			 gas pipelines or electric transmission facilities at the national boundary
			 of the United States for the import or export of oil, natural gas, or
			 electricity to or from Canada or Mexico, and for other purposes.<pagebreak></pagebreak></official-title>

		<section id="HCD9973EB5A9D4DEEB07333A00DF00CE7" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>North American Energy Infrastructure Act</short-title></quote>.</text>
		</section><section commented="no" id="H02BD5D445CC947D5BC1F30D5C3E793D5"><enum>2.</enum><header>Finding</header><text display-inline="no-display-inline">Congress finds that the United States should establish a more uniform, transparent, and modern
			 process for the construction, connection, operation, and maintenance of
			 oil and natural gas pipelines and electric transmission facilities for the
			 import and export of oil and natural gas and the transmission of
			 electricity to and from Canada and Mexico, in pursuit of a more secure and
			 efficient North American energy market.</text>
		</section><section id="H6CC67129A66148D0AB47F92DD0F3B839"><enum>3.</enum><header>Authorization of certain energy infrastructure projects at the national boundary of the United
			 States</header>
			<subsection id="H8C41FAE127CE47D0A325E1A5C5279EE7"><enum>(a)</enum><header>Authorization</header><text display-inline="yes-display-inline">Except as provided in subsection (c) and section 7, no person may construct, connect, operate, or
			 maintain a cross-border segment of an oil pipeline or electric
			 transmission facility for the import or export of oil or the transmission
			 of electricity to or from Canada or Mexico without obtaining a certificate
			 of crossing for the construction, connection, operation, or maintenance of
			 the cross-border segment under this section.</text>
			</subsection><subsection commented="no" id="HABDA980B2F0B48BBAEA0FE26ECA5E623"><enum>(b)</enum><header>Certificate of crossing</header>
				<paragraph id="H0BC03DB6CBEE4C5E83C4253A0020853E"><enum>(1)</enum><header>Requirement</header><text display-inline="yes-display-inline">Not later than 120 days after final action is taken under the National Environmental Policy Act of
			 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>) with respect to a cross-border segment for
			 which a request is received under this section, the relevant official
			 identified under paragraph (2), in consultation with appropriate Federal
			 agencies, shall issue a certificate of crossing for the cross-border
			 segment unless the relevant official finds that the construction,
			 connection, operation, or maintenance of the cross-border segment is not
			 in the public interest of the United States.</text>
				</paragraph><paragraph id="H9ABCFD2F7FD44DC78F1C8A5D01928748"><enum>(2)</enum><header>Relevant official</header><text>The relevant official referred to in paragraph (1) is—</text>
					<subparagraph id="H66CEC27D332F42C197EB298BCA5001C2"><enum>(A)</enum><text display-inline="yes-display-inline">the Secretary of State with respect to oil pipelines; and</text>
					</subparagraph><subparagraph id="H9EB0AF8DEA9E415DAD22B09B8F2017E8"><enum>(B)</enum><text>the Secretary of Energy with respect to electric transmission facilities.</text>
					</subparagraph></paragraph><paragraph id="H2A6ECF5B73F64DCC80CFF0A870BD718C"><enum>(3)</enum><header>Additional requirement for electric transmission facilities</header><text display-inline="yes-display-inline">In the case of a request for a certificate of crossing for the construction, connection, operation,
			 or maintenance of a cross-border segment of an electric transmission
			 facility, the Secretary of Energy shall require, as a condition of issuing
			 the certificate of crossing for the request under paragraph (1), that the
			 cross-border segment of the electric transmission facility be constructed,
			 connected, operated, or maintained consistent with all applicable policies
			 and standards of—</text>
					<subparagraph id="H12C3805AFCE8484F9CAED1242BFDB743"><enum>(A)</enum><text>the Electric Reliability Organization and the applicable regional entity; and</text>
					</subparagraph><subparagraph commented="no" id="H05C2DB633E254DB3ABE4D4CDA3B6FA87"><enum>(B)</enum><text display-inline="yes-display-inline">any Regional Transmission Organization or Independent System Operator with operational or
			 functional control over the cross-border segment of the electric
			 transmission facility.</text>
					</subparagraph></paragraph></subsection><subsection id="H08B70089F41F4022B2F531668B4786AD"><enum>(c)</enum><header>Exclusions</header><text display-inline="yes-display-inline">This section shall not apply to any construction, connection, operation, or maintenance of a
			 cross-border segment of an oil pipeline or electric transmission facility
			 for the import or export of oil or the transmission of electricity to or
			 from Canada or Mexico—</text>
				<paragraph id="H5E9E16C5214B4F068DEAC900A5B041D1"><enum>(1)</enum><text display-inline="yes-display-inline">if the cross-border segment is operating for such import, export, or transmission as of the date of
			 enactment of this Act;</text>
				</paragraph><paragraph id="HD33C3AF2689140E9B3CC42B0B271B8D1"><enum>(2)</enum><text>if a permit described in section 6 for such construction, connection, operation, or maintenance has
			 been issued;</text>
				</paragraph><paragraph id="HF128F84AAA124DE397FB0A0285355478"><enum>(3)</enum><text display-inline="yes-display-inline">if a certificate of crossing for such construction, connection, operation, or maintenance has
			 previously been issued under this section; or</text>
				</paragraph><paragraph commented="no" id="HC8815CD0945D4E169CBF3B3C38A8D23A"><enum>(4)</enum><text display-inline="yes-display-inline">if an application for a permit described in section 6 for such construction, connection, operation,
			 or maintenance is pending on the date of enactment of this Act, until the
			 earlier of—</text>
					<subparagraph commented="no" id="H88B9C41F10E44104A682A9D9B96044C3"><enum>(A)</enum><text>the date on which such application is denied; or</text>
					</subparagraph><subparagraph commented="no" id="H20CE4780A34B41C78817C05F4D81B7AA"><enum>(B)</enum><text>July 1, 2016.</text>
					</subparagraph></paragraph></subsection><subsection id="HBDE61FE9901B429D84717E7D4A2BF170"><enum>(d)</enum><header>Effect of other laws</header>
				<paragraph id="H2004A80E3B1446B3A36B8518A41EBEAC"><enum>(1)</enum><header>Application to projects</header><text>Nothing in this section or section 7 shall affect the application of any other Federal statute to a
			 project for which a certificate of crossing for the construction,
			 connection, operation, or maintenance of a cross-border segment is sought
			 under this section.</text>
				</paragraph><paragraph id="H56A889753F8F4CA389BD1636307CA494"><enum>(2)</enum><header>Natural Gas Act</header><text>Nothing in this section or section 7 shall affect the requirement to obtain approval or
			 authorization under sections 3 and 7 of the Natural Gas Act for the
			 siting, construction, or operation of any facility to import or export
			 natural gas.</text>
				</paragraph><paragraph id="H6DBEDC731B844C428A4C1DA930E8A4F5"><enum>(3)</enum><header>Energy Policy and Conservation Act</header><text>Nothing in this section or section 7 shall affect the authority of the President under section
			 103(a) of the Energy Policy and Conservation Act.</text>
				</paragraph></subsection></section><section id="H92BFC1DF02B24B9193D3539C151932B7"><enum>4.</enum><header>Importation or exportation of natural gas to Canada and Mexico</header><text display-inline="no-display-inline">Section 3(c) of the Natural Gas Act (<external-xref legal-doc="usc" parsable-cite="usc/15/717b">15 U.S.C. 717b(c)</external-xref>) is amended by adding at the end the
			 following: <quote><short-title>No order is required under subsection (a) to authorize the export or import of any natural gas to
			 or from Canada or Mexico.</short-title></quote>.</text>
		</section><section id="H5D96B91401644FFCA95A1B3CBD035D9A"><enum>5.</enum><header>Transmission of electric energy to Canada and Mexico</header>
			<subsection id="HE315AE81316C41DF89830246666910BC"><enum>(a)</enum><header>Repeal of requirement To secure order</header><text display-inline="yes-display-inline">Section 202(e) of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/824a">16 U.S.C. 824a(e)</external-xref>) is repealed.</text>
			</subsection><subsection id="H243977C1493C4B8791DFE2932076E639"><enum>(b)</enum><header>Conforming amendments</header>
				<paragraph id="H171D3B5CE30A4E23B7A48710B9585312"><enum>(1)</enum><header>State regulations</header><text>Section 202(f) of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/824a">16 U.S.C. 824a(f)</external-xref>) is amended by striking <quote><short-title>insofar as such State regulation does not conflict with the exercise of the Commission's powers
			 under or relating to subsection 202(e)</short-title></quote>.</text>
				</paragraph><paragraph id="H891EBDCEDFE94C53A0AF5D1200654315"><enum>(2)</enum><header>Seasonal diversity electricity exchange</header><text display-inline="yes-display-inline">Section 602(b) of the Public Utility Regulatory Policies Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/824a-4">16 U.S.C. 824a–4(b)</external-xref>) is
			 amended by striking <quote><short-title>the Commission has conducted hearings and made the findings required under section 202(e) of the
			 Federal Power Act</short-title></quote> and all that follows through the period at the end and inserting <quote><short-title>the Secretary has conducted hearings and finds that the proposed transmission facilities would not
			 impair the sufficiency of electric supply within the United States or
			 would not impede or tend to impede the coordination in the public interest
			 of facilities subject to the jurisdiction of the Secretary.</short-title></quote>.</text>
				</paragraph></subsection></section><section id="HC05C20084EDA450AAB9434703B542E53"><enum>6.</enum><header>No Presidential permit required</header><text display-inline="no-display-inline">No Presidential permit (or similar permit) required under Executive Order 13337 (3 U.S.C. 301
			 note), Executive Order 11423 (<external-xref legal-doc="usc" parsable-cite="usc/3/301">3 U.S.C. 301</external-xref> note), <external-xref legal-doc="usc" parsable-cite="usc/3/301">section 301</external-xref> of title 3,
			 United States Code, Executive Order 12038, Executive Order 10485, or any
			 other Executive Order shall be necessary for the construction, connection,
			 operation, or maintenance of an oil or natural gas pipeline or electric
			 transmission facility, or any cross-border segment thereof.</text>
		</section><section id="HD106951B84164333A8F5C5F7FDCE596E"><enum>7.</enum><header>Modifications to existing projects</header><text display-inline="no-display-inline">No certificate of crossing under section 3, or permit described in section 6, shall be required for
			 a modification to the construction, connection, operation, or maintenance
			 of an oil or natural gas pipeline or electric transmission facility—</text>
			<paragraph id="H457495DAEA3E406985235B71C642F62D"><enum>(1)</enum><text>that is operating for the import or export of oil or natural gas or the transmission of electricity
			 to or from Canada or Mexico as of the date of enactment of the Act;</text>
			</paragraph><paragraph id="H8AADA262DED54D608737BBE7BE773030"><enum>(2)</enum><text display-inline="yes-display-inline">for which a permit described in section 6 for such construction, connection, operation, or
			 maintenance has been issued; or</text>
			</paragraph><paragraph id="H4C11C233C4ED4A3F866D682BFBDB55F0"><enum>(3)</enum><text display-inline="yes-display-inline">for which a certificate of crossing for the cross-border segment of the pipeline or facility has
			 previously been issued under section 3.</text>
			</paragraph></section><section id="H3A250A0B0C5448C899CE94478DD7FE62"><enum>8.</enum><header>Effective date; rulemaking deadlines</header>
			<subsection id="HD4C66F758E5445F8914843142199F727"><enum>(a)</enum><header>Effective date</header><text display-inline="yes-display-inline">Sections 3 through 7, and the amendments made by such sections, shall take effect on July 1, 2015.</text>
			</subsection><subsection id="H151896E6ADE9418CA5749FE5C896D232"><enum>(b)</enum><header>Rulemaking deadlines</header><text>Each relevant official described in section 3(b)(2) shall—</text>
				<paragraph id="H9469204693CE4B91BB144E83AA91C10C"><enum>(1)</enum><text>not later than 180 days after the date of enactment of this Act, publish in the Federal Register
			 notice of a proposed rulemaking to carry out the applicable requirements
			 of section 3; and</text>
				</paragraph><paragraph id="HCB2B790F594B4B67AD71323B3FBD2046"><enum>(2)</enum><text display-inline="yes-display-inline">not later than 1 year after the date of enactment of this Act, publish in the Federal Register a
			 final rule to carry out the applicable requirements of section 3.</text>
				</paragraph></subsection></section><section id="HDFC3683FE39D4459A0DE1B11F6450D7E"><enum>9.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act—</text>
			<paragraph commented="no" id="HF922DDCD7FDA4D6593779E81AAD0ED81"><enum>(1)</enum><text>the term <term>cross-border segment</term> means the portion of an oil or natural gas pipeline or electric transmission facility that is
			 located at the national boundary of the United States with either Canada
			 or Mexico;</text>
			</paragraph><paragraph id="H8B0BDD7D3BE448C5922E024B2A1DB54D"><enum>(2)</enum><text>the term <term>modification</term> includes a reversal of flow direction, change in ownership, volume expansion, downstream or
			 upstream interconnection, or adjustment to maintain flow (such as a
			 reduction or increase in the number of pump or compressor stations);</text>
			</paragraph><paragraph id="H84F218307671476EB7E163A6A2BBB86B"><enum>(3)</enum><text>the term <term>natural gas</term> has the meaning given that term in section 2 of the Natural Gas Act (<external-xref legal-doc="usc" parsable-cite="usc/15/717a">15 U.S.C. 717a</external-xref>);</text>
			</paragraph><paragraph id="H2C7E4B185BE74FA0A5D087A51080B239"><enum>(4)</enum><text>the term <term>oil</term> means petroleum or a petroleum product;</text>
			</paragraph><paragraph commented="no" id="H78B29DEAE4A74D67BF974C66EF26AFFF"><enum>(5)</enum><text>the terms <term>Electric Reliability Organization</term> and <term>regional entity</term> have the meanings given those terms in section 215 of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/824o">16 U.S.C. 824o</external-xref>); and</text>
			</paragraph><paragraph commented="no" id="H7078C49F31FF4C1FB2303C9CAEFDC607"><enum>(6)</enum><text>the terms <term>Independent System Operator</term> and <term>Regional Transmission Organization</term> have the meanings given those terms in section 3 of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/796">16 U.S.C. 796</external-xref>).</text>
