<official-title display="yes">To direct the Administrator of the Environmental Protection Agency to change the Spill Prevention, Control, and Countermeasure rule with respect to certain farms.</official-title>

<section id="HA1C90A43E82E47E18ED8A64A2477DC4D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Farmers Undertake Environmental Land Stewardship Act</short-title></quote> or the <quote><short-title>FUELS Act</short-title></quote>.</text> </section> 
<section id="H48EA33220DDF4FEC81B05B9DA8912F86" section-type="subsequent-section"><enum>2.</enum><header>Applicability of Spill Prevention, Control, and Countermeasure rule</header> 
<subsection id="HE08A3039546D4B979A1128AA5B03ABC4"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Administrator, in implementing the Spill Prevention, Control, and Countermeasure rule with respect to any farm, shall—</text> 
<paragraph id="H894115DDEB224D649EEF73360D287CE8"><enum>(1)</enum><text>require certification of compliance with such rule by—</text> 
<subparagraph id="H6C2104E62DE046D2A159CA9343DC9E99"><enum>(A)</enum><text>a professional engineer for a farm with—</text> 
<clause id="HD0C0C23745F543359F021B788A2EC11C"><enum>(i)</enum><text>an individual tank with an aboveground storage capacity greater than 10,000 gallons;</text> </clause> 
<clause id="H86094F91966741C28B6CE80F6090F694"><enum>(ii)</enum><text>an aggregate aboveground storage capacity greater than or equal to 42,000 gallons; or</text> </clause> 
<clause id="H0490DC340B1E4C86A3AD701A4CCD67BF"><enum>(iii)</enum><text>a history that includes a spill, as determined by the Administrator; or</text> </clause></subparagraph> 
<subparagraph id="HC6B6D50B06D94E33A97D49DD930DA954"><enum>(B)</enum><text>the owner or operator of the farm (via self-certification) for a farm with—</text> 
<clause id="H9CF735C5E4754C6FA293F55690E5C9AE"><enum>(i)</enum><text display-inline="yes-display-inline">an aggregate aboveground storage capacity greater than 10,000 gallons but less than 42,000 gallons; and</text> </clause> 
<clause id="HC4DB60A49BBC45E1A0117073C0FF830A"><enum>(ii)</enum><text display-inline="yes-display-inline">no history of spills, as determined by the Administrator; and</text> </clause></subparagraph></paragraph> 
<paragraph id="HACCE2341C44F4323819B184203961747"><enum>(2)</enum><text>exempt from all requirements of such rule any farm—</text> 
<subparagraph id="H3B55C02DAC6D4CE9A3742F57E5D928B2"><enum>(A)</enum><text display-inline="yes-display-inline">with an aggregate aboveground storage capacity of less than or equal to 10,000 gallons; and</text> </subparagraph> 
<subparagraph id="HB674719A2BD3452EA19B3062F96D0091"><enum>(B)</enum><text display-inline="yes-display-inline">no history of spills, as determined by the Administrator.</text> </subparagraph></paragraph></subsection> 
<subsection id="HED5CC5EE22C0461FA1C6301BB6CDA4C9"><enum>(b)</enum><header>Calculation of aggregate aboveground storage capacity</header><text display-inline="yes-display-inline">For the purposes of subsection (a), the aggregate aboveground storage capacity of a farm excludes all containers on separate parcels that have a capacity that is less than 1,320 gallons.</text> </subsection></section> 
<section id="HCCFB65A79B414651A53B07F0596C57D9"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act, the following terms apply:</text> 
<paragraph id="H7A7EB717BB0B4D5C8935337FFED64AB2"><enum>(1)</enum><header>Administrator</header><text display-inline="yes-display-inline">The term <quote>Administrator</quote> means the Administrator of the Environmental Protection Agency.</text> </paragraph> 
<paragraph id="H49EEF01EF275401DB2DBF79D42B32E53"><enum>(2)</enum><header>Farm</header><text>The term <quote>farm</quote> has the meaning given such term in <external-xref legal-doc="regulation" parsable-cite="cfr/40/112.2">section 112.2</external-xref> of title 40, Code of Federal Regulations.</text> </paragraph> 
<paragraph id="HDC2439F5BFD44B75BE985B0F1C1B8CD0"><enum>(3)</enum><header>Gallon</header><text>The term <quote>gallon</quote> refers to a United States liquid gallon.</text> </paragraph> 
<paragraph id="HD7D14C296A16427FBC47A01351BED502"><enum>(4)</enum><header>Spill Prevention, Control, and Countermeasure rule</header><text>The term <quote>Spill Prevention, Control, and Countermeasure rule</quote> means the regulation promulgated by the Environmental Protection Agency under part 112 of title 40, Code of Federal Regulations.</text> </paragraph></section>
