<section id="HBEF1D9D7D4454F04A7C9FD937B7249FB" section-type="section-one"><enum>1.</enum><header>Medical certification requirements for airmen and air traffic controllers relating to sleep disorders</header> 
<subsection id="HE19823CE7FE3485EAD865A4975D172AF"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Transportation may, consistent with accepted medical standards and practices, implement or enforce a requirement providing for the screening, testing, or treatment (including consideration of all possible treatment alternatives) of an airman or an air traffic controller for a sleep disorder—</text> 
<paragraph id="H035B5EBE30E640CA9C4BA955E8415BC4"><enum>(1)</enum><text display-inline="yes-display-inline">in the case of an airman, only if the requirement is adopted pursuant to a rulemaking proceeding; and</text></paragraph> 
<paragraph id="HABEC22FDEAFE447AA4B08BAC7372C85B"><enum>(2)</enum><text display-inline="yes-display-inline">in the case of an air traffic controller, only if the Federal Aviation Administration meets its obligations pursuant to <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/71">chapter 71</external-xref> of title 5, United States Code. </text></paragraph></subsection> 
<subsection id="H2C0A4FC5F114448D9D5CB75BE0A18313"><enum>(b)</enum><header>Applicability</header><text display-inline="yes-display-inline">Subsection (a) shall not apply to a requirement that was in force before November 1, 2013.</text></subsection> 
<subsection id="H4A755815A970454EA0418CC658E3EA48"><enum>(c)</enum><header>Definitions</header><text>In this section, the following definitions apply:</text> 
<paragraph id="H610457B239794705A4F555F03FAE3C3C"><enum>(1)</enum><header>Airman</header><text display-inline="yes-display-inline">The term <quote>airman</quote> has the meaning given that term in <external-xref legal-doc="usc" parsable-cite="usc/49/40102">section 40102(a)</external-xref> of title 49, United States Code.</text></paragraph> 
<paragraph id="HEEAB00AC8D1847908F35644D82BF628D"><enum>(2)</enum><header>Air traffic controller</header><text display-inline="yes-display-inline">The term <quote>air traffic controller</quote> means a civilian employee of the Department of Transportation described in <external-xref legal-doc="usc" parsable-cite="usc/5/2109">section 2109</external-xref> of title 5, United States Code.</text></paragraph> 
<paragraph id="H309A8C2D9A6A46DEAE6DE114452780AD"><enum>(3)</enum><header>Sleep disorder</header><text display-inline="yes-display-inline">The term <quote>sleep disorder</quote> includes obstructive sleep apnea.</text></paragraph></subsection></section>
