			 terms of an amendment to, or a repeal of, a section or other provision,
			 the reference shall be considered to be made to a section or other
			 provision of the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1801">50 U.S.C. 1801 et seq.</external-xref>).</text>
		</section><title id="H9F8B19EC18B94F50810737838B5BF746"><enum>I</enum><header>FISA business records reforms</header>
			<section id="HC90359FEAE6244F5A35C5A9DB78B2A37"><enum>101.</enum><header>Additional requirements for call detail records</header>
				<subsection id="H998ABAD29F82478A8983B4215AB10352"><enum>(a)</enum><header>Application</header><text display-inline="yes-display-inline">Section 501(b)(2) (<external-xref legal-doc="usc" parsable-cite="usc/50/1861">50 U.S.C. 1861(b)(2)</external-xref>) is amended—</text>
					<paragraph id="HCDFBDADBC3CF4800BC59D130555874AD"><enum>(1)</enum><text>in subparagraph (A)—</text>
						<subparagraph id="HF4C75D8980E24B08BEA488F73A154927"><enum>(A)</enum><text>in the matter preceding clause (i), by striking <quote>a statement</quote> and inserting <quote>in the case of an application other than an application described in subparagraph (C) (including an
			 application for the production of call detail records other than in the
			 manner described in subparagraph (C)), a statement</quote>; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H9D19ABF56B394C00B8EB65B0AAFE5728"><enum>(B)</enum><text>in clause (iii), by striking <quote>; and</quote> and inserting a semicolon;</text>
						</subparagraph></paragraph><paragraph commented="no" id="HC584A96FC2B7473F8AE491A210475C48"><enum>(2)</enum><text>by redesignating subparagraphs (A) and (B) as subparagraphs (B) and (D), respectively; and</text>
					</paragraph><paragraph id="HBCFB2146FD944DC59787FCF7C44B790C"><enum>(3)</enum><text>by inserting after subparagraph (B) (as so redesignated) the following new subparagraph:</text>
						<quoted-block display-inline="no-display-inline" id="H4FBDFF6AA63F4657815BDD5BFDF2F4A4" style="OLC">
							<subparagraph id="H50F7CA2C4AEE4645AD7330F13CB82564"><enum>(C)</enum><text display-inline="yes-display-inline">in the case of an application for the production on a daily basis of call detail records created
			 before, on, or after the date of the application relating to an authorized
			 investigation (other than a threat assessment) conducted in accordance
			 with subsection (a)(2) to protect against international terrorism, a
			 statement of facts showing that—</text>
								<clause id="HBD195B43F93A4E98BE40F360FB272C09"><enum>(i)</enum><text display-inline="yes-display-inline">there are reasonable grounds to believe that the call detail records sought to be produced based on
			 the specific selection term required under subparagraph (A) are relevant
			 to such investigation; and</text>
								</clause><clause id="HE41026350B664360A6F0D6420C8F1F94"><enum>(ii)</enum><text display-inline="yes-display-inline">there are facts giving rise to a reasonable, articulable suspicion that such specific selection
			 term is associated with a foreign power or an agent of a foreign power;
			 and</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection id="HDAFD13C3B4064578BF4AD9680F44B400"><enum>(b)</enum><header>Order</header><text>Section 501(c)(2) (<external-xref legal-doc="usc" parsable-cite="usc/50/1861">50 U.S.C. 1861(c)(2)</external-xref>) is amended—</text>
					<paragraph id="H76C5E06170C8457E9A83E5A3BFDFA213"><enum>(1)</enum><text>in subparagraph (D), by striking <quote>; and</quote> and inserting a semicolon;</text>
					</paragraph><paragraph id="H2E4A8BA298C94E43A8F64534F33893B7"><enum>(2)</enum><text>in subparagraph (E), by striking the period and inserting <quote>; and</quote>; and</text>
					</paragraph><paragraph id="HDDC8A492FB4C42BE811983F9E32F2A6A"><enum>(3)</enum><text>by adding at the end the following new subparagraph:</text>
						<quoted-block display-inline="no-display-inline" id="HD3AA3202110443E58D582999EC21E6B6" style="OLC">
							<subparagraph id="HE9303997331040E2884BECCB41BE3015"><enum>(F)</enum><text display-inline="yes-display-inline">in the case of an application described in subsection (b)(2)(C), shall—</text>
								<clause id="HA8E83A51F0BA43418CF49C56B3F7A902"><enum>(i)</enum><text>authorize the production on a daily basis of call detail records for a period not to exceed 180
			 days;</text>
								</clause><clause id="HE1543EA3236B4E59B8E718DF9C0B84F4"><enum>(ii)</enum><text>provide that an order for such production may be extended upon application under subsection (b) and
			 the judicial finding under paragraph (1);</text>
								</clause><clause id="H5D99880DAF924B148891F595ADD9D0A8"><enum>(iii)</enum><text display-inline="yes-display-inline">provide that the Government may require the prompt production of call detail records—</text>
									<subclause id="HD05790CD225642CF806D5F3D2C08CED1"><enum>(I)</enum><text>using the specific selection term that satisfies the standard required under subsection
			 (b)(2)(C)(ii) as the basis for production; and</text>
									</subclause><subclause id="HF0C16B46A7E1411E92C6A6069C1861EA"><enum>(II)</enum><text display-inline="yes-display-inline">using call detail records with a direct connection to such specific selection term as the basis for
			 production of a second set of call detail records;</text>
									</subclause></clause><clause id="H952CC4A830D94F3589F5FC42B6AB943C"><enum>(iv)</enum><text display-inline="yes-display-inline">provide that, when produced, such records be in a form that will be useful to the Government;</text>
								</clause><clause commented="no" id="H7D43EF63ECC64E58A1719E370E6BB7D1"><enum>(v)</enum><text display-inline="yes-display-inline">direct each person the Government directs to produce call detail records under the order to furnish
			 the Government forthwith all information, facilities, or technical
			 assistance necessary to accomplish the production in such a manner as will
			 protect the secrecy of the production and produce a minimum of
			 interference with the services that such person is providing to each
			 subject of the production; and</text>
								</clause><clause id="H74998862364C4C9BA09480C752FA1113"><enum>(vi)</enum><text display-inline="yes-display-inline">direct the Government to—</text>
									<subclause id="H71620B9588DD43079B7A96FC8514CD04"><enum>(I)</enum><text>adopt minimization procedures that require the prompt destruction of all call detail records
			 produced under the order that the Government determines are not foreign
			 intelligence information; and</text>
									</subclause><subclause id="HFDEA17C987A9495BAF12CC7BB7F0725C"><enum>(II)</enum><text>destroy all call detail records produced under the order as prescribed by such procedures.</text></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection></section><section id="H64A16F5D21CE4FF9A2DD2BF9B98134A2"><enum>102.</enum><header>Emergency authority</header>
				<subsection id="HD30504DF576143459CA543D49A672FD9"><enum>(a)</enum><header>Authority</header><text display-inline="yes-display-inline">Section 501 (<external-xref legal-doc="usc" parsable-cite="usc/50/1861">50 U.S.C. 1861</external-xref>) is amended by adding at the end the following new subsection:</text>
					<quoted-block display-inline="no-display-inline" id="H4FD230D5F4E64D71BC5B7882BE7DF4C4" style="OLC">
						<subsection id="H6AA4A0DC3A804693947077D30974473A"><enum>(i)</enum><header>Emergency authority for production of tangible things</header>
							<paragraph display-inline="no-display-inline" id="HD05050C0281F4E9A9B5CBA6FA8017FD0"><enum>(1)</enum><text>Notwithstanding any other provision of this section, the Attorney General may require the emergency
			 production of tangible things if the Attorney General—</text>
								<subparagraph display-inline="no-display-inline" id="HD724B30C8FE74DF19510BE9B3438B0A0"><enum>(A)</enum><text display-inline="yes-display-inline">reasonably determines that an emergency situation requires the production of tangible things before
			 an order authorizing such production can with due diligence be obtained;</text>
								</subparagraph><subparagraph display-inline="no-display-inline" id="HE94911763382442EA08FB683784A6783"><enum>(B)</enum><text>reasonably determines that the factual basis for the issuance of an order under this section to
			 approve such production of tangible things exists;</text>
								</subparagraph><subparagraph display-inline="no-display-inline" id="H9DF0DF6B0D9B4C87B29CF4A03A1C1A45"><enum>(C)</enum><text>informs, either personally or through a designee, a judge having jurisdiction under this section at
			 the time the Attorney General requires the emergency production of
			 tangible things that the decision has been made to employ the authority
			 under this subsection; and</text>
								</subparagraph><subparagraph display-inline="no-display-inline" id="H4C11A0D1ED5D46778281CD87B6C24784"><enum>(D)</enum><text>makes an application in accordance with this section to a judge having jurisdiction under this
			 section as soon as practicable, but not later than 7 days after the
			 Attorney General requires the emergency production of tangible things
			 under this subsection.</text>
								</subparagraph></paragraph><paragraph display-inline="no-display-inline" id="HBDEA8D82231346EF84DEC914BCCBF726"><enum>(2)</enum><text>If the Attorney General authorizes the emergency production of tangible things under paragraph (1),
			 the Attorney General shall require that the minimization procedures
			 required by this section for the issuance of a judicial order be followed.</text>
							</paragraph><paragraph display-inline="no-display-inline" id="H6639EC536BF14F3DA410FD13B889759E"><enum>(3)</enum><text>In the absence of a judicial order approving the production of tangible things under this
			 subsection, the production shall terminate when the information sought is
			 obtained, when the application for the order is denied, or after the
			 expiration of 7 days from the time the Attorney General begins requiring
			 the emergency production of such tangible things, whichever is earliest.</text>
							</paragraph><paragraph display-inline="no-display-inline" id="H41266156F8114F13B2FB7DECA976D370"><enum>(4)</enum><text>A denial of the application made under this subsection may be reviewed as provided in section 103.</text>
							</paragraph><paragraph display-inline="no-display-inline" id="HA7F6860D38BC4ED586C7F23295A54B54"><enum>(5)</enum><text>If such application for approval is denied, or in any other case where the production of tangible
			 things is terminated and no order is issued approving the production, no
			 information obtained or evidence derived from such production shall be
			 received in evidence or otherwise disclosed in any trial, hearing, or
			 other proceeding in or before any court, grand jury, department, office,
			 agency, regulatory body, legislative committee, or other authority of the
			 United States, a State, or political subdivision thereof, and no
			 information concerning any United States person acquired from such
			 production shall subsequently be used or disclosed in any other manner by
			 Federal officers or employees without the consent of such person, except
			 with the approval of the Attorney General if the information indicates a
			 threat of death or serious bodily harm to any person.</text>
							</paragraph><paragraph display-inline="no-display-inline" id="H583AF48D93B543BFB1A7978DB2818827"><enum>(6)</enum><text>The Attorney General shall assess compliance with the requirements of paragraph (5).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="H90883FB53BCC42879A2EE96B8BD91BA6"><enum>(b)</enum><header>Conforming amendment</header><text>Section 501(d) (<external-xref legal-doc="usc" parsable-cite="usc/50/1861">50 U.S.C. 1861(d)</external-xref>) is amended—</text>
					<paragraph id="H951D49966903440C9A12D73B165A1764"><enum>(1)</enum><text>in paragraph (1)—</text>
						<subparagraph id="HC8421107003C45E4BB82B5788898E260"><enum>(A)</enum><text>in the matter preceding subparagraph (A), by striking <quote>pursuant to an order</quote> and inserting <quote>pursuant to an order issued or an emergency production required</quote>;</text>
						</subparagraph><subparagraph id="HEC3723A6A6A3424AB6322F6A83FB69D3"><enum>(B)</enum><text>in subparagraph (A), by striking <quote>such order</quote> and inserting <quote>such order or such emergency production</quote>; and</text>
						</subparagraph><subparagraph id="H68FC7A0B445E48689C87124E3AE98784"><enum>(C)</enum><text>in subparagraph (B), by striking <quote>the order</quote> and inserting <quote>the order or the emergency production</quote>; and</text>
						</subparagraph></paragraph><paragraph id="H8EBA61C309B944679DAA98045B9F15BD"><enum>(2)</enum><text>in paragraph (2)—</text>
						<subparagraph id="HC898CD14326642B8B5DAE5079BBFE061"><enum>(A)</enum><text>in subparagraph (A), by striking <quote>an order</quote> and inserting <quote>an order or emergency production</quote>; and</text>
						</subparagraph><subparagraph id="H3BCD9115F9B5491FBD7552042168976D"><enum>(B)</enum><text>in subparagraph (B), by striking <quote>an order</quote> and inserting <quote>an order or emergency production</quote>.</text>
						</subparagraph></paragraph></subsection></section><section commented="no" id="H68C5A1A29C59443995AA46F50FFDD724"><enum>103.</enum><header>Prohibition on bulk collection of tangible things</header>
				<subsection commented="no" id="H35DC1FAB33F54CA892EC54F02E238587"><enum>(a)</enum><header>Application</header><text display-inline="yes-display-inline">Section 501(b)(2) (<external-xref legal-doc="usc" parsable-cite="usc/50/1861">50 U.S.C. 1861(b)(2)</external-xref>), as amended by section 101(a) of this Act, is further amended by inserting before subparagraph
			 (B), as redesignated by such section 101(a) of this Act, the following new
			 subparagraph:</text>
					<quoted-block display-inline="no-display-inline" id="H27C08D3FDDA14D8E8936AEDA14A7A5FA" style="traditional">
						<subparagraph commented="no" id="H1FAFD44E47BF4A7D913B13E5520D6B8C"><enum>(A)</enum><text>a specific selection term to be used as the basis for the production of the tangible things sought;</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection commented="no" id="H121B78C81E7743FDA728139AF26EF12D"><enum>(b)</enum><header>Order</header><text>Section 501(c) (<external-xref legal-doc="usc" parsable-cite="usc/50/1861">50 U.S.C. 1861(c)</external-xref>) is amended—</text>
					<paragraph id="HBC02F6FEB75A4B039C78B9075F250B29"><enum>(1)</enum><text>in paragraph (2)(A), by striking the semicolon and inserting <quote>, including each specific selection term to be used as the basis for the production;</quote>; and</text>
					</paragraph><paragraph id="H61398A5EAB424100A1D92F710E63B9FE"><enum>(2)</enum><text>by adding at the end the following new paragraph:</text>
						<quoted-block display-inline="no-display-inline" id="HFA540EFC7FBD4CF98FBE68E12F127E00" style="traditional">
							<paragraph id="H20DFE87F47F447A488DF267B454E4022" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">No order issued under this subsection may authorize the collection of tangible things without the
			 use of a specific selection term that meets the requirements of subsection
			 (b)(2).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection></section><section id="H1970732826804AB0BD90B3442F9EAA11"><enum>104.</enum><header>Judicial review of minimization procedures for the production of tangible things</header><text display-inline="no-display-inline">Section 501(c)(1) (<external-xref legal-doc="usc" parsable-cite="usc/50/1861">50 U.S.C. 1861(c)(1)</external-xref>) is amended by inserting after <quote>subsections (a) and (b)</quote> the following: <quote>and that the minimization procedures submitted in accordance with subsection (b)(2)(D) meet the
			 definition of minimization procedures under subsection (g)</quote>.</text>
			</section><section id="HB1F05C57C21E424CBC90AE1F6EA77F55"><enum>105.</enum><header>Liability protection</header><text display-inline="no-display-inline">Section 501(e) (<external-xref legal-doc="usc" parsable-cite="usc/50/1861">50 U.S.C. 1861(e)</external-xref>) is amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="H30B8F5F13C5D462DB9E2FDACA0764C0C" style="OLC">
					<subsection id="H15E28B64642D46779B107335837089AF"><enum>(e)</enum>
						<paragraph commented="no" display-inline="yes-display-inline" id="HC469978A4FC242018BC78BF2DCAAB725"><enum>(1)</enum><text>No cause of action shall lie in any court against a person who—</text>
							<subparagraph id="HC9807FB6635E4880A02ACAD39903526C" indent="up1"><enum>(A)</enum><text>produces tangible things or provides information, facilities, or technical assistance pursuant to
			 an order issued or an emergency production required under this section; or</text>
							</subparagraph><subparagraph id="HB24A938CE6C044E5B70ECDDCAEBA90B1" indent="up1"><enum>(B)</enum><text>otherwise provides technical assistance to the Government under this section or to implement the
			 amendments made to this section by the USA FREEDOM Act.</text>
							</subparagraph></paragraph><paragraph id="HE716F5B56DFD422E8C0B982688DE432F" indent="up1"><enum>(2)</enum><text>A production or provision of information, facilities, or technical assistance described in
			 paragraph (1) shall not be deemed to constitute a waiver of any privilege
			 in any other proceeding or context.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="H390C458A555C4953B4596CCE9648D763"><enum>106.</enum><header>Compensation for assistance</header><text display-inline="no-display-inline">Section 501 (<external-xref legal-doc="usc" parsable-cite="usc/50/1861">50 U.S.C. 1861</external-xref>), as amended by section 102 of this Act, is further amended by adding at the end the following new
			 subsection:</text>
				<quoted-block display-inline="no-display-inline" id="H2A22B01CA431416DAFF65C6D3C8A5AAC" style="OLC">
					<subsection id="H5FCA7357506444448110F00E7AE8A6BF"><enum>(j)</enum><header>Compensation</header><text display-inline="yes-display-inline">The Government shall compensate a person for reasonable expenses incurred for—</text>
						<paragraph id="H834E534A238E4B59B5B92185C34571FD"><enum>(1)</enum><text>producing tangible things or providing information, facilities, or assistance in accordance with an
			 order issued with respect to an application described in subsection
			 (b)(2)(C) or an emergency production under subsection (i) that, to comply
			 with subsection (i)(1)(D), requires an application described in subsection
			 (b)(2)(C); or</text>
						</paragraph><paragraph id="HC17BC40414094D44B697CA5B6C563339"><enum>(2)</enum><text>otherwise providing technical assistance to the Government under this section or to implement the
			 amendments made to this section by the USA FREEDOM Act.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="HB2A6E1CF01DA439E9E793DF9F563E13E"><enum>107.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 501 (<external-xref legal-doc="usc" parsable-cite="usc/50/1861">50 U.S.C. 1861</external-xref>), as amended by section 106 of this Act, is further amended by adding at the end the following new
			 subsection:</text>

							<subparagraph id="HAD6DE92379C84D0B9759D041EA24764F"><enum>(A)</enum><text>means session identifying information (including originating or terminating telephone number,
			 International Mobile Subscriber Identity number, or International Mobile
			 Station Equipment Identity number), a telephone calling card number, or
			 the time or duration of a call; and</text>
							</subparagraph><subparagraph id="H55417C895D7B416AB33A116821441744"><enum>(B)</enum><text>does not include—</text>
								<clause id="HFDACBA392BF545D795EFC9949E8B274A"><enum>(i)</enum><text>the contents of any communication (as defined in <external-xref legal-doc="usc" parsable-cite="usc/18/2510">section 2510(8)</external-xref> of title 18, United States Code);</text>
								</clause><clause id="H39C06B1CCD91493EAC32B07A30ED6BD8"><enum>(ii)</enum><text>the name, address, or financial information of a subscriber or customer; or</text>
								</clause><clause id="HD244A5B3B77F4539AB95E0962E51728A"><enum>(iii)</enum><text>cell site location information.</text>
								</clause></subparagraph></paragraph><paragraph commented="no" id="H4ED70DEE539F44BA8BA21A1DBDC80DAA"><enum>(2)</enum><header>Specific selection term</header><text display-inline="yes-display-inline">The term <quote>specific selection term</quote> means a discrete term, such as a term specifically identifying a person, entity, account, address,
			 or device, used by the Government to limit the scope of the information or
			 tangible things sought pursuant to the statute authorizing the provision
			 of such information or tangible things to the Government.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="H362DAE5B94AD48C39738655C103C40AD"><enum>108.</enum><header>Inspector general reports on business records orders</header><text display-inline="no-display-inline">Section 106A of the USA PATRIOT Improvement and Reauthorization Act of 2005 (<external-xref legal-doc="public-law" parsable-cite="pl/109/177">Public Law 109–177</external-xref>; 120 Stat. 200) is amended—</text>
				<paragraph id="HCB6D81BBE83C4CFC9E72241EEF7DAA80"><enum>(1)</enum><text>in subsection (b)—</text>
					<subparagraph id="H4F24A8C03B144994B31F2F954F00EC87"><enum>(A)</enum><text>in paragraph (1), by inserting <quote>and calendar years 2012 through 2014</quote> after <quote>2006</quote>;</text>

			 of the Intelligence Community shall assess—</text>
								<subparagraph id="H7B0159BA8DF24FE7A034D9E327AF7C98"><enum>(A)</enum><text>the importance of the information acquired under title V of the Foreign Intelligence Surveillance
			 Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1861">50 U.S.C. 1861 et seq.</external-xref>) to the activities of the intelligence community;</text>
								</subparagraph><subparagraph id="H887AF275E5F24A1394DAB657E744C60D"><enum>(B)</enum><text>the manner in which that information was collected, retained, analyzed, and disseminated by the
			 intelligence community;</text>
								</subparagraph><subparagraph id="HFB0D43049B2E42EBAE817B8913AC3581"><enum>(C)</enum><text>the minimization procedures used by elements of the intelligence community under such title and
			 whether the minimization procedures adequately protect the constitutional
			 rights of United States persons; and</text>
								</subparagraph><subparagraph id="HA77FB157D9864BFC94808E5F7097F5EA"><enum>(D)</enum><text>any minimization procedures proposed by an element of the intelligence community under such title
			 that were modified or denied by the court established under section 103(a)
			 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1803">50 U.S.C. 1803(a)</external-xref>).</text>
								</subparagraph></paragraph><paragraph id="H1687CF4EC2624935A68BF2813210FAE7"><enum>(2)</enum><header>Submission date for assessment</header><text>Not later than 180 days after the date on which the Inspector General of the Department of Justice
			 submits the report required under subsection (c)(3), the Inspector General
			 of the Intelligence Community shall submit to the Committee on the
			 Judiciary and the Select Committee on Intelligence of the Senate and the
			 Committee on the Judiciary and the Permanent Select Committee on
			 Intelligence of the House of Representatives a report containing the
			 results of the assessment for calendar years 2012 through 2014.</text></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block>
				</paragraph><paragraph id="HFFF224CEEBA94ED4B839DDE338BFFAA5"><enum>(5)</enum><text>in subsection (e), as redesignated by paragraph (3)—</text>
					<subparagraph id="H80FD92C17C0A4D9182F5F65DBAB01FFA"><enum>(A)</enum><text>in paragraph (1)—</text>

				<subsection id="HCBA7C7CC18994D20A223126506CCA3AE"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The amendments made by sections 101 through 103 shall take effect on the date that is 180 days
			 after the date of the enactment of this Act.</text>
				</subsection><subsection commented="no" id="HBBE272D96E3A4964A89317FDFCA20596"><enum>(b)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">Nothing in this Act shall be construed to alter or eliminate the authority of the Government to
			 obtain an order under title V of the Foreign Intelligence Surveillance Act
			 of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1861">50 U.S.C. 1861 et seq.</external-xref>) as in effect prior to the effective date described in subsection (a) during the period ending on
			 such effective date.</text>
				</subsection></section><section id="HDCE6CFF044444101B576D53B280CE5A1"><enum>110.</enum><header>Rule of construction</header><text display-inline="no-display-inline">Nothing in this Act shall be construed to authorize the production of the contents (as such term is
			 defined in <external-xref legal-doc="usc" parsable-cite="usc/18/2510">section 2510(8)</external-xref> of title 18, United States Code) of any electronic communication from an electronic communication
			 service provider (as such term is defined in section 701(b)(4) of the
			 Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1881">50 U.S.C. 1881(b)(4)</external-xref>) under title V of the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1861">50 U.S.C. 1861 et seq.</external-xref>).</text>

						<subsection id="H5ACFE185E6494E1FA86F57BE35A80189"><enum>(h)</enum><text display-inline="yes-display-inline">The Attorney General shall ensure that appropriate policies and procedures are in place to
			 safeguard nonpublicly available information concerning United States
			 persons that is collected through the use of a pen register or trap and
			 trace device installed under this section. Such policies and procedures
			 shall, to the maximum extent practicable and consistent with the need to
			 protect national security, include protections for the collection,
			 retention, and use of information concerning United States persons.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="H7D7DE3467BBC41B287C75795B9E93F91"><enum>(b)</enum><header>Emergency authority</header><text>Section 403 (<external-xref legal-doc="usc" parsable-cite="usc/50/1843">50 U.S.C. 1843</external-xref>) is amended by adding at the end the following new subsection:</text>

			 section shall be subject to the policies and procedures required under

				</subsection></section></title><title id="HF49438DCB064436488A8186586019FAA"><enum>III</enum><header>FISA acquisitions targeting persons outside the United States reforms</header>
			<section commented="no" id="HE6B7CC28274D46DFAD594D479840AB66"><enum>301.</enum><header>Minimization procedures</header><text display-inline="no-display-inline">Section 702(e)(1) (<external-xref legal-doc="usc" parsable-cite="usc/50/1881a">50 U.S.C. 1881a(e)(1)</external-xref>) is amended—</text>
				<paragraph commented="no" id="HB895E54BE431448B821F0E1F8A927466"><enum>(1)</enum><text>by striking <quote>that meet</quote> and inserting the following:</text>

			 which the sender and all intended recipients are determined to be located
			 in the United States at the time of acquisition, consistent with the need
			 of the United States to obtain, produce, and disseminate foreign
			 intelligence information; and</text>
							</clause><clause id="H12DBC5B8FB2647E1907B9F07DEB79007"><enum>(ii)</enum><text display-inline="yes-display-inline">prohibit the use of any discrete communication that is not to, from, or about the target of an
			 acquisition and is to or from an identifiable United States person or a
			 person reasonably believed to be located in the United States, except to
			 protect against an immediate threat to human life.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></section><section commented="no" display-inline="no-display-inline" id="HE6EA5E12174C467CB1CF7C13B56C8F86" section-type="subsequent-section"><enum>302.</enum><header display-inline="yes-display-inline">Limits on use of unlawfully obtained information</header><text display-inline="no-display-inline">Section 702(i)(3) (<external-xref legal-doc="usc" parsable-cite="usc/50/1881a">50 U.S.C. 1881a(i)(3)</external-xref>) is amended by adding at the end the following new subparagraph:</text>

			 certification or procedures under subparagraph (B), no information
			 obtained or evidence derived pursuant to the part of the certification or
			 procedures that has been identified by the Court as deficient concerning
			 any United States person shall be received in evidence or otherwise
			 disclosed in any trial, hearing, or other proceeding in or before any
			 court, grand jury, department, office, agency, regulatory body,
			 legislative committee, or other authority of the United States, a State,
			 or political subdivision thereof, and no information concerning any United
			 States person acquired pursuant to such part of such certification shall
			 subsequently be used or disclosed in any other manner by Federal officers
			 or employees without the consent of the United States person, except with
			 the approval of the Attorney General if the information indicates a threat
			 of death or serious bodily harm to any person.</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="H4E73EDBCA6C64C078E620F750835DA65"><enum>(ii)</enum><header display-inline="yes-display-inline">Exception</header><text display-inline="yes-display-inline">If the Government corrects any deficiency identified by the order of the Court under subparagraph
			 (B), the Court may permit the use or disclosure of information obtained
			 before the date of the correction under such minimization procedures as
			 the Court shall establish for purposes of this clause.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</section></title><title id="HFFD420E0EEFB4532B08131B1DA916108"><enum>IV</enum><header>Foreign Intelligence Surveillance Court reforms</header>
			<section commented="no" id="H52A6FFC2F5A046ED83B4604D07BC44A6"><enum>401.</enum><header>Appointment of amicus curiae</header><text display-inline="no-display-inline">Section 103 (<external-xref legal-doc="usc" parsable-cite="usc/50/1803">50 U.S.C. 1803</external-xref>) is amended by adding at the end the following new subsection:</text>
				<quoted-block display-inline="no-display-inline" id="H4A8805F917A34D4A9486644B16FACD47" style="OLC">
					<subsection commented="no" id="HE4C1ED552D684EB98421E4DB3A983B44"><enum>(i)</enum><header>Amicus curiae</header>
						<paragraph commented="no" id="H8BBFD675678C4339827D9C287AB9E331"><enum>(1)</enum><header>Authorization</header><text display-inline="yes-display-inline">A court established under subsection (a) or (b), consistent with the requirement of subsection (c)
			 and any other statutory requirement that the court act expeditiously or
			 within a stated time—</text>
							<subparagraph id="H48C6BD1AE41E4841B449B31361568BF4"><enum>(A)</enum><text>shall appoint an individual to serve as amicus curiae to assist such court in the consideration of
			 any application for an order or review that, in the opinion of the court,
			 presents a novel or significant interpretation of the law, unless the
			 court issues a written finding that such appointment is not appropriate;
			 and</text>
							</subparagraph><subparagraph id="H245169624CF0443393EA7586111E98E2"><enum>(B)</enum><text>may appoint an individual to serve as amicus curiae in any other instance as such court deems
			 appropriate.</text>
							</subparagraph></paragraph><paragraph commented="no" id="H267848A51516434DAF23ABB126D9BD1E"><enum>(2)</enum><header>Designation</header><text display-inline="yes-display-inline">The presiding judges of the courts established under subsections (a) and (b) shall jointly
			 designate not less than 5 individuals to be eligible to serve as amicus
			 curiae. Such individuals shall be persons who possess expertise in privacy
			 and civil liberties, intelligence collection, telecommunications, or any
			 other area that may lend legal or technical expertise to the courts and
			 who have been determined by appropriate executive branch officials to be
			 eligible for access to classified information.</text>
						</paragraph><paragraph commented="no" id="H47D976D448F04433B47C44FE83B75A81"><enum>(3)</enum><header>Duties</header><text display-inline="yes-display-inline">An individual appointed to serve as amicus curiae under paragraph (1) shall carry out the duties
			 assigned by the appointing court. Such court may authorize the individual
			 appointed to serve as amicus curiae to review any application,
			 certification, petition, motion, or other submission that the court
			 determines is relevant to the duties assigned by the court.</text>
						</paragraph><paragraph commented="no" id="HEF361205060745179922E48FCD08EDB3"><enum>(4)</enum><header>Notification</header><text display-inline="yes-display-inline">The presiding judges of the courts established under subsections (a) and (b) shall notify the
			 Attorney General of each exercise of the authority to appoint an
			 individual to serve as amicus curiae under paragraph (1).</text>
						</paragraph><paragraph commented="no" id="H01E4B419FFEB417F857F3BA1A42FD5FA"><enum>(5)</enum><header>Assistance</header><text>A court established under subsection (a) or (b) may request and receive (including on a
			 non-reimbursable basis) the assistance of the executive branch in the
			 implementation of this subsection.</text>
						</paragraph><paragraph commented="no" id="H47A7D74F26F6439FA79F6EBEA7BE30B5"><enum>(6)</enum><header>Administration</header><text>A court established under subsection (a) or (b) may provide for the designation, appointment,
			 removal, training, or other support for an individual appointed to serve
			 as amicus curiae under paragraph (1) in a manner that is not inconsistent
			 with this subsection.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="H0CAA54021D2444BAA92243450A519C7C"><enum>402.</enum><header>Declassification of decisions, orders, and opinions</header>
				<subsection id="H81F07A7EA246473F96E11F9DDB2508CD"><enum>(a)</enum><header>Declassification</header><text display-inline="yes-display-inline">Title VI (<external-xref legal-doc="usc" parsable-cite="usc/50/1871">50 U.S.C. 1871 et seq.</external-xref>) is amended—</text>
					<paragraph id="HF0132737FEE945448D2876594B72A8DF"><enum>(1)</enum><text display-inline="yes-display-inline">in the heading, by striking <quote><header-in-text level="title" style="OLC">Reporting Requirement</header-in-text></quote> and inserting <quote><header-in-text level="title" style="OLC">Oversight</header-in-text></quote>; and</text>
					</paragraph><paragraph id="HDA0D9D86FCA840AF92F9A0DD555C2B63"><enum>(2)</enum><text>by adding at the end the following new section:</text>

							<section id="HF6166EACAF4B482EB3C89F1F0C0C551C"><enum>602.</enum><header>Declassification of significant decisions, orders, and opinions</header>
								<subsection id="HD53E697F6A3C44868823852129B58AD9"><enum>(a)</enum><header>Declassification required</header><text display-inline="yes-display-inline">Subject to subsection (b), the Director of National Intelligence, in consultation with the Attorney
			 General, shall conduct a declassification review of each decision, order,
			 or opinion issued by the Foreign Intelligence Surveillance Court or the
			 Foreign Intelligence Surveillance Court of Review (as defined in section
			 601(e)) that includes a significant construction or interpretation of any
			 provision of this Act, including a construction or interpretation of the
			 term <quote>specific selection term</quote>, and, consistent with that review, make publicly available to the greatest extent practicable each
			 such decision, order, or opinion.</text>
								</subsection><subsection id="HD46C5E90C9B640C091999AC8F75B39C2"><enum>(b)</enum><header>Redacted form</header><text>The Director of National Intelligence, in consultation with the Attorney General, may satisfy the
			 requirement under subsection (a) to make a decision, order, or opinion
			 described in such subsection publicly available to the greatest extent
			 practicable by making such decision, order, or opinion publicly available
			 in redacted form.</text>
								</subsection><subsection id="H67B347E75C944C27939A05DD8A035273"><enum>(c)</enum><header>National security waiver</header><text>The Director of National Intelligence, in consultation with the Attorney General, may waive the
			 requirement to declassify and make publicly available a particular
			 decision, order, or opinion under subsection (a) if—</text>
									<paragraph id="H54C48AEF336E42E8A554707114EFE3B5"><enum>(1)</enum><text display-inline="yes-display-inline">the Director of National Intelligence, in consultation with the Attorney General, determines that a
			 waiver of such requirement is necessary to protect the national security
			 of the United States or properly classified intelligence sources or
			 methods; and</text>
									</paragraph><paragraph id="H54FDE149EA6D4CC99489AB095699D405"><enum>(2)</enum><text display-inline="yes-display-inline">the Director of National Intelligence makes publicly available an unclassified statement prepared
			 by the Attorney General, in consultation with the Director of National
			 Intelligence—</text>
										<subparagraph id="H33E37795F77E4A8AB23FF89547D8B7E5"><enum>(A)</enum><text>summarizing the significant construction or interpretation of a provision under this Act; and</text>
										</subparagraph><subparagraph id="HE9852F014ABD472AB67A74902EACAAB9"><enum>(B)</enum><text>that specifies that the statement has been prepared by the Attorney General and constitutes no part
			 of the opinion of the Foreign Intelligence Surveillance Court or the
			 Foreign Intelligence Surveillance Court of Review.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection id="H2A9C3702A463469893D0F72689175079"><enum>(b)</enum><header>Table of contents amendments</header><text>The table of contents in the first section is amended—</text>

			 section:</text>

			 Permanent Select Committee on Intelligence and the Committee on the
			 Judiciary of the House of Representatives and the Select Committee on
			 Intelligence and the Committee on the Judiciary of the Senate and, subject
			 to a declassification review by the Attorney General and Director of
			 National Intelligence, make publicly available on an Internet website—</text>
								<paragraph id="H775E2202652E49B8857053E526A030ED"><enum>(1)</enum><text>the number of orders entered under each of sections 105, 304, 402, 501, 702, 703, and 704;</text>
								</paragraph><paragraph id="HCF786B2D1F964E16849E5FD3F854D1AE"><enum>(2)</enum><text>the number of orders modified under each of those sections;</text>
								</paragraph><paragraph id="HB7CDA5336A454B649031A1162C069921"><enum>(3)</enum><text>the number of orders denied under each of those sections; and</text>
								</paragraph><paragraph id="H17F5B80EB3814435A93ABA50AD996463"><enum>(4)</enum><text display-inline="yes-display-inline">the number of appointments of an individual to serve as amicus curiae under section 103, including
			 the name of each individual appointed to serve as amicus curiae.</text>
								</paragraph></subsection><subsection id="H4BB59B182CEF4ED38D8BF496AB1B865E"><enum>(b)</enum><header>Report by Director of National Intelligence</header><text>The Director of National Intelligence shall annually make publicly available a report that
			 identifies, for the preceding 12-month period—</text>
								<paragraph id="H93AC601B995146D6A20E064A37C1D2F3"><enum>(1)</enum><text>the total number of orders issued pursuant titles I and III and sections 703 and 704 and the
			 estimated number of targets affected by such orders;</text>
								</paragraph><paragraph id="HA2E127054F66463CA80FC9FFF379D608"><enum>(2)</enum><text>the total number of orders issued pursuant to section 702 and the estimated number of targets
			 affected by such orders;</text>
								</paragraph><paragraph id="H6CB697C8E574454A91BC8D420ABD8C41"><enum>(3)</enum><text>the total number of orders issued pursuant to title IV and the estimated number of targets affected
			 by such orders;</text>
								</paragraph><paragraph id="H2CC9FA8569DF4AE78DE8618177671DD9"><enum>(4)</enum><text>the total number of orders issued pursuant to applications made under section 501(b)(2)(B) and the
			 estimated number of targets affected by such orders;</text>
								</paragraph><paragraph id="H7FFDE5C7CD81465CAFCA8F07A9C1F2C0"><enum>(5)</enum><text>the total number of orders issued pursuant to applications made under section 501(b)(2)(C) and the
			 estimated number of targets affected by such orders; and</text>
								</paragraph><paragraph id="H3567A7F4FA6046009F271E6184A43FD4"><enum>(6)</enum><text>the total number of national Security letters issued and the number of requests for information
			 contained within such national security letters.</text>
								</paragraph></subsection><subsection display-inline="no-display-inline" id="H8FB4570D277346F9802B6264C589C7FA"><enum>(c)</enum><header>National security letter defined</header><text>The term <quote>national security letter</quote> means any of the following provisions:</text>

				<subsection id="HE79ABC935A8B45D982E71A1D846F8398"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Title VI (<external-xref legal-doc="usc" parsable-cite="usc/50/1871">50 U.S.C. 1871 et seq.</external-xref>), as amended by section 603 of this Act, is further amended by adding at the end the following new
			 section:</text>
					<quoted-block display-inline="no-display-inline" id="HA782237931924347A8B9CD33A90AAFF6" style="OLC">
						<section id="H85C72C6C243D415A833F94D9F39728B1"><enum>604.</enum><header>Public reporting by persons subject to orders</header>
							<subsection id="H5E571BEA52AE46E28ECDFEF6C0FF5ED3"><enum>(a)</enum><header>Reporting</header><text display-inline="yes-display-inline">A person may semiannually publicly report the following information with respect to the preceding
			 half year using one of the following structures:</text>
								<paragraph id="H37D4E5E14BE04B8988CFE55465BB68EF"><enum>(1)</enum><text>Subject to subsection (b), a report that aggregates the number of orders or national security
			 letters the person was required to comply with in the following separate
			 categories:</text>
									<subparagraph id="H490C008D90F243FE960EBD150641F8D3"><enum>(A)</enum><text>The number of national security letters received, reported in bands of 1000 starting with 0-999.</text>
									</subparagraph><subparagraph id="H75A86484BA144EC98B869973151CD21F"><enum>(B)</enum><text>The number of customer accounts affected by national security letters, reported in bands of 1000
			 starting with 0-999.</text>
									</subparagraph><subparagraph id="HE2AC2305B6574B6AA122F92063330468"><enum>(C)</enum><text>The number of orders under this Act for content, reported in bands of 1000 starting with 0-999.</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H6925355D630049C89C72C52AB002CF98"><enum>(D)</enum><text>With respect to content orders under this Act, in bands of 1000 starting with 0-999, the number of
			 customer accounts affected under orders under title I;</text>
									</subparagraph><subparagraph id="H7E576D1C4F5945B0BCC5F390FF83F56B"><enum>(E)</enum><text>The number of orders under this Act for non-content, reported in bands of 1000 starting with 0-999.</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HB9B2C4B3C5844463A29898C73B16119B"><enum>(F)</enum><text>With respect to non-content orders under this Act, in bands of 1000 starting with 0-999, the number
			 of customer accounts affected under orders under—</text>
										<clause commented="no" id="HFE8A3FC604364CC595D3D5ADB2B86587"><enum>(i)</enum><text>title IV;</text>
										</clause><clause commented="no" id="H0AD6530A281C457BA437452316C14C45"><enum>(ii)</enum><text>title V with respect to applications described in section 501(b)(2)(B); and</text>
										</clause><clause commented="no" id="HBC4633A417754520916956AB1577374F"><enum>(iii)</enum><text>title V with respect to applications described in section 501(b)(2)(C).</text>
										</clause></subparagraph></paragraph><paragraph id="H939CC313F2FE44CE9A5AFC983BDD202E"><enum>(2)</enum><text display-inline="yes-display-inline">A report that aggregates the number of orders, directives, or national security letters the person
			 was required to comply with in the following separate categories:</text>
									<subparagraph id="HEAE2F0D3CF5B49E2A7861E03BC25B34F"><enum>(A)</enum><text>The total number of all national security process received, including all national security letters
			 and orders or directives under this Act, reported as a single number in a
			 band of 0-249 and thereafter in bands of 250.</text>
									</subparagraph><subparagraph id="H12F9CA5B2C884EE88A0311AD574BCBBD"><enum>(B)</enum><text display-inline="yes-display-inline">The total number of customer selectors targeted under all national security process received,
			 including all national security letters and orders or directives under
			 this Act, reported as a single number in a band of 0-249 and thereafter in
			 bands of 250.</text>
									</subparagraph></paragraph><paragraph id="H8191BA2CC9FE48E1B88890E4B7B9EFC7"><enum>(3)</enum><text display-inline="yes-display-inline">Subject to subsection (b), a report that aggregates the number of orders or national security
			 letters the person was required to comply with in the following separate
			 categories:</text>
									<subparagraph id="HDF915D9FCD2F48C8BF7116BC2CD8DE75"><enum>(A)</enum><text>The number of national security letters received, reported in bands of 500 starting with 0-499.</text>
									</subparagraph><subparagraph id="H2BE5C4A475BE4C91990F380DD4F60CED"><enum>(B)</enum><text>The number of customer accounts affected by national security letters, reported in bands of 500
			 starting with 0-499.</text>
									</subparagraph><subparagraph id="HC8AC9E55756B4BEBA378B8201A2D0551"><enum>(C)</enum><text>The number of orders under this Act for content, reported in bands of 500 starting with 0-499.</text>
									</subparagraph><subparagraph id="H6D2136B5892F4E8EA395B5043EBB0B69"><enum>(D)</enum><text>The number of customer selectors targeted under such orders, in bands of 500 starting with 0-499.</text>
									</subparagraph><subparagraph id="H102681D7505543599FB55248BFEE3EDA"><enum>(E)</enum><text>The number of orders under this Act for non-content, reported in bands of 500 starting with 0-499.</text>
									</subparagraph><subparagraph id="HD9BEF51D40BB4C07AC84049DC55EE9F4"><enum>(F)</enum><text>The number of customer selectors targeted under such orders, reported in bands of 500 starting with
			 0-499.</text>
									</subparagraph></paragraph></subsection><subsection id="HA5EEFBDA5CD443FDAF68667BAD4AE79A"><enum>(b)</enum><header>Period of time covered by reports</header><text>With respect to a report described in paragraph (1) or (3) of subsection (a), such report shall
			 only include information—</text>
								<paragraph id="H2EA7A7805C91469EB6C560BF0DC90F31"><enum>(1)</enum><text>except as provided in paragraph (2), for the period of time ending on the date that is at least 180
			 days before the date of the publication of such report; and</text>
								</paragraph><paragraph id="HB89B9DE46FF8467AA3250B0FD4FE637C"><enum>(2)</enum><text display-inline="yes-display-inline">with respect to an order under this Act or national security letter received with respect to a
			 platform, product, or service for which a person did not previously
			 receive such an order or national security letter (not including an
			 enhancement to or iteration of an existing publicly available platform,
			 product, or service), for the period of time ending on the date that is at
			 least 2 years before the date of the publication of such report.</text>
								</paragraph></subsection><subsection commented="no" id="HCBEE0D57EDC74E5DB6AE9265E9C22C0C"><enum>(c)</enum><header>Other forms of agreed to publication</header><text>Nothing in this section shall be construed to prohibit the Government and any person from jointly
			 agreeing to the publication of information referred to in this subsection
			 in a time, form, or manner other than as described in this section.</text>
							</subsection><subsection id="H983E8820E13147DDB8C0DACF265F50D8"><enum>(d)</enum><header>National security letter defined</header><text>The term <quote>national security letter</quote> has the meaning given the term in section 603.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="HB578CB0381254692A37B3D1AD5C2B15B"><enum>(b)</enum><header>Table of contents amendment</header><text display-inline="yes-display-inline">The table of contents in the first section, as amended by section 603 of this Act, is further

					<paragraph id="HE4002EDA90374B1F85D0679F62A9AB4E"><enum>(1)</enum><text display-inline="yes-display-inline">not later than 45 days after the date on which the Foreign Intelligence Surveillance Court or the
			 Foreign Intelligence Surveillance Court of Review issues a decision,
			 order, or opinion, including any denial or modification of an application
			 under this Act, that includes a significant construction or interpretation
			 of any provision of this Act or results in a change of application of any
			 provision of this Act or a new application of any provision of this Act, a
			 copy of such decision, order, or opinion and any pleadings, applications,
			 or memoranda of law associated with such decision, order, or opinion; and</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="HE28E7893BE1849579439EB3F3A0AD46E"><enum>606.</enum><header>Submission of reports under FISA</header>
				<subsection id="H7067B1523492402194E9F6C0F1978BA3"><enum>(a)</enum><header>Electronic surveillance</header><text>Section 108(a)(1) (<external-xref legal-doc="usc" parsable-cite="usc/50/1808">50 U.S.C. 1808(a)(1)</external-xref>) is amended by striking <quote>the House Permanent Select Committee on Intelligence and the Senate Select Committee on
			 Intelligence, and the Committee on the Judiciary of the Senate,</quote> and inserting <quote>the Permanent Select Committee on Intelligence and the Committee on the Judiciary of the House of
