		</section><title id="H87A959CDF0164E839F52AD0A5D27D432"><enum>I</enum><header>FISA business records reforms</header>
			<section id="H2E13A60BEB4548418490B3AF27221CA5"><enum>101.</enum><header>Additional requirements for call detail records</header>
				<subsection id="H39C23995F44B4F40AF69CB464BBBF3B6"><enum>(a)</enum><header>Application</header><text display-inline="yes-display-inline">Section 501(b)(2) (<external-xref legal-doc="usc" parsable-cite="usc/50/1861">50 U.S.C. 1861(b)(2)</external-xref>) is amended—</text>
					<paragraph id="HD6413C02E3CF4A18BF31D7D7E1676AA7"><enum>(1)</enum><text>in subparagraph (A)—</text>
						<subparagraph id="H62A73ADB826C4F8F9DC1822594E60FD4"><enum>(A)</enum><text>in the matter preceding clause (i), by striking <quote>a statement</quote> and inserting <quote>in the case of an application other than an application described in subparagraph (C), a statement</quote>; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H9307F5503E374370B66919E5C0853E6E"><enum>(B)</enum><text>in clause (iii), by striking <quote>; and</quote> and inserting a semicolon;</text>
						</subparagraph></paragraph><paragraph commented="no" id="HC2658ABF38794D58BED781FB1A8371FF"><enum>(2)</enum><text>by redesignating subparagraphs (A) and (B) as subparagraphs (B) and (D), respectively; and</text>
					</paragraph><paragraph id="HA425D7CACC3B4C2993F1F9CE44E55AC7"><enum>(3)</enum><text>by inserting after subparagraph (B) (as so redesignated) the following new subparagraph:</text>
						<quoted-block changed="added" committee-id="HJU00" display-inline="no-display-inline" id="H42F5F24E5A6A4DB68FE258BFD293FC27" reported-display-style="italic" style="OLC">
							<subparagraph id="H818CA88ACC9B491484FA2E7C3C269C37"><enum>(C)</enum><text display-inline="yes-display-inline">in the case of an application for the production of call detail records created on or after the
			 date of the application, a statement of facts showing that—</text>
								<clause id="HA359AA3E3A1E4BB0903BC023852CFD86"><enum>(i)</enum><text display-inline="yes-display-inline">there are reasonable grounds to believe that the call detail records sought to be produced based on
			 the specific selection term required under subparagraph (A) are relevant
			 to an authorized investigation (other than a threat assessment) conducted
			 in accordance with subsection (a)(2) to protect against international
			 terrorism; and</text>
								</clause><clause id="HBA36AE7771724E289669B4B41D209310"><enum>(ii)</enum><text display-inline="yes-display-inline">there are facts giving rise to a reasonable, articulable suspicion that such specific selection
			 term is associated with a foreign power or an agent of a foreign power;
			 and</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection id="HCC6233A2D3754F629583C4E820617608"><enum>(b)</enum><header>Order</header><text>Section 501(c)(2) (<external-xref legal-doc="usc" parsable-cite="usc/50/1861">50 U.S.C. 1861(c)(2)</external-xref>) is amended—</text>
					<paragraph id="H3F6B3825447B40A68135BA9B96856DF6"><enum>(1)</enum><text>in subparagraph (D), by striking <quote>; and</quote> and inserting a semicolon;</text>
					</paragraph><paragraph id="H27E3CDD249C540B2A84B778546B8DDC0"><enum>(2)</enum><text>in subparagraph (E), by striking the period and inserting <quote>; and</quote>; and</text>
					</paragraph><paragraph id="HD9799B7FEC124B459BD930F6F01A14CB"><enum>(3)</enum><text>by adding at the end the following new subparagraph:</text>
						<quoted-block changed="added" committee-id="HJU00" display-inline="no-display-inline" id="H936398F0729A4332997D46C643AF09F8" reported-display-style="italic" style="OLC">
							<subparagraph id="H765F15A7D42D490DA46C5CF1ADD051E8"><enum>(F)</enum><text display-inline="yes-display-inline">in the case of an application described in subsection (b)(2)(C), shall—</text>
								<clause id="HBB0B06048D13470185DA62C13B0FF4F0"><enum>(i)</enum><text>authorize the production of call detail records for a period not to exceed 180 days;</text>
								</clause><clause id="HCDBA25C1328F4E4595C22305FD0C7F05"><enum>(ii)</enum><text>provide that an order for such production may be extended upon application under subsection (b) and
			 the judicial finding under paragraph (1);</text>
								</clause><clause id="HF76D13BB4225412FB978913595C15318"><enum>(iii)</enum><text>provide that the Government may require the production of call detail records—</text>
									<subclause id="H47EEC2AAC81E4801963024A19F9121CC"><enum>(I)</enum><text>using the specific selection term that satisfies the standard required under subsection
			 (b)(2)(C)(ii) as the basis for production; and</text>
									</subclause><subclause id="HB64B9AEBA1574AF88E335D47E8F3065E"><enum>(II)</enum><text>using the results of the production under subclause (I) as the basis for production;</text>
									</subclause></clause><clause commented="no" id="H68F6FD54B4B74F62B03B85C79D9D0700"><enum>(iv)</enum><text display-inline="yes-display-inline">direct each person the Government directs to produce call detail records under the order to furnish
			 the Government forthwith all information, facilities, or technical
			 assistance necessary to accomplish the production in such a manner as will
			 protect the secrecy of the production and produce a minimum of
			 interference with the services that such person is providing to each
			 subject of the production; and</text>
								</clause><clause id="HE7F9D189016A49B5997549956174B947"><enum>(v)</enum><text>direct the Government to destroy all call detail records produced under the order not later than 5
			 years after the date of the production of such records, except for records
			 that are relevant to an authorized investigation (other than a threat
			 assessment) conducted in accordance with subsection (a)(2) to protect
			 against international terrorism.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection></section><section id="HC53F90E67E3C47BDA6705F48F2D7EE8C"><enum>102.</enum><header>Emergency authority</header>
				<subsection id="H4DD595F5277E48E08E7FA46C45414237"><enum>(a)</enum><header>Authority</header><text display-inline="yes-display-inline">Section 501 (<external-xref legal-doc="usc" parsable-cite="usc/50/1861">50 U.S.C. 1861</external-xref>) is amended by adding at the end the following new subsection:</text>
					<quoted-block changed="added" committee-id="HJU00" display-inline="no-display-inline" id="HD705A058BD5A4BFBB72A374EB1B856F9" reported-display-style="italic" style="OLC">
						<subsection id="H461BA1FB186742A4AAB8AAEF4BE88142"><enum>(i)</enum><header>Emergency authority for production of tangible things</header>
							<paragraph display-inline="no-display-inline" id="H87BC9CDC3CB4434BA3BE2010DFB5FAEA"><enum>(1)</enum><text>Notwithstanding any other provision of this section, the Attorney General may require the emergency
			 production of tangible things if the Attorney General—</text>
								<subparagraph display-inline="no-display-inline" id="H98E299F012214C74A46BF2101D93F40A"><enum>(A)</enum><text display-inline="yes-display-inline">reasonably determines that an emergency situation requires the production of tangible things before
			 an order authorizing such production can with due diligence be obtained;</text>
								</subparagraph><subparagraph display-inline="no-display-inline" id="H4B4C1964C18E48949BE0329E2C86AEC4"><enum>(B)</enum><text>reasonably determines that the factual basis for the issuance of an order under this section to
			 approve such production of tangible things exists;</text>
								</subparagraph><subparagraph display-inline="no-display-inline" id="H737E16B1A63D4830A954F888312E6980"><enum>(C)</enum><text>informs, either personally or through a designee, a judge having jurisdiction under this section at
			 the time the Attorney General requires the emergency production of
			 tangible things that the decision has been made to employ the authority
			 under this subsection; and</text>
								</subparagraph><subparagraph display-inline="no-display-inline" id="H76F9B58E3A724A5CAB10D1BF4F72D4BC"><enum>(D)</enum><text>makes an application in accordance with this section to a judge having jurisdiction under this
			 section as soon as practicable, but not later than 7 days after the
			 Attorney General requires the emergency production of tangible things
			 under this subsection.</text>
								</subparagraph></paragraph><paragraph display-inline="no-display-inline" id="H6985106DCD2B4BC98E954BA18A2DD11F"><enum>(2)</enum><text>If the Attorney General authorizes the emergency production of tangible things under paragraph (1),
			 the Attorney General shall require that the minimization procedures
			 required by this section for the issuance of a judicial order be followed.</text>
							</paragraph><paragraph display-inline="no-display-inline" id="H53A11EB435E3426D91EA3A79E77023B3"><enum>(3)</enum><text>In the absence of a judicial order approving the production of tangible things under this
			 subsection, the production shall terminate when the information sought is
			 obtained, when the application for the order is denied, or after the
			 expiration of 7 days from the time the Attorney General begins requiring
			 the emergency production of such tangible things, whichever is earliest.</text>
							</paragraph><paragraph display-inline="no-display-inline" id="H15EBCA3BFCBE44EBAA8988910228917B"><enum>(4)</enum><text>A denial of the application made under this subsection may be reviewed as provided in this section.</text>
							</paragraph><paragraph display-inline="no-display-inline" id="H7679B2CA225647C88038EAAC3B66EAC8"><enum>(5)</enum><text>If such application for approval is denied, or in any other case where the production of tangible
			 things is terminated and no order is issued approving the production, no
			 information obtained or evidence derived from such production shall be
			 received in evidence or otherwise disclosed in any trial, hearing, or
			 other proceeding in or before any court, grand jury, department, office,
			 agency, regulatory body, legislative committee, or other authority of the
			 United States, a State, or political subdivision thereof, and no
			 information concerning any United States person acquired from such
			 production shall subsequently be used or disclosed in any other manner by
			 Federal officers or employees without the consent of such person, except
			 with the approval of the Attorney General if the information indicates a
			 threat of death or serious bodily harm to any person.</text>
							</paragraph><paragraph display-inline="no-display-inline" id="HFF84F4BD1A6746D89CC5D604C5ED957D"><enum>(6)</enum><text>The Attorney General shall assess compliance with the requirements of paragraph (5).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="H6CFC0026DA494625902AD60DD8E833B7"><enum>(b)</enum><header>Conforming amendment</header><text>Section 501(d) (<external-xref legal-doc="usc" parsable-cite="usc/50/1861">50 U.S.C. 1861(d)</external-xref>) is amended—</text>
					<paragraph id="H0CC6A36F06784952B63C443E628C6F1E"><enum>(1)</enum><text>in paragraph (1)—</text>
						<subparagraph id="H7C0BD174B621424BBEEC09AEC848E479"><enum>(A)</enum><text>in the matter preceding subparagraph (A), by striking <quote>pursuant to an order</quote> and inserting <quote>pursuant to an order issued or an emergency production required</quote>;</text>
						</subparagraph><subparagraph id="HDBDF135DC74846FAAA1E0393BA3C2BA6"><enum>(B)</enum><text>in subparagraph (A), by striking <quote>such order</quote> and inserting <quote>such order or such emergency production</quote>; and</text>
						</subparagraph><subparagraph id="H3D58C296233046F9A5E412BEF6479004"><enum>(C)</enum><text>in subparagraph (B), by striking <quote>the order</quote> and inserting <quote>the order or the emergency production</quote>; and</text>
						</subparagraph></paragraph><paragraph id="H4A1B2649AD6943DE843D4F008DBE4C55"><enum>(2)</enum><text>in paragraph (2)—</text>
						<subparagraph id="H982634BF5DC84947B52455D6621171B6"><enum>(A)</enum><text>in subparagraph (A), by striking <quote>an order</quote> and inserting <quote>an order or emergency production</quote>; and</text>

						</subparagraph></paragraph></subsection></section><section commented="no" id="H218467F8DE8744E493B0F077E36FA2E1"><enum>103.</enum><header>Prohibition on bulk collection of tangible things</header>
				<subsection commented="no" id="H353D8C898E8C46D2888105BFEEADFBF3"><enum>(a)</enum><header>Application</header><text display-inline="yes-display-inline">Section 501(b)(2) (<external-xref legal-doc="usc" parsable-cite="usc/50/1861">50 U.S.C. 1861(b)(2)</external-xref>), as amended by section 101(a) of this Act, is further
			 amended by inserting before subparagraph (B), as redesignated by such
			 section 101(a) of this Act, the following new subparagraph:</text>

					<paragraph id="H6D9CC2EA7B2946618FE4FC4E33C1C70F"><enum>(1)</enum><text>in paragraph (2)(A), by striking the semicolon and inserting <quote>, including each specific selection term to be used as the basis for the production;</quote>; and</text>
					</paragraph><paragraph id="H57C70848A14445F38F89CFF243594F43"><enum>(2)</enum><text>by adding at the end the following new paragraph:</text>

			 use of a specific selection term that meets the requirements of subsection
			 (b)(2).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection></section><section id="H3033D398CCE447EE84810B40217F842E"><enum>104.</enum><header>Judicial review of minimization procedures for the production of tangible things</header><text display-inline="no-display-inline">Section 501(c)(1) (<external-xref legal-doc="usc" parsable-cite="usc/50/1861">50 U.S.C. 1861(c)(1)</external-xref>) is amended by inserting after <quote>subsections (a) and (b)</quote> the following: <quote>and that the minimization procedures submitted in accordance with subsection (b)(2)(D) meet the
			 definition of minimization procedures under subsection (g)</quote>.</text>
			</section><section id="H5F5F9E483F774365A6703ACC10ACA3D6"><enum>105.</enum><header>Liability protection</header><text display-inline="no-display-inline">Section 501(e) (<external-xref legal-doc="usc" parsable-cite="usc/50/1861">50 U.S.C. 1861(e)</external-xref>) is amended to read as follows:</text>
				<quoted-block changed="added" committee-id="HJU00" display-inline="no-display-inline" id="H0B920C52B60B4FBFB96E70534AA13331" reported-display-style="italic" style="OLC">
					<subsection id="HADF521AD8D09461293A5E9BE8915C1E4"><enum>(e)</enum><text display-inline="yes-display-inline">No cause of action shall lie in any court against a person who produces tangible things or provides
			 information, facilities, or technical assistance pursuant to an order
			 issued or an emergency production required under this section. Such
			 production shall not be deemed to constitute a waiver of any privilege in
			 any other proceeding or context.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="H5717A6D2BDE64F6BA948FD26D7E293B1"><enum>106.</enum><header>Compensation for assistance</header><text display-inline="no-display-inline">Section 501 (<external-xref legal-doc="usc" parsable-cite="usc/50/1861">50 U.S.C. 1861</external-xref>), as amended by section 102 of this Act, is further amended by adding
			 at the end the following new subsection:</text>
				<quoted-block changed="added" committee-id="HJU00" display-inline="no-display-inline" id="H0948FD85D7CF4923BE39D1F9BF4710E1" reported-display-style="italic" style="OLC">
					<subsection id="H3FCA3A07DAC44300AF71819347EF8EDA"><enum>(j)</enum><header>Compensation</header><text display-inline="yes-display-inline">The Government shall compensate, at the prevailing rate, a person for producing tangible things or
			 providing information, facilities, or assistance in accordance with an
			 order issued or an emergency production required under this section.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="H693F9F8076AE4583B209E9FE7196EF8E"><enum>107.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 501 (<external-xref legal-doc="usc" parsable-cite="usc/50/1861">50 U.S.C. 1861</external-xref>), as amended by section 106 of this Act, is further amended by adding
			 at the end the following new subsection:</text>
				<quoted-block changed="added" committee-id="HJU00" display-inline="no-display-inline" id="H35656B9A8C184E5788B6EE440A5ED5A2" reported-display-style="italic" style="OLC">
					<subsection id="H77C111B61E2D4D0FBA95489229ACDF02"><enum>(k)</enum><header>Definitions</header><text>In this section:</text>
						<paragraph id="H15180BAA55EB47DA88C4572F87C761DC"><enum>(1)</enum><header>Call detail record defined</header><text display-inline="yes-display-inline">The term <quote>call detail record</quote>—</text>
							<subparagraph id="H0084B5E36D0C44A8A063E29379B73DA3"><enum>(A)</enum><text>means session identifying information (including originating or terminating telephone number,
			 International Mobile Subscriber Identity number, or International Mobile
			 Station Equipment Identity number), a telephone calling card number, or
			 the time or duration of a call; and</text>
							</subparagraph><subparagraph id="H5E34BEE23E8C4BDC8B41B55EAE57F19A"><enum>(B)</enum><text>does not include—</text>
								<clause id="H0FF7BC5741874CD6A196454A668D03F4"><enum>(i)</enum><text>the contents of any communication (as defined in <external-xref legal-doc="usc" parsable-cite="usc/18/2510">section 2510(8)</external-xref> of title 18, United States Code);</text>
								</clause><clause id="H3E62639DCE9B4C37B96552C4A42B6B39"><enum>(ii)</enum><text>the name, address, or financial information of a subscriber or customer; or</text>
								</clause><clause id="HAE0810B65D574FE5A9A21411A5429099"><enum>(iii)</enum><text>cell site location information.</text>
								</clause></subparagraph></paragraph><paragraph id="H3D40D59901DC46FFBAB89E514BBEB3A4"><enum>(2)</enum><header>Specific selection term</header><text>The term <quote>specific selection term</quote> means a term used to uniquely describe a person, entity, or account.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="H88D3EFE67C5B46BDBC3B80C1D766FCA5"><enum>108.</enum><header>Inspector general reports on business records orders</header><text display-inline="no-display-inline">Section 106A of the USA PATRIOT Improvement and Reauthorization Act of 2005 (<external-xref legal-doc="public-law" parsable-cite="pl/109/177">Public Law 109–177</external-xref>;
			 120 Stat. 200) is amended—</text>
				<paragraph id="H0E9F606B60B74FC3888DA7D1AAA79E45"><enum>(1)</enum><text>in subsection (b)—</text>
					<subparagraph id="H4D6887B8358D4F9AA41D7DB7B8691D47"><enum>(A)</enum><text>in paragraph (1), by inserting <quote>and calendar years 2012 through 2014</quote> after <quote>2006</quote>;</text>

			 containing the results of the audit conducted under subsection (a) for
			 calendar years 2012 through 2014.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
				</paragraph><paragraph id="HE68DDBF7F25E4EC7822845C8DE418975"><enum>(3)</enum><text>by redesignating subsections (d) and (e) as subsections (e) and (f), respectively;</text>
				</paragraph><paragraph id="H31B14EF911544AB2975FC0DCD9DA54FE"><enum>(4)</enum><text>by inserting after subsection (c) the following new subsection:</text>
					<quoted-block changed="added" committee-id="HJU00" id="HA30C681D7083495EB1B37A89570A61A4" reported-display-style="italic" style="OLC">
						<subsection id="HB4308F665ABA42E19E7D601B7515BCDF"><enum>(d)</enum><header>Intelligence assessment</header>
							<paragraph id="HF2EF560CFCED402DA195F1C0363C0D1D"><enum>(1)</enum><header>In general</header><text>For the period beginning on January 1, 2012, and ending on December 31, 2014, the Inspector General
			 of the Intelligence Community shall assess—</text>
								<subparagraph id="HADE2B8A68B0C4A8FB6557FEF6369C45F"><enum>(A)</enum><text>the importance of the information acquired under title V of the Foreign Intelligence Surveillance
			 Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1861">50 U.S.C. 1861 et seq.</external-xref>) to the activities of the intelligence
			 community;</text>
								</subparagraph><subparagraph id="HA30766C0CA964CBD864FD3A907368763"><enum>(B)</enum><text>the manner in which that information was collected, retained, analyzed, and disseminated by the
			 intelligence community;</text>
								</subparagraph><subparagraph id="HE21B6624BE7F4E3E9DDE300A0651FB6C"><enum>(C)</enum><text>the minimization procedures used by elements of the intelligence community under such title and
			 whether the minimization procedures adequately protect the constitutional
			 rights of United States persons; and</text>
								</subparagraph><subparagraph id="H47895D46C3564E0C93728F49C5691A64"><enum>(D)</enum><text>any minimization procedures proposed by an element of the intelligence community under such title
			 that were modified or denied by the court established under section 103(a)
			 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1803">50 U.S.C. 1803(a)</external-xref>).</text>
								</subparagraph></paragraph><paragraph id="H86BC2C444CED407FB4D11118D0502B85"><enum>(2)</enum><header>Submission date for assessment</header><text>Not later than December 31, 2015, the Inspector General of the Intelligence Community shall submit
			 to the Committee on the Judiciary and the Select Committee on Intelligence
			 of the Senate and the Committee on the Judiciary and the Permanent Select
			 Committee on Intelligence of the House of Representatives a report
			 containing the results of the assessment for calendar years 2012 through
			 2014.</text></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H6B6CF33F74C94D30BF3151193236A81F"><enum>(5)</enum><text>in subsection (e), as redesignated by paragraph (3)—</text>
					<subparagraph id="HABD28D0B7CD84DD5AE9F153B8FBEC4C2"><enum>(A)</enum><text>in paragraph (1)—</text>
						<clause id="HF32C9FDA5C064F16B0AA8601CD7F4E61"><enum>(i)</enum><text>by striking <quote>a report under subsection (c)(1) or (c)(2)</quote> and inserting <quote>any report under subsection (c) or (d)</quote>; and</text>
						</clause><clause id="H7DA5D97DDCCB4D0486EABEE4F8C8E6C1"><enum>(ii)</enum><text>by striking <quote>Inspector General of the Department of Justice</quote> and inserting <quote>Inspector General of the Department of Justice, the Inspector General of the Intelligence
			 Community, and any Inspector General of an element of the intelligence
			 community that prepares a report to assist the Inspector General of the
			 Department of Justice or the Inspector General of the Intelligence
			 Community in complying with the requirements of this section</quote>; and</text>
						</clause></subparagraph><subparagraph id="H23C4C4DA5D814B4CB077F924A20CE2B9"><enum>(B)</enum><text>in paragraph (2), by striking <quote>the reports submitted under subsections (c)(1) and (c)(2)</quote> and inserting <quote>any report submitted under subsection (c) or (d)</quote>;</text>
					</subparagraph></paragraph><paragraph id="H8196354B98B8434E932085EEB3E1225D"><enum>(6)</enum><text>in subsection (f), as redesignated by paragraph (3)—</text>

			 information, as defined in section 101(e)(1), shall not be disseminated in
			 a manner that identifies any United States person, without such person’s
			 consent, unless such person’s identity is necessary to understand foreign
			 intelligence information or assess its importance; and</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H06CE72B0F3CB4E53A7B6CFA1DDC02E22"><enum>(C)</enum><text display-inline="yes-display-inline">notwithstanding subparagraphs (A) and (B), procedures that allow for the retention and
			 dissemination of information that is evidence of a crime which has been,
			 is being, or is about to be committed and that is to be retained or
			 disseminated for law enforcement purposes.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>

			<section commented="no" display-inline="no-display-inline" id="H076C2A7B76AB448EA5B302ED9E93E1C3" section-type="subsequent-section"><enum>301.</enum><header display-inline="yes-display-inline">Prohibition on reverse targeting</header><text display-inline="no-display-inline">Section 702(b)(2) (<external-xref legal-doc="usc" parsable-cite="usc/50/1881a">50 U.S.C. 1881a(b)(2)</external-xref>) is amended by striking <quote>the purpose</quote> and inserting <quote>a purpose</quote>.</text>

			 to be located in the United States, except to protect against an immediate
			 threat to human life.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></section><section commented="no" display-inline="no-display-inline" id="HFDD22F3737A743E1BBB5085518DC0499" section-type="subsequent-section"><enum>303.</enum><header display-inline="yes-display-inline">Limits on use of unlawfully obtained information</header><text display-inline="no-display-inline">Section 702(i)(3) (<external-xref legal-doc="usc" parsable-cite="usc/50/1881a">50 U.S.C. 1881a(i)(3)</external-xref>) is amended by adding at the end the following new
			 subparagraph:</text>

						<clause commented="no" display-inline="no-display-inline" id="HA863568D927B46659DD7B09FAB6618CA"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as provided in clause (ii), no information obtained or evidence derived from an acquisition
			 pursuant to a certification or targeting or minimization procedures
			 subject to an order under subparagraph (B) concerning any United States
			 person shall be received in evidence or otherwise disclosed in any trial,
			 hearing, or other proceeding in or before any court, grand jury,
			 department, office, agency, regulatory body, legislative committee, or
			 other authority of the United States, a State, or political subdivision
			 thereof, and no information concerning any United States person acquired
			 from the acquisition shall subsequently be used or disclosed in any other
			 manner by Federal officers or employees without the consent of the United
			 States person, except with the approval of the Attorney General if the
			 information indicates a threat of death or serious bodily harm to any
			 person.</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="H38708CA25EA64147835601A5016BA413"><enum>(ii)</enum><header display-inline="yes-display-inline">Exception</header><text display-inline="yes-display-inline">If the Government corrects any deficiency identified by the order of the Court under subparagraph
			 (B), the Court may permit the use or disclosure of information acquired
			 before the date of the correction under such minimization procedures as
			 the Court shall establish for purposes of this clause.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</section></title><title id="H6125B45FFB7D4D32AFF8C661806E3DA5"><enum>IV</enum><header>Foreign Intelligence Surveillance Court reforms</header>
			<section commented="no" id="HDBDE2538CBBF455BB392ED6997D151CB"><enum>401.</enum><header>Appointment of amicus curiae</header><text display-inline="no-display-inline">Section 103 (<external-xref legal-doc="usc" parsable-cite="usc/50/1803">50 U.S.C. 1803</external-xref>) is amended by adding at the end the following new subsection:</text>
				<quoted-block changed="added" committee-id="HJU00" display-inline="no-display-inline" id="H75F8E77B428641FBBC977CD95F5CD525" reported-display-style="italic" style="OLC">
					<subsection commented="no" id="HC7DC90F2E27943389AB87296EDA8801B"><enum>(i)</enum><header>Amicus curiae</header>
						<paragraph commented="no" id="H988D2D096C3B4601B17E5D4D0B6A2DB6"><enum>(1)</enum><header>Authorization</header><text display-inline="yes-display-inline">A court established under subsection (a) or (b), consistent with the requirement of subsection (c)
			 and any other statutory requirement that the court act expeditiously or
			 within a stated time—</text>
							<subparagraph id="H1E2FA7D1F30D4A4686678B12CF0A6445"><enum>(A)</enum><text>shall appoint an individual to serve as amicus curiae to assist such court in the consideration of
			 any application for an order or review that, in the opinion of the court,
			 presents a novel or significant interpretation of the law, unless the
			 court issues a written finding that such appointment is not appropriate;
			 and</text>
							</subparagraph><subparagraph id="H0BBC1F795D4E430AB094152C5640B592"><enum>(B)</enum><text>may appoint an individual to serve as amicus curiae in any other instance as such court deems
			 appropriate.</text>
							</subparagraph></paragraph><paragraph commented="no" id="H341868C847984AE7854BB7EC756FCA43"><enum>(2)</enum><header>Designation</header><text display-inline="yes-display-inline">The presiding judges of the courts established under subsections (a) and (b) shall jointly
			 designate not less than 5 individuals to be eligible to serve as amicus
			 curiae. Such individuals shall be persons who possess expertise in privacy
			 and civil liberties, intelligence collection, telecommunications, or any
			 other area of law that may lend legal or technical expertise to the courts
			 and who have been determined by appropriate executive branch officials to
			 be eligible for access to classified information.</text>
						</paragraph><paragraph commented="no" id="H70E2D38790D9433F93005F16CAA45E1C"><enum>(3)</enum><header>Duties</header><text display-inline="yes-display-inline">An individual appointed to serve as amicus curiae under paragraph (1) shall carry out the duties
			 assigned by the appointing court. Such court may authorize the individual
			 appointed to serve as amicus curiae to review any application,
			 certification, petition, motion, or other submission that the court
			 determines is relevant to the duties assigned by the court.</text>
						</paragraph><paragraph commented="no" id="HA986C317A6C24084A941D16395D24FDF"><enum>(4)</enum><header>Notification</header><text display-inline="yes-display-inline">The presiding judges of the courts established under subsections (a) and (b) shall notify the
			 Attorney General of each exercise of the authority to appoint an
			 individual to serve as amicus curiae under paragraph (1).</text>
						</paragraph><paragraph commented="no" id="H77604D2D6C1A48CE91A0E646D478BECB"><enum>(5)</enum><header>Assistance</header><text>A court established under subsection (a) or (b) may request and receive (including on a
			 non-reimbursable basis) the assistance of the executive branch in the
			 implementation of this subsection.</text>
						</paragraph><paragraph commented="no" id="HC5A0AB68228E47408F029EF0BA0C9F72"><enum>(6)</enum><header>Administration</header><text>A court established under subsection (a) or (b) may provide for the designation, appointment,
			 removal, training, or other support for an individual appointed to serve
			 as amicus curiae under paragraph (1) in a manner that is not inconsistent
			 with this subsection.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="H7E8FDA25C88C496CBA776D97638FDCA2"><enum>402.</enum><header>Declassification of decisions, orders, and opinions</header>
				<subsection id="HF18D435ABFF9443EB85B8551A59195A2"><enum>(a)</enum><header>Declassification</header><text display-inline="yes-display-inline">Title VI (<external-xref legal-doc="usc" parsable-cite="usc/50/1871">50 U.S.C. 1871 et seq.</external-xref>) is amended—</text>

								<subsection id="H5937C63CC54C4CA5A2D497A2795500A5"><enum>(a)</enum><header>Declassification required</header><text display-inline="yes-display-inline">Subject to subsection (b), the Attorney General shall conduct a declassification review of each
			 decision, order, or opinion issued by the Foreign Intelligence
			 Surveillance Court or the Foreign Intelligence Surveillance Court of
			 Review (as defined in section 601(e)) that includes a significant
			 construction or interpretation of any provision of this Act and,
			 consistent with that review, make publicly available to the greatest
			 extent practicable each such decision, order, or opinion.</text>
								</subsection><subsection id="HD9CCF9F8150C45E7B335D3E0BE70FF41"><enum>(b)</enum><header>Redacted form</header><text>The Attorney General may satisfy the requirement under subsection (a) to make a decision, order, or
			 opinion described in such subsection publicly available to the greatest
			 extent practicable by making such decision, order, or opinion publicly
			 available in redacted form.</text>
								</subsection><subsection id="H2104677B0BC94857AA260AD582BB2A44"><enum>(c)</enum><header>National security waiver</header><text>The Attorney General may waive the requirement to declassify and make publicly available a
			 particular decision, order, or opinion under subsection (a) if the
			 Attorney General—</text>
									<paragraph id="H4F5AFDE53F7649BEA77E24FD3E604AFE"><enum>(1)</enum><text display-inline="yes-display-inline">determines that a waiver of such requirement is necessary to protect the national security of the
			 United States or properly classified intelligence sources or methods; and</text>
									</paragraph><paragraph id="H7B2FEF725D2F41DF85528659ACBFDFC6"><enum>(2)</enum><text>makes publicly available an unclassified summary of such decision, order, or opinion.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>

				<subsection id="HCF7111BB1F68499B9385EB3B5201B2A5"><enum>(a)</enum><header>Application</header><text display-inline="yes-display-inline">Section 501(b)(2) (<external-xref legal-doc="usc" parsable-cite="usc/50/1861">50 U.S.C. 1861(b)(2)</external-xref>) is amended—</text>

			 in accordance with subsection (a)(2) to protect against international
			 terrorism; and</text>
								</clause><clause id="HE1C5A8746CDD40A7AE909F1F9F74E6BF"><enum>(ii)</enum><text display-inline="yes-display-inline">there are facts giving rise to a reasonable, articulable suspicion that such specific selection
			 term is associated with a foreign power or an agent of a foreign power;
			 and</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection id="H08DD096F42C740018EEB59F8697201F1"><enum>(b)</enum><header>Order</header><text>Section 501(c)(2) (<external-xref legal-doc="usc" parsable-cite="usc/50/1861">50 U.S.C. 1861(c)(2)</external-xref>) is amended—</text>
					<paragraph id="H82B4BF3C7FAF452A9416E27E8608931C"><enum>(1)</enum><text>in subparagraph (D), by striking <quote>; and</quote> and inserting a semicolon;</text>
					</paragraph><paragraph id="H7FDEDE1861554C099E9DFA75A8789F1F"><enum>(2)</enum><text>in subparagraph (E), by striking the period and inserting <quote>; and</quote>; and</text>
					</paragraph><paragraph id="H79A6DFF0990C45F5BF4685DB6B05B5C5"><enum>(3)</enum><text>by adding at the end the following new subparagraph:</text>

							<subparagraph changed="added" id="H8DF35BC0557241658238F545BD1FA690" reported-display-style="boldface-roman"><enum>(F)</enum><text display-inline="yes-display-inline">in the case of an application described in subsection (b)(2)(C), shall—</text>
								<clause id="H7B2A99439AE5499AAECF8F6510676A5D"><enum>(i)</enum><text>authorize the production of call detail records for a period not to exceed 180 days;</text>
								</clause><clause id="H88AF8EBB203043B08A09BB1F17128219"><enum>(ii)</enum><text>provide that an order for such production may be extended upon application under subsection (b) and
			 the judicial finding under paragraph (1);</text>
								</clause><clause id="HA96FD645E2C9454E98F65F88C30A2BF8"><enum>(iii)</enum><text>provide that the Government may require the production of call detail records—</text>
									<subclause id="HB4CB272E63B8457CBF00FA66C454E043"><enum>(I)</enum><text>using the specific selection term that satisfies the standard required under subsection
			 (b)(2)(C)(ii) as the basis for production; and</text>
									</subclause><subclause id="H18279D5617604EEEA80F0ABB8E38130F"><enum>(II)</enum><text>using the results of the production under subclause (I) as the basis for production;</text>
									</subclause></clause><clause commented="no" id="HD546FD59AC1B41E4BF2551293931F1F1"><enum>(iv)</enum><text display-inline="yes-display-inline">direct each person the Government directs to produce call detail records under the order to furnish
			 the Government forthwith all information, facilities, or technical
			 assistance necessary to accomplish the production in such a manner as will
			 protect the secrecy of the production and produce a minimum of
			 interference with the services that such person is providing to each
			 subject of the production; and</text>
								</clause><clause id="HCBE99FB820F44465AE9752E7D32243F6"><enum>(v)</enum><text>direct the Government to destroy all call detail records produced under the order not later than 5
			 years after the date of the production of such records, except for records
			 that are relevant to an authorized investigation (other than a threat
			 assessment) conducted in accordance with subsection (a)(2) to protect
			 against international terrorism.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection></section><section id="H3A1D5A9765324FA0B4EB204BFFDF6F56"><enum>102.</enum><header>Emergency authority</header>
				<subsection id="H9C77E7F18C5048068156CE81860F85B1"><enum>(a)</enum><header>Authority</header><text display-inline="yes-display-inline">Section 501 (<external-xref legal-doc="usc" parsable-cite="usc/50/1861">50 U.S.C. 1861</external-xref>) is amended by adding at the end the following new subsection:</text>
					<quoted-block changed="not-changed" display-inline="no-display-inline" id="H136289B394FD49E7935E3E472CF8A172" style="OLC">
						<subsection changed="added" id="H5530F336687B4CE69F2245F0FD94B15C" reported-display-style="boldface-roman"><enum>(i)</enum><header>Emergency authority for production of tangible things</header>
							<paragraph display-inline="no-display-inline" id="H51F64B0F26D3460EA1303E55A7B48BE0"><enum>(1)</enum><text>Notwithstanding any other provision of this section, the Attorney General may require the emergency
			 production of tangible things if the Attorney General—</text>
								<subparagraph display-inline="no-display-inline" id="HA7EE185B2829420A9F94A22800845ADA"><enum>(A)</enum><text display-inline="yes-display-inline">reasonably determines that an emergency situation requires the production of tangible things before
			 an order authorizing such production can with due diligence be obtained;</text>
								</subparagraph><subparagraph display-inline="no-display-inline" id="H4C8A371D6A1247ECB4AA3AE71A9CD672"><enum>(B)</enum><text>reasonably determines that the factual basis for the issuance of an order under this section to
			 approve such production of tangible things exists;</text>
								</subparagraph><subparagraph display-inline="no-display-inline" id="H62B98A8348054E8BA67038890E8FD9C4"><enum>(C)</enum><text>informs, either personally or through a designee, a judge having jurisdiction under this section at
			 the time the Attorney General requires the emergency production of
			 tangible things that the decision has been made to employ the authority
			 under this subsection; and</text>
								</subparagraph><subparagraph display-inline="no-display-inline" id="HE643275538834E88B04846A4C73BCA60"><enum>(D)</enum><text>makes an application in accordance with this section to a judge having jurisdiction under this
			 section as soon as practicable, but not later than 7 days after the
			 Attorney General requires the emergency production of tangible things
			 under this subsection.</text>
								</subparagraph></paragraph><paragraph display-inline="no-display-inline" id="H895EC1CB017E41B1970A5D2630744648"><enum>(2)</enum><text>If the Attorney General authorizes the emergency production of tangible things under paragraph (1),
			 the Attorney General shall require that the minimization procedures
			 required by this section for the issuance of a judicial order be followed.</text>
							</paragraph><paragraph display-inline="no-display-inline" id="H08B08E78F1424725BDABE6D11AF8F9EA"><enum>(3)</enum><text>In the absence of a judicial order approving the production of tangible things under this
			 subsection, the production shall terminate when the information sought is
			 obtained, when the application for the order is denied, or after the
			 expiration of 7 days from the time the Attorney General begins requiring
			 the emergency production of such tangible things, whichever is earliest.</text>
							</paragraph><paragraph display-inline="no-display-inline" id="H09BB3C069FF54A6A8B5ADA7075E46204"><enum>(4)</enum><text>A denial of the application made under this subsection may be reviewed as provided in this section.</text>
							</paragraph><paragraph display-inline="no-display-inline" id="H259648A62354454FB7DBEF7C38ECC02E"><enum>(5)</enum><text>If such application for approval is denied, or in any other case where the production of tangible
			 things is terminated and no order is issued approving the production, no
			 information obtained or evidence derived from such production shall be
			 received in evidence or otherwise disclosed in any trial, hearing, or
			 other proceeding in or before any court, grand jury, department, office,
			 agency, regulatory body, legislative committee, or other authority of the
			 United States, a State, or political subdivision thereof, and no
			 information concerning any United States person acquired from such
			 production shall subsequently be used or disclosed in any other manner by
			 Federal officers or employees without the consent of such person, except
			 with the approval of the Attorney General if the information indicates a
			 threat of death or serious bodily harm to any person.</text>
							</paragraph><paragraph display-inline="no-display-inline" id="H6BB3A137B3F44B46B416FA2F51B4BCED"><enum>(6)</enum><text>The Attorney General shall assess compliance with the requirements of paragraph (5).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>

					</paragraph></subsection></section><section id="H769DF39E78504CFB83304BBC1703515C"><enum>104.</enum><header>Judicial review of minimization procedures for the production of tangible things</header><text display-inline="no-display-inline">Section 501(c)(1) (<external-xref legal-doc="usc" parsable-cite="usc/50/1861">50 U.S.C. 1861(c)(1)</external-xref>) is amended by inserting after <quote>subsections (a) and (b)</quote> the following: <quote>and that the minimization procedures submitted in accordance with subsection (b)(2)(D) meet the
			 definition of minimization procedures under subsection (g)</quote>.</text>
			</section><section id="HF9AA35A1F7E34487987D019DAFB58E1E"><enum>105.</enum><header>Liability protection</header><text display-inline="no-display-inline">Section 501(e) (<external-xref legal-doc="usc" parsable-cite="usc/50/1861">50 U.S.C. 1861(e)</external-xref>) is amended to read as follows:</text>

			 information, facilities, or technical assistance pursuant to an order
			 issued or an emergency production required under this section. Such
			 production shall not be deemed to constitute a waiver of any privilege in
			 any other proceeding or context.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="H83C51832A8DE4D26911EE95A898453BB"><enum>106.</enum><header>Compensation for assistance</header><text display-inline="no-display-inline">Section 501 (<external-xref legal-doc="usc" parsable-cite="usc/50/1861">50 U.S.C. 1861</external-xref>), as amended by section 102 of this Act, is further amended by adding
			 at the end the following new subsection:</text>

			</section><section id="H985534153EFA41BFA51444D0382EFABD"><enum>107.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 501 (<external-xref legal-doc="usc" parsable-cite="usc/50/1861">50 U.S.C. 1861</external-xref>), as amended by section 106 of this Act, is further amended by adding
			 at the end the following new subsection:</text>

			 International Mobile Subscriber Identity number, or International Mobile
			 Station Equipment Identity number), a telephone calling card number, or
			 the time or duration of a call; and</text>
							</subparagraph><subparagraph id="H04E281B308674C8A80BD42605B142146"><enum>(B)</enum><text>does not include—</text>
								<clause id="H6647B9AC84664CC6B2320AB09923FA25"><enum>(i)</enum><text>the contents of any communication (as defined in <external-xref legal-doc="usc" parsable-cite="usc/18/2510">section 2510(8)</external-xref> of title 18, United States Code);</text>
								</clause><clause id="H3C4854BF7B05437490DDCC9BC0B99A7D"><enum>(ii)</enum><text>the name, address, or financial information of a subscriber or customer; or</text>
								</clause><clause id="HE58DD3E5856B480EB37A3D2022492207"><enum>(iii)</enum><text>cell site location information.</text>
								</clause></subparagraph></paragraph><paragraph id="H78822EBA7C2D461B84F5BB0D0754811B"><enum>(2)</enum><header>Specific selection term</header><text>The term <quote>specific selection term</quote> means a term used to uniquely describe a person, entity, or account.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="HC9F127B48B064390A6F1998806349F3E"><enum>108.</enum><header>Inspector general reports on business records orders</header><text display-inline="no-display-inline">Section 106A of the USA PATRIOT Improvement and Reauthorization Act of 2005 (<external-xref legal-doc="public-law" parsable-cite="pl/109/177">Public Law 109–177</external-xref>;
			 120 Stat. 200) is amended—</text>

								</subparagraph><subparagraph id="HAADCCBEDFB45457AB2B305BD200A59BB"><enum>(C)</enum><text>the minimization procedures used by elements of the intelligence community under such title and
			 whether the minimization procedures adequately protect the constitutional
			 rights of United States persons; and</text>
								</subparagraph><subparagraph id="H8CBEC696F67444E4AF736FB8427F5730"><enum>(D)</enum><text>any minimization procedures proposed by an element of the intelligence community under such title
			 that were modified or denied by the court established under section 103(a)
			 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1803">50 U.S.C. 1803(a)</external-xref>).</text>
								</subparagraph></paragraph><paragraph id="HC6FCA8014E9541E199FAC5BE020589D8"><enum>(2)</enum><header>Submission date for assessment</header><text>Not later than December 31, 2015, the Inspector General of the Intelligence Community shall submit
			 to the Committee on the Judiciary and the Select Committee on Intelligence

			 consistent with the need of the United States to obtain, produce, and
			 disseminate foreign intelligence information;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HAB7DD52400004649BD613DB522F98F5D"><enum>(B)</enum><text display-inline="yes-display-inline">procedures that require that nonpublicly available information, which is not foreign intelligence
			 information, as defined in section 101(e)(1), shall not be disseminated in
			 a manner that identifies any United States person, without such person’s
			 consent, unless such person’s identity is necessary to understand foreign
			 intelligence information or assess its importance; and</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H7B4A9BCD955C4BFDB7A2AC712DA0DE1F"><enum>(C)</enum><text display-inline="yes-display-inline">notwithstanding subparagraphs (A) and (B), procedures that allow for the retention and
			 dissemination of information that is evidence of a crime which has been,
			 is being, or is about to be committed and that is to be retained or

			<section commented="no" display-inline="no-display-inline" id="H9BA4EDEE58E9413EADECC41CBE676BC6" section-type="subsequent-section"><enum>301.</enum><header display-inline="yes-display-inline">Prohibition on reverse targeting</header><text display-inline="no-display-inline">Section 702(b)(2) (<external-xref legal-doc="usc" parsable-cite="usc/50/1881a">50 U.S.C. 1881a(b)(2)</external-xref>) is amended by striking <quote>the purpose</quote> and inserting <quote>a purpose</quote>.</text>

				</paragraph></section><section commented="no" display-inline="no-display-inline" id="H8205D047CF4F43069DF29726F00686BE" section-type="subsequent-section"><enum>303.</enum><header display-inline="yes-display-inline">Limits on use of unlawfully obtained information</header><text display-inline="no-display-inline">Section 702(i)(3) (<external-xref legal-doc="usc" parsable-cite="usc/50/1881a">50 U.S.C. 1881a(i)(3)</external-xref>) is amended by adding at the end the following new
			 subparagraph:</text>

						<clause commented="no" display-inline="no-display-inline" id="H79D76C438F1B4FB6B802C1218B694194"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as provided in clause (ii), no information obtained or evidence derived from an acquisition
			 pursuant to a certification or targeting or minimization procedures
			 subject to an order under subparagraph (B) concerning any United States
			 person shall be received in evidence or otherwise disclosed in any trial,
			 hearing, or other proceeding in or before any court, grand jury,
			 department, office, agency, regulatory body, legislative committee, or
			 other authority of the United States, a State, or political subdivision
			 thereof, and no information concerning any United States person acquired
			 from the acquisition shall subsequently be used or disclosed in any other
			 manner by Federal officers or employees without the consent of the United
			 States person, except with the approval of the Attorney General if the
			 information indicates a threat of death or serious bodily harm to any
			 person.</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="HBE03BA327E2A40ABBF8EEFA94DDF95BA"><enum>(ii)</enum><header display-inline="yes-display-inline">Exception</header><text display-inline="yes-display-inline">If the Government corrects any deficiency identified by the order of the Court under subparagraph
			 (B), the Court may permit the use or disclosure of information acquired
			 before the date of the correction under such minimization procedures as
			 the Court shall establish for purposes of this clause.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</section></title><title id="H357E2AF6EB7C4A958046997F3EB63463"><enum>IV</enum><header>Foreign Intelligence Surveillance Court reforms</header>
			<section commented="no" id="H6E65729B5E33437EA0DA9AC52A64865D"><enum>401.</enum><header>Appointment of amicus curiae</header><text display-inline="no-display-inline">Section 103 (<external-xref legal-doc="usc" parsable-cite="usc/50/1803">50 U.S.C. 1803</external-xref>) is amended by adding at the end the following new subsection:</text>
				<quoted-block changed="not-changed" display-inline="no-display-inline" id="HF7D71441F0FF4B17BDBC22C74EB28BEA" style="OLC">
					<subsection changed="added" commented="no" id="H447A0B8A69964C8194B48D49B0B60FD2" reported-display-style="boldface-roman"><enum>(i)</enum><header>Amicus curiae</header>
						<paragraph commented="no" id="H3FA38209BE504998943F80FEC08AA122"><enum>(1)</enum><header>Authorization</header><text display-inline="yes-display-inline">A court established under subsection (a) or (b), consistent with the requirement of subsection (c)
			 and any other statutory requirement that the court act expeditiously or
			 within a stated time—</text>
							<subparagraph id="H72F23456781E49BBA38CCEA8EA9EB360"><enum>(A)</enum><text>shall appoint an individual to serve as amicus curiae to assist such court in the consideration of
			 any application for an order or review that, in the opinion of the court,
			 presents a novel or significant interpretation of the law, unless the
			 court issues a written finding that such appointment is not appropriate;
			 and</text>
							</subparagraph><subparagraph id="H964F4C2FFBF14C05AA7ACEDBE4975BE6"><enum>(B)</enum><text>may appoint an individual to serve as amicus curiae in any other instance as such court deems
			 appropriate.</text>
							</subparagraph></paragraph><paragraph commented="no" id="HC2A30FF6E6024DFD97846EC40556F901"><enum>(2)</enum><header>Designation</header><text display-inline="yes-display-inline">The presiding judges of the courts established under subsections (a) and (b) shall jointly
			 designate not less than 5 individuals to be eligible to serve as amicus
			 curiae. Such individuals shall be persons who possess expertise in privacy
			 and civil liberties, intelligence collection, telecommunications, or any
			 other area of law that may lend legal or technical expertise to the courts
			 and who have been determined by appropriate executive branch officials to
			 be eligible for access to classified information.</text>
						</paragraph><paragraph commented="no" id="H29181E4DFADA404D93417D1C19F64349"><enum>(3)</enum><header>Duties</header><text display-inline="yes-display-inline">An individual appointed to serve as amicus curiae under paragraph (1) shall carry out the duties
			 assigned by the appointing court. Such court may authorize the individual
			 appointed to serve as amicus curiae to review any application,
			 certification, petition, motion, or other submission that the court
			 determines is relevant to the duties assigned by the court.</text>
						</paragraph><paragraph commented="no" id="HD76B5DDC9E404584A64B3EC5279D88ED"><enum>(4)</enum><header>Notification</header><text display-inline="yes-display-inline">The presiding judges of the courts established under subsections (a) and (b) shall notify the
			 Attorney General of each exercise of the authority to appoint an
			 individual to serve as amicus curiae under paragraph (1).</text>
						</paragraph><paragraph commented="no" id="H79169C1320D248899558C99932694E4A"><enum>(5)</enum><header>Assistance</header><text>A court established under subsection (a) or (b) may request and receive (including on a
			 non-reimbursable basis) the assistance of the executive branch in the
			 implementation of this subsection.</text>
						</paragraph><paragraph commented="no" id="HC3A7399287064DE0A45CA1C4361F2F42"><enum>(6)</enum><header>Administration</header><text>A court established under subsection (a) or (b) may provide for the designation, appointment,
			 removal, training, or other support for an individual appointed to serve
			 as amicus curiae under paragraph (1) in a manner that is not inconsistent
			 with this subsection.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="HFEFA226F0DAE44B398259898533902BB"><enum>402.</enum><header>Declassification of decisions, orders, and opinions</header>
				<subsection id="HB3EBB41C5E414060AF78C4F637996B8C"><enum>(a)</enum><header>Declassification</header><text display-inline="yes-display-inline">Title VI (<external-xref legal-doc="usc" parsable-cite="usc/50/1871">50 U.S.C. 1871 et seq.</external-xref>) is amended—</text>

			 Review (as defined in section 601(e)) that includes a significant
			 construction or interpretation of any provision of this Act and,
			 consistent with that review, make publicly available to the greatest

			 opinion described in such subsection publicly available to the greatest
			 extent practicable by making such decision, order, or opinion publicly
			 available in redacted form.</text>
								</subsection><subsection id="HB4E56840AFDA42F89C8774D7CE9C1F97"><enum>(c)</enum><header>National security waiver</header><text>The Attorney General may waive the requirement to declassify and make publicly available a
			 particular decision, order, or opinion under subsection (a) if the
			 Attorney General—</text>
									<paragraph id="H44ABC58151F647D1AD97761126BBBB6A"><enum>(1)</enum><text display-inline="yes-display-inline">determines that a waiver of such requirement is necessary to protect the national security of the
			 United States or properly classified intelligence sources or methods; and</text>
