		<section id="H8B1FA0092FFB454496FB6E5DEAE5EDBF" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Consumer Financial Freedom and Washington Accountability Act</short-title></quote>.</text>
		</section><section id="H198E92A9FEB54271B0EF160BE80155AB"><enum>2.</enum><header>Financial Product Safety Commission</header>
			<subsection id="H8C1CCB29D6254CC780F58A510C590D1A"><enum>(a)</enum><header>Establishment</header><text>Section 1011 of the Consumer Financial Protection Act of 2010 (<external-xref legal-doc="usc" parsable-cite="usc/12/5491">12 U.S.C. 5491</external-xref>) is amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="HD94ACE2F00A146FEBE5B14114C5EA1E0" style="OLC">
					<section id="H8268C5DF83984922840753AF914D0A5C"><enum>1011.</enum><header>Establishment of the Financial Product Safety Commission</header>
						<subsection id="HC1D24B6C1F2E496283807E6AB691B5BD"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">There is established an independent commission to be known as the <quote>Financial Product Safety Commission</quote> (hereinafter referred to in this section as the <quote>Commission</quote>), which shall regulate the offering and provision of consumer financial products or services under
			 the Federal consumer financial laws. The Commission shall be considered an
			 Executive agency, as defined in <external-xref legal-doc="usc" parsable-cite="usc/5/105">section 105</external-xref> of title 5, United States Code. Except as otherwise provided expressly by law, all Federal laws
			 dealing with public or Federal contracts, property, works, officers,
			 employees, budgets, or funds, including the provisions of chapters 5 and 7
			 of title 5, shall apply to the exercise of the powers of the Commission.</text>
						</subsection><subsection id="H17059B835D874E17945A2BE2D44AD2FC"><enum>(b)</enum><header>Authority To prescribe regulations</header><text display-inline="yes-display-inline">The Commission may prescribe such regulations and issue such orders in accordance with this title
			 as the Commission may determine to be necessary for carrying out this
			 title and all other laws within the Commission’s jurisdiction and shall
			 exercise any authorities granted under this title and all other laws
			 within the Commission’s jurisdiction.</text>
						</subsection><subsection id="H41E0E58C9CF0474995E63D0751C47705"><enum>(c)</enum><header>Composition of the Commission</header>
							<paragraph id="H3F7C1EE6519E40FCBADC95939285F9E4"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Commission shall be composed of the Vice Chairman for Supervision of the Federal Reserve System
			 and 4 additional members who shall be appointed by the President, by and
			 with the advice and consent of the Senate, from among individuals who—</text>
								<subparagraph id="HA216D8EC91BE4BE292E4B16ECC94A89D"><enum>(A)</enum><text>are citizens of the United States; and</text>
								</subparagraph><subparagraph id="H2FD6A8E85F0444E8A0E8B3C95F6DBD17"><enum>(B)</enum><text>have strong competencies and experiences related to consumer financial protection.</text>
								</subparagraph></paragraph><paragraph id="H981319CB36514CFAA9F2D2C5918C016E"><enum>(2)</enum><header>Staggering</header><text display-inline="yes-display-inline">The members of the Commission appointed under paragraph (1) shall serve staggered terms, which
			 initially shall be established by the President for terms of 1, 2, 4, and
			 5 years, respectively.</text>
							</paragraph><paragraph id="HCC3DABF5461F4A49ACB9607E5190CD55"><enum>(3)</enum><header>Terms</header>
								<subparagraph id="H4774F4E25073433BA0825F6C775054F4"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Each member of the Commission appointed under paragraph (1), including the Chair, shall serve for a
			 term of 5 years.</text>
								</subparagraph><subparagraph id="HFB683D92DA9C48168521B91E8799C8DF"><enum>(B)</enum><header>Removal</header><text display-inline="yes-display-inline">The President may remove any member of the Commission appointed under paragraph (1).</text>
								</subparagraph><subparagraph id="H1C718CB8FA1A488D9BA4147241B30127"><enum>(C)</enum><header>Vacancies</header><text display-inline="yes-display-inline">Any member of the Commission appointed under paragraph (1) appointed to fill a vacancy occurring
			 before the expiration of the term to which that member’s predecessor was
			 appointed (including the Chair) shall be appointed only for the remainder
			 of the term.</text>
								</subparagraph><subparagraph id="H52D50BD556194C3198EA7AFD7DD74D83"><enum>(D)</enum><header>Continuation of service</header><text display-inline="yes-display-inline">Each member of the Commission appointed under paragraph (1) may continue to serve after the
			 expiration of the term of office to which that member was appointed until
			 a successor has been appointed by the President and confirmed by the
			 Senate, except that a member may not continue to serve more than 1 year
			 after the date on which that member’s term would otherwise expire.</text>
								</subparagraph><subparagraph id="HBCA41B62DFBE4F18AEB8A125ECE1D964"><enum>(E)</enum><header>Other employment prohibited</header><text display-inline="yes-display-inline">No member of the Commission appointed under paragraph (1) shall engage in any other business,
			 vocation, or employment.</text>
								</subparagraph></paragraph></subsection><subsection display-inline="no-display-inline" id="HDD79007360AE40DDBD269EEB398A7C6B"><enum>(d)</enum><header>Affiliation</header><text>With respect to members appointed pursuant to subsection (c)(1), not more than 2 shall be members
			 of any one political party.</text>
						</subsection><subsection id="H9933B4F200074093A0B2EEFA95B359EF"><enum>(e)</enum><header>Chair of the Commission</header>
							<paragraph id="H27EFACDE71A948FA888EBCB2E7F66ABE"><enum>(1)</enum><header>Appointment</header><text display-inline="yes-display-inline">The Chair of the Commission shall be appointed by the President from among the members of the
			 Commission appointed under subsection (c)(1).</text>
							</paragraph><paragraph id="H9EB15935AF06435194A2F01CE5811BA0"><enum>(2)</enum><header>Authority</header><text display-inline="yes-display-inline">The Chair shall be the principal executive officer of the Commission, and shall exercise all of the
			 executive and administrative functions of the Commission, including with
			 respect to—</text>
								<subparagraph id="H5EFB4F0B9B5B48778D17333B8BACF731"><enum>(A)</enum><text display-inline="yes-display-inline">the appointment and supervision of personnel employed under the Commission (other than personnel
			 employed regularly and full time in the immediate offices of members of
			 the Commission other than the Chair);</text>
								</subparagraph><subparagraph id="H4B9F2CB9DC7E43978394079A3919DF35"><enum>(B)</enum><text display-inline="yes-display-inline">the distribution of business among personnel appointed and supervised by the Chair and among
			 administrative units of the Commission; and</text>
								</subparagraph><subparagraph id="HEAD9EDE37F3F428C9EBDF0B5CD688661"><enum>(C)</enum><text>the use and expenditure of funds.</text>
								</subparagraph></paragraph><paragraph id="H6209BAC999EE402AA5FCBD858F125966"><enum>(3)</enum><header>Limitation</header><text>In carrying out any of the Chair’s functions under the provisions of this subsection the Chair
			 shall be governed by general policies of the Commission and by such
			 regulatory decisions, findings, and determinations as the Commission may
			 by law be authorized to make.</text>
							</paragraph><paragraph id="H17E7ACF8DAFC4E118A0C20D21030D66C"><enum>(4)</enum><header>Requests or estimates related to appropriations</header><text>Requests or estimates for regular, supplemental, or deficiency appropriations on behalf of the
			 Commission may not be submitted by the Chair without the prior approval of
			 the Commission.</text>
							</paragraph></subsection><subsection display-inline="no-display-inline" id="H4F38341B16774805BCA763B3DB4016AE"><enum>(f)</enum><header>No impairment by reason of vacancies</header><text display-inline="yes-display-inline">No vacancy in the members of the Commission shall impair the right of the remaining members of the
			 Commission to exercise all the powers of the Commission. Three members of
			 the Commission shall constitute a quorum for the transaction of business,
			 except that if there are only 3 members serving on the Commission because
			 of vacancies in the Commission, 2 members of the Commission shall
			 constitute a quorum for the transaction of business. If there are only 2
			 members serving on the Commission because of vacancies in the Commission,
			 2 members shall constitute a quorum for the 6-month period beginning on
			 the date of the vacancy which caused the number of Commission members to
			 decline to 2.</text>
						</subsection><subsection id="H406CC4B8B553403E825E024ED353C672"><enum>(g)</enum><header>Seal</header><text>The Commission shall have an official seal.</text>
						</subsection><subsection id="H817A7DC031A64B4EBC87B811257E4C2C"><enum>(h)</enum><header>Compensation</header>
							<paragraph id="H8DFBFF5562AA4118A0157746691D1CD4"><enum>(1)</enum><header>Chair</header><text>The Chair shall receive compensation at the rate prescribed for level I of the Executive Schedule
			 under <external-xref legal-doc="usc" parsable-cite="usc/5/5313">section 5313</external-xref> of title 5, United States Code.</text>
							</paragraph><paragraph id="H561CEBC08EB548F28E1AD16E6D150C81"><enum>(2)</enum><header>Other members of the Commission</header><text>The 3 other members of the Commission appointed under subsection (c)(1) shall each receive
			 compensation at the rate prescribed for level II of the Executive Schedule
			 under <external-xref legal-doc="usc" parsable-cite="usc/5/5314">section 5314</external-xref> of title 5, United States Code.</text>
							</paragraph></subsection><subsection id="HFBBF2D9E7065498491606567E3476C01"><enum>(i)</enum><header>Initial quorum established</header><text>During any time period prior to the confirmation of at least two members of the Commission, one
			 member of the Commission shall constitute a quorum for the transaction of
			 business. Following the confirmation of at least 2 additional
			 commissioners, the quorum requirements of subsection (f) shall apply.</text>
						</subsection><subsection id="H360B3988C8D44A9BBD923C208E4E030E"><enum>(j)</enum><header>Offices</header><text display-inline="yes-display-inline">The principal office of the Commission shall be in the District of Columbia. The Commission may
			 establish regional offices of the Commission in order to carry out the
			 responsibilities assigned to the Commission under the Federal consumer
			 financial laws.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H018F4E3BE88E485491199A91313B0904"><enum>(b)</enum><header>Bringing the Commission into the regular appropriations process</header><text display-inline="yes-display-inline">Section 1017 of the Consumer Financial Protection Act of 2010 (<external-xref legal-doc="usc" parsable-cite="usc/12/5497">12 U.S.C. 5497</external-xref>) is amended—</text>
				<paragraph id="HBA71982039F642728BB2B7014FE49810"><enum>(1)</enum><text>in subsection (a)—</text>
					<subparagraph id="H76F7F23C11B74C16AA149E30F233D1ED"><enum>(A)</enum><text>by amending the heading of such subsection to read as follows: <quote><header-in-text level="subsection" style="OLC">Budget, financial management, and audit.—</header-in-text></quote>;</text>
					</subparagraph><subparagraph id="HBF8F2CEA27BB45568B6DCD5E294F2E29"><enum>(B)</enum><text>by striking paragraphs (1), (2), and (3);</text>
					</subparagraph><subparagraph id="H5A781733E03746D18EA509C0CB5DD78F"><enum>(C)</enum><text>by redesignating paragraphs (4) and (5) as paragraphs (1) and (2), respectively; and</text>
					</subparagraph><subparagraph id="H493446C757F84B4F968CBB5EFBC9C1D8"><enum>(D)</enum><text>by striking subparagraphs (E) and (F) of paragraph (1), as so redesignated;</text>
					</subparagraph></paragraph><paragraph id="H03940C9A57A9431D843BEF98675174AD"><enum>(2)</enum><text>by striking subsections (b) and (c);</text>
				</paragraph><paragraph id="H5FE352B596AD4A248A17FBDABEC21151"><enum>(3)</enum><text>by redesignating subsections (d) and (e) as subsections (b) and (c), respectively; and</text>
				</paragraph><paragraph id="HAFEF973720CF43898D208CE9E5D85FFD"><enum>(4)</enum><text>in subsection (c), as so redesignated—</text>
					<subparagraph id="HEA9BB21FA25442559D326D767B6A2F80"><enum>(A)</enum><text>by striking paragraphs (1), (2), and (3) and inserting the following:</text>
						<quoted-block display-inline="no-display-inline" id="HC458CD96F7604D53A491A8D4A9C2E2FA" style="OLC">
							<paragraph id="HEBA4F21A9D824C8CBB0D797D495E9B40"><enum>(1)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated to carry out this title $300,000,000 for each of fiscal
			 years 2014 and 2015.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="H3B815370646A4F8EA41F0508D533CEDE"><enum>(B)</enum><text>by redesignating paragraph (4) as paragraph (2).</text>
					</subparagraph></paragraph></subsection><subsection id="HE265A9BC75CF4CFB8A94A5B270ADBBA1"><enum>(c)</enum><header>Ensuring the independence of the Commission</header><text display-inline="yes-display-inline">The Consumer Financial Protection Act of 2010 is amended—</text>
				<paragraph id="H55EE07B9F7BF47F080B554D0142DCFFA"><enum>(1)</enum><text display-inline="yes-display-inline">in section 1012(c) (<external-xref legal-doc="usc" parsable-cite="usc/12/5492">12 U.S.C. 5492(c)</external-xref>), by striking paragraphs (2), (3), (4), and (5); and</text>
				</paragraph><paragraph id="H334573D1F7D0477EB2F0A4EAC484C768"><enum>(2)</enum><text display-inline="yes-display-inline">in section 1014(b) (<external-xref legal-doc="usc" parsable-cite="usc/12/5494">12 U.S.C. 5494(b)</external-xref>), by striking <quote>Not fewer than 6 members shall be appointed upon the recommendation of the regional Federal Reserve
			 Bank Presidents, on a rotating basis.</quote>.</text>
				</paragraph></subsection><subsection id="HF9CE36DC5D3A4343948B498DFEF2E9FC"><enum>(d)</enum><header>Conforming amendments</header>
				<paragraph id="H264FE7BD30364B339D9727357B93047D"><enum>(1)</enum><header>Consumer Financial Protection Act of 2010</header>
					<subparagraph id="H6DD1024E39044737809D18D9A12DC843"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided under subparagraph (B), the Consumer Financial Protection Act of 2010 (<external-xref legal-doc="usc" parsable-cite="usc/12/5481">12 U.S.C. 5481 et seq.</external-xref>) is amended—</text>
						<clause id="HC919479348DD4BC9B5053EC621CBCEBC"><enum>(i)</enum><text>by striking <quote>Director of the</quote> each place such term appears, other than where such term is used to refer to a Director other than
			 the Director of the Bureau of Consumer Financial Protection;</text>
						</clause><clause id="HE0593F95C3C547A9B6E06E06AA06D851"><enum>(ii)</enum><text display-inline="yes-display-inline">by striking <quote>Director</quote> each place such term appears and inserting <quote>Financial Product Safety Commission</quote>, other than where such term is used to refer to a Director other than the Director of the Bureau
			 of Consumer Financial Protection; and</text>
						</clause><clause id="HB0C0EC672C224303BAB98CF5F948D113"><enum>(iii)</enum><text display-inline="yes-display-inline">in section 1002 (<external-xref legal-doc="usc" parsable-cite="usc/12/5481">12 U.S.C. 5481</external-xref>), by striking paragraph (10).</text>
						</clause></subparagraph><subparagraph id="H67671722442C493CB8E8AA96BD1564DB"><enum>(B)</enum><header>Exceptions</header><text display-inline="yes-display-inline">The Consumer Financial Protection Act of 2010 is amended—</text>
						<clause display-inline="no-display-inline" id="H444E238373D043CEB05E7919B4BD8E9B"><enum>(i)</enum><text display-inline="yes-display-inline">in section 1012(c)(4) (<external-xref legal-doc="usc" parsable-cite="usc/12/5492">12 U.S.C. 5492(c)(4)</external-xref>), by striking <quote>Director</quote> each place such term appears and inserting <quote>Financial Product Safety Commission</quote>;</text>
						</clause><clause id="HAFB1364DD1544E31A07710637E47755E"><enum>(ii)</enum><text display-inline="yes-display-inline">in section 1013(c)(3) (<external-xref legal-doc="usc" parsable-cite="usc/12/5493">12 U.S.C. 5493(c)(3)</external-xref>)—</text>

						</clause><clause id="H74F9A458F1BE436C8A931E2994AC9291"><enum>(v)</enum><text display-inline="yes-display-inline">in section 1066(a) (<external-xref legal-doc="usc" parsable-cite="usc/12/5586">12 U.S.C. 5586(a)</external-xref>), by striking <quote>Director of the Bureau is</quote> and inserting <quote>first member of the Commission is</quote>.</text>
						</clause></subparagraph></paragraph><paragraph id="H11B9C96024E74FD4A3A5C153C492FDB2"><enum>(2)</enum><header>Dodd-Frank Wall Street Reform and Consumer Protection Act</header><text display-inline="yes-display-inline">The Dodd-Frank Wall Street Reform and Consumer Protection Act (<external-xref legal-doc="usc" parsable-cite="usc/12/5301">12 U.S.C. 5301 et seq.</external-xref>) is amended—</text>
					<subparagraph id="H0C53BA8787D14F27B651D0A922FA13C9"><enum>(A)</enum><text>in the table of contents for such Act by amending the item relating to section 1011 to read as
			 follows:</text>

					</subparagraph></paragraph><paragraph id="HBF34417F5BC646B4A1694B049CB01733"><enum>(3)</enum><header>Electronic Fund Transfer Act</header><text display-inline="yes-display-inline">Section 920(a)(4)(C) of the Electronic Fund Transfer Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1693o-2">15 U.S.C. 1693o–2(a)(4)(C)</external-xref>), as added by section 1075(a)(2) of the Consumer Financial Protection Act of 2010, is amended by
			 striking <quote>Director of the Bureau of Consumer Financial Protection</quote> and inserting <quote>Financial Product Safety Commission</quote>.</text>
				</paragraph><paragraph id="H370B82FACD164C7E93128C7ACBEED047"><enum>(4)</enum><header>Expedited Funds Availability Act</header><text display-inline="yes-display-inline">The Expedited Funds Availability Act (<external-xref legal-doc="usc" parsable-cite="usc/12/4001">12 U.S.C. 4001 et seq.</external-xref>), as amended by section 1086 of the Consumer Financial Protection Act of 2010, is amended by
			 striking <quote>Director of the Bureau</quote> each place such term appears and inserting <quote>Financial Product Safety Commission</quote>.</text>
				</paragraph><paragraph id="H2761D396F92646A7B9F2F8BA4A7925A1"><enum>(5)</enum><header>Federal Deposit Insurance Act</header><text display-inline="yes-display-inline">Section 2 of the Federal Deposit Insurance Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1812">12 U.S.C. 1812</external-xref>), as amended by section 336(a) of the Dodd-Frank Wall Street Reform and Consumer Protection Act,
			 is amended by striking <quote>Director of the Consumer Financial Protection Bureau</quote> each place such term appears and inserting <quote>Chair of the Financial Product Safety Commission</quote>.</text>

			<subsection id="H7E11F01B72F14C9587C9A65837A23696"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1013(a)(2) of the Dodd-Frank Wall Street Reform and Consumer Protection Act (<external-xref legal-doc="usc" parsable-cite="usc/12/5493">12 U.S.C. 5493(a)(2)</external-xref>) is amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="H9650C4957E194A10A9F02CCA541B9152" style="OLC">
					<paragraph id="H9E5C3552A7DB4E7FA5BDC020286BB96D"><enum>(2)</enum><header>Compensation</header><text display-inline="yes-display-inline">The rates of basic pay for all employees of the Financial Product Safety Commission shall be set
			 and adjusted in accordance with the General Schedule set forth in <external-xref legal-doc="usc" parsable-cite="usc/5/5332">section 5332</external-xref> of title 5, United States Code.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HA1804BDE1EE240B9A847871A644F579F"><enum>(b)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendment made by subsection (a) shall apply to service by an employee of the Financial Product
			 Safety Commission following the 90-day period beginning on the date of
			 enactment of this Act.</text>
			</subsection></section><section id="H8D7BC7B8E25549E9B89BBAEE3D5D880F"><enum>4.</enum><header>Consumer right to financial privacy</header>
			<subsection id="HB1DA01B8C55F4DC79841297580A5FCAB"><enum>(a)</enum><header>Requirement of the Financial Product Safety Commission To obtain permission before collecting
			 nonpublic personal information</header>
				<paragraph id="HEB060EA5E368494BB3DE13DAE8EDB130"><enum>(1)</enum><header>Required notification and permission</header><text display-inline="yes-display-inline">Section 1022(c)(9)(A) of the Dodd-Frank Wall Street Reform and Consumer Protection Act (<external-xref legal-doc="usc" parsable-cite="usc/12/5512">12 U.S.C. 5512(c)(9)(A)</external-xref>) is amended—</text>
					<subparagraph id="H1B78495ED1814C7A8778F78066A92779"><enum>(A)</enum><text>by striking <quote>may not obtain from a covered person or service provider</quote> and inserting <quote>may not request, obtain, access, collect, use, retain, or disclose</quote>;</text>
					</subparagraph><subparagraph id="H755A6C7F003F43E88166C3A488B044F2"><enum>(B)</enum><text>by striking <quote>personally identifiable financial</quote> and inserting <quote>nonpublic personal</quote>; and</text>
					</subparagraph><subparagraph id="H8E86BEFB4E83453B9D513E3E8DC6E931"><enum>(C)</enum><text display-inline="yes-display-inline">by striking <quote>from the financial records</quote> and all that follows through the period at the end and inserting</text>
						<quoted-block display-inline="yes-display-inline" id="H4D3BBB0A432F4487B2E7F8F4441A4BF6" style="OLC"><text>unless—</text><clause id="HA2AEA341B28442E99DD497E35F89DAEC"><enum>(i)</enum><text display-inline="yes-display-inline">the Financial Product Safety Commission clearly and conspicuously discloses to the consumer, in
			 writing or in an electronic form, what information will be requested,
			 obtained, accessed, collected, used, retained, or disclosed; and</text>
							</clause><clause id="HE1D7EE933187408687880E0C1B49FD94"><enum>(ii)</enum><text display-inline="yes-display-inline">before such information is requested, obtained, accessed, collected, used, retained, or disclosed,
			 the consumer informs the Financial Product Safety Commission that such
			 information may be requested, obtained, accessed, collected, used,
			 retained, or disclosed.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="H4AA8D2D968F847DA845BD218C8F6A564"><enum>(2)</enum><header>Application of requirement to contractors of the Financial Product Safety Commission</header><text display-inline="yes-display-inline">Section 1022(c)(9)(B) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/12/5512">12 U.S.C. 5512(c)(9)(B)</external-xref>) is amended to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="HF74F72C6035B42E3AC53C416BFC0A700" style="OLC">
						<subparagraph id="H6A607814E6554D4499F339E35DCE42B5"><enum>(B)</enum><header>Application of requirement to contractors of the Financial Product Safety Commission</header><text display-inline="yes-display-inline">Subparagraph (A) shall apply to any person directed or engaged by the Financial Product Safety
			 Commission to collect information to the extent such information is being
			 collected on behalf of the Financial Product Safety Commission.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H02FABC3505FA40A5AF3FC0B26FB647E3"><enum>(3)</enum><header>Definition of nonpublic personal information</header><text display-inline="yes-display-inline">Section 1022(c)(9) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/12/5512">12 U.S.C. 5512(c)(9)</external-xref>) is amended by adding at the end the following:</text>

				</paragraph></subsection><subsection display-inline="no-display-inline" id="HEED2D9C0CDF04584B135DC5E8BDD07ED"><enum>(b)</enum><header>Removal of exemption for the Financial Product Safety Commission from the Right to Financial
			 Privacy Act</header><text>Section 1113 of the Right to Financial Privacy Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/12/3413">12 U.S.C. 3413</external-xref>) is amended by striking subsection (r).</text>
			</subsection></section><section id="H2F1CA7D087B245A9B1D9F9EBBB31E44F"><enum>5.</enum><header>Consumer financial protection safety and soundness improvements</header>
			<subsection id="HFDF00B7E508C4957BE32561F7C154BB5"><enum>(a)</enum><header>Council voting procedure</header><text>Section 1023(c)(3)(A) of the Consumer Financial Protection Act of 2010 (<external-xref legal-doc="usc" parsable-cite="usc/12/5513">12 U.S.C. 5513(c)(3)(A)</external-xref>) is amended—</text>
				<paragraph id="HCAC2B529A4524401A2D70DA01B18E1B1"><enum>(1)</enum><text>by striking <quote><short-title><fraction>2/3</fraction></short-title></quote> and inserting <quote><short-title>a majority</short-title></quote>; and</text>
				</paragraph><paragraph id="H57F27673BF964A028EDE6552310561F9"><enum>(2)</enum><text>by inserting before the period the following: <quote><short-title>, excluding the Chair of the Financial Product Safety Commission</short-title></quote>.</text>
				</paragraph></subsection><subsection id="HCBD8F2547952452D90DC489916BA3847"><enum>(b)</enum><header>Review authority of the Council</header><text>Section 1023 of the Consumer Financial Protection Act of 2010 (<external-xref legal-doc="usc" parsable-cite="usc/12/5513">12 U.S.C. 5513</external-xref>) is amended—</text>
				<paragraph id="HC00B2D295C7C4641AC2C81E6B17A37CC"><enum>(1)</enum><text>in subsection (a)—</text>
					<subparagraph id="H3DC14C4BD8B04206BA7534BF636B45E4"><enum>(A)</enum><text>by striking <quote><short-title>may</short-title></quote> and inserting <quote><short-title>shall</short-title></quote>; and</text>
					</subparagraph><subparagraph id="HF6C87745FBFD44E48B345CBE0B3554C0"><enum>(B)</enum><text>by striking <quote><short-title>regulation or provision would put the safety and soundness of the United States banking system or
			 the stability of the financial system of the United States at risk</short-title></quote> and inserting <quote><short-title>regulation which is the subject of the petition is inconsistent with the safe and sound operations
			 of United States financial institutions</short-title></quote>; and</text>
					</subparagraph></paragraph><paragraph id="H0117ACED1B874C0192B3E177A69186F4"><enum>(2)</enum><text>in subsection (c)—</text>

				</paragraph></subsection></section><section id="H78EBB5249DF242DEAC66AD9448B2C8B4"><enum>6.</enum><header>Analysis of regulations</header><text display-inline="no-display-inline">Section 1022 of the Consumer Financial Protection Act of 2010 (<external-xref legal-doc="usc" parsable-cite="usc/12/5512">12 U.S.C. 5512</external-xref>) is amended by adding at the end the following new subsection:</text>
			<quoted-block display-inline="no-display-inline" id="H0DC8E7957DAD49BAA9386A1962FAE7A0" style="OLC">
				<subsection id="H5383438D09604FBFA6B796AD25C2296D"><enum>(e)</enum><header>Analysis of regulations</header>
					<paragraph id="H231EC1B3832A4BF880A0E2301FA343A8"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Each time the Commission proposes a new rule or regulation, the Commission shall—</text>
						<subparagraph id="HB5D1F940366349408CC57C2A8CAAC679"><enum>(A)</enum><text display-inline="yes-display-inline">carry out an initial regulatory flexibility analysis for such proposed rule or regulation, which
			 shall be carried out as closely as possible to those initial regulatory
			 flexibility analyses required under <external-xref legal-doc="usc" parsable-cite="usc/5/603">section 603</external-xref> of title 5, United States Code, but which shall analyze the financial impact of the proposed rule
			 or regulation on covered persons, regardless of size; and</text>
						</subparagraph><subparagraph id="H1CB345265B304118BCA27C62D69A80F5"><enum>(B)</enum><text>carry out an analysis of whether the proposed rule or regulation will impair the ability of
			 individuals and small businesses to have access to credit.</text>
						</subparagraph></paragraph><paragraph id="H20818E6D6C2F463DA56DDE45A42C1AD8"><enum>(2)</enum><header>Report</header><text display-inline="yes-display-inline">The Commission shall issue a report to the Council on each analysis carried out under paragraph
			 (1), and make such analysis available to the public.</text>
					</paragraph><paragraph id="HC9E597B65BC34A2B8D91F386671EB9ED"><enum>(3)</enum><header>Use of existing resources</header><text>The Commission shall use existing resources to carry out the requirements of this subsection.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H5A4ECE0F224D4B99A3B93C76CAD684D5"><enum>7.</enum><header>Repeal of exclusive rulemaking authority</header><text display-inline="no-display-inline">Section 1022(b) of the Consumer Financial Protection Act of 2010 (<external-xref legal-doc="usc" parsable-cite="usc/12/5512">12 U.S.C. 5512(b)</external-xref>) is amended by striking paragraph (4).</text>
