><enum>(b)</enum><header>Visual recording</header><paragraph commented="no" display-inline="yes-display-inline" id="HC0C16A40A2464600A0E7FB00B2443752"><enum>(1)</enum><text display-inline="yes-display-inline">The Secretary shall prescribe regulations establishing procedures to ensure that, except as provided by paragraph (2), any visual recording made by the Secretary of a patient during the course of furnishing care under this title is carried out only with the full and informed consent of the patient or, in appropriate cases, a representative thereof.</text></paragraph><paragraph id="H5A601291A1DD496E9DB90D0AF84706A2" indent="up1"><enum>(2)</enum><text>The Secretary may waive the requirement for informed consent under paragraph (1) with respect to the visual recording of a patient if such recording is made—</text><subparagraph display-inline="no-display-inline" id="HB5070E2877284F96961D06AC4FE683B8"><enum>(A)</enum><text display-inline="yes-display-inline">pursuant to a determination by a physician or psychologist that such recording is medically necessary or necessary for the safety of the patient;</text></subparagraph><subparagraph display-inline="no-display-inline" id="HAF6207559D13439DA16C81634E9BA529"><enum>(B)</enum><text>pursuant to a warrant or order of a court of competent jurisdiction; or</text></subparagraph><subparagraph display-inline="no-display-inline" id="H3C8FEDEB008F41EDBA015353EAFFB2EE"><enum>(C)</enum><text>in a public setting where a person would not have a reasonable expectation to privacy, such as a waiting room or hallway, and such recording is for general security purposes not particularized to the patient.</text></subparagraph></paragraph><paragraph id="H9740A095593046F484CA2AB9D8D1EDB1" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">In this subsection, the term <term>visual recording</term> means the recording or transmission of images or video, but does not include—</text><subparagraph id="H01B6B99CDB76403BBAF7DF849E50DA31"><enum>(A)</enum><text>medical imaging, including such imaging produced by radiographic procedures, nuclear medicine, endoscopy, ultrasound, or other similar procedures; or</text></subparagraph><subparagraph id="H03A9B17CA38F4B5097D96B11DB9A01AC"><enum>(B)</enum><text>images, video, and other clinical information transmitted for the purposes of providing treatment through telehealth and telemedicine technologies.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section display-inline="no-display-inline" id="HFFFC243FCD554BB2B141F8507B73F073" section-type="subsequent-section"><enum>15.</enum><header>Two-month extension of Veterans Retraining Assistance Program</header><text display-inline="no-display-inline">Section 211 of the VOW to Hire Heroes Act of 2011 (<external-xref legal-doc="public-law" parsable-cite="pl/112/56">Public Law 112–56</external-xref>; 125 Stat. 713; <external-xref legal-doc="usc" parsable-cite="usc/38/4100">38 U.S.C. 4100</external-xref> note) is amended—</text><paragraph id="HA88C3C9C2F964A908B26E9B31426FC4E"><enum>(1)</enum><text>in subsection (a)(2)(B), by striking <quote>March 31, 2014</quote> and inserting <quote>May 31, 2014</quote>;
