		<section id="HB9076E980DA04FFB9F40E67FC45D5917" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Critical Infrastructure Protection Act</short-title></quote> or <quote><short-title>CIPA</short-title></quote> .</text>
		</section><section id="H70A294DEB54C400FA330663DF92DA834"><enum>2.</enum><header>EMP planning, research and development, and protection and preparedness</header>
			<subsection id="H03B4FA243F724D9DA6F670BC8484DA53"><enum>(a)</enum><header>In general</header><text>The Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/121">6 U.S.C. 121</external-xref>) is amended—</text>
				<paragraph id="HE7F2645ED7D844D7BDD83AC49A88417F"><enum>(1)</enum><text>in section 2 (<external-xref legal-doc="usc" parsable-cite="usc/6/101">6 U.S.C. 101</external-xref>), by inserting after paragraph (6) the following:</text>
					<quoted-block display-inline="no-display-inline" id="HD0F878D2E59E43E88761E2360A3E94E5" style="OLC">
						<paragraph id="H96B69D918DCC4DDE97C177ED91C26779"><enum>(6a)</enum><header>EMP</header><text>The term <term>EMP</term> means—</text>
							<subparagraph id="idC686B4370718437CAB485C014EE8D389"><enum>(A)</enum><text>an electromagnetic pulse caused by intentional means, including acts of terrorism; and</text>
							</subparagraph><subparagraph id="id4119D6199BA243B39F2634BA45E2B553"><enum>(B)</enum><text>a geomagnetic disturbance caused by solar storms or other naturally occurring phenomena.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H0A16F2A15A364FF3A4EAB1DD56C7BFC9"><enum>(2)</enum><text>in title V (<external-xref legal-doc="usc" parsable-cite="usc/6/311">6 U.S.C. 311 et seq.</external-xref>), by adding at the end the following:</text>

						<section id="HCFC201A723204AB7B0DCCC3A3176C66C"><enum>526.</enum><header>National planning scenarios and education</header><text display-inline="no-display-inline">The Secretary shall, to the extent practicable—</text>
							<paragraph id="H8456928400C346BB90B949528DCDDD76"><enum>(1)</enum><text>include in national planning scenarios the threat of EMP events; and</text>
							</paragraph><paragraph id="H0A9F1E96D122413E846F3A9757515D89"><enum>(2)</enum><text>conduct outreach to educate owners and operators of critical infrastructure, emergency planners,
			 and emergency responders at all levels of government of the threat of EMP
			 events.</text></paragraph></section><after-quoted-block>;</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H494CFA74BE6D47B2A7756B7927A18B41"><enum>(3)</enum><text>in title III (<external-xref legal-doc="usc" parsable-cite="usc/6/181">6 U.S.C. 181 et seq.</external-xref>), by adding at the end of the following:</text>
					<quoted-block display-inline="no-display-inline" id="H88E6C273CC524B6881794DFE4AF55486" style="OLC">
						<section id="H8C1925FEEBDC475EBEE4683004DD5EBC"><enum>318.</enum><header>EMP research and development</header>
							<subsection id="HC0FE21EAE0D04EE5B478D4DCE31C4080"><enum>(a)</enum><header>In general</header><text>In furtherance of domestic preparedness and response, the Secretary, acting through the Under
			 Secretary for Science and Technology, and in consultation with other
			 relevant agencies and departments of the Federal Government and relevant
			 owners and operators of critical infrastructure, shall, to the extent
			 practicable, conduct research and development to mitigate the consequences
			 of EMP events.</text>
							</subsection><subsection id="HE14DA24EC68B44ADB16B055856A98940"><enum>(b)</enum><header>Scope</header><text>The scope of the research and development under subsection (a) shall include the following:</text>
								<paragraph id="H55BB1563150A45578A12B8F3D77002E2"><enum>(1)</enum><text>An objective scientific analysis of the risks to critical infrastructures from a range of EMP
			 events.</text>
								</paragraph><paragraph id="H1CE13867988440079E5BA5C5A1867BA3"><enum>(2)</enum><text>Determination of the critical national security assets and vital civic utilities and
			 infrastructures that are at risk from EMP events.</text>
								</paragraph><paragraph id="H64B0F39E7B464392909FC55613842E02"><enum>(3)</enum><text>An evaluation of emergency planning and response technologies that would address the findings and
			 recommendations of experts, including those of the Commission to Assess
			 the Threat to the United States from Electromagnetic Pulse Attack.</text>
								</paragraph><paragraph id="H0C66BFB758D240E1A6DCCC82462EE5E6"><enum>(4)</enum><text>An analysis of technology options that are available to improve the resiliency of critical
			 infrastructure to EMP.</text>
								</paragraph><paragraph id="HF3E6F75A7B1C4743B6AFA9C5DD013FCA"><enum>(5)</enum><text>The restoration and recovery capabilities of critical infrastructure under differing levels of
			 damage and disruption from various EMP events.</text></paragraph></subsection></section><after-quoted-block>; and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H0A20B193B7C342DFAE349AB4E9C532EB"><enum>(4)</enum><text>in section 201(d) (<external-xref legal-doc="usc" parsable-cite="usc/6/121">6 U.S.C. 121(d)</external-xref>), by adding at the end the following:</text>

						<paragraph id="HCE22563CD6AB4B40A08C4ADE883F318F"><enum>(26)</enum>
							<subparagraph commented="no" display-inline="yes-display-inline" id="HE0C5D135D0524FC9924F2AC09C24BF93"><enum>(A)</enum><text>Prepare and submit to the Committee on Homeland Security of the House of Representatives and the
			 Committee on Homeland Security and Governmental Affairs of the Senate—</text>
								<clause id="HD87FDDFDA78049DD91EEAF5DE7DE6033" indent="up1"><enum>(i)</enum><text>a recommended strategy to protect and prepare the critical infrastructure of the American homeland
			 against EMP events, including from acts of terrorism; and</text>
								</clause><clause id="HCC4A577450A34BF3B1B415AF1F5068D5" indent="up1"><enum>(ii)</enum><text>biennial updates on the status of the recommended strategy.</text>
								</clause></subparagraph><subparagraph id="HFDB071A99BB74679B91207557D560278" indent="up1"><enum>(B)</enum><text>The recommended strategy shall—</text>
								<clause id="HCB09F328AA824040B9B522FBA8E695E8"><enum>(i)</enum><text>be based on findings of the research and development conducted under section 318;</text>
								</clause><clause id="HBD5FC4BD220A41119D9D636EFFE2E7AA"><enum>(ii)</enum><text>be developed in consultation with the relevant Federal sector-specific agencies (as defined under
			 Homeland Security Presidential Directive–7) for critical infrastructures;</text>
								</clause><clause id="HE5D8463109CB44948872E50D4B1A5DA5"><enum>(iii)</enum><text>be developed in consultation with the relevant sector coordinating councils for critical
			 infrastructures; and</text>
								</clause><clause id="H7A553392EB2346239510839C27BA499F"><enum>(iv)</enum><text>include a classified annex as needed.</text>
								</clause></subparagraph><subparagraph id="H1B0F951FF0AA4D08AB61988A4F75DB9D" indent="up1"><enum>(C)</enum><text>The Secretary may, if appropriate, incorporate the recommended strategy into a broader
			 recommendation developed by the Department to help protect and prepare
			 critical infrastructure from terrorism and other threats if, as
			 incorporated, the strategy complies with subparagraph (B).</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H8C4989B4BDFD40A6A63FF5C6A4150C5A"><enum>(b)</enum><header>Clerical amendments</header><text>The table of contents in section 1(b) of such Act is amended—</text>
				<paragraph id="HAC545500CCDB442B8144738F69687FCD"><enum>(1)</enum><text>by adding at the end of the items relating to title V the following:</text>

							<toc-entry level="section">Sec. 526. National planning scenarios and education.</toc-entry></toc><after-quoted-block>; </after-quoted-block></quoted-block><continuation-text continuation-text-level="paragraph">and</continuation-text></paragraph><paragraph id="H5E0B3B39DE354799AA802118BED5869F"><enum>(2)</enum><text>by adding at the end of the items relating to title III the following:</text>
					<quoted-block display-inline="no-display-inline" id="H7448E339B3BD4F3BAC4527668D1CD144" style="OLC">
						<toc regeneration="no-regeneration">
							<toc-entry level="section">Sec. 318. EMP research and development.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H76AEB4BB41E2495294AE71D32C4619D7"><enum>(c)</enum><header>Deadline for recommended strategy</header><text>The Secretary of Homeland Security shall submit the recommended strategy required under the
			 amendment made by subsection (a)(4) by not later than one year after the
			 date of the enactment of this Act.</text>
			</subsection><subsection id="H1FDC5F9EAAA94CA4A5BC62732917B0D8"><enum>(d)</enum><header>Report</header><text>The Secretary shall submit a report to Congress by not later than 180 days after the date of the
			 enactment of this Act describing the progress made in, and an estimated
			 date by which the Department of Homeland Security will have completed—</text>
				<paragraph id="H28C8370D58EF47DDB38C62666A5239DE"><enum>(1)</enum><text>including EMP (as defined in the amendment made by subsection (a)(1)) threats in national planning
			 scenarios;</text>
				</paragraph><paragraph id="HFF6B821EDE984FEC86A60951B817094E"><enum>(2)</enum><text>research and development described in the amendment made by subsection (a)(3);</text>
				</paragraph><paragraph id="HBC27720939FB497797241BA80227B714"><enum>(3)</enum><text>development of the comprehensive plan required under the amendment made by subsection (a)(4); and</text>
				</paragraph><paragraph id="HEC8DECB4E1AC4D2A98A154DEE97AA11A"><enum>(4)</enum><text>outreach to educate owners and operators of critical infrastructure, emergency planners and
			 emergency responders at all levels of government regarding the threat of
			 EMP events.</text>
				</paragraph></subsection></section><section id="HD259B1A65FE24471B85501D80A7FE916"><enum>3.</enum><header>No regulatory authority</header><text display-inline="no-display-inline">Nothing in this Act, including the amendments made by this Act, shall be construed to grant any
			 regulatory authority.</text>
		</section><section id="HE2D3EAA7567E43B3AB768ABDF143B547"><enum>4.</enum><header>No new authorization of appropriations</header><text display-inline="no-display-inline">This Act, including the amendments made by this Act, may be carried out only by using funds
			 appropriated under the authority of other laws.</text>
